In January 2021 Lorena Ochoa of the Los Angeles Conservation Corps emailed Ellen Endo of the Little Tokyo Business Improvement District to tell her that one of their Big Belly trash cans often had hypodermic needles in it and that therefore they wouldn’t service it any more:

Just want to bring to your attention the high volume of syringes being tossed inside this bigbelly. I cannot have the corpsmember driver service anymore bigbelly’s under these conditions. It’s a safety hazardous matter taking syringes to the City of LA sanitation site. I’m going to attach a list of Call Active Clean up companies that can come out and service these types of matters.

Endo wrote to Adriana Velasquez, a staffer in CD14 rep Kevin De Leon’s office, explaining Ochoa’s position and suggesting that they replace the Big Bellies with normal wire trash cans as soon as possible:

This post is ultimately about an email conversation between Blair Besten and Hollywood Superlawyer Jeffrey Charles Briggs about a public records request that renowned podcaster Carrie Poppy submitted to Besten’s BID in May 2020. It’s a fascinating look behind the scenes as a CPRA request is filled. If you want to skip my nonsense and get straight to the goods, here’s a link to the email itself, and here are a bunch of emails between Poppy and Briggs about her request.

Like I said up there in the title, in March 2020 Carrie Poppy sent a request for public records to Blair Besten, the half-pint Norma Desmond of the Historic Core BID, the third weirdest of the minor Downtown BIDs. Poppy’s request included the following sentence: If any of these records are held by the BID in electronic form I will need to inspect them and potentially receive copies in electronic form.”

And because apparently she’s always thinking of me, Besten immediately fired off a desperate email to self-proclaimed Hollywood Superlawyer Jeffrey Charles Briggs which contained a plaintive cri de coeur: “This sounds like an [Kohlhaas]esque request. ‘Electronic Form’ as they are being held – you know? Maybe?” And Briggs, always voluble, rarely sensible, had something to say about Poppy’s request as well.

Writing in all caps like the serial killer he never had the nerve to become Briggs had this clueless comment: I DON’T UNDERSTAND THIS UNLESS SHE THINKS WE WOULD CHARGE HER FOR A THUMB DRIVE OR WHATEVER; WE CAN JUST SEND PDF’S OR THE EMAILS THEMSELVES IF THERE ARE ANY, BY EMAIL. WE CAN FIGURE OUT HOW TO TRANSMIT WHEN WE KNOW WHAT WE HAVE.”

The Greater Leimert Park Village BID Renewed For Five Years Starting In 2020 — Despite LA City Clerk Holly Wolcott’s Declared Policy Of Not Using City Owned Properties To Tip A BID Over The Formation Threshold She Voted All The City Property Yes — Without These Votes The BID Would Have Overwhelmingly Failed To Be Created At Both The Petition Stage And At The Balloting Stage — The BID Was Thus Forced On Property Owners By The City Of Los Angeles — Which Is Not How Things Are Supposed To Work —This Smells Of Council Office Interference But As Usual It’s Going To Take Forever To Learn What’s Going On

General background: This post is about the Greater Leimert Park Village Business Improvement District. I sued them over CPRA compliance in 2018 and they produced records and settled up with my lawyer, Anna von Herrmann, in 2019.
Technical background: There are two phases in the establishment of a business improvement district. The first is the petition stage. In order for the establishment process to move forward petitions in favor representing more than 50% of the total assessed value in the BID must be submitted. If this happens the process moves to the balloting stage. In order for the BID to be established ballots representing more than 50% of the total assessed value represented by the ballots received must vote in favor of formation.

Key point: To create a BID more than 50% of the total value must vote yes on petitions but only more than 50% of the value of received ballots must vote yes.1

Warning: The figures I use in this post come from this spreadsheet I made from the actual petitions and this other one I made from the actual ballots. I was forced to make my own spreadsheets because the City of LA would only provide the figures formatted as a PDF.2 None of the differences are enough to change any of the conclusions I draw from the numbers.

When the City of Los Angeles started up the modern version of its business improvement district program in 1994 the City Council required the City Clerk to vote yes on both BID petitions and ballots for City-owned property. In 2018, though, in apparent violation of this requirement, Clerk Holly Wolcott seems to have unilaterally decided not to vote her petitions yes until private owners of property had already brought support over the 50.1% threshold.

