A Couple Of Newly Obtained Emails Reveal Hitherto Unknown Clues About The LA City Council’s Famously Habitual Brown Act Violations — All Fifteen Council District Chiefs Of Staff Held An Impromptu And Illegal Serial Meeting In March 2020 — The Statute Of Limitations Has Run But It’s Clearly A Violation And Clearly Neither The First Nor The Last Time This Has Happened — And Another Email — This From CD5 Enviro-Dude Andy Shrader To His Boss Koretz — Suggests That The Chiefs Aren’t The Only Staffers Doing This — He Mentions A “Daily Staff Meeting” That Includes Republicans Who Might Spill Beans To Other Councilmembers — Sounds Like Another Brown Act Violation To Me!

The Brown Act famously forbids the Los Angeles City Council and its committees from meeting in secret1 to conduct its public business. The prohibition is found at §54952.2(b)(1), which states categorically that:

A majority of the members of a legislative body shall not, outside a meeting authorized by this chapter, use a series of communications of any kind, directly or through intermediaries, to discuss, deliberate, or take action on any item of business that is within the subject matter jurisdiction of the legislative body.

But anyone who pays even a little attention to meetings of the Los Angeles City Council or its committees can see that there’s some kind of collusion going on behind the scenes. There are too many unanimous votes, too many obviously scripted comments by Councilmembers responding to scripted comments by other Councilmembers when there’s no legal way for them to have known what their colleagues were planning to say, and just too much foreknowledge of the course of legislation.

It’s really unlikely that the Councilmembers themselves make all the arrangements. Almost surely the collusion is done by their staff. This doesn’t make it any less against the law. It’s exactly the scenario contemplated in the phrase “directly or through intermediaries.” So for instance, if 15 staff members, one from each Council district, got together to discuss pending motions, votes, or anything else within the subject matter jurisdiction of the City Council and then relayed information from the discussion to their bosses it’s a violation.2

One of my very long term projects is finding proof that the City Council does in fact engage in these illegal meetings and also to understand the means by which they do it. It’s slow going, though, and not just because of the City’s general unwillingness to comply with the Public Records Act. What I’m looking for is evidence of habitual and chronic outlawry, so the City has even more pressing reasons to withhold the records.3 But from time to time I come across something interesting and suggestive, and today I actually have two!

A Brief Discussion Of How Homeless Encampment Sweeps Are Scheduled In The City Of Los Angeles — Or At Least Part Of The Process — The Whole Thing Is Driven By Housedweller Complaints — Filtered Through Council Districts As Political Patronage — LAHSA Involvement — Every Kind Of Outreach — Is Basically A Cover For Relocation — The Only Actual Goal

A couple days ago it came out on Twitter that a lot of people in Los Angeles don’t understand how homeless encampment sweeps get scheduled and why, in particular how encampments to be swept are chosen. I promised to write a post about it, and here we are!1 Part of the reason for the delay is that the story is really complex, so I’m just going to talk qualitatively about how encampments end up being targeted by Council Districts and leave the rest for another post or two.2 For instance, the City has two kinds of sweep teams, which are CARE and CARE+, but I’m not going to talk about the differences,3 which are probably important, but not for this post.

Each Council Office has a staffer whose job is to work out their District’s sweep schedule with LA Sanitation. I think that ordinarily every request for a sweep in a given District goes through this San contact.4 The scheduling is done by email as well as by editing Google Docs, and the emails occasionally reveal the reason a given encampment is being targeted. I Have Been Forced Yet Again To File A Petition Against The City Of Los Angeles To Enforce The California Public Records Act — The Bureau Of Street Services Refuses To Release Emails About Those Illegal Anti-Homeless Planters — Which I Have Been Waiting On For Well Over A Year

Starting in 2018 gangs of astonishingly unhinged and utterly psychopathic housedwellers and some owners of commercial property began installing anti-homeless planters illegally on the streets of Los Angeles, aided, abetted, and assisted in their outlawry by City Council offices and LAPD officers. By April 2019 I had learned that not only were the planters illegal but that the City requires permits for placing structures or large objects on public sidewalks, none of which had been issued for these planters. So, via the California Public Records Act, I began asking for records.

