It’s been a while since I’ve asked for records from the Wilshire Center BID, in fact we haven’t heard from them since the whole sad clown Mike Hakim episode last summer. But just the other day I got about 200 new emails from the always cooperative Mr. Mike Russell, their doughty zeck dreck, and as always you can peruse them at your leisure and pleasure here on Archive.Org. And there are no blockbusters in there, but you might enjoy looking through the usual rattle and hum of the daily BIDness.

However, there is one really interesting, at least from a technical BIDological point of view, item, and that is this October 2, 2018 email from Rick Scott of the City Clerk’s BID division to Jose Flores, his subordinate, CCed to Mr. Mike Russell and, in a particularly cruel touch of bureaucratic passive aggression, every last one of Jose Flores’s supervisors. It seems that some internet random known as nezabudka1937@gmail.com fired off an angry little missive to the Clerk’s BID division at Clerk.NBID@lacity.org complaining about homelessness and urban decay in K-Town (of course there’s a transcription of everything after the break).

Jose Flores, who’s apparently tasked with sifting through the chaff,1 forwarded it to Rick Scott, and Rick Scott was all like, Jose! Send it to Mr. Mike Russell next time! Why? Here’s where things get strange. Thus all-caps-icalized Rick Scott:

With ANY stakeholder issue the BID is always the first entity they should contact. If their issue isn’t resolved after a reasonable time we will contact the BID to try to resolve it. The BIDs don’t work for us. They are paid to address stakeholders’ concerns.

Wow. Just wow. First of all, the angry email was from an unidentified internet random. It’s big if true that Rick Scott’s correct that BIDs are paid to address the concerns of internet randoms as long as he calls them stakeholders. But I’m pretty sure it’s not true.2 BIDs are paid to address the concerns of their boards of directors, not even the concerns of the people who pay their assessments. And it gets worse. Lots worse.

Anyone who’s paying attention to Los Angeles politics recently knows about the hipster apocalypse presently unfolding in Highland Park. I had occasion yesterday morning to walk south on Figueroa Street this morning from Avenue 61 to Avenue 503 and it’s basically like hipster Jim Crow, with businesses duplicated on every block and divided starkly along racial lines. A hipster tonsorial salon4 next to a Latino barber, hipster clothing next to work shoes or ropas segundas, hipster cold-press juice bars next to stands selling jugos naturales, and so on.

Weirdest of all is the situation with coffee places. Over and over and over again one sees a hipster coffee place full of tattooed young white people right next to a panaderia full of brown people. Both places serve coffee and baked goods and yet somehow there’s evidently no way that one place can satisfy both crowds. It makes absolutely no sense to me, probably not to any sane people.5 These coffee places, three or four to the block, are a stark and clear symbol of the holocaust that so-called legacy businesses along Figueroa Street are undergoing and which those along York Boulevard have already undergone baby gone.

And because hipster-serving establishments charge prices that are many times the prices the older businesses can sustain, they can afford rents high enough to drive the older places out of business. And the landlords are thrilled by this, of course, because they pocket the extra money with extra outlay of neither capital nor labor on their part. It’s a zillionaire’s wet dream.6 And it’s also not a mystery. It’s well-covered in the press. Rents go up and very soon after the vultures start feathering their nests.

And because it’s not a mystery, and because it’s a subject of deep import to many constituents in CD1, it’s entirely fitting and proper that residents would share their concern with their Council staffers and entirely fitting and proper that said Council staffers would respond. And we have already seen that something like this happened with the world’s oldest field deputy, Bill Cody, the crankiest and most bellicose flunky ever to rep Gil Cedillo or, for that matter, any other Councilmember in the entire damn history of Los Angeles.

At the May 15 meeting of the North Figueroa Association, which is the property owners’ association for the infamous Highland Park BID, he was questioned pretty intensely by Jesse Rosas about this very issue and responded in a rather mealy-mouthed fashion by claiming that his boss, Gil Cedillo, was taking care of it by hiring some kind of a firm, known as Barrio Planners, that presumably knows how to take care of such things:

And I’m always worried about that. Oh, one more thing. We have Barrio Planners, who’s been helping a lot of the local businesses to try to find placement for some of the ones who, um, … a couple of properties have changed situations and … I have been working with all those businesses, I [unintelligible] them together with Barrio Planners, they’ll work on that issue, we pay them to do that. So, we’re very, very concerned about that and we’ve been working tirelessly on that issue.

