On June 16, 2020 Council District 5 rep Paul Koretz was one of only three Councilmembers to vote against asking City staff to report back on ways to cut a mere $150M from the LAPD budget.1 For some background check out this excellent essay by Jacob Woocher in Knock-LA. Koretz defended his position both before and after the vote by admitting that he’d received public comments urging him to support the cuts but also, according to Elizabeth Chou of the Daily News, “Koretz said he’s heard “emphatic” calls to defund the police dept, but he said he’s also heard from others who “feel very differently, and for whom public safety is a very high priority.” Those people fear “slower response times” from police”.

Koretz wants to show the world that he’s representing his constituents, rather than voting the straight LA Police Protective League line in opposition to his constituents’ desires. But doesn’t he sound like he’s lying? So I thought I’d check it out by asking CD5 for the communications from the public, hoping to learn how many of these folks who, according to Koretz, “feel very differently, and for whom public safety is a very high priority” actually did get in touch with Koretz.

I’ve been spending some time looking into the ways in which City Council offices materially support housedweller aggression against homeless residents of Los Angeles, including especially by facilitating illegal hostile architecture. Venice is one of the main theaters in which this drama is currently being performed, what with the proliferation of illegal planters and other, more idiosyncratic projects like for instance the Frederick Passageway, just west of the Penmar Golf Course. So naturally I’m spending a great deal of time sending requests to CD11 under the California Public Records Act.

And for a long time they completely ignored me, but then, by pure good fortune, in response to a request to LAPD, I received a stunning and unexpected email conversation between (now former) CD11 field deputy Taylor Bazley and various worthies proving conclusively that, despite many, many explicit denials from Mike Bonin’s flacks that there was any coordination at all between Bonin’s office and the outlaw planter-placers, Bazley was in fact directly involved in the process, even to the extent of calling in a sweep of a homeless encampment specifically so that illegal planters could be placed.

This discovery magnified the importance of the emails I’d requested from CD11 to the point where we all put on our hustle-hats and filed a petition splickety splat! And, as it turns out the City is wont to do, they pretty quickly started handing over records.1 You can take a look at the first batch here on Archive.Org. And these are all interesting, certainly, but the most interesting of all is this spool of emails between Taylor Bazley and various folks about the Frederick Passageway. There are two threads to the conversation here.

First there’s Bazley coordinating with angry housedwellers to ruin this public passageway by planting crap all over it to thwart the efforts of homeless human beings to survive, mostly because the housedwellers find them unaesthetic. Some of the identities of these housedwellers are known. For instance, there is ringleader Saul C. Janson, who claims to be some kind of lawyer. There is also self-proclaimed coffee confectioner Allison Altschuler, who can be contacted at allisonaltschuler@gmail.com. And shockingly untalented and shockingly well-known cartoonist Rick Detorie, who you can email at rdetorie@yahoo.com. Last but never ever ever least is zillionaire NBC news producer Richard Adams. Bazley spends months, years, encouraging them. He suggests places they can find funding for their aggressive anti-human project. Listens sympathetically to their crazed rants. Really gets into the details of hostile landscaping, e.g. suggesting that they avoid shade trees because the homeless will enjoy sitting under them. Accompanies them in person to City offices to help them obtain permits. Helps them collect astroturf letters of support for submission to the Bureau of Engineering, telling them they don’t have to be sincere or even have much content as the only purpose is ass-covering in the event that someone sues the City.

And so on, all done in the inimitably sycophantic and cynical Bazleyian manner. This material is an important addition to the history of anti-homeless landscaping in Venice. To date we didn’t really know who was behind the appropriation and destruction of this public street, and we certainly did not know the extent to which Bazley and CD11 were involved in coordinating it.2

But in addition to that conversation, which is new and important but at the same time fairly predictable, familiar in tone and content if not in specifics, there are also a bunch of emails between Bazley, Mike Bonin himself, who repeatedly orders Bazley to cater to the whims of the housedwellers, and Debbie Dyner Harris, at that time a district director for Bonin, also ordering Bazley to please get to work and please please the housedwellers.

