My Public Records Act Suit Against The Venice Beach BID Is Finally Over — They Handed Over The Records And Paid My Lawyer $21,000 — A Purely Avoidable Waste Of Money — But What Do They Care? — Not Their Damn Money

Well, in case you missed it, in February 2017 I sent a request to the Venice Beach BID for various public records, and they ignored me and ignored me and ignored me, and finally I hired a lawyer, the incomparable Abenicio Cisneros, and in April 2018 he filed a suit against them seeking to enforce compliance with the damn law.

And now, finally, the case is done with the signing of this settlement agreement. Notably, the BID handed over the records and paid Cisneros $21,435 for his work on the case. This payoff is one hundred percent wasted money that the BID could have saved had they only complied with the law in the first place. But they did not. And I have another request in to them, so we’ll see if they learned their lesson. Meanwhile, behold a partial transcription of the agreement:

I recently obtained a small collection of emails between Venice beat cops Kristan Delatori, Peggy Thusing, and the recently self-destructed Nicole Alberca1 and those fan favorite BIDdies Mark Sokol and Carl Lambert. You can peruse the whole set here on Archive dot Org, and in today’s post I’ll discuss a few high/low-lights!

OK, remember the Venice Neighborhood Council election in 2016? The outcome was widely interpreted by sane people as being yet another death blow administered to the longtime rotting corpse of Venice. And now, thanks to this June 2016 day-after email from Carl Lambert to undisclosed recipients including Nicole Alberca we learn that Lambert divides the winners up into friendlies and not-friendlies.

And we learn who the friendlies are! And that there is a supermajority of them! And we also learn that Carl Lambert sends late-night texts to Nicole Alberca! And they make her smile! All these Venice zillionaires and their pet cops are really far too cozy for our safety and comfort, I think.

The South Park BID Failed To Even Negotiate Let Alone Execute A Contract With Tara Devine For Handling Their 2017 Renewal — They Didn’t Even Realize There Was No Contract Until My CPRA Request Called Their Attention To It — At Which Point Bob Buente Suggested Fraudulently Executing A Back-Dated Contract — But Worried This Would Haunt The Board If “we’re deposed because Tara does something nefarious” — Ellen Riotto — Who Has More Common Sense Than The Average Zeck Dreck — Advised Against It

So in 2017, back when I was trying to understand Tara Devine’s BID consultancy work for the South Park BID, I sent the Parkies a CPRA request for her contract.1 At the time, twisted little minion Katie Kiefer, who quit the BID earlier this year and is now working for shockingly rapey CD14 repster José Huizar, kept telling me that the BID didn’t have any records responsive to my request. I found this impossible to believe, that putatively competent zillionaire business types would hire someone to do a job for which they’d be paid in the high five figures and not have a written contract explaining what they were expected to do.

It didn’t seem plausible2 so I assumed Katie Kiefer was playing word games with me, which was exactly the kind of crapola she was pulling at the time, all under the baleful influence of Carol Humiston, the world’s angriest CPRA lawyer, along with the rest of her 2017 Parkie buddies. You can read the whole correspondence here on Archive.Org if you’re interested.3 But now, thanks to the recent release of Bob Buente’s emails, a hyper-Aladdinesque trove of wonders provided to me by the ever-helpful Ellen Salome Riotto, current zeck dreck of the Parkers, the truth has come out and can now be explained!

I made my original request for Tara Devine’s contract on July 12, 2017. On July 13, 2017 the Parkies, hiding as usual behind their sinister masks, told me that there was no contract. And here’s where things get interesting! The next day, on July 14, 2017, Ellen Riotto emailed her executive committee and asked them if there even was a contract:

Also note that if she were following the law she would have asked these BIDdies if they had the records before she told me that they did not, but there’s not much to be done about that. And with that simple request, things really went off the rails!

South Park BID Executive Directrix Ellen Riotto On Shadowy BID Consultant Tara Devine — “It Was Painful Working With Her But Frankly I Don’t Have Time” To Find Someone Else

Recently I obtained a big stack of emails from South Park BID treasurer Bob “Balder Than You’ll Ever Be” Buente and posted the whole steaming heap on Archive.Org for your reading pleasure. And one thing I’m finding in the set of records is a lot of anger towards shadowy BID consultant Tara Devine, who helped the Parkers get their BID renewed last year. For instance, as we’ve already seen, Bob Buente openly declared that he was “not a Tara fan.”

