On August 15, 2018, faced with Rena Leddy’s unhinged intransigence and chronic disregard of the law, I was forced to file a petition asking a judge to require the Fashion District BID to comply with the California Public Records Act. Most of the petitions I’ve filed recently have had only to do with BIDs ignoring my requests altogether1 but this one raises interesting and possibly novel issues of how exemptions to the CPRA are to be interpreted in general and in Los Angeles in particular. I’m represented by Abenicio Cisneros and Karl Olson.2

There are four classes of records at issue in this petition. Those are:3

  • Emails between the FDBID and either the South Park BID or DLANC
  • Emails in the possession of BID Board president Mark Chatoff
  • Emails between the BID and Urban Place Consulting
  • Emails in the possession of BID renewal committee chair Linda Becker

Rena Leddy claimed either that such records didn’t exist or that, if they did, the BID could withhold them on the basis of the so-called deliberative process exemption.4 In each of the four cases either there’s independent evidence that responsive records exist or else it defies belief that no records exist. For instance it is not plausible at all that Linda Becker, chair of the BID’s renewal committee, does not possess a single email relevant to the conduct of the BID’s business.5

Kicking Off Our New Brown Act Enforcement Project With A Demand Letter To The Byzantine Latino Quarter BID Insisting That Their Advisory Board Of Directors Stop Discussing Public Business In Secret Via Email — With A Writ Petition To Follow If They Won’t Unconditionally Commit To Following The Damn Law In The Future

Long-time readers of this blog will recall that one of our constant themes has been the exposure of an unrelenting series of violations of the Brown Act by the various BIDs of Los Angeles. I started the blog in October 2014 and that very month caught the Sunset Vine BID and its dear leader, Ms. Kerry Morrison, requiring IDs in order to attend meetings, which is a violation of §54953.3.

Since then it’s just been one damn thing after another, what with the South Park BIDdies refusing to share documents considered by their board at a meeting, or requiring meeting attendees to sign in, or their teleconferencing fiasco, or the Venice Beach BID’s deficient agenda descriptions, or the Central City East Association‘s discussing and voting on matters that were not agendized, or the East Hollywood BID‘s teleconferencing violations, and those aren’t even the worst of the bunch.

One of the most important prohibitions imposed by the Brown Act is found at §54952.2(b), which states that “[a] majority of the members of a legislative body shall not, outside a meeting authorized by this chapter, use a series of communications of any kind, directly or through intermediaries, to discuss, deliberate, or take action on any item of business that is within the subject matter jurisdiction of the legislative body.”

In the past we have seen shameless, egregious violations of this section, e.g. the Pacific Palisades BID in 2016, or also by the Central City East Association as part of their relentlessly immoral, illegal campaign against the formation of a Skid Row Neighborhood Council, and by the Los Feliz Village BID, whose violation of §54952.2(b) was bad enough that it actually earned them a written rebuke from the Public Integrity Division of the Los Angeles County District Attorney.

That last outcome has been an anomaly, though. Despite my having filed multiple reports against BIDs for serious violations of the Brown Act, the District Attorney has, to date, ignored all of them but the Los Feliz one.6 But the legislature, oh wise and omniscient!, has determined that Brown Act enforcement is too important to be left only up to the whims of County District Attorneys. They’ve also allowed for private citizens to enforce the law as well!

So this time, when I discovered dispositive evidence that the Byzantine Latino Quarter BID had violated §54952.2(b) of the Brown Act on at least two occasions earlier this year by discussing BID business in private via email I decided that I would take matters into my own hands rather than relying on the County DA to handle the violation. And the violations are really extreme and also somewhat lurid. One involves BID board member and Greek Orthodox priest Father John Bakas arguing against homeless shelters on the grounds that homeless people are dangerous and incorrigible, e.g.

Of course, it took some time and effort to study the law, get professional advice, and generally prepare an infrastructure for the private prosecution of such violations. Now that it’s all set up, it’s not just good for this one violation, but will work for all future violations that come to my attention. Thus it is with a great deal of pride that I announce an ongoing project to force the BIDs of Los Angeles to stop violating the Brown Act by prosecuting them myself if necessary! The Education Of Ms. Ellen Salome Riotto, Episode 837 — Another Brown Act Violation At South Park — Not To Mention A Copy Of A Presentation By Sonder™ — The World’s Creepiest Hotel Company — Well Beloved, Of Course, Of South Park, The World’s Fourth Creepiest BID

It’s beginning to feel like all I do around here is educate the freaking South Park BIDdies about their legal obligations under the Brown Act. These are people who are so lawyered up in their daily lives that they don’t even tell their kids they love them except on advice of counsel but for whatever reason they cannot or will not get reliable guidance on how to follow a single one of California’s government transparency laws.7

There was this episode in February, this episode in April, this other episode in April, and now here we are in July with yet another hilarious tale of egregious flouting of statutory obligations on the part of the South Parkers.8 You may well recall that the South Parkies had a board meeting last Thursday, June 28, and that I attended and recorded it. And Ms. Joella Hopkins was a highlight, but not the only highlight.