This is a side of the process we very rarely get to see. Councilmembers either only send very few emails or else their offices routinely and illegally withhold them. And these few emails are terse. The staff knows what to do, they don’t need to be told explicitly. Records, after all, will end up on the Internet. Best, then, not to generate any. This material, while actually less sensational than the other, is equally if not more important for shining light on the internal processes of Bonin’s office.

Another fact, revealed for the first time by these newly released records, is that the housedwellers were looking to this project not just as a way to exclude some unaesthetic human beings by installing plants on a public street. They were actually looking to literally privatize the street by annexing parts of it and adjoining them to their lots, thereby increasing their property values. This unexpected but ultimately not surprising development demonstrates in a pretty stark way that most if not all anti-homeless housedweller rage is actually about money.

Usually, possibly, the financial gains from hostile architecture are framed as about how aesthetics and perceptions of homeless neighbors affect property values but, at least in this case, it’s about actual annexation of publicly owned land. Thus spake Taylor Bazley: “a lot of the adjacent property owners are looking to assume ten more feet of property through the process of street vacation.” Taylor doesn’t go along with this plan, but not because he sees anything wrong with it. It’s just, he assures his boss, that it takes too long.

But as much as is revealed by these emails, one of the central mysteries remains unexplained. You’ll see, if you read on to the transcripts below, that the complaints that initiated the multi-year process of installing hostile landscaping on the Frederick Passageway are so stupid as to be incoherent. Saul Janson is angry, e.g., that the homeless people in the encampment laugh, eat food from takeout containers, own cell phones, and so on. He compares homeless people’s possessions to cancer, saying that their “stuff metastasizes daily”>.

He thinks single women are more particularly vulnerable to the unspecified predations of the homeless than, I guess, men and non-single women? The man is a slime-oozing braindead ball of enraged emotional putrefaction, certainly no one to be taken seriously. Oh, I forgot to mention! Janson and his neighbors “are mostly caring and socially responsible people.” Just ask them! If he weren’t a housedweller the best he could hope for out of City officials would be to be ignored. The worst would involve throwing away his tent or his insulin, tasing him, jailing him, 5150ing him into oblivion, leaving him to die on the pavement in the rain.

But none of that happens here. Instead of mocking and ignoring him, Bonin writes to Bazley and Dyner Harris to tell them to take care of the guy’s concerns. We’ve seen this exact phenomenon in CD13, as well as in CD11 with a whole different Klown Kar Krew, so it’s not isolated. What I don’t understand, what I despair of understanding, is why Councilmembers are so solicitous of these housedwellers. They’re not necessarily big donors. For instance, according to the Ethics Commission, none of Janson, Altschuler, or Adams have ever given a penny to Bonin.3

They’re not influential, they’re not going to sway an election. And yet the CMs listen to them, sweep encampments, disrupt lives, at their request. Maybe it’s because they’re asking for something the CMs want to do anyway and so provide political cover? I legitimately don’t get it and nothing in these emails gives even a clue. The Resurgence Of The Unhinged Grudge Informer — Anonymous CD5 Resident Threatens To Call ICE On Construction Workers Because They Don’t Speak English And The Constant Beeping Of Trucks Drives Her Crazy — And CD5 Staffer Debbie Dyner Harris Doesn’t Say A Critical Word About It — It’s All Normal In Quality-Of-Life-Land — If Our Society Creates And Weaponizes An Institution Like ICE It’s Certainly Not Unexpected That People Would Use It As A Weapon — But Can’t We Rely On Our Public Officials Not To Encourage It — If Only Through Their Invidious Silence?

Tomorrow, July 12, 2019, under the banner of Lights for Liberty, thousands of people across the country and across the world will be participating in vigils at American concentration camps run by ICE, protesting the murderous treatment of the prisoners held there. You can find an event near you here. There are any number of serious reasons to abolish ICE, you can even ask ICE agents about it.

And one of these reasons is that the very existence of this organization, which is empowered to lock people up and torture them on the barest suspicion that they’re somehow violating immigration laws, incites people to use that power to further their personal goals. Under the original Nazis concentration camps were not only a tool of state terror but were used regularly by ordinary people to settle entirely non-political grudges with their neighbors.