And since that day, more than five months ago at this point, my compatriots and I have been trying to figure out exactly what the heck Bill Freaking Cody was talking about. And because the CPRA mill grinds slowly we didn’t get much action for quite a while, but because the CPRA mill does grind, CD1 finally handed over some emails. You can read all of them here on Archive.Org, and turn the page for selections that reveal that despite the good game talked by Bill Cody, the Council District’s intervention via Barrio Planners on behalf of these threatened businesses seems to have been quite minimal and therefore the subject of wild overhyping by Bill Cody when e.g. he claims that they have “been working tirelessly on that issue.”

Mitch O’Farrell Has A Private Gmail Account Through Which He Conducts City Business — And His Chief Of Staff, Jeanne Min, Refuses To Release All Emails From This Account — Insists That There Is More Public Interest In Withholding Them — But No One Actually Believes That — Probably Not Even Her

In the last few years a number of public officials have been criticized extensively7 for using privately controlled email accounts to conduct public business. Hillary Clinton was famously investigated by the FBI for this. And just yesterday it was revealed that Ivanka Trump has done the same thing. Thus we were fascinated to learn recently that CD13’s own Mitch O’Farrell also uses a privately owned Gmail account, mitchof13@gmail.com, to conduct City business and, doubtless, to evade scrutiny.

This was discovered recently by our friends at the Hollywood Sunshine Coalition, who passed us the material on which this post is based. And this revelation settles a big mystery. As you know, I personally have obtained many thousands of pages of emails from CD13 on any number of subjects, and there are never any at all from O’Farrell himself. Previously I had thought that either Dan Halden, who handled most of my requests, was purposely omitting emails from his boss or else that O’Farrell was communicating in ways that didn’t leave traces, like phone calls. Now it seems likely that he has been evading scrutiny by using this secret email address.

The HSC has been making public records act requests for emails from this account. There are two ways to approach this. The first, and so far the only successful, way is to find correspondents who are subject to the CPRA and ask them for emails involving O’Farrell’s secret email address. This led to request number 18-2976 on the City’s newish CPRA platform, which is called Nextrequest.8 For some reason the City has made the request page available for public view but not the records provided. They turned over 21 highly duplicative PDF pages of emails between O’Farrell and various officers and, interestingly, some members of the Hollywood Studio District Neighborhood Council. You can read these 21 pages here. Apparently the HSC has other such requests pending.

But the HSC’s other strategy has turned to be much more interesting, even though it hasn’t gotten them any actual records yet. It’s based on last year’s absolutely monumental California Supreme Court opinion in City of San Jose v. Superior Court, which found that the emails and text messages of public officials are subject to the CPRA even if they are held in private accounts.

Based on this principle, on November 7 the HSC sent this CPRA request to CD13, asking for all emails held in the account from July 1, 2013 through the present.9 And yesterday, probably unsurprisingly, O’Farrell’s chief of staff, Jeanne Min, replied with the usual mush-mouthed nonsense, the TL;DR of which is “fuck you no records.” The HSC responded pretty scathingly, and then responded again for good measure. They’ve promised to keep me in the loop with respect to further developments. After the break you can find transcriptions of most of these emails along with some technical discussion of the CPRA issues implicated.

Meanwhile I’m told by those who ought to know that the HSC will not drop this request and that they are prepared to litigate if necessary. We’ll see what happens, I guess. Whatever happens, it’s clear that the public interest is very much against allowing Mitch O’Farrell to get away with maintaining this secret side channel for communicating with his favored few and with secreting emails away from public scrutiny and the City’s record retention policies.

LAPD Officer Michael Ling Labels Annual BET Experience In Late June “One Of The Most Troublesome Times” Of The Year In Hollywood — Due To Black People “Spilling From Downtown Into Hollywood” — Circulates List Of Nightspots That Cater To Those People — Advises Officers To “Be Vigilant” — Makes The Obligatory Unsupported Reference To Street Gangs — Because Black People, Amirite?

Here’s the briefest possible background. At least since 2015 Kerry Morrison of the Hollywood Property Owners’ Alliance has been carrying on a vendetta against minority-serving nightclubs in Hollywood, in which she was eagerly joined by weaselly little whiteboy Mitch O’Freaking Farrell and his loyal crew of bald-headed freaks at the LAPD. This led to hearings in City Hall followed by a series of despicable and illegal license revocations followed by a bunch of distastefully gleeful public cackling by Kerry Morrison.

Subsequently in 2016 I filed a public records act request with the LAPD hoping to shed some light on these ongoings. The cops dragged their feet for two freaking years, but last month finally did release a ton of really important material about the LAPD’s BID-inspired racist vendetta against bars in Hollywood that dare to serve liquor to negroes. There’s so much that I’m laying it on you in increments. The whole set is available here on Archive.Org, and the first article in this series is here and today we turn to an email about how LAPD perceives the annual BET Experience event at LA Live. Foreshadowing: They don’t like it, not hard to guess why.

