Friends, cast your minds back to the Spring of 2015! Kerry Morrison’s various BIDs were all in a psychotic tizzy about dark-skinned people coming to Hollywood on the weekends to drink and dance and have some damn fun. Kerry Morrison and her yes-mob started a campaign against the nightclubs on Hollywood Blvd whose patrons were insufficiently lacking in melanin.1 This led, by the Fall of 2015, to Hollywood’s itchy skritchy little Council-snitchy, the one, the only, Mitch O’Freaking Farrell, starting a high-profile public campaign to shut down every nightspot that made Ms. Kerry Freaking Morrison wrinkle her freaking nose in disdain.

There was some pushback from the club owners in 2016, e.g. from the owner of the Rusty Mullet, whose lawyers played video from this blog at a Council hearing, and the organizers of the #blackhollywoodmatters campaign who, notably, convinced Marqueece Harris-Dawson to vote against the wishes of his smarmy little buddy from CD13 in a committee hearing, although naturally he reversed himself at the full Council vote. But in the usual way of things these minor victories didn’t have much of an effect,2 and by the end of August 2016 Kerry Morrison was, like Grendel’s momma, sitting around her reeking lair counting her ill-gotten victories on her poisonous and twisted little talons.

Around this time, that is, in August 2016, I filed a public records act request with the LAPD asking for emails related to these matters. And because the LAPD is basically a criminal conspiracy with respect to CPRA and just will not comply with the freaking law, which is why they get sued under the CPRA all the freaking time, it took them two whole years to hand over the goods. But they finally did produce thousands of pages3 and I recently published the whole pile on Archive.Org for your pleasure and edification.

At this late date, of course, and this was doubtless the City’s intention, the battle for the soul of Hollywood Blvd is pretty much over, with the reprehensible frightening whitening brightening of its nightlife essentially complete. However, history is interesting as well as political science, so I plan to write on these emails from time to time as there’s a lot of really disturbing and important material in there. Two Interesting Protests Against BID Renewals In Hollywood — One By A Civil Engineer Attacking The Constitutional Adequacy Of Ed Henning’s Self-Plagiarized Boilerplate Engineering Report — The Other Somewhat Plausibly Accusing Kerry Morrison Of Complicity In The Payoff Of Transients To Harass Anti-BID Property Owners

You may have noticed that the Property and Business Improvement Law of 1994 makes allowance for property owners in a proposed BID to file “protests,” which must be accounted for by the City during the establishment or renewal process.1 For whatever reason, possibly the mandate that the City make a determination regarding protests received,2 these protests show up in the relevant Council File for all the world to read! And sometimes they are really interesting! Like the two recent doozies I have for your pleasant perusal today!

Setrak Kinian protest — this is against the renewing Hollywood Entertainment District BID, filed by a property owner in the old Sunset & Vine BID — the two BIDs are being unified in their current renewal — and has some essentially kooky but nevertheless fairly explanatory3 allegations against Ms. Kerry Morrison.

For instance, Kinian claims that her BID pays off homeless people to hang around the properties of BID opponents in order to encourage them to support the BID. He also makes the not-completely-implausible claim that one goal of the BID is to force smaller property owners to sell out to larger ones. The Council File for this renewal is CF 14-0855. Jim McQuiston protest — Against the renewing Hollywood Media District BID. McQuiston is a civil engineer and provides a really detailed4 denunciation of Ed Henning’s characteristically crapola engineer’s report. This is especially interesting to me given that one of my ongoing projects, which is to get the Board for Professional Engineers to take the preparation of engineering reports for BID formations seriously as the practice of civil engineering.5 The Council File for this renewal is CF 12-0963. Final BID Patrol Arrest Rates For 2016 And 2017 Show Close To 90% Drop From 2014, Which Was Their Last Unscrutinized Year — This Precipitous, Unexplained Decrease Leads Hollywood BIDs To Consider Using Unarmed Security In 2018 Or 2019

I started scrutinizing the three major Hollywood business improvement districts in late 2014, and soon discovered that the so-called BID Patrol, armed security guards employed by Andrews International under contract to the two BIDs managed by the Hollywood Property Owners Alliance, that is to say the Hollywood Entertainment District BID and the Sunset & Vine BID, was responsible for more than one thousand custodial arrests of homeless residents of Hollywood every year.

And these arrests were1 ugly affairs. They involve harmless people, like ice-cream vendors, being handcuffed, forced into SUVs, and chained to a bench, sometimes for hours. There were 2,682 such arrests in 2007, a number of such shocking incomprehensibility that I published a four volume set of photographs of these victims in order to provide some means of visceralizing the sheer incredible magnitude.