There were also two presentations, one from AEG and another from yet another creepy-as-fuck hotel industry disrupter, known as Sonder, whose main advantage over Motel 6 seems to be that they have listening devices in their hotel rooms so that if guests play music too loud the company can turn it down remotely. What could possibly go wrong with that? You can watch Sonder’s spiel starting here, and AEG’s starting here.

Both of these presentations had associated slide shows, which the presenters seemed to think were somehow confidential. Sonder’s had some statement on it about how it was tip-top-secret, and the AEG presenters actually asked if there were any media representatives in the room. Watch and listen here as the AEG lady asks directly albeit fairly incoherently: “Can I just ask for process oriented are there any media in the room today?”

But as far as I’m concerned, and the law tends to agree with me, once people show a slideshow in a meeting covered by the Brown Act, that slideshow is public property. So naturally I sent Ellen S. an email asking for copies of the goods, and turn the page for transcriptions, commentary, and to learn what ensued!

José Huizar was scheduled to speak at yesterday’s South Park BID board of directors meeting, so off I went to record the goings-on for history’s sake. The entire video is here on YouTube and Huizar starts here. His remarks were even more devoid of content than usual, although I’ll have something to say about them soon.9

The CM was, however, late to the meeting, leaving his brand-new Downtown District Director, Carol Schatz’s former event planner, the one and only Joella Hopkins, CSEP, CMP, MBA, to extemporize for a surprisingly long time, starting here. As always there’s a transcription after the break.

The focus at first was on homelessness. In particular on the usual story about how essential it is for the City to build enough housing so that the LAPD can start arresting every homeless person in sight. She then moved on to what she characterized as “a rise, a more blatant rise in public safety issues with transients or mentally ill assaulting our residents on the street.” And while Joella Hopkins’s remarks are usually weird, her remarks here were even weirder than usual.

Of course, this “rise in public safety issues” is a favorite narrative of our City’s zillionaire elite when it comes to repressing the homeless of Los Angeles. Usually they don’t bother with evidence, but Joella Hopkins, to her credit, her shame, something, did at least try to support the claim, seemingly justifying it with this cryptic remark: “… if you guys are on social media …”

At Eager Prompting Of Scofflaw Board Member, Brand New South Park BID Homeless Outreach Coordinator Angela De Los Santos Admits On Camera To Violations Of State Law Regarding Where BID Activities Can Take Place

You may recall that I regularly write about the South Park BID and the seemingly endless parade of their wanton violations of the Brown Act. It seems like every meeting brings another violation and the last meeting involved at least two distinct violations. Thus it will come as a welcome change of pace, I am sure, to learn that this post is about the South Park BID violating the law, to be sure, since that’s pretty much what they do over there, but at least it’s not about them violating the Brown Act!

The law in question here is the Property and Business Improvement District Law of 1994, which states at §36625(a)(6) that “[t]he revenue from the levy of assessments within a district shall not be used to provide improvements, maintenance, or activities outside the district…” And yet, at the April 26, 2018 meeting of the South Park BID, funding activities outside the BID is precisely what was discussed. But I’m getting ahead of my story!

See, what happened is that on April 9, 2018 the South Park BID hired a homeless outreach coordinator, Angela De Los Santos, who was introduced to the BID on the 26th by executive Directrix Ellen Salome Riotto. Angela De Los Santos passed out a handout (which stated that there were only 18 homeless people in the South Park BID), talked about her duties for a while, and then took questions from the Board.