She stuck to this policy in 2020 with the Chinatown BID renewal fiasco to the point where Gil Cedillo introduced a motion requiring her to vote the petitions yes even though she was already required to do so by Council’s 1996 action. So isn’t it interesting that the Greater Leimert Park Village BID, which renewed in 2019 for five years beginning in 2020, would have failed to be established at both the petition stage and at the ballot stage if Wolcott hadn’t voted the City’s outrageously high 12.8% of the assessed property values in favor of formation?

Background: This post follows up on a post from last year, and here’s some useful background from there:

It’s been a while since I’ve written about our old friends at the Highland Park BID but that’s certainly not because I lost interest in them! You’ll recall that in early 2018 they released a really rich set of emails in response to some requests made under the California Public Records Act. These records revealed, among other things, the BID’s complicity in the ongoing hurricane-force gentrification of Highland Park, using tactics like mural erasure and harassment of street vendors. The emails also showed the BID’s creepy Facebook stalking of local antigentrification activists, coordinated with weirdo CD1 staffer Bill Cody.

The post is about my lawsuit against these BIDs. You can read most of the pleadings filed here on Archive.Org as well.

Remember last January? Before all this pandemic insurrection nonsense? Anyway, that’s when I filed a suit against both the Highland Park Business Improvement District and the Lincoln Heights BID1 over their failures to comply with the California Public Records Act. I haven’t written much on it because at first it looked like it was going to settle quickly. The BIDs agreed to produce the records and everything was fine.

Then they fired their lawyers and hired Carol “World’s angriest CPRA lawyer” Humiston’s firm, Bradley & Gmelich, to fight the petition instead. Humiston, of course, has it in for me and is even willing to break the law and the rules of the California State Bar to further her obsessive campaign. She apparently actually believes that the only reason I request records from BIDs is to fuck with them and run up their lawyer bills, and she’s determined to prove this in court.

So these new lawyers, apparently more determined to get at me than to help their clients, aggressively tried to depose me, I guess to get me to admit to my evil anti-BID plans. There’s nothing that my evidence can add to a CPRA case, though. The law specifically states that the requester’s purpose is irrelevant.2 and my lawyer, the incomparable Colleen Flynn, filed a motion for a protective order to stave them off.

On September 24, 2020 the directors of six Downtown Los Angeles business improvement districts met with incoming City Councilmember Kevin de León. The BIDs involved were South Park, Historic Core, Downtown Center, Downtown Industrial District, Arts District, and Little Tokyo and the meeting was arranged by South Park BID director Ellen Riotto.

Riotto got in touch with de León’s office on July 27 asking to meet, and by September was working with de León staffer Sarah Flaherty1 to schedule it. On September 23, the night before the meeting, Riotto sent an agenda to Flaherty along with a note about how darn thrilled they all were.2 The agenda was fairly bland:

My Letter To The Los Angeles City Council Opposing The Renewal Of The Chinatown Business Improvement District — The Hearing Is In Eleven Days — On September 29, 2020 — Still Time To Get Your Comments In!

If you follow business improvement districts in Los Angeles you’ll already know that the Chinatown BID, run by the strange, violent, and unhinged George Yu, is one of the City’s worst. The BID is up for renewal this year, and the hearing is to be held on September 29, 2020. Such hearings are not regulated by the Brown Act, by the way, but by another code section entirely, which allows for unlimited public comment.

BIDs are established by a balloting process, but the City Council is not required to establish a BID even if balloting is successful. BID renewal has been mostly pro forma in Los Angeles, with the notable exception of the Venice Beach BID in 2016. Yu’s BID has less support than any BID in recent memory, and may in fact be vulnerable to City Council denial or extreme modification. Therefore I think public comment is essential. The renewal is in Council File 12-0489, and you can drop a comment there using the icon that says “NEW”.