In particular I asked for emails between BSS investigators and various CD11 staff. Later I also asked for copies of all citations issued by BSS from January 1, 2016 on for unpermitted planters and other structures placed on sidewalks. And after the usual months-long fruitless exchange of emails between me and BSS investigator Temo Llanes, filled with lies, errors, deceptions, and broken promises, the City of LA stopped responding to me at all. Remember Last Year When We Learned That LAPD Was Helping Psychopathic NIMBY Housedwellers To Install Illegal Anti-Encampment Planters — And I Filed A Complaint Against A Bunch Of Them From Pacific Division — Well In June 2020 LAPD Informed Me That They Had Completed Their Investigation And Declared My Complaint “Unfounded” — And Invited Me To Ask Them Questions If I Had Any — Which I Did — Namely Would They Release The Results Of The Investigation — And The Investigator — A Dude Known As Sergeant Paul Aeschliman — Told Me He Wasn’t Allowed To Release The Info — But He Didn’t Know Why He Wasn’t Allowed — And The Laws He Cited In Support Of His Position Actually Didn’t Forbid The Release Of The Documents — So That Discussion Is Ongoing Even If The Officers Aren’t Busted For Their Illegal Planter Placing — Or Not Yet Anyway!

It’s strange in these apocalyptic times to remember that just last year anti-encampment planters, illegally placed on sidewalks in utter antisocial defiance of the law, were such a huge part of the City’s discussions about the rights of the unhoused. The planters were set up by psychopathic NIMBYs like Mark Ryavec, assisted by the LAPD, the Venice Neighborhood Council, and CD11 rep Mike Bonin, who lied about his office’s involvement until emails revealed the deep complicity of his former Venice field deputy Taylor Bazley.1

I ended up reporting Bazley to the Los Angeles Ethics Commission and a bunch of LAPD officers to Internal Affairs. I haven’t heard back about Bazley yet2 but last month I did hear back from LAPD about the officers I’d complained about. Here’s their response, also transcribed below. Can you imagine?! David Ryu Certainly Seems To Be Yet Another Landlord On The Los Angeles City Council — And Apparently Perfectly Comfortable Voting On Various Tenants’ Rights Issues Without Recusing Himself Or Even Mentioning It — He And His Sister Esther Bought A Four Unit Apartment Building In 2018 — And Immediately Signed It Over To A Shady Entity Called Daejopia LLC — Controlled By Their Brother Joseph — Ryu Acknowledged On His Form 700 That He Owns The Building — Although He Lists It By Parcel Number Rather Than Address — But Denies Receiving Any Rental Income From It — Which Seems Really Highly Unlikely Given That It Appears To Be Fully Occupied — But Maybe He’ll Explain Himself If For Some Unknown Reason It Is True — Did I Mention That Kenneth Yoon — Who Sold The Building To David And Esther Ryu — Turned Around And Gave Ryu An $800 Contribution A Month After The Deal Closed? — And That The Ryus Only Needed To Borrow $460K On What Was Apparently A $840K Transaction?

On Tuesday, March 17, 2020 the Los Angeles City Council considered an emergency ordinance to halt evictions and give renters 24 months to cover missed payments. Or at least that’s what the original motion, introduced by CD11 rep Mike Bonin, called for. During the debate,1 though, various other councilmembers, notably Paul Krekorian, Paul Koretz, and Herb Wesson, argued passionately against the harm that such an ordinance would do to the proverbial mom and pop landlords by giving these deadbeat tenants so damn long to settle up.

Two years is far long, they said. Mom and pops can’t afford to wait, they said. Will increase default rate, said they. They said all kinds of impassioned stuff in favor of reducing repayment time by a murderous 75%. But one of the things they didn’t say was that all three of these councilmembers are themselves landlords. It’s impossible to imagine that they weren’t thinking of their own interests while arguing to amend this motion. I wrote a piece on this a few days ago, the research for which also revealed that they weren’t the only three, by the way.

It turned out that Jose Huizar, Nury Martinez, and Curren Price are also landlords and also voted yes on the change to a 6 month grace period. My method of landlord discovery relied solely on Form 700s, which are annual financial disclosure forms required of elected officials in California. And rental income is a specific category which must be identified as such. For instance, consider the relevant section from Paul Krekorian’s most recent filing.