And this evening, just for tricks and snuggles, I have for your sophisticated perusal yet another fine example of the South Park we-hate-TD genre.1 It seems that in May 2018 Ellen Salome Riotto, Zeck Dreck of the South Park BID, realized almost at the last moment that if the BID was going to increase assessments for 2019 they had better get on the damn case because the relevant spreadsheet was due to the City by June 1.

And, unlike the Venice Beach BID, which just went ahead and raised the damn assessments, Ellen Riotto evidently felt a need for caution, so she asked the Executive Committee of the South Park BID2 about hiring none other than Ms. Tara Devine, seemingly on an ad hoc basis, to advise on the proper procedure for jacking up everyone’s property taxes.

Just take a look at this email of May 1, 2018 where she tells her bosses all about her plan. She mentions that she has “a call into Tara” and then, perhaps remembering that no one actually likes Tara, feels the need to affirm her bosses’ feelings: “yes, I know it was painful working with her.” So why is she calling on Tara, you might well ask. It is because she, Ellen Salome Riotto, put things off for too long and now it’s too late to get someone competent: “frankly I don’t have time to find a new consultant, bring them up to speed on our BID and make decisions.”

Of course, in order to explain the fact that she’s hiring Tara even though everyone at the BID hates Tara, she has had to own up to the fact that she, Ellen Salome Riotto, is to blame for being a poisonous procrastinator. But that’s OK! You know every single one of those damn management books they sell at every airport in this country?3

They all quote that pernicious nonsense about crisis and opportunity and Chinese writing and so forth4 and then they universally go on from there to tell people to own their damn mistakes and the bosses will be super-impressed! They might even tell people to make mistakes on purpose just so they can reap the benefits of owning them. And Ellen Salome Riotto didn’t get where she is today by not reading those books!5 And that is, no doubt, why she seems so pleased with herself for closing the email with some high-powered mistake-owning: “I want to apologize for the fire-drill here. I should have entered the reminder in my calendar on April 1st, not May 1st. Lesson learned.”

As usual, it’s another tale full of sound and fury6 but it’s interesting to those who are interested, among whom we proudly count ourselves! And we’ll be back with more soonest! And turn the page for a transcription of the complete email!

Remember when Jessica Lall left the South Park BID after Carol Schatz’s hand popped up out of out of that lake and handed Jessica Lall control over that weaponized slice of zillionaire mob-rule known as the Central City Association? And Ellen Salome Riotto came up out of nowhere like Dick Whittington and his damn cat to assume the holy mantle of interim South Park BID Zeck Dreck?1

And around that time, for whatever reason, twisted little Parkie minion Katie Kiefer was the boss of South Park BID’s CPRA efforts. And the power went to her head, or she had not yet realized that Carol Freaking Humiston was working through her own weirdo anger issues rather than giving prudent advice to her clients, or something. And in those dark days the South Parkies were a very model for CPRA-obstructionist BIDdies.

But, you know, I keep trying, because they have important information out there in the Park. And I am pleased to announce that those dark days are past! Now, under the enlightened regime of Ellen Salome Riotto, now promoted to most expressly non-interim Zeck Dreck, the records are pouring in! And there are no nonsensical copypasta exemption claims of the aggressively psychotic sort Katie Kiefer was so very damn fond of! And the first batch is prepped and available! It’s about 800 emails from the hidden vaults of BID Board treasurer Bob Buente! And you can see all of them right here on Archive.Org!

And friend, there are a million good stories in there. Some of them are monumentally important, but those will have to wait till later. In this episode I want to share with you an objectively trivial but subjectively delicious little slice of gossip about shadowy BID consultant Tara Devine and her ultimately dissatisfied BID renewal clients over at South Park2 and how her failure led to Ellen Salome Riotto’s promotion.

Right now there is no BID more interesting to me in the entire City of Los Angeles than the Studio City BID. I mean, I dropped by one of their furtive little meetings last month and one of their directors, famously angry clown Matthew Dunn, was so rattled by my presence that he stormed out of his own meeting.1 And then they committed such an astonishing series of so very flagrant violations of the Brown Act that I was forced to send them a demand letter asking them to pinky swear that they’d never do it again.

And man, when it comes to his CPRAiatic duties, SCBID zeck dreck Dr. John Walker Ph.D.2 is a freaking pain in that thing that writers often resort to mentioning pains in for metaphorical purposes, but once in a while a few items trickle through the border wall as they did yesterday when he, or at least his pocky little minion Damian Gatto, sent over a few righteous goodies! And amongst these was this announcement from June 2018 in which the Studio City BID gave notice to the BID Consortium that it was hiring a replacement for Emmy-winning Zeck Dreck Dr. John Walker!! There is a transcription of this remarkable document after the break.