So it was a welcome discovery indeed to find out that in 2015, almost certainly as a result of my scrutiny, BID patrol arrests dropped 70%, from 1,057 to 313. Circumstances beyond my control have, maybe you’ve noticed, limited my ability to write about the HPOA, but I recently obtained arrest rate statistics for 2016 and 2017, and they show an even more precipitous drop in arrests in the two HPOA BIDs, with only 152 custodial arrests in 2016 and only 131 in 2017.

Thus from 2015 to 2016 there was a more than 50% reduction, which was an 85.6% reduction from 2014, their last unscrutinized year. This trend continued in 2017. Of course, this huge reduction in arrests did not lead to any corresponding reduction in costs. The HPOA paid roughly the same in 20172 to have 131 homeless people arrested as it did in 2014 to have 1,057 homeless people arrested. I have no doubt whatsoever that this is due to my scrutiny, and I am about as proud of saving these multiple thousands of people the pain, humiliation, and legal troubles consequent on these chickenshit arrests as I am of anything I’ve ever done.

Kerry Morrison’s Ruinously Expensive Obsessions With Homeless Outreach And Guns Cause Severe Cutbacks In BID Patrol Service Even As Expenditures Go Up, Up, Up — HPOA/CHC Books Cooked In 2015 To Obscure This Trend — Time For An Intervention!

Watch and listen here1 to an interminable discussion at last Tuesday’s meeting of the Board of Directors of the Central Hollywood Coalition2 about how to pay the increasing cost of the armed BID Patrol while, at the same time, maintaining or expanding dedicated “homeless outreach” services, also provided by Andrews International. In particular, staff is asking the board to approve a 5% increase in the A/I budget for next year to cover salary increases and so on.

Here are some numbers. A/I pays its BID Patrol officers $31.50 an hour.3 Almost certainly the BID is paying A/I significantly more than that. Also note that base pay for A/I unarmed officers is $13 per hour. In other words, armed officers cost about 2.5 times as much as unarmed officers. If A/I’s markup to the BID is a percentage of its HR costs then this ratio will hold constant regardless of what the BID is actually paying.4 Now, most BIDs in the City of Los Angeles do not have armed security. In fact, as far as I can tell, the two HPOA BIDs run by Kerry Morrison are the only BIDs that do.5 We have written before about Kerry Morrison’s disturbing and utterly disproportionate love of guns, and that’s probably enough to explain her insistence on armed security despite the high cost.6 And the cost is very high. According to the Sunset & Vine BID’s 2015 independent audit, the BID paid $805,608 for security out of total annual expenditures of $1,542,735.7

And what do they get for that? It’s explained in this exchange from last week‘s meeting.8 It’s essentially four dedicated officers per fourteen hour day, backed up by officers from the Hollywood Entertainment District, with slightly less on Sundays. Assuming 8 hour days, and not adjusting for Sundays, this is 11,648 hours per year.9 Dividing this into the 2015 security expenditure yields a rate of $69.16. Announcing Our New LAMC 49.5.5(A) Project: Peter Zarcone And The HPOA Music Festival Fiasco Provide Raw Material For Our First Experimental Attempt At Seeing What This Law Actually Prohibits

LAMC 49.5.5(A) states, rather succinctly, that:

City officials, agency employees, appointees awaiting confirmation by the City Council, and candidates for elected City office shall not misuse or attempt to misuse their positions or prospective positions to create or attempt to create a private advantage or disadvantage, financial or otherwise, for any person.

Here’s what seems to be required of a City official or employee to violate this law:1
  1. That they misuse their position, where I’m thinking “misuse” means:
    • They do something that requires the powers granted to them by virtue of their position and
    • their powers were not granted for the purpose of doing that thing.
  2. The misuse creates a private advantage or disadvantage for someone, where I’m thinking “private” means:
    • The advantage or disadvantage created does not further public policy goals. E.g. getting arrested creates a disadvantage for the arrestee, but the disadvantage furthers a public goal. Winning a contract through the City’s bidding process advantages the successful bidder, but the advantage furthers a public goal.

