A developer wants to build a building that’s taller than the local zoning allows, or has less parking than required. Maybe there are pesky historical structures on the proposed site or the new building will attract enough additional traffic to gridlock the streets around it. There are any number of reasons why a given building might not be allowed. It’ll still get built, though.

The developer will just have to pay hundreds of thousands, even millions, of dollars to the appropriate councilmember to get it approved. And these payments are inextricably integrated into our City’s building approval process. One might even suspect, and not without reason, that the ultimate purpose of zoning codes in Los Angeles is to induce developers to pay for exceptions to them.

And it’s not bribery, at least not the illegal kind. The CM doesn’t get to pocket the money. Instead it goes into one of the dozens of City trust funds set up specifically for receiving such monies. Just for instance, Mitch O’Farrell, CD13 repster, has one called the “Council District 13 Public Benefits Trust Fund.” It’s authorized by the Los Angeles Administrative Code at §5.414 ” for the receipt, retention and disbursement of gifts, contributions and bequests for the support of police and community activities within Council District 13.”

The fees are imposed on developers by the City Council at the behest of the relevant CM. To see an example of how this works take a look at CF 07-1379, wherein some developers sought permission to build another mixed-use monstrosity in Hollywood, this one at 1540 N. Vine Street.1 The developers got what they came for, which was Ordinance Number 178,836, authorizing construction. And in there, buried among other conditions, will be found paragraphs 26 and 27, stating how much money they’re going to give to Mitch O’Farrell in exchange for their zoning changes:

BID Consultant John Lambeth Of Civitas Advisors Is Working On Forming The Echo Park BID For The City Of Los Angeles — And The Route 66 BID For That Matter — No One’s Paying Him For Route 66 And The City Won’t Act Promptly Re Echo Park — What’s A Putatively Ethical Consultant To Do? — Refuse To Sign The Damn Contract Until The City Gets Its Act Together!

Good God, could the neverending saga of the inchoate Echo Park BID get even weirder? Since you ask, the answer, of course, is obviously yes. You may recall that very recently Councilbaby Mitch O’Farrell moved that the City give BID consultants Civitas Advisors another heaping beaucoup de bigly bucks to let them continue working on the extraordinarily multiyear process of creating the Echo Park BID.

The City memorialized this effort in Council File 10-0154-S1, created on February 27, 2018 to contain the above-mentioned motion. On April 13, 2018 the full council adopted the motion which, for reasons I won’t even think about pretending to understand, doesn’t seem to require Mayoral concurrence to take effect. So they got the money, they got the BID consultant, what’s the damn problem?

More Eye-Poppingly Implausible Deliberative Process Exemption Claims By Attorney Briggs, BID-Addled Self-Proclaimed 36th Level Shaolin Black Belt CPRA-Fu Master — Not!

Recently, first on February 8, 2018 and then again on February 17, 2018, I’ve published some sets of emails for which self-proclaimed Hollywood Superlawyer Jeffrey Charles Briggs had at some point in the past claimed were exempt from production via the California Public Records Act due to the half-delusional common law principle known to the zillionaire elite and their minions as the Deliberative Process Exemption.

Both of those sets of documents were collateral fallout from an almost-concluded writ petition I was forced by Briggs’s bizarro intransigence to file against his client, the Hollywood Media District. Today, though, I have yet another set, this batch from the East Hollywood BID. They are also a client of Briggs, moved not only to bizarro intransigence but to a freaking intransigential paradigm shift by Briggs’s newly emboldened stance against simple compliance with the law.1

There are two quite distinct parts to this story. First, there are the actual emails that Briggs Esq. claimed to be exempt. Along with those goes much more than a modicum of mockery. Second, there’s the story of the CPRA request itself and how Attorney Briggs cannot for the freaking life of him just tell his client to follow the damn law because it’s easier for everyone in the long run. East Hollywood BID Poised To Advocate For Cop-Sponsored Delusional Anti-Prop-47 Pro-Death-Penalty Propaganda Presentation At January 16 Board Meeting, Thereby Just About Stretching Their State-Law-Mandated Local-Activities-Only Restriction To The Freaking Limit And Beyond

One of the most neglected aspects of the Property and Business Improvement District Act, the fons et origo of the state’s grant of authority to establish, regulate, and control BIDs, is a limitation found in §36625(a)(6), which states:

The revenue from the levy of assessments within a district shall not be used to provide improvements, maintenance, or activities outside the district or for any purpose other than the purposes specified in the resolution of intention, as modified by the city council at the hearing concerning establishment of the district.

This places two essential limitations on how BIDs are allowed to spend the money they collect from property owners.1 First, BIDs must only spend their money on stuff inside their districts, and second they must only spend it on activities specified in the resolution of intention to form the district. In the City of Los Angeles, at least, these activities are specified by incorporating the BID’s management district plan, which is filed with the City Council at some point prior to the BID’s formation, into the ordinance of intention.2

Now, if you follow this blog even half-heartedly, you’re well aware that this statute is completely flouted by BIDs in the City of Los Angeles. For instance, Blair Besten’s lobbying over Skid Row, which isn’t part of the Historic Core BID at all, not to mention Hurricane Kerry Morrison’s indefatigable lobbying everyone in the whole freaking universe over reforms to the Public Records Act.