The very existence of the capability creates the irresistible urge to use it. The blade itself incites to violence.1 This behavior was so commonplace and so problematic for various reasons that there’s a term for those who engage in it, they’re grudge informers. As Colleen Murphy puts it in her fine book The Conceptual Foundations of Transitional Justice:

The term “grudge informers” refers to individuals who, during periods of conflict or repression, report personal enemies to authorities in order to get rid of them.2

Now, I’m not interested in rehashing the endlessly stupid discussions about the appropriacy of comparisons of ICE concentration camps to Nazi concentration camps nor, obviously, the appropriacy of the term “concentration camp” to refer to them. If it strikes you that there are two legitimate sides to that debate, you can go here and talk about it to your heart’s content.

I am, however, interested in talking about public records. In this case, a set of emails I obtained from the office of Paul Koretz, putatively esteemed CD5 repster, containing the phrase “quality of life.” I’m really interested in the kind of crazy shit that housedwellers gripe about to their council offices, and especially interested in the kind of terrorism that gets conjured up and poured down upon the tender heads of the helpless like so much molten lead from the ramparts as a result of such complaints.

Searches on this phrase seemed like a good way to find more of it, and oh boy, did that ever work out! Just for instance, if you have the heart, or the stomach, really, take a look at this endless series of constituent complaints from folks on Sweetzer Avenue in May of this year, really worked up about some construction noise created by an assuredly villainous outfit known as ETCO Homes.

Donald Duckworth Was The Very First BID Consultant Involved With Venice Beach BID Formation — In June 2014 Debbie Dyner Harris Introduced El Duckie To Carl Lambert — Meetings Were Held — Duckworth Drafted Petitions And Gave Advice — Then El Duckie Seems To Have Stopped Returning Carl Lambert’s Emails —Then Nothing Until Tara Devine Took Over — Reason For That Not Yet Clear

The story of Tara Devine and the Venice Beach BID has been told repeatedly and in great detail starting in 2016 when the ultimately successful push to establish this most-despised of Los Angeles BIDs1 was revived. But the pre-2016 history remains obscure, not least due to zeck dreck Devine’s obstreperous obstructionism with respect to providing public records.2

Of course, everything about this BID is interesting,3 so what a pleasant surprise it was to find in a recent release of goodies4 by BIDdological freak show specimen Donald Duckworth a series of emails from 2014 showing that when Mike Bonin first kicked off the Venice Beach BID formation process his staffie Debbie Dyner Harris turned to El Duckworth to hook up with criminal conspirator and founding BIDfather Carl Freaking Lambert to get the job done. Internal evidence strongly suggests that this was the beginning of the modern VBBID formation process.5 Strangely, Estela Lopez, the wickedest woman on Skid Row, was also slated to be involved.6

The story begins on June 5, 2014 when Debbie Dyner Harris emailed El Duckworth with a little proposition:

Hi Don. I hope all is well. The Councilmember is hosting several property owners and business owners along Ocean Front Walk in Venice at a meeting this Monday, June 9, to discuss creating a BID. He was wondering if you’d be able to attend, to help answer any questions on the creation and operation of a BID, and providing your insight. We will be joined by Miranda Paster of the City Clerk’s office, as well as the founding director and the current president of Central City East’s BID.

I am sorry for the late notice, we’ve been trying to develop our agenda. It will be held this Monday, June 9, at 9:45am in our Westchester community room. I hope you can make it!

First Known Instance Of Los Angeles City Attorney’s Office Involvement In BID Formation Revealed By Emails Between Rampart Neighborhood Prosecutor Andrew Said And Wilshire Center Director Mike Russell About How To Get A BID In Westlake

It’s well known in the anti-BID community that the City of Los Angeles is fully committed to the completely false story that a BIDs is formed by a spontaneous upswelling of property owners, uninfluenced by the City and completely outside of the City’s power to direct. Of course, as I said, this is a lie, and there’s plenty of evidence that it is a lie. State law not only gives the City the absolute right to determine everything BIDs do with their money but the City is not shy about exercising this right when necessary.