But it turned out that this method was flawed. Not flawed in the sense of producing false positives. The six that I identified are in fact landlords. Flawed, though, in the sense of producing false negatives based, as it is, on the disclosures being honest.2 And that’s how I missed the fact that CD4 representative David Ryu is also a landlord,3 although it’s certainly not obvious at all from his most recent Form 700. First, take a look at the relevant section:

He lists an assessor’s parcel number rather than an address. I didn’t previously look up the property, though, because he checked off the box indicating that he’d received no rental income. It turns out, though, that skipping this was a huge mistake on my part. I finally did look into the matter and it turns out that I had previously missed everything! Yesterday The Los Angeles City Council Eviscerated A Reasonably Good Eviction Moratorium Motion — On The Insistence Of Paul Krekorian And Herb Wesson — Who Kept Talking Up The Needs Of The So-Called Mom And Pop Landlords — Who In Everyone’s Fantasies About Capitalism On A Human Scale Are Not Insatiable Villainous Psychopaths Like Non Mom And Pop Landlords Are — And Somehow Neither Krekorian Nor Wesson Thought It Was Worth Mentioning That They Themselves Are Mom And Pop Landlords — As Is Paul Koretz — And Nury Martinez — And Curren Price — And Jose Huizar — And Mike Bonin’s Husband — Although Bonin Voted Against Krekorian’s Eviscerating Motion — So At Least There’s That

Yesterday the Los Angeles City Council considered and passed1 a long list of motions intended to alleviate some of the devastating effects of the coronavirus pandemic on our City. One of the most essential of these was CD11 rep Mike Bonin’s motion to stop evictions and ban late rent fees until the end of the emergency declaration and then give renters 24 months to pay missed rent.

The meeting itself was interminable and the public is excluded from City Hall and had to sit out on the front patio under a tent. But fortunately a number of extremely hard-working reporters were on the case, and it’s due to the incomparable Sahra Sulaiman‘s live-tweeting of this episode that I’m able to tell the story I’m telling here.

Sulaiman reported that Paul Krekorian, our second fashiest councilmember, was all about 24 months to repay being far, far too long:

Can’t tell who (Krekorian?) suggests that we are shifting loss bc if we give tenants too much time to pay back, the grace pd may extend beyond their lease and therefore end up being uncollectable. And that we need to consider more options, like applying security deposit to rent.

Krekorian went on to say that:

He acknowledges some folks will never be able to pay it back and that some landlords can absorb that, but others cannot, and that may have other negative consequences.

Got it? Paul Krekorian acknowledges that some landlords can absorb the loss from tenants not paying back rent while other landlords cannot absorb the loss. This is his reason for wanting to cut the repayment period down from 24 months to 6 months.

Hey, did you know that California state law requires public officials like Paul Krekorian to file annual disclosures of their financial interests? Well, it does. They’re called “Form 700s” and here’s Paul Krekorian’s from 2018. And as expected, rental income is income and thus counts as a financial interest to be listed on the form.

Donald Trump Is Poised To Forcibly Relocate Homeless Human Beings – Move Them Into Concentration Camps To Please His Bloodthirsty Constituents – Meanwhile A Newly Obtained Email Shows That Mike Bonin Does The Same Sort Of Thing – Arranging For An Encampment Sweep Across The Street From The St. Joseph Center On Hampton Avenue For No Better Reason Than To Placate Housedwelling Psychopaths – He’s Willing To Sic The LAPD On The Unhoused For No Better Reason Than That It Suits His Political Goals – Keep This In Mind The Next Time Bonin Flips Out And Compares Advocates For The Rights Of Homeless Human Beings To Donald Trump

In this troubled time, perhaps to be known to future history as the early days of fully formed American fascism, sane people have legitimate reasons to worry about the President of the United States adding homeless human beings to the already too-long list of people he’s willing to intern in camps, torture, and kill in order to further his political purposes.1

Meanwhile our local politicians keep up their characteristically hypocritical performance of opposition to Trump and empathy towards the unhoused2 while continuing to call down sweeps on their encampments, displacing them, endangering them, occasionally killing them. Endangering, sacrificing, just as Donald Trump does, the lives of actual human beings for no better reason than to please their bloodthirsty constituents, who demand visible action in lieu of actual solutions.

Of course, that’s not how these politicians frame their activities. They go on and on and on about how police-attended encampment sweeps are necessary to help homeless residents, to disincentivize them from living on the street and encourage them to accept shelter, et cetera. But that’s not a reason the City of Los Angeles has sweeps, not at all. And whatever all the reasons might be, political expedience is certainly one of them.

