Announcing Our New LAMC 49.5.5(A) Project: Peter Zarcone And The HPOA Music Festival Fiasco Provide Raw Material For Our First Experimental Attempt At Seeing What This Law Actually Prohibits

LAMC 49.5.5(A) states, rather succinctly, that:

City officials, agency employees, appointees awaiting confirmation by the City Council, and candidates for elected City office shall not misuse or attempt to misuse their positions or prospective positions to create or attempt to create a private advantage or disadvantage, financial or otherwise, for any person.

Here’s what seems to be required of a City official or employee to violate this law:1
  1. That they misuse their position, where I’m thinking “misuse” means:
    • They do something that requires the powers granted to them by virtue of their position and
    • their powers were not granted for the purpose of doing that thing.
  2. The misuse creates a private advantage or disadvantage for someone, where I’m thinking “private” means:
    • The advantage or disadvantage created does not further public policy goals. E.g. getting arrested creates a disadvantage for the arrestee, but the disadvantage furthers a public goal. Winning a contract through the City’s bidding process advantages the successful bidder, but the advantage furthers a public goal.

The law is enforced by the City Ethics Commission, although it doesn’t seem to have been used much. There is, e.g., this case from 2010 involving a Fire Inspector who charged money for successful inspections. This is the kind of thing one would expect to fall under this statute. However, there is also one high profile case pending right now which doesn’t seem ordinary at all. It seems quite unexpected. In 2014 LAPD Officer Jim Parker was among those who responded to a sex-in-a-car call involving Daniele Watts and her boyfriend. She accused the police of racism and brutality, and Parker anonymously leaked an audio recording of the incident, which exonerated the police. Subsequently, the Ethics Commission issued a public accusation against Parker for violating LAMC 49.5.5(A) on the theory that leaking the confidential audio recording, which he only had access to by virtue of his position, constituted a misuse which created a private advantage for himself.2

This is very encouraging. It seems that perhaps the Ethics Commission is willing to at least think about a broad application of this seemingly very broad law. And it’s an interesting thing about laws that no one can actually be sure what they mean, what the range of application is, until they’re repeatedly tested in the courts. Well, that’s not exactly right. If a court decides that people of average intelligence can’t be sure at all what the law actually prohibits or requires, they’re likely to toss it out as unconstitutionally vague. But, I guess, if people don’t know exactly what the law prohibits or requires, but average people could have realized that it potentially prohibits what they’re doing or requires what they’re not doing, then it’s not too vague, even if no one actually did realize those things.3 That’s the space I’m interested in exploring with respect to LAMC 49.5.5(A). And because I’m not interested in philosophical explorations any more I’m going to explore this issue by actually turning people in to the CEC to find out what happens, beginning with our old friend, Peter Zarcone. A couple weeks ago we wrote about a Zoning Administrator hearing being held for the purpose of revoking the Rusty Mullet’s conditional use permit. Well, the hearing was held on July 28, 2016. As far as we know a determination has not yet been made, but we recently obtained more than five hours of audio from the hearing. You can listen to part I and also part II here. It’s not easy to get through the whole damned thing, which is why you’re lucky to have us! We’ve listened to the whole thing and made clips of some interesting bits. Note that as long as we were haunting City Hall to get this material we also obtained audio from the CUP revocation hearings for the Cosmo Nightclub and the Cashmere, and you can find both of those on this Archive.org page.

Now, long-time readers of this blog will recall that in March 2015 we broke the story that Fabio Conti, Carol Massie, Kerry Morrison, Marty Shelton, and pretty much everyone on the Board of Directors of the Sunset & Vine BID except for Chase Gordon are a bunch of racists who want to shut down every bar on Hollywood Boulevard because they don’t like the skin color of the patrons. So imagine our pleasure at learning that Mike Ayaz, the Rusty Mullet’s lawyer, actually showed our video at the hearing! This was part of the evidence for his position, with which we concur, that the restaurant appears on a hit list of bars being targeted for racist reasons by the BID, the LAPD, and the City Government. You can hear the whole clip here, where he refers to Fabio’s speech as “disturbing video which I would like to play of a quasi-governmental agency that basically…I think I’ll let the video speak for itself.” And speak for itself it does:

Be sure to catch the audience reaction at the end. It doesn’t make anyone sane happy to hear Fabio Conti channeling Marty Shelton claiming that “the Lindsey Lohans of the world are not hanging out at the Rusty Mullet” with the regulars, who are “decidedly minority, brown and black, and my guess, from a lower economic strata.” These dimwits on the BID are clearly going to regret the day they neglected to listen to their one and only sane Board Member, Chase Gordon, who responded to this bullshit in March 2015 by saying that he didn’t “think that we should be, especially public-facing, going out with the distinction of ‘we don’t want lower economic statuses coming and visiting Hollywood.” Anyway, who can say what will happen, but we here at MK.org are inordinately proud on this beautiful Sunday morning that the citizen journalism of our intrepid correspondent is paying off in this big way. This story is a sleeper, but when it finally makes the papers, it’s going to be huge.