And then the applications started rolling in! The first applicant I have information about was evidently Ms. Vicki Nussbaum, who used to be the executive director of the Sherman Oaks BID and may still be for all I know, but is at least also the executive director of the Century City BID.3 You’ll hear more about this lady’s application quite soon, but not today.4

And the next applicant that I know anything about is our old friend Taylor Freaking Bazley! That’s right, Mike Bonin’s creepy little field deputy for Venice, deeply implicated in the horror show that is the Venice Beach BID, is out looking for another job! Do his friends at CD11 know about this?! Probably not, because he obviously isn’t using them as references! You can read everything I know in this September 12, 2018 email from SCBID Board member Ben Besley5 to John Walker, Board president Tony Richman, and fellow hiring committee members Barry Wise and Dean Cutler.

Here’s the story in brief, and you will find detailed discussion and transcriptions of all relevant emails after the break! About a month ago Taylor Bazley interviewed for the job. After his interview he sent a sycophantic thanks-friend! email to Board president Tony Richman about how the committee’s shit smelled like roses and so on.6 Also, he seems to have given shadowy BID president Tara Devine’s name as a reference. The hiring committee evidently found it difficult to get in touch with Tara Devine. Finally, Ben Besley got an email from admin@venicebeachbid.com, a well-known pseudonym of Ms. Tara Devine, splaining that Tara Devine was too busy to talk to him right now but maybe later!

Then John Walker weighed in with a story about how TD was being investigated for not spending BID money properly and also how the SCBID didn’t hire her to be their renewal consultant because she charged too damn much. He closed this defamational little missive with the defamer’s favorite excuse: “This is not meant to sway your investigation but I think you should be aware of some history.” So yeah, just another example of how the Los Angeles BID world is like one big seething daisy chain but without the sex.7 Turn the page for transcriptions of all relevant material!

Donald Duckworth Was The Very First BID Consultant Involved With Venice Beach BID Formation — In June 2014 Debbie Dyner Harris Introduced El Duckie To Carl Lambert — Meetings Were Held — Duckworth Drafted Petitions And Gave Advice — Then El Duckie Seems To Have Stopped Returning Carl Lambert’s Emails —Then Nothing Until Tara Devine Took Over — Reason For That Not Yet Clear

The story of Tara Devine and the Venice Beach BID has been told repeatedly and in great detail starting in 2016 when the ultimately successful push to establish this most-despised of Los Angeles BIDs1 was revived. But the pre-2016 history remains obscure, not least due to zeck dreck Devine’s obstreperous obstructionism with respect to providing public records.2

Of course, everything about this BID is interesting,3 so what a pleasant surprise it was to find in a recent release of goodies4 by BIDdological freak show specimen Donald Duckworth a series of emails from 2014 showing that when Mike Bonin first kicked off the Venice Beach BID formation process his staffie Debbie Dyner Harris turned to El Duckworth to hook up with criminal conspirator and founding BIDfather Carl Freaking Lambert to get the job done. Internal evidence strongly suggests that this was the beginning of the modern VBBID formation process.5 Strangely, Estela Lopez, the wickedest woman on Skid Row, was also slated to be involved.6

The story begins on June 5, 2014 when Debbie Dyner Harris emailed El Duckworth with a little proposition:

Hi Don. I hope all is well. The Councilmember is hosting several property owners and business owners along Ocean Front Walk in Venice at a meeting this Monday, June 9, to discuss creating a BID. He was wondering if you’d be able to attend, to help answer any questions on the creation and operation of a BID, and providing your insight. We will be joined by Miranda Paster of the City Clerk’s office, as well as the founding director and the current president of Central City East’s BID.

I am sorry for the late notice, we’ve been trying to develop our agenda. It will be held this Monday, June 9, at 9:45am in our Westchester community room. I hope you can make it!

As you no doubt recall, in April 2017 I was forced by the weirdo intransigence of Ms. Tara Devine to file a writ petition against the Venice Beach BID because they could not, would not, comply with the damn public records act for essentially years on end. And in June Tara Devine started handing over records, with more handed over in July. She’s evidently producing a batch a month even though she promised more, because just the other day I got a set of 284 emails between her and the City of Los Angeles, and I published them as usual on Archive.Org for your edification and pleasure.1

And there is a lot of good stuff in this set, but first a little more background. You will, of course, recall that the Venice Beach BID, despite being funded by the City starting in January 2017, didn’t even have a Board meeting until January 2018 and didn’t begin providing services until many months after that. This series of egregious failures led to a great deal of tension between the BIDdies and the City. So much so that in May 2018 the BIDdies got called on the carpet at City Hall and were also forced, much against their will, to refund all the money they’d collected for 2017.

