When last we peeked into the Minutes of the Board of Directors of the Pacific Palisades BID, we learned that they were all sitting around up there in Northwest Zillionaireville quaking in their super-pricy boots over the influx of gang members from urban Santa Monica. Today, well, there’s the serious matter of street vending to discuss, of course, but first, take a look at the minutes from January 4, 2017, where we learn about this:

Homeless issue – One person is a problem on Via de la Paz lately. He is a 300 lb., male black man with a nasty temper. Officer Moore recommends signing a “Trespass Arrest Authorization” form which was handed out.

Got it? He weights three hundred pounds.1 He’s black. And not only that, he is both male and a man. This is a truly frightening situation! I’m wondering if their trespass authorization form has a place to put the weight of trespassers that the cops are authorized to arrest? The standard form does not, but the LAPD is famous for deploying multiple helicopters to fly against the homeless in the Palisades. Are they going to refuse them a custom anti-homeless trespass form? Especially if they’re being overrun by a horde of three hundred distinct pounds of angry homeless black male man?

I mean, I know you can never be too rich or too thin, but that the Palisadesians are extra-scared of this man because “he is a 300 lb., male black man…” is somewhat unexpected, even though 300 lb. people can certainly “pose to be dangerous.” I would have thought that fear of the homeless would be measured more by the individual than by the pound, but I’m wrong again. Certainly this is why I can’t afford to live in the Palisades amongst the jittery little psychopathic self-interested zillionaire theorists of homelessness. My priorities are obviously really confused.

And if they’re going to pieces to this extent over one “300 lb., male black man,” how are they going to feel about the gracious shimmering snow-white streets of their little village2 being overrun by the herds of dark-skinned heladeros, frutateros, and eloteros that are even now massing at their borders just waiting for the City Council to give them the go-ahead to swarm in and start supplying their victims, the hitherto-uncorrupted-by-Mexican-ice-cream-treats Palisadeseans, with paletas de limón? Pacific Palisades BID Poised To Spend Almost 3% Of 2017 Assessments Fighting My CPRA Requests. Is This Really The Best Use Of Property Owner’s Money?? Also, Rick Lemmo’s Vow To Thwart Me By Proceeding “According To The Strictest Rules Of Law” May Reveal Hitherto Unsuspected Paradox In CPRA!!

Another Rick in the wall, part 97: Rick Lemmo, who is Rick Caruso’s senior VP for some kind of nonsensical crap, explains the zillionaire’s view of law-abiding high finance.
For a brief moment this morning, I was worried that it’s a bad thing that my coverage of the Pacific Palisades BID, initiated mainly because of a confluence of my interest in CD11 and the fact that the criminal intransigence of Mike Bonin’s staff has made it essentially impossible for me to get records directly from them, is tending fairly unexpectedly towards the navel-gaze, self-reference, point-is-to-understand-the-world, nerdview rather than towards the outward-looking, the-point-is-to-change-it focus which is somewhat of an ideal around here. That anxiety took me about 35 seconds to get over, so we’re going meta again this morning sans apologia.1

In any case, whatever her manifold faults as a CPRA client may be, Laurie Sale, executive directrix of the Palisades BID, is at least a reliable source of minutes and agendas. You may recall that she was previously kind enough to send me the PPBID’s 2016 minutes and agendas, and this weekend she sent me the 2017 minutes and agendas through February. There’s some interesting stuff in there, primarily about street vending, which I will write on quite soon. The minutes also suggest that CD11 field deputy Sharon Shapiro2 is an actual member of the PPBID’s Board of Directors. I’ll be looking into this, not least because it’s reminiscent of Debbie Dyner Harris’s ill-fated attempt to nab a voting seat for CD11 on the Board of the Venice Beach Property Owners Association, which was slapped down ignominiously by City Attorney Mike Feuer as a conflict of interest.

But never mind that for now. The text for today’s sermon is this little slab of nonsense, found in the BID’s minutes for February 1, 2017:

BID received requests for public records – copies of meeting minutes, agenda, emails back and forth within the City, etc. from a gentleman who is requesting this from many BIDs. Elliot made a motion to retain attorney not to exceed $4,000. Rick seconded, all approved, motion carried. In the event that this person wants copies made, then we need to request payment. Rick motioned: “we don’t want to make it difficult for him, but to rather provide him every access to public records according to the strictest rules of law so that it doesn’t provide any financial detriment to the property owners of our business improvement district.” Susan seconded. Unanimously approved, motion carries.

