There seem to be two distinct ways that BIDs get started in Los Angeles. One is that a bunch of property owners want to start one, they talk to their council rep or the City Clerk, hire a consultant, and go through the process we’ve all come to know and love. But it seems that sometimes the City takes the initiative, they hire their own consultant, and as part of their duties, the consultant puts together a proponent group.

That seems to be what’s going on with the infamous Echo Park BID, and it’s also the way that the Hollywood Route 66 BID is being formed.1 Both of these establishments are being handled by OG2 BID consultancy Civitas Advisors. And as you may recall, a good citizen of Los Angeles recently supplied me with a massive set of emails between Civitas and the City Clerk‘s office.3

And buried amongst the interminable babbling about God-knows-what-all4 I uncovered a couple of really interesting gems. First, there is the contract between the City and Civitas for establishing the Hollywood Route 66 BID, and second there is a feasibility study for the BID prepared by Civitas in February 2018.5 Both of them have a lot to tell us about how BIDs get started and function in Los Angeles! Leron Gubler Of The Hollywood Chamber Of Commerce Wrote To The City Council To Tell Them That Legal Street Vending Is Causing Hollywood Boulevard To Be “Compared To A Third World Bazaar” — And Because He’s A Racist Fucking Moron He Takes It For Granted That That’s A Bad Thing


ACTION NOTE: Carol Schatz told us that City Council was going to be taking up street vending again soon, and she was correct. It’s scheduled for the Economic Development Committee on April 16 at 2 p.m. in City Hall room 340, which is the Ferraro Council Chamber. Obviously they’re expecting a crowd.

Business Improvement Districts and other white supremacist zillionaire flunkies like various chambers of commerce and the Central City Association have spent the last three years fighting against legalized street vending in Los Angeles because they’re a bunch of puritanical racists. Ordinarily, though, they have the sense to hide their puritanical racism behind a thin screen of concern for slightly more acceptable issues like civic order, the rule of law, public health, whatever.

However, a couple days ago, Leron Gubler of the Hollywood Chamber of Commerce let the mask slip just for a moment. He sent this letter, a transcription of which is after the break, to City Council to oppose legalizing street vending.1 And in it he stated:

The Chamber and the Hollywood Entertainment District BID continue to be inundated with complaints from our property owners and visitors on Hollywood Boulevard about the increase in sidewalk vendors over the past year. The street, especially at night, is being compared to a third world bazaar.

It’s not even a dog whistle. He’s explicitly complaining that there are too many unruly darkies on Hollywood Blvd., because who else is found in a “third world bazaar”? These people2 don’t seem to have the first clue that they don’t own Hollywood Blvd., they don’t own this City. And this is not the first time they’ve complained about nonwhite people taking over Hollywood Blvd.

Their visions for Hollywood Blvd., for Los Angeles, are no more important or valid than anyone else’s, no matter what the color of their skin or whether or not they have a zillion bucks in the bank. Most of Los Angeles likes street vending. Most of Los Angeles likes unruly darkies. We are unruly darkies here. Without unruly darkies there would be no Los Angeles. Our City would be just like freaking Hancock Park or San Marino. Most of Los Angeles likes what vending does for our streets, our neighborhoods, our humanity. If these BIDdies don’t like it, why don’t they move back to America or Palos Verdes or wherever they came from?

The Hollywood Chamber Of Commerce Amended Its Lobbying Registration Form in April 2017 And The Only Change Was The Date They Qualified — More Interesting, Though, Is The Fact That They Consider Their Pro-Establishment Advocacy For Jeff Zarrinnam’s Inchoate Hollywood-Western And Route 66 BIDs To Be Lobbying Activity

It’s well-known that the Municipal Lobbying Ordinance requires lobbyists of all stripes to register with the City Ethics Commission. The Hollywood Chamber of Commerce is no exception to the rule.1 They are also required to amend their registration forms if there are any material changes in the information provided.2

And as you know if you follow this blog, I find everything to do with lobbyists in Los Angeles fascinating, and thus I haunt the Ethics Commission’s lobbying pages, poring over the alphabetical lists of individual lobbyists and of lobbyist firms and employers to see if anything’s changed or if something is newly interesting.

And lo! Last night I noticed that our old friends, the Hollywood Chamber of Commerce, had amended their registration form on April 28. Here are the two forms:

Well, I stared and stared and stared at those two forms just trying to figure out what had changed. Eventually I noticed that the original form had January 31, 2017 as the date they’d qualified as a lobbying entity3 whereas the amended version had January 1, 2017 as the day of qualifying.

There’s a lot of information on the forms, though, and I didn’t feel confident that the difference I’d noticed was in fact the only difference. I wasn’t sure what do to until this morning, when it occurred to me that if I put both pages into the GIMP, superimposed one on top of the other, and then faded the opacity up and down I’d be able to notice what changed.4 And it turns out that in fact, it’s correct that the only change was the date of the Hollywood Chamber’s qualifying as a lobbyist.