Just for instance, take a look at this December 2017 email from Taylor Bazley, formerly on CD11 repster Mike Bonin’s staff, to LAPD senior lead Adrian Maxwell, asking him to “focus resources” a homeless encampment on Hampton Avenue in Venice. Bazley was communicating Bonin’s concerns which had nothing to do with helping the inhabitants in any way at all. No, Bazley’s stated reason for focusing resources on this “particularly disadvantageous” encampment were that:

… across the street is the primary homeless serving organization for the SPA (St. Joseph Center) – people will think that the encampment is due to the organization and the Councilmember is concerned that this will make projects we all want to move forward, more difficult with an already skeptical neighborhood.

My Public Records Act Lawsuit Against The City Of Los Angeles — CD11 In Particular — Is Settled — The City Handed Over The Records And Will Pay My Attorney $12K For Her Trouble — Gotta Wonder Why They Think This Is Better Than Just Complying With The Law

Maybe you remember that in June of this year I was forced by the unhinged intransigence of various CD11 staffers with respect to compliance with the public records act, with the able assistance of the incomparable Anna von Herrmann, to file suit against the City of Los Angeles. The issue was over emails mostly involving planters illegally placed on the public sidewalks of Venice by the usual Klown Kar Krew of psychopathic housedwellers, aided and abetted in their absolute flouting of the law by various CD11 staff members.

And unlike e.g. the Venice Beach BID, at least the City of Los Angeles knows when they’re beat and they started handing over records immediately. And although I still have some issues with the City’s compliance, especially over the formats in which they choose to produce emails, this wasn’t the time to fight those battles, and they do at least know when they’re beat.

A lot of the material they produced in response to this suit was quite important. Not least e.g. was this story about how former and not-really-well-missed Bonin staffie Taylor Bazley not only abetted angry housedwellers in another crazed anti-homeless hostile landscaping project but even discouraged them from planting trees because, spake Bazley, homeless people like shade.

And just recently the settlement agreement was finalized, and you can get your copy here. As is the way with such material it’s really not that interesting. But there is one really interesting bit and that is that the City of Los Angeles agreed to pay von Herrmann $12,665 for her labors.

In June of this year I was forced to file yet another lawsuit against the City of Los Angeles to enforce my rights under the California Public Records Act in the face of their habitual reflexive intransigence, this time against CD11 over emails having to do with those goddamned planters. Well, as I have already reported, the City caved immediately and began handing over records.

And just recently I got another set of goodies from them with a little bit of interesting stuff in it, so I thought it was time to catch you all up on the story, provide links to the goodies, and mock and shame yet another unhinged homeless-hating housedweller, this one seemingly promoting Mexico City style mass killings by the Olympics Committee.1

Let’s start with the links. These are all the emails at issue in this suit that I’ve received so far. They’re not in any kind of order, and, as usual, the City has engaged in its usual passive aggressive scrambling, crooked scanning, chronological disordering, and so on, so, by design, they’re pretty much impossible to sort through and understand globally. I’ve been spending some time looking into the ways in which City Council offices materially support housedweller aggression against homeless residents of Los Angeles, including especially by facilitating illegal hostile architecture. Venice is one of the main theaters in which this drama is currently being performed, what with the proliferation of illegal planters and other, more idiosyncratic projects like for instance the Frederick Passageway, just west of the Penmar Golf Course. So naturally I’m spending a great deal of time sending requests to CD11 under the California Public Records Act.

And for a long time they completely ignored me, but then, by pure good fortune, in response to a request to LAPD, I received a stunning and unexpected email conversation between (now former) CD11 field deputy Taylor Bazley and various worthies proving conclusively that, despite many, many explicit denials from Mike Bonin’s flacks that there was any coordination at all between Bonin’s office and the outlaw planter-placers, Bazley was in fact directly involved in the process, even to the extent of calling in a sweep of a homeless encampment specifically so that illegal planters could be placed.

This discovery magnified the importance of the emails I’d requested from CD11 to the point where we all put on our hustle-hats and filed a petition splickety splat! And, as it turns out the City is wont to do, they pretty quickly started handing over records.1 You can take a look at the first batch here on Archive.Org. And these are all interesting, certainly, but the most interesting of all is this spool of emails between Taylor Bazley and various folks about the Frederick Passageway. There are two threads to the conversation here.