In Which I Use The Palisades BID As A Test-Case For A New Tactic In The Neverending Quest To Find Some Way To Force Business Improvement Districts To Comply With The California Public Records Act Without Having To File Yet Another Freaking Writ Petition

Laurie Sale is a sympathetic character, no doubt, but if we start letting our personal feelings towards people stand in the way of enforcing the law then anarchy will follow as surely as the night follows the day, so we’re not gonna do that! Plus even sympathetic characters, if they’re lawless, can still pose to be dangerous!
Here’s the short version of this post: Laurie Sale of the Palisades BID has been telling me for months that she is too busy to work on my CPRA requests. Yesterday she turns out to be too busy to send copies of emails in a reasonable format. She continues to be too busy to provide an estimated date of production even though CPRA requires it. She keeps telling me she only works half-time. BIDs sign a contract with the City which requires them to maintain staffing adequate for the completion of required work in a timely manner. CPRA compliance is required work. Being too busy to do it is not doing it in a timely manner. Too busy for CPRA, BIDs?? Breach of freaking contract!!

And here is a quick recap of how we got to this place. About 80% of the staff of this website grew up in Venice, so we all got really interested in the Venice Beach BID. Unfortunately, CD11 staffie Chad Molnar took offense at the use I made of the fruits of a couple CPRA requests and stopped complying with the law altogether, forcing me to turn him in to the City Ethics Commission. That’s going to take forever to resolve, though.

Thus thwarted in my attempts to learn about the inner workings of Mike Bonin’s weirdo little empire directly, I have turned to requesting materials of all the BIDs in his district, which are Westchester Town Center, Brentwood Village, Gateway to LA, and last, but never ever least, the Pacific Palisades BID,1 which was explicitly called out by Mike Bonin himself on the floor of the Council Chambers as one of the good BIDs. I have received some material from these halfwits-by-the-sea, which provided raw material for our most popular post in the month of January, but mostly their executive directrix, Laurie Sale, keeps telling me that she’s too damned busy to send stuff in a timely manner.

And finally, yesterday, she condescended to transmit a bunch of emails to me by forwarding them, with her own typed annotations prepended. I had asked for them in native format,2 and providing them in native format is required by CPRA.3 It’s important to get emails this way because it preserves the integrity of the headers and also it ensures that attachments arrive in precisely their native formats as well.4 I habitually request emails in native formats and most BIDs have figured out how to comply with this requirement. So I told Laurie Sale that her forwarded emails weren’t acceptable and could she please figure out how to send them in the right format. I can tell from her headers that she uses Outlook, so I sent her a link to Microsoft Support which explains how to export emails to a PST file. It’s not hard.

But she was having none of it. She fired back this cranky little number, stating:

Is There Such A Thing As An Honest Lobbyist? Probably Not, But Nevertheless, Larry Kosmont Handled The Gateway To LA BID’s Recent Renewal And Registered With The Ethics Commission To Do So, Casting Further Doubt On Any Theory That Implies That Shadowy BID Consultant Tara Devine Was Not Also Required To Register

We’ve been discussing BID consultants a lot recently because of shadowy BID consultant Tara Devine and the fact that it looks so much like BID consultancy satisfies the LAMC’s definition of lobbying that it’s very likely that she broke the laws requiring registration, causing me, in the throes of a well-developed sense of civic duty, to report her transgressions to the Ethics Commission and then again to report some associated transgressions to Mike Feuer. What will come of these matters no one can now know, of course, but one aspect that troubled me slightly is the apparent novelty of the charges. That is, all the BID consultants I knew of at the time weren’t registered. This doesn’t mean they don’t have to register. After all, consider what happened with BID security and the Police Commission as a result of our reporting. But nevertheless, one never wants to be the first to make an argument if it’s possible to avoid it.