The law is enforced by the City Ethics Commission, although it doesn’t seem to have been used much. There is, e.g., this case from 2010 involving a Fire Inspector who charged money for successful inspections. This is the kind of thing one would expect to fall under this statute. However, there is also one high profile case pending right now which doesn’t seem ordinary at all. It seems quite unexpected. In 2014 LAPD Officer Jim Parker was among those who responded to a sex-in-a-car call involving Daniele Watts and her boyfriend. She accused the police of racism and brutality, and Parker anonymously leaked an audio recording of the incident, which exonerated the police. Subsequently, the Ethics Commission issued a public accusation against Parker for violating LAMC 49.5.5(A) on the theory that leaking the confidential audio recording, which he only had access to by virtue of his position, constituted a misuse which created a private advantage for himself.2

This is very encouraging. It seems that perhaps the Ethics Commission is willing to at least think about a broad application of this seemingly very broad law. And it’s an interesting thing about laws that no one can actually be sure what they mean, what the range of application is, until they’re repeatedly tested in the courts. Well, that’s not exactly right. If a court decides that people of average intelligence can’t be sure at all what the law actually prohibits or requires, they’re likely to toss it out as unconstitutionally vague. But, I guess, if people don’t know exactly what the law prohibits or requires, but average people could have realized that it potentially prohibits what they’re doing or requires what they’re not doing, then it’s not too vague, even if no one actually did realize those things.3 That’s the space I’m interested in exploring with respect to LAMC 49.5.5(A). And because I’m not interested in philosophical explorations any more I’m going to explore this issue by actually turning people in to the CEC to find out what happens, beginning with our old friend, Peter Zarcone. Yesterday the Planning and Land Use Management Committee heard the Cosmo Club’s appeal of the Zoning Administrator’s revocation of their conditional use permit. See the whole thing here, with a very short second part here. Also, the Council file is here. This is the second in the ongoing series of Hollywood clubs that cater to minorities being targeted for elimination by Kerry Morrison, the Hollywood Property Owners Alliance, the LAPD, and CD13 rep Mitch O’Farrell. The racist nature of this anti-nightclub campaign is revealing itself to the public, as dirty secrets will do, so this hearing drew some protesters who stated clearly, articulately, just exactly what is going on in Hollywood. Also, although L.A. Times reporting on this issue to date has been sporadic and radically incomplete, I spotted the incomparable Emily Alpert-Reyes exchanging contact information with Cosmo Club attorney Mike Ayaz after the hearing, so maybe something interesting is forthcoming.

There are links to a number of highlights at the end of this post, but the hearing was particularly rich, and I’m going to have to cover it in increments, starting at the end. If you’re not familiar with the situation, you can read up about it here and also here.1 But here is the short version of how we got to this point: Kerry Morrison, her BIDs, and Peter Zarcone decided to destroy a bunch of nightclubs in Hollywood. Mitch O’Farrell told City Planning to get on it. They did, and the City Council will vote in favor of Mitch no matter how bogus the evidence is because they also want to exercise unilateral control over every aspect of everything in their districts, which they can only do with the connivance of their colleagues. Marqueece Harris-Dawson didn’t play along at yesterday’s hearing, which, although he was merely doing his job as a Councilmember, is very brave, since if he does it too often the zillionaire elite will certainly take away his seat in 2019.

In any case, after interminable testimony by Zoning Administrator Aleta James which listed every traffic ticket and open container violation within 100 yards of the business as is evidently the practice in these cases, after LAPD Hollywood Division Captain Cory Palka shilling for real estate developers, after greasy little liar and LAPD Hollywood undercover vice cop Benjamin Thompson told his greasy little lies, after many cogent comments by actual human beings opposing the City’s raw destructive power, after Sean Rafael from the Cosmo played OUR VIDEO from 2015, after all that, a small miracle occurred. Councilmember Marqueece Harris-Dawson of CD8 questioned the Zoning Administrator extremely closely, ultimately a round of applause from the audience, who were amazed to witness that rarest of phenomena in Los Angeles: truth spoken from behind a desk in a Council hearing. A couple weeks ago we wrote about a Zoning Administrator hearing being held for the purpose of revoking the Rusty Mullet’s conditional use permit. Well, the hearing was held on July 28, 2016. As far as we know a determination has not yet been made, but we recently obtained more than five hours of audio from the hearing. You can listen to part I and also part II here. It’s not easy to get through the whole damned thing, which is why you’re lucky to have us! We’ve listened to the whole thing and made clips of some interesting bits. Note that as long as we were haunting City Hall to get this material we also obtained audio from the CUP revocation hearings for the Cosmo Nightclub and the Cashmere, and you can find both of those on this Archive.org page.