And it seems that, obviously at least in hindsight, these serious consequences in 2018 arose from a great deal of tension between the City and the BID in 2017. The text for today’s sermon is a series of emails from October of that year between Tara Devine and Rita Moreno of the City Clerk which demonstrates exactly that.

It all started when Rita Moreno asked Tara Devine why the BID didn’t even have a working phone, which was forcing the City to field the outpouring of complaints from property owners who had paid a ton of money but were receiving nothing for it. Tara Devine, as is her angry and unprofessional little wont, flipped out on Rita Moreno, and the whole vitriolic exchange with links and transcriptions is right after the break!

Minuscule Release Of Emails From Venice Beach BID Nevertheless Reveals Likely Brown Act Violations Along With Interesting Operational Details — Tara Devine Adopts Radically Different Personae Depending On Which Email Address She’s Sending From — Ultimately Successful Security Vendor Allied Universal Employed Powerhouse Lobbying Firm Cerrell To Help Win VBBID Contract — Possibly It Didn’t Help Them Win The Contract But Not Enough Evidence To Say For Sure (Yet!)

So in April 2018 I had to file a petition against the Venice Beach BID seeking to enforce compliance with the California Public Records Act because they’re so damn obstructionist that they had, at that time, been ignoring my requests for 14 months. Well, a few weeks after my lawyer filed the petition, Tara Devine started producing records1 and recently I received another set, this consisting of 45 emails between Devine and various parties on the subject of the BID’s search for a security provider. The whole set is available here on Archive.Org.

Unfortunately, there’s very little of specific interest here, although not nothing, and the interest is most certainly not nothing. Most importantly, there’s yet more circumstantial evidence that the VBBID engaged in systematic and egregious violations of the Brown Act during 2017. On a more personal level, but still interesting for the insight they yield into the weirdo mindset of BID executive director Tara Devine, there are records here demonstrating the radically different modes of address she uses depending on which email account she’s using to communicate.

For instance, she addresses Becky Dennison as “Becky” when sending from her tara@venicebeachbid.com or her tara@devine-strategies.com accounts, but when sending anonymously from admin@venicebeachbid.com she calls her “Ms. Dennison.” Note that this phenomenon may or may not be related to the semantic oddities of Kerrymorrisonese.

It’s also interesting that the ultimately successful bidder for the BID’s security contract, Allied Universal, hired Los Angeles superlobbyists Cerrell to influence the BID’s choicemaking process. Unfortunately the emails contain just enough information to show that this happened while remaining silent on why it happened or how it played out in the selection process. Hopefully further research will shed light on these issues.

Yesterday was the second Friday of the month, so I hauled myself out West on the 733 to listen to the Venice Beach BIDdies babble on about whatever it is they’re talking about out there on Main Street, just inches from the Southern border of the City of Santa Monica. And naturally I videotaped the whole thing, and you can watch it here on YouTube or here on Archive dot Org as you prefer.

As always there was a lot of interesting stuff going on, and I’ll have at least one more post for you about it, but today’s topic is the security report by BID Patrol boss Azucena Vela of Allied Universal security. Here’s how it all went down. First, famous-in-Venice member of the Neighborhood Council Colleen Saro spoke during the newly attenuated public comment period. You can watch her here. She had a lot to say, but the salient bit was her comment on the BID Patrollies riding their damn bikes on the Boardwalk:

Your security guys first of all shouldn’t be on a bike on the boardwalk on a bike because that’s illegal so it’s kind of difficult for them to enforce if they’re breaking the law…

And if you know anything about Venice you know that, first, bikes on the Boardwalk are a big problem. People who ride them there are your basic antisocial psychopaths who are so fixated on their own convenience that they don’t care at all about running over children, old people, wheelchair riders and other human beings who can’t dodge quick enough. Also, second, it is actually against the law to ride a bike on the Boardwalk. It says so explicitly at LAMC §56.15(2):

No person shall ride, operate or use a bicycle or unicycle on Ocean Front Walk between Marine Street and Via Marina within the City of Los Angeles, except that bicycle or unicycle riding shall be permitted along the bicycle path adjacent to Ocean Front Walk between Marine Street and Washington Boulevard.
