This post is ultimately about an email conversation between Blair Besten and Hollywood Superlawyer Jeffrey Charles Briggs about a public records request that renowned podcaster Carrie Poppy submitted to Besten’s BID in May 2020. It’s a fascinating look behind the scenes as a CPRA request is filled. If you want to skip my nonsense and get straight to the goods, here’s a link to the email itself, and here are a bunch of emails between Poppy and Briggs about her request.

Like I said up there in the title, in March 2020 Carrie Poppy sent a request for public records to Blair Besten, the half-pint Norma Desmond of the Historic Core BID, the third weirdest of the minor Downtown BIDs. Poppy’s request included the following sentence: If any of these records are held by the BID in electronic form I will need to inspect them and potentially receive copies in electronic form.”

And because apparently she’s always thinking of me, Besten immediately fired off a desperate email to self-proclaimed Hollywood Superlawyer Jeffrey Charles Briggs which contained a plaintive cri de coeur: “This sounds like an [Kohlhaas]esque request. ‘Electronic Form’ as they are being held – you know? Maybe?” And Briggs, always voluble, rarely sensible, had something to say about Poppy’s request as well.

Writing in all caps like the serial killer he never had the nerve to become Briggs had this clueless comment: I DON’T UNDERSTAND THIS UNLESS SHE THINKS WE WOULD CHARGE HER FOR A THUMB DRIVE OR WHATEVER; WE CAN JUST SEND PDF’S OR THE EMAILS THEMSELVES IF THERE ARE ANY, BY EMAIL. WE CAN FIGURE OUT HOW TO TRANSMIT WHEN WE KNOW WHAT WE HAVE.”

On September 24, 2020 the directors of six Downtown Los Angeles business improvement districts met with incoming City Councilmember Kevin de León. The BIDs involved were South Park, Historic Core, Downtown Center, Downtown Industrial District, Arts District, and Little Tokyo and the meeting was arranged by South Park BID director Ellen Riotto.

Riotto got in touch with de León’s office on July 27 asking to meet, and by September was working with de León staffer Sarah Flaherty1 to schedule it. On September 23, the night before the meeting, Riotto sent an agenda to Flaherty along with a note about how darn thrilled they all were.2 The agenda was fairly bland:

Historic Core BID Slammed With $40K In Costs And Fees As A Result Of My California Public Records Act Request — Defended By Hollywood Superlawyer Jeffrey Charles Briggs — Who Has Not Won A Single One Of These Cases For His BIDdie Clients — His Whole Argument Here — And In The Rest Of The BID CPRA Cases He’s Defended — Is That I Should Lose Because My Entire Motive For Requesting Records Is To Trick BIDs Into Violating The CPRA — Then Sue Them Repeatedly — And Eventually Drive BIDs Out Of Business — This Is Provably False — And Patently Idiotic — And Explicitly Irrelevant Anyway — But Briggs Keeps Screeching About It — At Some Point I’m Expecting The BIDs To Realize That It’s Cheaper — And Easier — And Smarter — To Just Follow The Damn Law — But It Keeps Not Happening

Quick summary! In August 2018 I was forced by the unhinged intransigence of Blair Besten, half-pint Norma Desmond of the Historic Core BID, to file a petition seeking to enforce my rights under the California Public Records Act. So the usual on-and-freaking-on process of CPRA litigation happened and after a few archetypally zany moments, like La Besten denying under oath that those things her BID sends out via MailChimp are, you know, emails, everybody filed their briefs in July and on November 5, 2019 we finally had the damn trial and the BID lost big freaking time!

And when a local agency such as a BID loses a CPRA case the law is very clear. The judge must award costs and fees to the requester.1 It doesn’t happen automatically, though. The prevailing requester has to file a fee motion and if the parties can’t agree on it there’s a hearing. So we filed the motion, and by “we” I mean my attorney, the incomparable Colleen Flynn, and here’s a copy of the fee motion. The BID flipped out and you can read their reply to the fee motion and our reply to their reply if reading a flipout is interesting to you.

We were supposed to have a hearing in May, but of course that didn’t happen. However, the judge did issue a tentative ruling, of which there is a transcription below, and awarded us $39,720 in fees and $1,099.25 in costs. This may seem high, but Chalfant cut Flynn’s hourly rate from $740 to $400 based on his unarticulated evaluation of the difficulty of the case and the level of expertise involved, which apparently judges mostly just have the discretion to do.

Quick summary! And the judge, James Chalfant, did as judges will do, and issued a tentative ruling the day before, and you can read it right here.1 And then this afternoon at the trial, after some characteristically futile yammering by counsel for respondent, the notoriously feckless Jeffrey Charles Briggs, the judge adopted his tentative ruling, handing us, that is me and my lawyer, the incomparable Colleen Flynn, a major victory. In particular, said the judge, those things that MailChimp sends are indeed emails and the BID is ordered to search for them and hand them over.