And this morning I sent my own letter of opposition for the file to Gil Cedillo. Here’s a copy of my letter, mostly about Yu’s financially irresponsible defiance of the California Public Records Act and the harm it’s done to the civic life of our City. I also touch on Yu’s sadistic sense of humor regarding the electrocution of homeless residents of Chinatown. Read on for a transcription if you don’t prefer PDFs.

Chinatown BID Renewal Hearing Scheduled For September 29 At 10 AM — BID Renewal Hearings Are Regulated By Government Code §53753 Rather Than The Brown Act — The Main Difference Is That The City Is Not Allowed To Limit The Time For Public Comment At Such Hearings — The Law Explicitly Mandates That All Objections Must Be Heard — The City Ignored This In 2016 — And Thereby Messed Up The Venice Beach BID Establishment — It Is Also Essential For Anti-BID Property Owners To Return Ballots Opposing The BID — Because Of Quirks In The Law Unreturned Ballots Essentially Count As Yes Votes



For a little while it looked like George Yu had messed up the Chinatown BID renewal process and that there would be no BID for 2021. But Yu and Gil Cedillo, acting through his flunky Hugo Ortiz, maneuvering behind the scenes and off the record, managed to get the process back on track somehow and ballots have been issued announcing a hearing on September 29, 2020 to solemnize the renewal and allow the BID to continue operations in 2021.1

There are two essential things for activists to understand about this part of the process. First, anti-BID property owners MUST vote no and return their ballots. The BID will be established unless received votes against outweigh received votes in favor. Unreturned ballots essentially count as yes votes.2

The second thing is that BID renewal hearings are not regulated by the Brown Act. Instead they’re covered by Government Code §53753 The main difference is that, as Los Angeles activists know all too well, the Brown Act allows City Council to limit the total time for public comment but §53753(d) specifically forbids such a limitation:

At the time, date, and place stated in the notice mailed pursuant to subdivision (b), the agency shall conduct a public hearing upon the proposed assessment. At the public hearing, the agency shall consider all objections or protests, if any, to the proposed assessment. At the public hearing, any person shall be permitted to present written or oral testimony. The public hearing may be continued from time to time.

The City messed this up in 2016 when the Venice BID was being established. Herb Wesson, then president of the Council, cut off public comment and thus didn’t allow everyone to talk, as if it were an ordinary Brown Act hearing. The incomparable Shayla Myers of LAFLA wrote a demand letter to the City explaining the problem, and the City repealed the ordinance establishing the Venice BID and had to redo the entire process.

In any case, on September 29, when the Council is hearing objections or protests to the renewal of the Chinatown BID, they will have to hear all of them, every last one. Everybody gets to convey their feelings about the BID and about why it is a terrible idea to keep funding and empowering George Yu. And if there’s not time for everyone to talk on September 29, well, as the law says, “[t]he public hearing may be continued from time to time.” Here are a few things that might be worth mentioning, but there is so much more:

Chinatown Business Improvement District Chief George Yu Calls Self-Electrocution Of Homeless People “Natural Selection” — Yu Told LAPD Officer Stephen Nichols Not To Repair Dangerously Altered Streetlight Wiring — So That More Homeless People Would Die When They Charged Their Phones — Because “that will be the only way that the City will take care of business” — And LAPD Officer Stephen Nichols’s Response To Yu’s Homicidal Mania? — And I Quote — “☺☺☺☺☺☺☺☺☺☺☺☺”

Homeless people need cell phones to survive, and charging them is a perennial problem. Although the City of Los Angeles could very, very easily put electrical outlets on streetlights they refuse to do so, which leads to the dangerous but necessary practice of makeshift rewiring by unhoused people. As revealed by this newly obtained email conversation, in March 2019 this was happening regularly in Chinatown.

LAPD Officer Stephen Nichols told George Yu, the unhinged megalomaniac leader of the reprehensible Chinatown Business Improvement District, that if Yu gave him a list of affected lights he would personally deal with the unauthorized wiring. But Yu told him not to do that. Yu cited a recent electrocution death in Westlake and told Nichols:

“Lets let BSL do their work. I would prefer natural selection like the Westlake incident to happen as that will be the only way that the City will take care of business.”