Which leads irresistibly to the question of why Leron Gubler and/or Nicole Shahenian, who are the Hollywood Chamber’s two registered lobbyists, felt the need to make this tiny change. Read on for speculations and some other chit-chat about the fact that Leron Gubler lists the establishment of the Hollywood Western and the Route 66 BIDs as issues the Chamber is lobbying for this year.

BIDs Benefit Immensely From Coercive Collection Of Mandatory Assessments And Complain Incessantly About Being Subject To The California Public Records Act. They Can’t Have One Without The Other, Yet Both Are Voluntary, So Why Don’t They Grow Up And Quit Whining About The Consequences Of Their Choices?

A business improvement district (BID) in Los Angeles1 is a geographical area in which the owners of commercial property are assessed an additional fee for various services that aren’t provided by the City. These fees are collected either by the City of L.A. via direct billing2 or, more usually, by the County of Los Angeles as an add-on to property tax bills.

The state law authorizing BIDs requires each BID to be administered by a property owners’ association (POA).3 In the normal course of things these organizations are conjured up by the City at the time the BID is established, although sometimes previously existing nonprofits will end up as a POA. One example of this is the Hollywood Chamber of Commerce, which serves as POA for the East Hollywood BID, although it predates its existence.

The law requires these POAs to be nonprofits, although it doesn’t specify what kind of nonprofit they should be. For various reasons, at least in Los Angeles, they are usually 501(c)(6) organizations. Because the City is handing over what’s essentially tax money to these POAs,4 they have a great deal of control over their activities and what they spend their money on.

Open Letter To Holly Wolcott And Miranda Paster Regarding Nicole Shahenian’s Violation Of LAMC 48.04(B) In 2014

Here’s a letter I sent this morning to Holly Wolcott and Miranda Paster about the fact that East Hollywood BID Director Nicole Shahenian appears to have violated LAMC 48.04(B) by stating that the EHBID’s 2015 Annual Planning Report had been prepared at a Board meeting on December 29, 2014, when in reality no such meeting took place. Also maybe look at the actual complaint I filed with the Ethics Commission.

The main points are that the Clerk ought to institute some kind of oversight to make sure that this nonsense stops happening. The Ethics Commission will rule on Nicole Shahenian’s violation of the Municipal Lobbying Ordinance, but that only applies because she was coincidentally registered as a lobbyist in 2014. Most BID directors are not registered lobbyists,1 but many of them apparently lie about the APR approval process. This could potentially create dire consequences due to the fact that, e.g., BIDs can actually be disestablished for such transgressions, whether or not the Municipal Lobbying Ordinance is involved. You read that right. The LAPD is trying to get the Rusty Mullet shut down because they allow dancing and they cause murders, kidnappings, and burglaries. Of course, you want to know what’s really going on here, don’t you?

Lots of New Unsorted Emails Between HPOA, LAPD, the Media District BID, the Hollywood Chamber of Commerce, and CD13

I uploaded tons of emails today, some between the LAPD and the three Hollywood BIDs, some between CD13 and the Hollywood BIDs and/or the Hollywood Chamber of Commerce. The LAPD emails are notable because I made the request that they were provided in response to on January 9, 2015. I have had to hassle them, complain to OIG about them, hassle them some more, bargain with them, plead with them, and finally, after more than 11 months, they actually handed over some emails. There seem to be about 16,000 pages to go, so at this rate I should have them all slightly less than 30 years from now.

Remember back in March 2015 when we reported on the weirdly racist meanderings of Hollywood Chamber of Commerce flunky Marty Shelton as filtered through the unrepressed id of jittery little psychopath and Hollywood McDonald’s queen Carol Massie, who, in a surprising-even-for-her outburst at a meeting of the Sunset-Vine BID Board blamed Hollywood nightclub owners for ruining everything because they run “…these businesses who don’t really care about anything except that they make a profit.”??

At that time, we responded, quite reasonably even if we do say so ourselves, to the effect that:

Carol, here’s a newsflash: your company destroys rainforests, destroys the health of the world’s people, exploits its employees, destroys everything, because it doesn’t “really care about anything except that [it] make[s] a profit.” That’s what McDonald’s does.

Well, now it’s time for us to confess. We didn’t really know that for sure. We were just guessing. For all we knew at that time the corporate overlords of the mighty McDonald’s machine were all sitting around back in good old Oak Brook, Illinois, where they have pitched their mansion, just not caring at all about money cause money can’t buy them love or whatever. We just made a claim that sounded plausible and kept our fingers crossed that we wouldn’t end up in trouble. Well, we were right!