Listen, this isn’t a joke. First get a copy of the hearing notice in the matter of the Rusty Mullet, being held at the Zoning Commission tomorrow morning. Then read the LAPD summary:

Los Angeles Police Department arrest report and crime analysis documentation of: multiple violations of Conditional Use Permit conditions including, failure to have an operable electronic age verification device, failure to implement a Designated Driver Program, failure to post mandated hours of operation, excess number of seats, allowance of amplified music to extend beyond the premises, allowance of live amplified music, allowance of dancing, allowance of loitering, and allowance of patrons to queue in line outside the premises; as well as, murder, rapes, aggravated assaults, assault with a deadly weapon, batteries, physical altercations, kidnapping, possession of a weapon, narcotic drug violations, grand theft auto, robberies, burglary, thefts, service of an obviously intoxicated person, failure of security guard to possess valid security guard license, public drunkenness, disorderly conduct, disturbing the peace, vandalism, and violation of State of California Department of Alcoholic Beverage Control required operating conditions.

You read that right. The LAPD is trying to get the Rusty Mullet shut down because they allow dancing and they cause murders, kidnappings, and burglaries. Of course, you want to know what’s really going on here, don’t you?

Recall that, at its Board meeting on February 18, 2016, the Hollywood Property Owners Alliance spent over 40 minutes discussing LAPD’s request to have the BID Patrol work until 4 a.m. on weekends. Andrews International VP Bill Farrar recounted a meeting with CD13 representative Mitch O’Farrell, claiming that the CM was eager to cover the costs. This led me to write to O’Farrell opposing this plan. Now, at the Central Hollywood Coalition Board meeting that took place on Tuesday, March 8, Steve Seyler and Kerry Morrison announced that, not only are the plans to extend the BID Patrol’s hours cancelled, but Peter Zarcone, formerly CO of LAPD’s Hollywood Division, has been transferred to 77th Street.

Watch, listen, and learn as Central Hollywood Coalition BID-Boardies Brian Folb and Carol Massie misunderstand everything about everything about homelessness in Los Angeles. We suppose that one of the big drawbacks to being a zillionaire is that you end up thinking you’re the sun and the rest of the world orbits around you and then you expose your delusions in public, maybe even on camera, and then you get mocked (to witness which, if you’re wondering, is why you’ve all been summoned here today!)

As anyone who’s awake in this city knows, the City of LA is considering a comprehensive strategy for dealing with homelessness. At Tuesday’s CHC Board of Directors meeting, the incomparably executive directrix Kerry Morrison, in her inimitably Board-by-the-nose-leading manner, told the Board of Directors that what they wanted to do about that right now was precisely nothing, and she’d get back to them next month to let them know if they wanted to do anything later. She also passed around a letter from the Fashion District as an example (although, in keeping with the zillionaire elite’s weirdly commie ethic with respect to the content of their public comments, the whole thing is essentially plagiarized from Carol Schatz’s letter on behalf of the Central City Association; why these people aren’t ashamed to show their faces in public we are never gone understand…) You can read a transcription after the break along with what we humbly hope are some entertaining observations.

Well, our faithful correspondent hasn’t had time to attend a BID meeting in a while, but he made it to the SVBID Board Meeting on Tuesday, November 10, over at the Hollywood YMCA (right across the street from the famed Selma Park). And what a witches brew of craziness he witnessed over there! They had brand-new Eric Garcetti aide Alisa Orduna there to talk to them about the mayor’s declaration of a state of emergency about homelessness. And can she ever talk. Does she make sense? Some of the time.1 But, as Sigmund Freud taught the world, even in incomprehensible free-associationalism, truth can be found by those who take the time to look. And it does take time. We were planning to cover Alisa’s entire 40-ish minute thing in one post, but after spending two days transcribing just the first 12 minutes, we found that our sanity requires us to lay it on you in increments. Thus spake Alisa Orduna: So with all of that said, on September 22nd, Mayor Garcetti along with City Council made an announcement declaring an emergency. And there was a commitment of a hundred million dollars in resources to finally address homelessness. And, looking at it since that time, what does that really mean?

And later she said: So the hundred million was an announcement, and that was just a commitment, so that was just kinda throwing a benchmark out there and saying how are we gonna rise to the occasion?

And then Fabio Conti proclaimed: Did anybody think, oh a hundred million! That’s [unintelligible]. There’s no hundred million.

And she replied: It’s kind of [unintelligible] is standing by that commitment, so everyone is looking for it.

No one had the hundred million, but don’t worry, it shows we take it seriously and also don’t worry, we’re all out looking for the money! So we guess this was known, kind of. We guess there’s not really a revelation here. The New York Times quoted Herb Wesson at the time of the declaration as saying “The $100 million figure was chosen in part for its symbolism, said Herb J. Wesson Jr., the City Council president, to show county, state and federal officials that the city was willing to make a significant contribution to an urgent problem.” Now we find out from Alisa that actually it was chosen not just in part for its symbolism, but it was entirely symbolic. We wondering if she’s talking out of school, being new and maybe not entirely broken to the plow. Time will tell, we suppose. Read on for the rest of the news. And iPads! When will the city learn that iPads are not only going to solve problems, they’re likely to lead to FBI raids on public buildings and speculation about indictments?