Perhaps you recall that in August 2018, due to the unhinged intransigent obstructionism of both Ms. Blair Besten, the half-pint Norma Desmond of the Historic Core, and Mr. Jeffrey Charles Briggs, the self-proclaimed Hollywood superlawyer with whom she cahoots, I was forced to file a petition to enforce my rights under the California Public Records Act with a trial scheduled for September 3, 2019 at 1:30 PM in Department 85 of the Stanley Mosk Courthouse.

Well time rolls on, one damn day at a time, we’re all done with meeting and conferring and discovery and all the suchlike pleasant pastimes in which we, the litigious few, engage like some elaborate dance before the main event, and now it’s time to file our trial brief. So that’s just what we did, just yesterday, and you can get a copy here.

And what a brief it is, friends, elaborating as it does on not just the broad overview of the utter unhingedness of Besten’s intransigent obstructionism, but both the nitty and the gritty, every last gritty little grain, of it, spelled out in painstaking detail like a tale told not by but certainly of an idiot, full of sound and fury, signifying a lot of something about a whole damn lot of nothing.

Although, listen, I’m leaving out all the small-scale details of the BID’s abject failure to respond properly to my requests, where they sent 19 emails here and 17 emails there, none of which were responsive, and then repeated this over and over and over again and then was all like computer problems! Logistical difficulties! Boo freaking boo-hoo-hoo! That right there is a far more than adequate summary.

Also I’m leaving out the details of the requests, which were for interesting emails, which is more than enough detail to follow the argument. If you want to read all that stuff, and the supporting evidence, and it is certainly worth reading, read the whole brief!

It’s been a long while since we here at the blog have heard from Blair Besten, the half-pint Norma Desmond of the Historic Core.1 Well, it’s because, like with El Duckworth, she is so convinced that she is above the law that I haven’t gotten any substantial records out of her infernal BID in ever so long, and without records I will not, I can not, mock.

And of course, as you know, I’m in the process of suing her and her damnable BID to enforce compliance with the Public Records Act. And she’s going to lose, because losing is what she does best. So at some point the records will be rolling in again and the full-time mockery will resume. Until then, though, well, I have always relied on the kindness of strangers, and they are strangely kind to me.

In particular, just recently, unsolicited, was handed to me2 an audio track of an unscheduled appearance made by Ms. Besten at some bullshit meeting conducted at some bullshit Downtown residential bullshit location, having something to do with some bullshit or other. So I made it into a video3 and you can listen here on YouTube and here on Archive.Org, where you can also download it more easily. And of course there’s also a complete transcription after the break!

And best of all, this unexpected bit of Besteniana means that it’s gonna be like the good old days around here what with all the mere mockery unloosed upon the world! Gonna mock around the clock tonight! Turn the page, I’m gonna lay it on you in increments, but before then let’s just spoil the ending and take a look at the single most incomprehensibly lobotomized proclamation proclaimed by Ms. Blair Besten in a long unbroken chain of incomprehensibly lobotomized proclamity!

What, you may ask, does Ms. Blair Besten think that the plaintiffs in the lawsuit Mitchell v. Los Angeles are so freaking wrong about? Why “they’re saying that it’s a constitutional right to have stuff in Skid Row.” If you stop and think about it, Ms. Besten, that’s kind of like, almost, what the Fourteenth Amendment to the constitution is saying with all that jive about “nor shall any State deprive any person of life, liberty, or property, without due process of law.”

See the part about property? That’s what grownups call “stuff.” And I don’t see anything about it not being true in Skid Row. In fact, all kinds of people have “stuff” in Skid Row. Like e.g. all those property owners in the Downtown Industrial District BID. Gonna tell them they can’t have stuff there?

And the amendment goes on to say that states may not “deny to any person within its jurisdiction the equal protection of the laws.” They seem to have left out the not in Skid Row bit there too. So on Blair Besten’s testimony it’s hard to see why she’s so upset at the prospect of the City settling Mitchell. But she is very upset. Can see how it might get confusing to folks like Besten. And listen, lest you think I’m being pointlessly mean to Blair Besten, please keep in mind that this is not just some kook spouting her theories to the waves on Venice Beach.

She is the head of a major Downtown Business Improvement District, hand-picked by Jose Huizar over the objections of its board of directors to administer its outrageously high $2.2 million budget. She is widely considered by City officials to be some kind of expert on homelessness, to the point where they appointed her to the damn HHH citizens’ oversight committee over the objections of a lot of sane and accomplished people. She’s not just a kook, although she is a kook. She’s a dangerous kook with a lot of power. So yeah, I’m being mean to Blair Besten, but not pointlessly mean. Anyway, read on, friends!

On April 3, 2017, Batty Little Fusspot Blair Besten Tried To Use Her Business Card As ID To Register To Vote Online Against The Skid Row Neighborhood Council — When This Was Unsurprisingly Rejected By DONE Patti Berman And Bob Newman Pleaded For An Exception — And Grayce Liu Granted One In The Form Of Extra Time To Upload Acceptable Documents — Which She Did With 16 Minutes To Spare — Were Pro Skid Row Voters Given The Same Opportunity?