First there’s Bazley coordinating with angry housedwellers to ruin this public passageway by planting crap all over it to thwart the efforts of homeless human beings to survive, mostly because the housedwellers find them unaesthetic. Some of the identities of these housedwellers are known. For instance, there is ringleader Saul C. Janson, who claims to be some kind of lawyer. Bazley spends months, years, encouraging them. He suggests places they can find funding for their aggressive anti-human project. Listens sympathetically to their crazed rants. Really gets into the details of hostile landscaping, e.g. suggesting that they avoid shade trees because the homeless will enjoy sitting under them. Accompanies them in person to City offices to help them obtain permits. Helps them collect astroturf letters of support for submission to the Bureau of Engineering, telling them they don’t have to be sincere or even have much content as the only purpose is ass-covering in the event that someone sues the City.

And so on, all done in the inimitably sycophantic and cynical Bazleyian manner. This material is an important addition to the history of anti-homeless landscaping in Venice. To date we didn’t really know who was behind the appropriation and destruction of this public street, and we certainly did not know the extent to which Bazley and CD11 were involved in coordinating it.2

But in addition to that conversation, which is new and important but at the same time fairly predictable, familiar in tone and content if not in specifics, there are also a bunch of emails between Bazley, Mike Bonin himself, who repeatedly orders Bazley to cater to the whims of the housedwellers, and Debbie Dyner Harris, at that time a district director for Bonin, also ordering Bazley to please get to work and please please the housedwellers.

This is a side of the process we very rarely get to see. Councilmembers either only send very few emails or else their offices routinely and illegally withhold them. And these few emails are terse. The staff knows what to do, they don’t need to be told explicitly. Records, after all, will end up on the Internet. Best, then, not to generate any. This material, while actually less sensational than the other, is equally if not more important for shining light on the internal processes of Bonin’s office.

Another fact, revealed for the first time by these newly released records, is that the housedwellers were looking to this project not just as a way to exclude some unaesthetic human beings by installing plants on a public street. They were actually looking to literally privatize the street by annexing parts of it and adjoining them to their lots, thereby increasing their property values. This unexpected but ultimately not surprising development demonstrates in a pretty stark way that most if not all anti-homeless housedweller rage is actually about money.

Usually, possibly, the financial gains from hostile architecture are framed as about how aesthetics and perceptions of homeless neighbors affect property values but, at least in this case, it’s about actual annexation of publicly owned land. Thus spake Taylor Bazley: “a lot of the adjacent property owners are looking to assume ten more feet of property through the process of street vacation.” Taylor doesn’t go along with this plan, but not because he sees anything wrong with it. It’s just, he assures his boss, that it takes too long.

But as much as is revealed by these emails, one of the central mysteries remains unexplained. You’ll see, if you read on to the transcripts below, that the complaints that initiated the multi-year process of installing hostile landscaping on the Frederick Passageway are so stupid as to be incoherent. Saul Janson is angry, e.g., that the homeless people in the encampment laugh, eat food from takeout containers, own cell phones, and so on. He compares homeless people’s possessions to cancer, saying that their “stuff metastasizes daily”>.

He thinks single women are more particularly vulnerable to the unspecified predations of the homeless than, I guess, men and non-single women? The man is a slime-oozing braindead ball of enraged emotional putrefaction, certainly no one to be taken seriously. Oh, I forgot to mention! Janson and his neighbors “are mostly caring and socially responsible people.” Just ask them! If he weren’t a housedweller the best he could hope for out of City officials would be to be ignored. The worst would involve throwing away his tent or his insulin, tasing him, jailing him, 5150ing him into oblivion, leaving him to die on the pavement in the rain.

But none of that happens here. Instead of mocking and ignoring him, Bonin writes to Bazley and Dyner Harris to tell them to take care of the guy’s concerns. We’ve seen this exact phenomenon in CD13, as well as in CD11 with a whole different Klown Kar Krew, so it’s not isolated. What I don’t understand, what I despair of understanding, is why Councilmembers are so solicitous of these housedwellers. They’re not necessarily big donors. For instance, according to the Ethics Commission, none of Janson, Altschuler, or Adams have ever given a penny to Bonin.3

They’re not influential, they’re not going to sway an election. And yet the CMs listen to them, sweep encampments, disrupt lives, at their request. Maybe it’s because they’re asking for something the CMs want to do anyway and so provide political cover? I legitimately don’t get it and nothing in these emails gives even a clue.