So as I’m sure you’re aware, the BET Experience is a four day annual event culminating in the BET Awards. It’s like the Oscars, the Emmys, the Grammys, and so on, with one major difference. The honorees, the performers, the staff, the audience, they’re mostly Black people. And as you might guess, that makes all the difference in the world to the LAPD.

And therefore thus spake LAPD Hollywood officer Michael Ling:“As you know, this weekend is one of the most troublesome times in the HED due to the increase [sic] patronage to the area in light of the BET Experience spilling from the downtown area into Hollywood.” Isn’t the language colorful? According to this LAPD genius, it’s not just yet another huge industry event Downtown with participants coming to Hollywood to drink and dance and have a good time. Instead we have people “spilling from the downtown area into Hollywood.” You know, like slop buckets or whatever.

And in case the recipients don’t get the point, “Like many years before, alcohol and violent [sic] seems to go hand in hand.” He closes with a list of “venues that are cater [sic] to the festivities” and “Advised our officers to be viligant, increase awareness and BE SAFE.” Because BET Experience. Like the Oscars. Like the Emmys. Like the Grammys. But Black people. Therefore a list of bars for cops to give extra attention to. Thousands Of Pages Of 2016 LAPD Emails Shed Light On Hollywood Nightclub Racism And Creepy Cop Tricks — Including Targeted Enforcement Against Minority-Serving Establishments — Sending People “To Jail Before They Commit Crimes” — Explicit Targeting Of Putatively Chronic Offenders — Not To Mention Bizarro-World Redaction Policies Which Shed Some Light On The LAPD’s Contempt For The Public Records Act

Friends, cast your minds back to the Spring of 2015! Kerry Morrison’s various BIDs were all in a psychotic tizzy about dark-skinned people coming to Hollywood on the weekends to drink and dance and have some damn fun. Kerry Morrison and her yes-mob started a campaign against the nightclubs on Hollywood Blvd whose patrons were insufficiently lacking in melanin.10 This led, by the Fall of 2015, to Hollywood’s itchy skritchy little Council-snitchy, the one, the only, Mitch O’Freaking Farrell, starting a high-profile public campaign to shut down every nightspot that made Ms. Kerry Freaking Morrison wrinkle her freaking nose in disdain.

There was some pushback from the club owners in 2016, e.g. from the owner of the Rusty Mullet, whose lawyers played video from this blog at a Council hearing, and the organizers of the #blackhollywoodmatters campaign who, notably, convinced Marqueece Harris-Dawson to vote against the wishes of his smarmy little buddy from CD13 in a committee hearing, although naturally he reversed himself at the full Council vote. But in the usual way of things these minor victories didn’t have much of an effect,11 and by the end of August 2016 Kerry Morrison was, like Grendel’s momma, sitting around her reeking lair counting her ill-gotten victories on her poisonous and twisted little talons.

Around this time, that is, in August 2016, I filed a public records act request with the LAPD asking for emails related to these matters. And because the LAPD is basically a criminal conspiracy with respect to CPRA and just will not comply with the freaking law, which is why they get sued under the CPRA all the freaking time, it took them two whole years to hand over the goods. But they finally did produce thousands of pages12 and I recently published the whole pile on Archive.Org for your pleasure and edification.

At this late date, of course, and this was doubtless the City’s intention, the battle for the soul of Hollywood Blvd is pretty much over, with the reprehensible frightening whitening brightening of its nightlife essentially complete. However, history is interesting as well as political science, so I plan to write on these emails from time to time as there’s a lot of really disturbing and important material in there. I know some of you out there have been remembering such classics as the story of the angry scary fat black homeless male man or the story of the gang members escaping the seething urban hellscape of Santa Freaking Monica and thereby wondering just why it is that it’s been since March freaking 2017 since I last posted any full frontal mockery of the halfwits-by-the-sea out in Northwest Zillionaireville. I’m speaking of course of the Pacific Palisades Business Improvement District, Mike Freaking Bonin’s platonic ideal of a good BID.

And it’s certainly no coincidence that my last few posts about these coastal dimwits had to do with Laurie Freaking Sale’s weirdo Humistonian CPRA aggression. For instance there was the incident of Ms. Laurie Sale’s being too busy to follow the law, a theory which doesn’t work so well for non-zillionaires.13 Then there was the case of board member Rick Freaking Lemmo explaining how they were going to spend 3% of their annual assessments on lawyers to keep records out of my hands.