How I Finally Had To Report The South Park BID To The District Attorney For Violating The Brown Act Even Though Board Member, Working Class Hero, And Self-Proclaimed Schmuck Paul Keller, The Finest Legal Mind Of His Generation, Screamed At Me In The Lobby That They Didn’t Actually Violate It

As you know well if you follow this blog, the South Park BID is severely challenged when it comes to Brown Act compliance. First, in February, they had deficient agenda descriptions, although they fixed that in response to my advice. Then last week they had a deficient teleconferencing option, which again they fixed in response to my advice. However, yesterday’s board meeting was held in a building where signing in as a condition of entry was mandatory. This is a clear violation of the Brown Act at §54953.3, which states unequivocally that:

A member of the public shall not be required, as a condition to attendance at a meeting of a legislative body of a local agency, to register his or her name, to provide other information, to complete a questionnaire, or otherwise to fulfill any condition precedent to his or her attendance.

Based on a previous visit to the building I suspected that they might require visitors to sign in, so I recorded the whole scene. I also determined to offer them a chance to avoid the violation by discussing it with the BIDdies if signing in was in fact required, which it was. The security guard didn’t have the BID’s phone number, so that was out.10

Anyway, while I was talking about it with the guard, South Park BID board member and self-proclaimed schmuck Paul Keller, the finest legal mind of his generation, came in and yelled at me for pressing the issue. His theory is that the law wasn’t violated because a signature was required to enter the building rather than the BID meeting. Maybe he wasn’t aware that his executive director, Ellen Salome Riotto,11 relies implicitly on my legal advice, with respect to the Brown Act anyway.

Far be it from me to say why he thinks this, him being the finest legal mind and all. Perhaps he’s basing it on the popular zillionaire legal maxim that any law that inconveniences even a single zillionaire must be unconstitutional. This is true, of course, at least 99\frac{44}{100}\% of the time, but not this particular time. On the other hand his rant suggests that the sign-in requirement wasn’t just another oversight, but actually constitutes BID policy.

Whatever was going on, I feel like they’ve had enough chances to mend their ways and have shown no interest in doing so. Hence I filed a complaint against them with the Public Integrity Division of the Los Angeles County District Attorney. Turn the page for a transcription, and stay tuned for details!

How Is South Park BIDdie And Famously Manic Minion Katie Kiefer Just Like Richard Nixon? This is just a short note to announce the availability of video of this morning’s meeting of the South Park BID‘s board of directors. There’s a lot going on here, and I have at least a few detailed posts to write about this material over the next few days, but I just wanted to provide links so you can see for yourself, and also to announce a stunning piece of news about the SPBID’s director of operations Katie Kiefer.

She is leaving the BID to go work for the prince of darkness himself, Mr. José Huizar, over at 200 N. Spring Street. This makes her the latest BIDdie to move over to Huizar’s office, the last known instance being Mr. Ari Simon, late of the Historic Core BID, batty little fusspot Blair Besten’s weirdo empire on Broadway.

Even Funnier The Second Time Around! Ellen Riotto And/Or Manic Minion Katie Kiefer Of The South Park BID Continue To Follow Open-Sourced Wiki-Legal Advice From Internet Randoms At Your Favorite Blog Evers!!

It seems like forever ago by now, but maybe you recall that in February the South Parkers sent around an agenda announcing a closed session that was so freaking out of compliance with the Brown Act that I could not, despite mom’s best advice, keep my mouth shut. Thus I emailed the Parkies and hilarity and agenda revisions ensued!

Well, these Southies have another meeting coming up this very Thursday, and imagine my joy when I received a copy of the agenda! And imagine my horror when I noticed the bit about teleconferencing! Here’s what it said:

We’ve been through this crapola before with the East Hollywood BID. The plain fact is that the Brown Act forbids teleconferencing unless it’s happening from a teleconference location where members of the public can go to participate. You can read all about it in §54953(b). It’s just not OK to assume that all members of the public who wish to participate have phones.

Also, the Brown Act at §54953.3 forbids local agencies12 to require members of the public to identify themselves as a condition of attending the meeting. This made me pretty sure that the BID’s requiring would-be teleconferencers to register their names with Ellen Riotto’s manic minion Katie Kiefer was another violation.

So anyway, usually I would just wait around for the BIDdies to actually break the damn law and then turn them in to the Public Integrity Division of the Los Angeles County District Attorney like I did with the Los Felizites and more recently with the Central City East Association. But it was so entertaining the last time I warned them and they actually took my advice that I thought I’d give that another try.

So I sent them an email saying essentially hey friends you’re about to break the law again! And what do you know? A couple hours later they sent me an email13 saying essentially hey friend, you’re right! We’ll change everything! And then a couple-few days later, that is, this morning, they sent out a revised agenda stating definitively that:

NOTE: Teleconferencing into this meeting will not be enabled.