And of course, all of them, every last delusional white supremacist BID in the whole freaking City of Los Angeles lobbying3 against Proposition 47, a particularly half-witted example of which can be found here. Which brings us to today’s subject, which is that squarmy little love child of Jeff Zarrinnam and David Miscavige known to the world as the East Hollywood BID.

It seems that at their upcoming meeting,4 at least according to the agenda, they’re poised to discuss the following item:

The Hollywood Chamber Of Commerce Amended Its Lobbying Registration Form in April 2017 And The Only Change Was The Date They Qualified — More Interesting, Though, Is The Fact That They Consider Their Pro-Establishment Advocacy For Jeff Zarrinnam’s Inchoate Hollywood-Western And Route 66 BIDs To Be Lobbying Activity

It’s well-known that the Municipal Lobbying Ordinance requires lobbyists of all stripes to register with the City Ethics Commission. The Hollywood Chamber of Commerce is no exception to the rule.1 They are also required to amend their registration forms if there are any material changes in the information provided.2

And as you know if you follow this blog, I find everything to do with lobbyists in Los Angeles fascinating, and thus I haunt the Ethics Commission’s lobbying pages, poring over the alphabetical lists of individual lobbyists and of lobbyist firms and employers to see if anything’s changed or if something is newly interesting.

And lo! Last night I noticed that our old friends, the Hollywood Chamber of Commerce, had amended their registration form on April 28. Here are the two forms:

Well, I stared and stared and stared at those two forms just trying to figure out what had changed. Eventually I noticed that the original form had January 31, 2017 as the date they’d qualified as a lobbying entity3 whereas the amended version had January 1, 2017 as the day of qualifying.

There’s a lot of information on the forms, though, and I didn’t feel confident that the difference I’d noticed was in fact the only difference. I wasn’t sure what do to until this morning, when it occurred to me that if I put both pages into the GIMP, superimposed one on top of the other, and then faded the opacity up and down I’d be able to notice what changed.4 And it turns out that in fact, it’s correct that the only change was the date of the Hollywood Chamber’s qualifying as a lobbyist.

Which leads irresistibly to the question of why Leron Gubler and/or Nicole Shahenian, who are the Hollywood Chamber’s two registered lobbyists, felt the need to make this tiny change. It’s hard to make fun of people whose publicly revealed antics are not only stranger than fiction but stranger even than satire. The Actual Mechanism By Which Suzanne Holley And The Central City Association Strangled The Incipient Street Vending Ordinance In Its Cradle By Sneaking In Unilateral Councilmember Opt-Out On Behalf Of BIDs, The Role In This Debacle Played By Criminal Conspirators Jessica Borek and Matt Rodriguez, And How The Council Messaged It To BIDs

Recall that I’ve been tracking the hysterical, irrational opposition of LA’s business improvement districts to the ongoing process of legalizing (some aspects of) street vending in the City since the Spring of 2015. A truly astonishing level of bitching and moaning in 2015 stalled out the whole process for most of 2016 because, I believe, everyone was too freaking sick of the whining and the carefully orchestrated lying on any number of occasions and the City just needed a rest.
A man arrested, transported, and handcuffed to a bench by the Andrews International BID Patrol in Hollywood for selling umbrellas on the street. At least it appears that this horror show is over, although I wouldn’t be surprised if there are even more loopholes and it’s not over at all.
Until the November election of Donald Trump and his subsequent threats to deport essentially anyone, U.S. citizen or not, who’d ever smiled while thinking of eating a taco spurred the Council into action on at least the small part (small but in no way insignificant) of the plan to decriminalize illegal street vending so that, no matter how much trouble the zillionaires might cause the heladeros, at least they wouldn’t be subject to arrest and subsequent deportation. That bit seemed urgent enough to pass Council outright, and even the anti-vending forces of the zillionaire elite seemed to realize that they were just going to be exposed as the nasty little mean creeps that they are if they fought back on this particular issue. However, the Council put off acting on an actual legalization framework until later.

But recall, as I reported in January, the instructions for the report-back were altered from the original, and quite sensible,1 request for

A process to create special vending districts to be initiated by Council, the Board of Public Works, or petition (with signatures from 20 percent of property owners or businesses in the proposed district), based on legitimate public health, safety and welfare concerns that are unique to specific neighborhoods with special circumstances.

to a request for language

Providing the City Council the ability to opt out of certain streets by Council action.

At that time I didn’t understand yet how this had all taken place, but now I’ve accumulated enough documentary evidence that it’s possible to sketch out a picture. The short version is that in December 2016, Suzanne Holley, at that time acting Executive Director2 of the Schatzian horror show known as the Central City Association of Los Angeles, wrote a letter to the City Council telling them to make the change. This was distributed to the BIDs via the BID Consortium. They all told their pet Councilmembers to change it. It got changed, and all the BIDs rejoiced, some of them quite publicly. The consequences of this are going to be horrific, and whatever street vending framework gets put in place will be DOA. Details and evidence after the break.
