The Hollywood Property Owners’ Alliance In Cahoots With CD13 Is Removing Ficus Trees From Hollywood — Why Has The City Of Los Angeles Ceded Its Duty To Care For Our Trees To A Bunch Of Nihilistic Zillionaires Who Don’t Even Live In Hollywood?

The Hollywood Property Owners’ Alliance, which runs the major Hollywood BID, has a long and troubled relationship with the City of Los Angeles and tree regulations. For instance, remember when that billboard company illegally cut down all those trees in Silver Lake in 2016 and the whole City flipped out even to the extent of revenge vandalism? This crisis somehow catapulted Mitch O’Farrell and David Ryu into a rare moment of sanity and they initiated CF 15-0467-S4, in which they asked for report-backs from the City Attorney and the Bureau of Street Services on how to prevent future rogue tree removals.

And the Bureau of Street Services came in with a pretty strong set of recommendations, which included requiring before-and-after photos of tree maintenance done by private parties as well as requiring the presence of City tree surgeons. Well, as you may recall, the BID absolutely flipped out over this in their characteristically privileged manner, which included typically unsubstantiated claims of their unparalleled arboreal competence and even featured archetypal BID genius Mark Echevarria of Musso & Frank giggling like a six-fingered chucklehead cause he never heard of tree surgeons.1

And over the last two years the issue of the wanton destruction of our City’s trees has not died down. In fact it’s getting worse and worse. For a good overview see this fine article by Alissa Walker in Curbed LA. The unwarranted removal of trees has emerged as a significant social justice issue with serious ecological ramifications. And political action can save trees. But political action is impossible if the City sneaks around and removes trees covertly.

And of course, the City’s favorite way to sneak around and do anything covertly is to palm it off onto the damn BIDs.2 Thus it was no surprise to discover a newly released email conversation between Marisol Rodriguez and Dan Halden of Mitch O’Farrell’s staff and Kerry Morrison and Rich Sarian of the HPOA which shows that the BID is in fact involved in secret tree destruction in Hollywood with the advice and consent of CD13.

Today I rode the good old Metro Line 45 North on Broadway to the freaking Fashion District BID board of directors meeting. And all I have to say to you all, my loyal readers,1 is that if you enjoy reading this blog, you owe me freaking big time for the crapola I sit through on your behalf just so we can all get a little giggle and a little spine-chill from the weirdly tedious yet terrifying antics regularly to be experienced at these people’s damn meetings.2

So I did record the entire damned meeting, and you can watch it here on YouTube and if you care about freedom at all you can also watch it here on Archive.Org. The whole thing was essentially as tedious as one might expect, with most of the interesting action taking place before the meeting was convened, so I didn’t get it on tape.3

That bit consisted of director Brian Taban, vice president for covert creepy operations at über-shady real estate firm JADE Enterprises,4 bitching and moaning to Rena Leddy5 like this: “It’s impossible to find a construction lender at reasonable rates Downtown. You can’t find a lender that’s comfortable lending forty, fifty million dollars these days.”6

But it wasn’t all a waste of time! Most interestingly, LAPD Super Duper Cop Mark Reina gave a long update on plans to shift the Northern boundary of Newton Division so that the Fashion District will lie entirely within the Central Division. Ahahahaha And LOL!!! Ellen Riotto Of The South Park BID Is Now Taking Sensitive Legal Advice From Internet Randoms At This Blog!!!

The Brown Act contains many wonderful treasures, but one of the wonderfullest is to be found at §54954.1, which states unambiguously that:

Any person may request that a copy of the agenda, or a copy of all the documents constituting the agenda packet, of any meeting of a legislative body be mailed to that person. … Upon receipt of the written request, the legislative body or its designee shall cause the requested materials to be mailed at the time the agenda is posted pursuant to Section 54954.2 and 54956 or upon distribution to all, or a majority of all, of the members of a legislative body, whichever occurs first.

I ask many of my BID friends to send me these notifications and their agenda packets. It really seems to piss most of them off.1 I don’t feel bad for asking BIDs to comply with the law, though. After all, it’s voluntary on their part and they’re making an awful damn lot of money out of it.