When Nichols finally got Yu’s point, which took a surprising amount of discussion, he thought it was hilarious. Nichols’s entire response: “☺☺☺☺☺☺☺☺☺☺☺☺” Here we see the thoroughly disgusting spectacle of an LAPD officer, sworn to protect and to serve, sharing a laugh with a notorious psychopath over the tactical political utility of mass electrocutions of homeless people.

It Appears That The Chinatown Business Improvement District Has Failed To Gain Sufficient Support For Its Scheduled 2021 Renewal And Will Cease All Operations On December 31, 2020

I would like to thank volunteers from Chinatown Community for Equitable Development for calling my attention to the monumental significance of these records.

Based on a set of records I recently obtained from the Los Angeles City Clerk’s office, it appears that the Chinatown Business Improvement District has failed to gain sufficient support for its scheduled 2021 renewal and will cease to exist on December 31, 2020. On June 8, 2020 the Clerk sent a letter to the BID’s executive director, the famously unhinged George Yu, informing him of the pending expiration:

Dear Mr. Yu:

The Greater Chinatown Business Improvement District (Chinatown BID) will expire on December 31, 2020 and must cease all BID operations after that date. The Office of the City Clerk is requesting a letter indicating the intention of the BID to renew or expire. If it is the BID’s intention to expire and not renew, this Office will require the following:

1. A letter from the Board President indicating intent to allow the BID to expire.

2. An inventory of all assets currently held by the Chinatown BID.

3. A timeline for winding down the Chinatown BID and an estimate of the associated costs.

Additionally, in accordance with Section 10 of Contract No. C-118431 between the City of Los Angeles and the Los Angeles Chinatown Business Council, Incorporated, all remaining revenues of the District, after all outstanding debts have been paid, derived from the levy of assessments, or derived from the sale of assets acquired with the revenues, shall be refunded to property owners in the manner described in Division 6, Chapter 9, Section 6.619 of the Los Angeles Administrative Code.

Here’s Actual Proof That Los Angeles City Clerk Holly Wolcott Is Refusing To Sign BID Establishment Petitions For LA City Property Until Half The Other Property Owners In The Proposed District Have Signed — This Is Not Exactly A Policy But Her “Preference” — According To Clerk Staff Anyway — Also See The Extraordinary Petulance Of Gil Cedillo’s Weirdo Flunky Jose Rodriguez When He Learns About It — And Turns Around And Covertly Threatens Clerk Staffer Rick Scott For Bearing The Bad News

This is a quick update on a technical but highly consequential issue regarding City of Los Angeles property included in business improvement districts. The state law is very clear that BID assessments apply equally to public property, which means that the City of LA gets to vote on BID formation and renewal. Furthermore, in 1996, when the modern era of California BIDs began, the City Council told the City Clerk to always vote yes unless specifically directed otherwise.

Which of course led BID proponents to include as much City property as possible within their boundaries since it made establishment very significantly easier given the guaranteed favorable votes from the City. This strategy reached a hitherto unseen level of absurdity in 2016 with the Venice Beach BID establishment process, in which City property constituted 25.05% of the assessed value and the non-City property owners who signed pro-BID petitions for only 27.26%. The BID would never have been established without the automatic yes from the City.

This already absurd outcome was surpassed in 2017 with the renewal of the San Pedro Historic Waterfront BID. The proponents in that case included huge tracts of essentially empty parcels belonging to the Port of Los Angeles. They brought the City’s proportion of assessed value to 37.24%, which left only 26.04% non-City property owners in favor of the BID. The case of the San Pedro BID seems not to have been widely noticed at the time, but of course the outcry over the Venice Beach BID was monumental, and the City’s role in ensuring its existence was discussed at great length.

It hadn’t been clear exactly what was going on, but something regarding the voting of City property changed over at the City Clerk’s office after the San Pedro BID fiasco. I first heard about it in 2018 in relation to the Byzantine Latino Quarter BID when Donald Duckworth, BIDdological freak show specimen and BID establishment consultant, told his clients that the City of Los Angeles would no longer vote its petitions in favor of formation until 50% of the private property owners had already voted in favor.

As we’ve seen above, this would be a major change. If this policy had been in place in 2016 neither the Venice Beach BID nor the San Pedro Historic Waterfront BID would exist.