Here’s the whole story in a nutshell, taken from this fabulous little gem of an email exchange (of course there’s a transcription after the break!) On April 3, 2017 Blair Besten, batty little fusspot director of the Historic Core Business Improvement District, third weirdest of the minor Downtown BIDs, tried to register online to vote against the Skid Row Neighborhood Council in solidarity with her fellow zillionaires and their minions. As I’m sure you’re aware, registering to vote online at that time required one to upload a photo of an ID. Blair Besten uploaded a picture of her business card instead.

Not acceptable, said the Department of Neighborhood Empowerment! So then DLANC president-for-life Patti Berman1 and weirdo-about-town, male-for-rent, and some kinda damn social worker Bob Freaking Newman2 emailed everybody saying please guys! Let Blair Besten register please!! And not only that, but Patti Berman used her dlanc.com email address during the conversation even though DLANC was required by City law to be neutral. Helping Blair Besten register is not neutral.

And then Grayce Liu, the famous führerin of DONE, said OK! Even though people who think their business card counts as ID usually have to show up in person to vote we will make an exception for Blair Besten! If she uploads her real ID in the next 51 minutes we will allow her to vote online!! And she did!! So she got to vote!! Mission accomplished and those are some helpful-ass City Officials, amirite?!

Annals Of LAPD Spying — Sometimes Protesters Don’t Get Permission From The Cops For Their Protests — And Sometimes The Cops “Monitor” Social Media To Uncover Protesters’ Plans — And Sometimes The Cops Share This Information With The Department Of Homeland Security — Not To Mention With Business Improvement Districts — Who Are No Strangers To Creepy-Ass Social Media Spying Themselves — So Watch What You Say On Facebook, Friends, If You Don’t Want A Bunch Of Unanticipated Cops Showing Up!

This is just a short note to discuss this email chain, which I recently received from the Historic Core BID as part of the fruits of a public records act request.1 It seems that last year, some group called Code Pink was planning a protest in Pershing Square on April 29, 20172 and they did not ask the permission of the LAPD. Even more interestingly it seems that the LAPD has officers dedicated to “monitoring social media” who track this kind of thing.

And one of them, James Baker, emailed a bunch of his fellow polices on April 22, 2017, to fill them in on the upcoming reign of anarchy Downtown. He mentioned explicitly that Code Pink was not cooperating with the LAPD, that there was no discussion of any civil disobedience, and that his officers would “continue to monitor social media for updates.”

Also interesting is the fact that four of the recipients were with the Department of Homeland Security.3 Another was Senior Lead Officer Michael Flanagan, who turned around and emailed batty little fusspot Blair Besten of the Historic Core BID, Brian Raboin of the Downtown Center BID, and Banyon Hutter of Allied Universal Security.

The record doesn’t show what,if anything, the BIDs did with the information, but it’s worth keeping in mind that this is happening. If you’re an activist, if you use social media to coordinate your events, don’t forget that the cops are reading it too, the BIDs are reading it, BID security is reading it, and they’re all coordinating with each other. How Is South Park BIDdie And Famously Manic Minion Katie Kiefer Just Like Richard Nixon? Well, We Won’t Have Either Of Them To Kick Around Any More — Not Sure Where Nixon’s At But Katie Kiefer’s Off To Work For José Huizar In CD14 — Did I Mention That I Recorded This Morning’s South Park BID Meeting? This is just a short note to announce the availability of video of this morning’s meeting of the South Park BID‘s board of directors. There’s a lot going on here, and I have at least a few detailed posts to write about this material over the next few days, but I just wanted to provide links so you can see for yourself, and also to announce a stunning piece of news about the SPBID’s director of operations Katie Kiefer.

She is leaving the BID to go work for the prince of darkness himself, Mr. José Huizar, over at 200 N. Spring Street. This makes her the latest BIDdie to move over to Huizar’s office, the last known instance being Mr. Ari Simon, late of the Historic Core BID, batty little fusspot Blair Besten’s weirdo empire on Broadway.

Tonight I have for you another juicy morsel from the recently announced set of emails from the Highland Park BID. Our story begins with this email from the BID Consortium to all of its zombie-like followers who, it seems, include Misty Iwatsu. The email was a listing of job opportunities for the LA BIDdie community, ensubjectified “Announcement:::BID Opportunities” and containing, in pertinent part, the following likely little slab of puckey:

The Culver City Arts District is looking to hire a part-time Executive Director to help manage the programs and Board. The position will only be about 20-25 hours a month ($45-50 an hour). They are hoping to find someone that can assist with the business outreach, events, board administration, oversee a marketing consultant and generally keep things humming along. It is fairly low-key – and relatively flexible – though the board is looking for a self-starter with exceptional communication skills that can keep things moving along without a lot of oversight.

And friend Misty Iwatsu evidently read that and thought something along the lines of “I’m gonna cut me a slice of that cake!” because, somewhat less than three days later, she sent this cheerful little missive off to City of Los Angeles employed BIDmeisterin Rita Moreno, whom so many of our BIDs rely on for her good sense and relative sanity,1 asking for some job-related info and, in the process, fatally revealing the fact that she thought Culver City was somehow a part of Los Angeles when everybody who’s actually paying attention knows it’s its own damn place, got their own damn mayor, their own damn city council, their own damn muni code. It’s just like a real city, only smaller!