So anyway, our friends at the South Park BID are reasonably cooperative about complying with the law. They invited me to sign up for their public mailing list, which I did. It’s an open question as to whether this is compliance, since the law requires notifications to be sent at the time that the board receives them, but this presently seems too minor to quibble over. On the other hand they spout an awful lot of spam through that account, and clearly I shouldn’t be required to sort through the junk just to be able to receive notifications that they’re legally mandated to send. Again, though, this is an argument for another day.

However, it turns out that the South Park BID does distribute packets to its board of directors in advance of the meetings and also that those are not available via the public mailing list. I only found out about this recently, so I wrote to the BID boss ladies and asked them to send them goodies my way!

After some nonsense with them interrogating me mercilessly about which email address I wanted the board packets sent to,2 we got all the details ironed out. And after that, my friends, it must follow, as the night the day, that I ended up sending Ellen Riotto some of my sage legal advice and, amazingly, she ended up taking it!3 Read on for the details and a bunch of emails!

Los Angeles Ethics Commissioners Fail To Understand Their Powers And Duties Under The City Charter And Thereby Inadvertently (??) Set The Stage For Exempting Nearly All 501(c)(3) Tax Exempt Organizations In Los Angeles From The Municipal Lobbying Ordinance

It seems like forever now, although it’s only been two years, that the Los Angeles Ethics Commission has been discussing proposed changes to the Municipal Lobbying Ordinance (MLO). At this point I just don’t have it in me to summarize the discussion any more, although you can find links to most of my posts on the subject in this post on the penultimate phase of the matter.

At the Commission’s meeting on Tuesday, which you can watch in its entirety right here (or here on Archive.Org if you prefer), there were only two matters left to settle. One was the issue of detailed reporting of contacts between lobbyists and City Officials. I hope to write on what happened with that later on. The other, and the subject of today’s post, had to do with exemptions from the MLO for 501(c)(3) nonprofits. You can watch the whole discussion beginning here. These organizations enjoy some exemptions now by virtue of LAMC §48.03(E,F). You can read the statute for yourself, but essentially it exempts 501(c)(3)s1 which have “… the purpose of representing the interests of indigent persons and whose primary purpose is to provide direct services to those persons…”

As they are wont to do, the staff, in the persons of Director of Policy Arman Tarzi and Mark Low, head of the lobbying program, provided the Commission with a detailed set of recommendations. There were four different options given that had to do with nonprofits, which you can read in the proposal. Of these, three were developed by staff and the fourth2 was provided by nonprofits and proposed to exempt all nonprofits, no matter what they do, which have gross annual receipts of under $2.5 Million.

Never content to leave well enough alone, these hyperorganized nonprofits presented the Commission with a so-called “Option 5,” which they circulated at the meeting. This option proposed to modify LAMC §48.03(E) to exempt from the MLO:

E. Any organization exempt from federal taxation pursuant to Section 501(c)(3) of the Internal Revenue Code that:
1. Provides assistance, such as food, clothing, shelter, child care, health, legal, vocational, relief, educational, and other similar assistance to disadvantaged people for free or at a significantly below-market rate; OR
2. Has gross receipts of less than $2.5 million.
This exemption also applies to the organization’s employees and board members while engaged in official duties. This exemption does not apply when an organization is seeking funding, property, or a permit from the City on its own behalf.

This morning our faithful correspondent rode the good old Red Line to the South, to the East, to the Civic Center, to the good old LAPD Discovery Section, where he was privileged to scan maybe a thousand pages of emails between various LAPD luminaries and the BIDs. There’s some serious and important stuff in there, and you’ll be reading about a lot of it here. But there’s also some silly stuff, and we’re breaking out a couple of the goofiest for you here tonight.

First we have this little gem, where some lady named Valorie Keegan, who is the current vice chair of the Hollywood Police Advisory Board but beyond that even the Google doesn’t seem to know exactly what she does, emails a link to our humble blog straight to LAPD Deputy Chief Beatrice Girmala! And which article is it a link to? It’s this old crowd pleaser about Pete Zarcone and the appearance of corruption at the LAPD. Valorie even admits that our conclusion is true. How’s that for validation from the top?! Chief Bea didn’t seem to have much to say back to Valorie, but if you look at the detailed summary at the top of the email, you’ll see that Chief Bea forwarded the email to someone. Our next task? Find out who! Maybe our readership isn’t 92% Kerry Morrison and her lawyers. Maybe we’re a big hit over at 100 W. First Street as well!
