Now Available: Miranda Paster’s Weekly Reports to Holly Wolcott on the Activities of the Neighborhood And Business Improvement District Section of the City Clerk’s Office

city_clerk_logoI’m pleased to announce the availability of 30 months of weekly reports from Miranda Paster in her capacity as head of the Neighborhood & Business Improvement District Section of the Los Angeles City Clerk to City Clerk Holly Wolcott. These are available through this page in the menu structure or directly from here. Finally, they are available at Archive.Org. They are full of fascinating information.

In particular, they show that as early as the week of September 30, 2014 the Clerk’s staff was meeting with Venice Beach BID Proponents. The Clerk’s staff also met with VBBID proponents on August 17, 2015 If you look at the weeks surrounding that date you’ll see that they were meeting with Tara Devine on a weekly basis even that early, not to mention the fact that they met with CD11 staff on January 13, 2015 about the BID and Mike Bonin himself in February of 2015. I’ve requested records relating to that meeting from everyone in sight, but don’t have super high hopes anything more will turn up. This rounds out the story of this set of handwritten notes by someone at CD11 of that very meeting. And there is a lot more stuff in these reports, some of it quite shocking.

Shadowy BID consultant Tara Devine, of shadowy BID consultantcy Devine Associates, slithered up out of the depths in which she habitually dwells to make a rare public appearance before the Los Angeles City Council on August 23, 2016, pleading for the Councilmembers to give life to the stitched-up-out-of-corpse-parts monster known as the Venice Beach BID which she’s been nurturing in her subterranean lair for many months now.

Even though the victory of her cause was a foregone conclusion, the dramaturgical conventions of the ritual ceremony that’s habitually performed in the John Ferraro Council Chambers in place of genuine democratic debate require that she pretend to be making reasoned arguments. She could as easily have recited the alphabet, assuming she is able to recite the alphabet, without affecting the success of her cause, but instead she chose to make checkable statements, all of which, as it happens, were lies. LAFLA Questions Legality of Venice Beach BID Approval Process in Letter to Mike Feuer, Holly Wolcott. Ballot Tabulation Published By City, Demonstrating Anti-Democratic Nature of BID Process. CD11 and Shadowy BID Consultant Tara Devine Play Favorites With Information Access

LEGAL-AID-FOUNDATION-OF-LOS-ANGELES1Today two interesting items hit the Venice Beach BID Council File. First there is a letter from LAFLA Attorney Shayla Myers demonstrating that the City did not follow the strictly mandated procedure for hearings prior to establishing an assessment district. The issue is that Council President Herb Wesson cut off public comment without allowing everyone present to be heard. This is completely acceptable under the Brown Act, which regulates general public meetings in California. In the cases covered by that law, agencies can put reasonable limits on public comment. However, the hearings that must be held before BIDs can be established are described in the Property and Business Improvement District Law of 1994, which at section 36623 requires that the “notice and protest and hearing procedure shall comply with Section 53753 of the Government Code.” This section requires…well, I’m going to let Myers explain:

If BIDs Are Such A Good Good Thing For The City Then Why Is Everyone Involved In Their Creation So Darned Secretive?

Ask anybody who’s making bank off BIDs. Ask the BID Consortium. Ask the freaking State Legislature, who has incorporated their findings in the freaking Streets and Highways Code at Section 36601(e)(1). Every zillionaire in the state of California and every zillionaire lackey legislator at every level will tell you that the flipping RAND Corporation Report on BIDs proves that they’re better for the health, wealth, and eternal salvation for the people of the Golden State than the the forthcoming resurrection of Jesus, Mary, and all 12 of the apostles.1 And yet when it comes to finding out who’s behind creating them, everybody lies, everybody hides.

Here’s the story. The City creates BIDs. This is no secret. When Aaron Epstein changed the world with his lawsuit the court found that yes, the City of Los Angeles created its BIDs. Read through the records from the years of work Jackie Goldberg dedicated in the 1990s to forming a BID in Hollywood. And yet if you ask anyone at the City for any records to do with the preformation of a BID, they will trot out their official story, which is a lie, that BIDs are formed by a spontaneous movement of property owners.2 This is what Laura McLennan, Mike Bonin’s Deputy Chief of Staff, told me this morning after I asked her for a copy of the list of property owners in the forthcoming Venice Beach BID. She also told me that CD11 didn’t have the list and that I should ask the City Clerk.

I don’t know if that was meant as bitter sarcasm or was just a symptom of ignorance (although I’d hope that someone as intimately involved with the VBBID formation process as Bonin’s senior staff must be would not suffer from the requisite level of ignorance), but actually I’d already asked the Clerk yesterday, been denied at multiple levels, and that’s why I was asking CD11.3 Staff members of the division that oversees BIDs told me that they didn’t have the list, that they didn’t have anything to do with the list, that the list didn’t have anything to do with the City, and that I could ask the shadowy private consultant who’s running the private side of the process, Tara Devine, for the list. I did ask Devine, even though it was obviously a waste of time to ask someone like Devine for anything she wasn’t obligated to provide by law. And it was a waste of time.