And there are plenty of concrete proofs that it’s actually the City of Los Angeles that creates BIDs. From then-CD13-rep Jackie Goldberg’s tireless efforts to form a BID in Hollywood in the mid 1990s to Eric Garcetti’s and Mitch O’Farrell’s almost decade-long quest to put together a BID in Echo Park to CD9 repster Curren Price’s strongarmed extortion of a South LA car dealership to get seed money for a BID along MLK Blvd. to CD11 rep Mike Bonin’s mendacious little flunky Debbie Dyner Harris’s multi-year involvement with the Venice Beach BID formation effort, the City is the motivating force, I’d venture, for every damn BID we have now and are gonna have in the future.

But every case I know of has involved the local Council District. This isn’t just my imagination, either. It’s reflected in these BID formation guidelines, published by the Los Angeles City Clerk‘s BID office, which state unequivocally that the BID formation process begins when: An individual, or a group of individuals (“proponent group”), or a Councilmember, desires to investigate the possibility of establishing a BID in a given area.

Consequently, what a surprise it was to find a set of emails between Andrew Said, who is neighborhood prosecutor for the Rampart Division, and Mike Russell, director of the Wilshire Center BID, which feature Andrew Said asking for Mr. Mike’s advice on how to start a BID in Westlake. Pacific Palisades BID Poised To Spend Almost 3% Of 2017 Assessments Fighting My CPRA Requests. Is This Really The Best Use Of Property Owner’s Money?? Also, Rick Lemmo’s Vow To Thwart Me By Proceeding “According To The Strictest Rules Of Law” May Reveal Hitherto Unsuspected Paradox In CPRA!!

Another Rick in the wall, part 97: Rick Lemmo, who is Rick Caruso’s senior VP for some kind of nonsensical crap, explains the zillionaire’s view of law-abiding high finance.
For a brief moment this morning, I was worried that it’s a bad thing that my coverage of the Pacific Palisades BID, initiated mainly because of a confluence of my interest in CD11 and the fact that the criminal intransigence of Mike Bonin’s staff has made it essentially impossible for me to get records directly from them, is tending fairly unexpectedly towards the navel-gaze, self-reference, point-is-to-understand-the-world, nerdview rather than towards the outward-looking, the-point-is-to-change-it focus which is somewhat of an ideal around here. That anxiety took me about 35 seconds to get over, so we’re going meta again this morning sans apologia.1

In any case, whatever her manifold faults as a CPRA client may be, Laurie Sale, executive directrix of the Palisades BID, is at least a reliable source of minutes and agendas. You may recall that she was previously kind enough to send me the PPBID’s 2016 minutes and agendas, and this weekend she sent me the 2017 minutes and agendas through February. There’s some interesting stuff in there, primarily about street vending, which I will write on quite soon. The minutes also suggest that CD11 field deputy Sharon Shapiro2 is an actual member of the PPBID’s Board of Directors. I’ll be looking into this, not least because it’s reminiscent of Debbie Dyner Harris’s ill-fated attempt to nab a voting seat for CD11 on the Board of the Venice Beach Property Owners Association, which was slapped down ignominiously by City Attorney Mike Feuer as a conflict of interest.

But never mind that for now. The text for today’s sermon is this little slab of nonsense, found in the BID’s minutes for February 1, 2017:

BID received requests for public records – copies of meeting minutes, agenda, emails back and forth within the City, etc. from a gentleman who is requesting this from many BIDs. Elliot made a motion to retain attorney not to exceed $4,000. Rick seconded, all approved, motion carried. In the event that this person wants copies made, then we need to request payment. Rick motioned: “we don’t want to make it difficult for him, but to rather provide him every access to public records according to the strictest rules of law so that it doesn’t provide any financial detriment to the property owners of our business improvement district.” Susan seconded. Unanimously approved, motion carries.

Shadowy BID Consultant Tara Devine Seems To Get Paid About $80,000 For Establishing A BID, Which I Managed To Discover Despite The Fact That She’s So Darned Secretive

Shadowy BID consultant Tara Devine looks fate’s oncoming train straight in the eye.
There’s an unresolved problem in the application of the California Public Records Act to business improvement districts. The thing is that the Property Owners’ Associations which administer the BIDs are, in part, subject to CPRA because §36612 of the Property and Business Improvement District Law of 1994 makes them so, stating that:

“Owners’ association” means a private nonprofit entity that is under contract with a city to administer or implement improvements, maintenance, and activities specified in the management district plan. … an owners’ association shall comply with the California Public Records Act … for all records relating to activities of the district.