Amongst the vast array of documents sent over yesterday by our faithful correspondent, we found a few revealing, upsetting, disgusting little servings of reprehensibility in the Board of Directors Minutes.

We’ll write about most of them later, but for today, consider the minutes of March 4, 2015. In fact, look on page 3, where we find some jive-ass nonsense labeled “President’s Report.” The President is DCBID and Central City Association Führerin Carol Schatz. The first section of her report is labeled “On the CCA Side.” CCA, of course, is the Central City Association, a private group which claims explicitly that the “work we do lobbying government and advancing policy is shaping the future of Los Angeles business.” That’s not something BIDs are allowed to be involved with, and yet, here they are, being involved with it. Fascism, as we’ve stated repeatedly, thrives on this kind of blurring-of-the-lines between private groups like the CCA and public city agencies1 like the BIDs. BIDs aren’t allowed to lobby on matters that don’t affect stuff within their boundaries. But that’s an argument for another day. Let’s look at what Carol had to say:

Carol had a meeting with Chief Charlie Beck and other BIDS regarding street vending and increase in crime Downtown. The biggest concern is that legalizing street vending will result in streets becoming uncontrollable. The fashion district is a prime example of the effects of street vending. These street vendors are being referred to as micro-entrepreneurs.Chief Beck advised that he would speak to Councilmember Price and Wesson to make it clear that he does not have the resources to manage street vending and it will be very damaging to what has been accomplished in Downtown.

I’m pleased, I mean, as pleased as one can be in context, to announce a bunch of new documents from the DCBID, courtesy of the ever-so-very-helpful Suzanne Holley. As my colleagues once mentioned, I’m requesting documents from the DCBID in honor of Fabio Conti’s stunning assertion that the “purple guys” are way-a-lot meaner than the A/I BID Patrol.

Well, I still don’t know if that’s true or not, but you can start to make up your own mind. Today I’m pleased to announce a bunch of new documents. First of all there is a ton of new information on the HPOA’s sleazy sweetsy-heartsy lease of city property for a homebase-slash-mothership for its cleansy-upsy crew. So much that we started a whole subpage for the matter. What’s new are some emails between CD13 and the HPOA about the lease and the actual lease application filled out by the HPOA as part of the leasing process. This includes beaucoup info about the inner workings of the HPOA, including full federal tax returns for 2011 and 2012. Read it!

Next there’s the first set of documents in our new project to identify by name, photograph, and badge number, every BID patrol officer currently working the streets of Hollywood and as many of the past officers as possible. I’ve set up a new subpage dedicated to this endeavor, and the first two documents can be found there. We’ve written before about the cataclysmic flood of white privilege rage rants unleashed by Fabio Conti’s cri de coeur for the BID Patrol to stop coddling the homeless and start, we don’t know, killing them or whatever it takes to get them out of Hollywood, and the present post concerns yet another boulder in that avalanche of angst. We’re going to comment on the unnamed white privilege rage ranter’s rant (you can see the fellow’s picture somewhere in the vicinity of this sentence) one line at a time. No. First of all, salmon swimming upstream are beautiful, delicious, and nutritious. You people in the BID are none of these things. Second, you’re not trying to “clean up the neighborhood,” you’re trying to ethnically cleanse the neighborhood.

One is at least plausibly laudable. The other is a violation of the United Nations Convention on the Prevention and Punishment of the Crime of Genocide. Also, your metaphor is deeply flawed. Salmon like swimming upstream. It’s what they’re born to do. It’s the crowning glory of their lives. They surely, if they could speak, wouldn’t be whining about it.

You know, we have the state and the city working against us by allowing people to sleep on the sidewalk, you know, all night long, because it’s the humane thing to do.

No. The state and the city are not allowing anyone to sleep on the sidewalk because it’s humane. The state doesn’t have the first thing to do with municipal laws and the city has been FORCED by the United States Court of Appeals for the Ninth Circuit in its landmark decision Jones v. City of Los Angeles, where it found that the city’s law against sitting on the sidewalk, LAMC 41.18(d), violates the Eighth Amendment to the United States Constitution. That is, it’s the Constitution of the United States that allows people to sleep on the sidewalk, Mr. Unnamed white privilege rage ranter. The city of Los Angeles fought this case every step of the way, and Charlie Beck and presumably other city officials can’t wait to start enforcing it again as soon as the terms of the settlement are met. By the way, your use of the word humane here is infelicitous; as Albert Einstein once said,1 sarcasm is the language of the Devil. Note that we’re skipping some of the technicalities of the Jones case here, but the simplified outline is true enough.