Ahahahaha And LOL!!! Ellen Riotto Of The South Park BID Is Now Taking Sensitive Legal Advice From Internet Randoms At This Blog!!!

The Brown Act contains many wonderful treasures, but one of the wonderfullest is to be found at §54954.1, which states unambiguously that:

Any person may request that a copy of the agenda, or a copy of all the documents constituting the agenda packet, of any meeting of a legislative body be mailed to that person. … Upon receipt of the written request, the legislative body or its designee shall cause the requested materials to be mailed at the time the agenda is posted pursuant to Section 54954.2 and 54956 or upon distribution to all, or a majority of all, of the members of a legislative body, whichever occurs first.

I ask many of my BID friends to send me these notifications and their agenda packets. It really seems to piss most of them off.14 I don’t feel bad for asking BIDs to comply with the law, though. After all, it’s voluntary on their part and they’re making an awful damn lot of money out of it.

So anyway, our friends at the South Park BID are reasonably cooperative about complying with the law. They invited me to sign up for their public mailing list, which I did. It’s an open question as to whether this is compliance, since the law requires notifications to be sent at the time that the board receives them, but this presently seems too minor to quibble over. On the other hand they spout an awful lot of spam through that account, and clearly I shouldn’t be required to sort through the junk just to be able to receive notifications that they’re legally mandated to send. Again, though, this is an argument for another day.

However, it turns out that the South Park BID does distribute packets to its board of directors in advance of the meetings and also that those are not available via the public mailing list. I only found out about this recently, so I wrote to the BID boss ladies and asked them to send them goodies my way!

After some nonsense with them interrogating me mercilessly about which email address I wanted the board packets sent to,15 we got all the details ironed out. And after that, my friends, it must follow, as the night the day, that I ended up sending Ellen Riotto some of my sage legal advice and, amazingly, she ended up taking it!16 Read on for the details and a bunch of emails!

The California Board For Professional Engineers Explicitly, Openly, Refuses To Enforce Professional Standards Against Engineers Who Produce Crack-Headed Nonsensical Reports For BID Formation , With Venice Beach Being A Prime Recent Example, Even Though The Legislature Clearly Intended Some Oversight — This Is An Overt Abrogation Of Their Duty But At Least It Explains The Submoronic Lobotomized Quality Of The Damn Reports

NOTE: This post turned out to be a lot more complex than I’d originally planned, so here’s a TL;DR:

  1. New BIDs are required to submit a report written by a state-certified engineer explaining why their boundaries and assessments make sense.
  2. Ed Henning, the engineer for the Venice Beach BID, submitted this totally nonsensical report.
  3. One of the same Venice residents who is suing the BID filed a complaint against Henning with the California Board for Professional Engineers alleging that Henning made up a bunch of stuff and otherwise acted incompetently in the report’s preparation.
  4. The Board rejected this complaint with this letter, claiming that they do not consider the preparation of BID reports to be within their jurisdiction. There’s a transcription of this PDF at the very end of this post.
  5. This is yet another example of how no one in the government, state or local, is willing to regulate BIDs at all or hold them accountable for anything.

My recent post on the East Hollywood BID in relation to one of the purposes of the Management District Plan for BID operations, focusing in part on some of the esoteric technicalities of the Property and Business Improvement District Act as it did, reminded me of another topic touching on PBID technicalities I’ve been meaning to write on for a few months now but have not yet, until today, gotten around to dealing with.

One of the required elements of the process of forming a property based BID, imposed by the PBID Law at §36622(n), is:

… a detailed engineer’s report prepared by a registered professional engineer certified by the State of California supporting all assessments contemplated by the management district plan.

This subsection actually incorporates a requirement imposed on all special assessment districts17 by the California Constitution at Article XIIID(4)(b), which imposes the same requirement in slightly more general language, having as it does to apply to any kind of special assessment:

All assessments shall be supported by a detailed engineer’s report prepared by a registered professional engineer certified by the State of California.

Now, these engineers’ reports which go along with BID formation are particularly interesting documents. First they’re interesting because they’re so mind-numbingly boring. My feeling is that if people write stuff this tedious and impossible to read they’re almost certainly hiding something, which is already of intrinsic interest. Second, they’re interesting because of the sheer unexpected variety of the nonsensical bullshit straight-facedly included in them, about which I’ll have more to say at a later date.