Well, it turns out that that’s not working out so well,14 because earlier this week I took a trek all the way out to the damn Palisades on public transit15 to finally inspect some records after fifteen tooth-pullingly painful months trying to talk some sense into Ms. Laurie Sale and then a few more months of my lawyer trying to talk some sense into the world’s angriest CPRA attorney, Ms. Carol F. Humiston.16

And good lord, friends! The craziness in these records is beyond fever pitch! It’s beyond Ebola pitch! Can’t easily be measured by disease slash pitch comparisons is how crazy it is! For various technical reasons it’s going to take a long time to prep this steaming pile o’ puckey for publication, so I’ll be dribbling it out a bit at a time. Today’s installment consists of 44 pages of emails amongst the BID Board, which can be found here on Archive.Org.

And amongst the millionish sharp little shards of crazy to be found here is the single most egregious violation of the Brown Act that I’ve ever known to be committed by a BID.17 In January 2016 BID zeck dreck Laurie Sale18 emailed her board with a motion to approve a contract and one by one they all voted yes by reply-all. Senior Lead LAPD Officer Julie Nony Says LAPD Continues Along The Path To Peace Paved 60 Years Ago By Ghandi [sic] And MLK — Senior Lead LAPD Officer Julie Nony Is Surprised That UCLA Students Drag Feet With Respect To Hosting Cop Discussion Group Because “This Seems Unusual For A School That Usually Participates In Protests” — Evidently Senior Lead LAPD Officer Julie Nony Is Now Assigned To The “Community Relationship Division” Of The LAPD Trying To Head Off Riots Before They Begin — TLDR: Senior Lead LAPD Officer Julie Nony Is A Lizard-Loving Moron

As you’re probably aware I have been trying to understand the situation with the Westwood Village BID and the Westwood Neighborhood Council and all them uppity UCLA students who want more bars open more hours.20 But, as you’re probably also aware, Westwood Village BID Boss BIDdie Andrew Lloyd Thomas, probably under the reeking influence of his lawyer, the ballistic barrister of Burbank, which is to say Carol Freaking Humiston, is really, really less than forthcoming with public records.21

One useful strategy for combating the kind of rabid knee-jerk obstructionism practiced by Carol Humiston’s zombie clients is to request records involving them from every possible agency that might have any. This may give access to the records more quickly.22 It’s also possible that this strategy will reveal interesting but hitherto unsuspected issues.

And that’s exactly what happened when I hit up UCLA for emails between their campus coppers and the WVBID. I threw in LAPD for good measure because LAPD is always interesting, and I got a small pile of emails, which you can find here on Archive.Org. Surprisingly, there were a bunch of emails between an old frenemy of this blog, Senior Lead Officer Julie Nony, a UCPD cop name of Kevin Kilgore, and a bunch of random undergraduate student government types.23

The short version is that Julie Nony was trying to get the students to host some blabbermouth jive known as Days of Dialogue and she was surprised that students were dragging their feet about it because everyone knows they’re a bunch of damn bomb throwing radical firebrands who would totally be interested in sitting down with some cops and having a conversation like this:

  1. Non-cops: Hey, we’re scared you’re going to kill us when we’re just walking to the corner to buy milk.
  2. Cops: I hear what you’re saying which is that you’re scared we’re going to kill you when you’re just walking to the corner to buy some milk.
  3. ????
  4. World Peace!!

How Herb Wesson Arranged For His Constituents To Pack A Council File With Phony Astroturf Letters Supporting His K-Town Homeless Shelter — And The Letters Were Written By Herb Wesson’s Assistant Chief Deputy Andrew Westall

One of the important topics we study here is the function of business improvement districts as lobbyists, not least as tools that the City uses to lobby itself in order to create the illusion of popular support for its initiatives. We recently saw an excellent example of this trope when Eric Garcetti used the Wilshire Center BID to supply a speaker putatively from the community to support his and Herb Wesson’s proposed Koreatown homeless shelter.

And it seems that Eric Garcetti was not the only LA Politician engaged in astroturfing support for this project. Just yesterday I obtained a huge trove of emails from the Byzantine Latino Quarter BID along Pico Blvd. The most interesting item in there24 is a May 15, 2018 email from Herb Wesson’s field deputy Cairo Rodriguez to Moises Gomez, BLQ BID director, asking him to submit a letter supporting the shelter.