The problem is that the Owners’ Association doesn’t seem to be required to comply with CPRA until it actually is under contract with the City. This, if accurate, means that the activities of the POA before the BID is approved are largely opaque to scrutiny. And this has been a severe problem in the case of the Venice Beach BID, where a number of people, not just me, have had the experience of CD11 staff,1 City Clerk staff, and even freaking Holly Wolcott herself, falsely denying that the City is involved in the BID formation process at all and telling members of the public that they should therefore seek information from shadowy BID consultant Tara Devine. Tara Devine, of course, ignores all requests for information from anyone who seems to be even a little skeptical about the benefits of BIDs.

None of this is the final word on the matter. The only reason that the legislature even made BIDs subject to CPRA is that Aaron Epstein, a brave and determined property owner, sued the living shit out of the Hollywood Property Owners Alliance2 in the 1990s and the Courts determined, in a stunningly righteous decision, that BIDs were subject to both CPRA and the Brown Act. It’s quite possible, perhaps even probable, that if the courts were asked whether or not POAs were subject to CPRA before the contract was signed, they would find that they were. However, that’s not a struggle in which I presently have the resources to engage, so alternative methods of information collection are required.

Fortunately,3 Tara Devine is not a one-BID woman. See, in 2015 the South Park BID was up for renewal.4 The process of BID renewal is essentially the same as the process for BID establishment, with the huge difference that it’s carried out by a POA that’s already under contract with the City, and is thus subject to CPRA. Check out this interesting series of emails from August 2016. It begins when Yo! Venice reporter Melanie Camp writes to Mike Bonin’s communications director David Graham-Caso, stating:

Hi David,

I have several questions regarding the BID. The information you provided, coupled with the information/misinformation flying around raises a couple of issues that need clearing up.

I’m interested in Mike’s opinion, as well as your own, on any or all of these.

Less than 40 minutes later, David Graham-Caso forwarded the email1 to Debbie Dyner Harris along with a terse note that said:

Can you please send this to the BID consultant to get her help with the answers?

And a mere 13 minutes after that, Debbie Dyner Harris forwarded the email2 to Tara Devine, stating:

Hi Tara. Can you please respond to her? Thanks

David Graham-Caso, CD11 Director of Communications, is a really cute guy, but also a conduit for misattributed propaganda!
Further conversation ensued, but the upshot is that, the very next day, Tara Devine sent over a page of answers, not to Melanie Camp, but to David Graham-Caso and Debbie Dyner Harris to do with as they would do. And evidently what they did do was send the answers to Melanie Camp. And evidently what Melanie Camp did was attribute the answers to Mike Bonin in the article she published a few days later, entitled Venice BID Approved.3 She not only attributed them to Mike Bonin when they were written by Tara Devine,4 but she essentially copy/pasted them into her article. In 2015 Bonin Aide Debbie Dyner Harris Sought To Leverage “Extremely Unusual” Outsized City Assessment For Venice Beach BID Into Voting Seat On Board Of Directors But City Attorney Said No! Freaking! Way! Conflict! Of! Freaking! Interest!

I’ve written before on how the City of Los Angeles arranges for itself to be lobbied by BIDs for various reasons. Now it appears that even this usual arrangement wasn’t enough for Mike Bonin and Debbie Dyner Harris at CD11 with respect to the Venice Beach BID. In particular, during the formation process, in December 2015, Dyner Harris emailed Miranda Paster asking if she could have a voting seat on the BID Board of Directors:

Hi Miranda, how are you? I hope all is well. I am checking on something we had discussed a while ago, but I can’t find in my notes. I wanted to confirm whether or not the City, as 1/3 paying member of the BID,1 is allowed to be a voting member on the BID board.

Miranda Paster replied a few days later, stating:

We opt out of sitting on the Board because it may appear to be a conflict of interest. We can sign the petition for a BID and we cast a ballot for the Prop 218 balloting. However, we do not sit on the boards and vote.

Debbie Dyner Harris doesn’t like this at all.