Now, long-time readers of this blog will recall that in March 2015 we broke the story that Fabio Conti, Carol Massie, Kerry Morrison, Marty Shelton, and pretty much everyone on the Board of Directors of the Sunset & Vine BID except for Chase Gordon are a bunch of racists who want to shut down every bar on Hollywood Boulevard because they don’t like the skin color of the patrons. So imagine our pleasure at learning that Mike Ayaz, the Rusty Mullet’s lawyer, actually showed our video at the hearing! This was part of the evidence for his position, with which we concur, that the restaurant appears on a hit list of bars being targeted for racist reasons by the BID, the LAPD, and the City Government. You can hear the whole clip here, where he refers to Fabio’s speech as “disturbing video which I would like to play of a quasi-governmental agency that basically…I think I’ll let the video speak for itself.” And speak for itself it does:

Be sure to catch the audience reaction at the end. It doesn’t make anyone sane happy to hear Fabio Conti channeling Marty Shelton claiming that “the Lindsey Lohans of the world are not hanging out at the Rusty Mullet” with the regulars, who are “decidedly minority, brown and black, and my guess, from a lower economic strata.” These dimwits on the BID are clearly going to regret the day they neglected to listen to their one and only sane Board Member, Chase Gordon, who responded to this bullshit in March 2015 by saying that he didn’t “think that we should be, especially public-facing, going out with the distinction of ‘we don’t want lower economic statuses coming and visiting Hollywood.” Anyway, who can say what will happen, but we here at MK.org are inordinately proud on this beautiful Sunday morning that the citizen journalism of our intrepid correspondent is paying off in this big way. This story is a sleeper, but when it finally makes the papers, it’s going to be huge.

The Hollywood heroes at Peru Village L.A. held a marvy little festival yesterday across the street from MK.org secret headquarters, which prompted us to break out this story, which we’ve been sitting on for years. Well, not just the festival, but the recent revelations that not only does the HPOA hate mainstream Mexican-American artistic styles, but our councilman, Mitch O’Farrell, who by his own account has “a solid reputation of improving the quality of life for constituents in the 13th Council District,” approves of the anti-Latino-art dog whistlings of the Central Hollywood Coalition. So tonight get ready to hear about how they all have it in for our local Peruvian community as well.

Here’s the back-story. In 2012, a bunch of local Peruvian-Americans in CD13 got a council file started in an attempt to get Vine Street between Melrose and Sunset designated “Peru Village.” This makes some sense because, e.g., there are about five Peruvian restaurants along there, including Mario’s Seafood, which has some of the most astonishing fried chicken in the United States, and Los Balcones, both of which are numbered among the finest restaurants of any variety in our City. So they sent a bunch of really cute kids around to knock on doors and they ended up collecting over 500 signatures from people in the neighborhood.1 If you’re not familiar with Los Angeles politics, it’s worth noting that actual city council elections can easily be decided by 500 votes. For mere neighborhood renaming this is a landslide.

But then in February 2013, jittery little psychopath and Hollywood McDonald’s Queen Carol Massie got wind of the plan and popped off this little slab of characteristically jittery psychopathy, in which she swizzlingly pours forth the toxic product of her unchecked anorectic id thusly, proving that she not only hates America and also hates dark-skinned Hollywood club patrons, but that she also has something against Peruvians:

I am a founding member of the Sunset/Vine Business Improvement District which includes this “Peru Village” area. Not only have I never heard of this petition but we, as business owners, work very hard to make Sunset Boulevard and the famous Sunset & Vine corner a place that people from all over the world2 view as an integral part of Hollywood. Peru Village would include the Cinerama Dome,3 a Hollywood icon, among others, which seems amazingly inappropriate.

Note that she never says WHY it seems amazingly inappropriate. Perhaps her laser-like zillionaire mental powers tell her that the Cinerama Dome is completely disjoint from all things Peruvian. Or maybe she just made it up, which would be completely in character for Carol Massie.

Our correspondent hasn’t been to the Joint Security Committee of the HPOA and the CHC in a long time, but we do miss his reports; that’s where the real crazy happens. Tonight’s little jewel has to do with the unknown LA County Sheriff’s Deputy whose picture is presently gracing your screen somewhere near this sentence. No one could understand his name when he announced it during the introductions, which is unfortunate because blasting the personal identity of ham-fisted babbling Sarah-Palin-wannabe cheese eaters like this genius all over the internet in close Google-cinity of their carefully transcribed moronic pronouncements is kind of this blog’s whole raison d’être and stuff. But ’twas not to be.

We reported a couple weeks ago that the Hollywood Property Owners Alliance had put out a request for artists to submit works to adorn local signal boxes that explicitly excluded graffiti art and cartoon art. This despite, perhaps, given the BID’s vicious white supremacism, because of the fact that graffiti and cartoon art styles are a cornerstone of indigenous Angeleno/Latino culture. Well, if you live in the area, you may have noticed that the Sunset & Vine BID, controlled by the Central Hollywood Coalition, the HPOA’s not-quite-so-evil twin sister, recently put up artwork on ten signal boxes in their district. Their call for artists incorporated the same restriction as the current HPOA one: “No Cartoon Images or Graffiti work of any kind will be considered.”