But the most amazing, unexpected part of Cairo Rodriguez’s appeal is that it came with a letter of support attached, just waiting for the blanks to be filled in. See here for the original DOCX file, and here for a PDF, and there’s a transcription after the break. This is so peculiar, isn’t it? Obviously Herb Wesson’s not trying to convince himself to vote for the shelter, and he doesn’t have to convince his colleagues, because they’ll vote for anything he supports in his own district, so what’s the point of these letters? So strange.

According to the metadata this faked-up letter of support was written by Andrew Westall, one of Herb Wesson’s senior staff members. And a glimpse at Council File 18-0392 shows that a lot of copies of this astroturf letter were in fact submitted by a lot of different organizations on letterhead, with signatures.25 There are links to samples after the break.

One Outcome Of The Unholy Alliance Between North Westwood Neighborhood Council Subdivision Advocate Michael Skiles And Icky-Skicky Biddy-Boy Andrew Thomas Was That Skiles Changed The Bylaws To Give Zillionaires Even More Representation Just Cause Thomas Asked Him To — Which Might Be The Kind Of Thing That Andrew Thomas Wants To Cover Up Via His Myriad Surreal CPRA Violations — Although That Relies On Dubious Assumption That The Guy Feels Shame

Maybe you heard about the movement to subdivide the Westwood Neighborhood Council and form the North Westwood Neighborhood Council. This subdivision was led by UCLA students calling themselves Westwood Forward, with incipient philosopher Michael Skiles, whose academic specialty is, of all things, action theory, at the helm. The City held an election in May and the subdivision was approved.

However, unlike the heartrending pain created by the sinister schemings of zillionaires in Skid Row and environs last year, the local Westwood zillionaires were all eleventy jillion percent in favor of this particular subdivision. The reason seems to be a widely shared perception that students will be much more in favor of building more residential megaplexes and handing out more liquor licenses than the mostly über-füddy-düddy single family house dwellers on the regular Westwood NC have proved to be over the last few decades.26

Knowing all this, it occurred to me in March 2018 that the Westwood Village BID might be involved in this whole subdivision thing and, with that in mind, I fired off a CPRA request to them asking for the goodies. After many painful months of lawyers, recriminations, stupidity, frustration, and whatever,27 Andrew Thomas, the BID’s ickety-skickety executive director finally coughed up some small percentage of the records to which I’m entitled.

And the tune he’s dancing to is, you’ll not be surprised to learn, all about more seats for zillionaires on the new neighborhood council’s board of directors. And Michael Skiles not only dances to the tune, but he dances like he likes dancing! He’ll go far in academia, friends.

An Interesting Example From Wilshire Center Showing How Eric Garcetti Used The BID To Supply A Tame Businessperson To Speak For Herb Wesson’s Proposed K-Town Homeless Shelter — Revealing At Least One Of The Ways In Which The City Of Los Angeles Relies On BIDs To Manufacture An Appearance Of Community Support For Its Projects — Did I Mention The City Told The BID A Week Before They Told The News Media And Asked The BID To Keep Quiet About It?!

It’s been clear for a long time now that one of the uses that the City gets out of BIDs is to encourage them to lobby it, thus creating an appearance of community support for projects that the City intended to do all along. It’s easy to see the results of this process at any City Council meeting where a bunch of BIDdies line up to speak in favor of random proposal X that they don’t have any organic reason for caring about.

However, it’s not so easy to see the lead-up to the lobbying events. Obviously City officials are reluctant to release the evidence, and perhaps the BIDdies are as well.28 That’s why today’s documents are so very interesting! The emails I’m presenting are part of a larger release from the Wilshire Center BID, and you can get the original MBOX file or PDFs if you prefer here on Archive.Org.

The story is about the by-now famous homeless shelter proposed for Koreatown by CD10 repster Herb Wesson. The world found out about this project on May 2, 2018 at a joint press conference held by Wesson and Eric Garcetti, as Gale Holland explains in this characteristically excellent story in the Times.29

But amazingly, City staffers told the BID about the proposal on April 26, a full week before anyone else knew. BID board members were asked to keep quiet about it and also to propose a businessperson to speak at the May 2 press conference in support of the shelter. Real Estate zillionaire Mike Hakim volunteered himself to speak at BID director Mike Russell’s request but was, it seems, ignored by everyone, no doubt due to his shady, universally hated skyscraper project in Koreatown.

Instead, Mike Russell nominated Greenbridge Investments flunky Brenda Arianpour, a real estate zillionaire whom Russell misrepresented as a small business owner. After thorough vetting by Garcetti’s communications flacks, Arianpour was chosen to speak in favor of the project. Although not, of course, to speak in her own unscrutinized words. Garcetti’s flacks were sure to discuss “talking points” with her in advance.