So imagine my pleasure in discovering that, first, the famous Gateway to LA BID, one of Mike Bonin’s babies out there by the Airport in CD11, renewed for 10 years in 2015, and they used a BID consultant named Larry Kosmont to handle the process for them. And second, that Larry Kosmont was not only registered as a lobbyist during this process, but that he specifically, explicitly, disclosed his work for the Gateway BID to the City and specifically, explicitly listed the City Clerk as one of the City offices he’d lobbied in furtherance of the renewal project. This is going to make it a lot harder for Tara Devine and her defenders, if any she has by now, to argue that it never occurred to anyone that BID consultants were lobbyists and therefore subject to registration. How I Reported Shadowy BID Consultant Tara Devine To Los Angeles City Attorney Mike Feuer For Knowingly And Fraudently Deceiving Mike Bonin With Regard To A Material Fact Pertinent To The Establishment Of The Star-Crossed Venice Beach BID

“I’ll be damned if I’m ever going to say, ‘It’s not my job,’” Feuer told the Times editorial board. We like that attitude. All L.A. residents should.
If you want to skip the explaining and go straight to the complaint, here it is.

Friends, take a look at the exceedingly fascinating LAMC § 48.04(B). This lovely little slab of ethicalliciousness illegalizes any occasion when a lobbyist might:

Fraudulently deceive or attempt to deceive any City official with regard to any material fact pertinent to any pending or proposed municipal legislation.

And of course, you recall what a lobbyist is, it’s a technical term in this setting.1 Lobbyists are defined in LAMC §48.02 to be:

any individual who is compensated to spend 30 or more hours in any consecutive three-month period engaged in lobbying activities which include at least one direct communication with a City official or employee, conducted either personally or through agents, for the purpose of attempting to influence municipal legislation on behalf of any person.

Well, as you may recall, I spent the last two months assembling a highly detailed argument that Tara Devine met this definition. If that’s right, and I certainly think that it is, she’s also forbidden from fraudulently deceiving Mike Bonin, e.g., about material facts in regard to the formation of the Venice Beach BID which, as I’m sure you know, requires legislation for the BID to be brought into existence.

The argument is that she got everyone to believe that it was required under state law to include commercially zoned properties in the BID, even though not only is this not true, not only did she know it was not true, but her having convinced everyone of this led to more properties being in the BID, which increased the amount of money under the control of her clients, the Venice Beach Property Owners Association. The $80,000 woman and famed co-conspirator of shady contributors and City Attorney lawsuit targets, liar and sneaky deceiver and putter of words into Mike Bonin’s mouth and subject of investigations, shadowy BID consultant Tara Devine, was the guest of honor at Wednesday’s meeting of the third creepiest BID downtown. Her appearance was recorded for this blog by an intrepid correspondent.1 The background is that the South Park BID and its little mutant offspring the South Park II BID are going to merge next year. The process is essentially as complex as starting a brand-new BID, and Tara Devine is the consultant leading the faithful through the slough of despond City bureaucracy. The South Parkies are going to miss some mandated deadline, which will cause the first year’s assessments to be billed and collected by the Los Angeles City Clerk’s office rather than by the County Assessor.

And this so-called “manual billing” has various consequences for the BID’s income that differ in various ways from what happens when the assessment is collected by the County of Los Angeles. You can listen here as Tara Devine explains one of these differences, which is a top-secret, not-to-be-advertised, not-advisable-to-broadcast, hitherto-unknown-to-anti-BID-theory hardship mercy rule. Shadowy BID Consultant Tara Devine Seems To Get Paid About $80,000 For Establishing A BID, Which I Managed To Discover Despite The Fact That She’s So Darned Secretive

Shadowy BID consultant Tara Devine looks fate’s oncoming train straight in the eye.
There’s an unresolved problem in the application of the California Public Records Act to business improvement districts. The thing is that the Property Owners’ Associations which administer the BIDs are, in part, subject to CPRA because §36612 of the Property and Business Improvement District Law of 1994 makes them so, stating that:

“Owners’ association” means a private nonprofit entity that is under contract with a city to administer or implement improvements, maintenance, and activities specified in the management district plan. … an owners’ association shall comply with the California Public Records Act … for all records relating to activities of the district.

The problem is that the Owners’ Association doesn’t seem to be required to comply with CPRA until it actually is under contract with the City. This, if accurate, means that the activities of the POA before the BID is approved are largely opaque to scrutiny. And this has been a severe problem in the case of the Venice Beach BID, where a number of people, not just me, have had the experience of CD11 staff,1 City Clerk staff, and even freaking Holly Wolcott herself, falsely denying that the City is involved in the BID formation process at all and telling members of the public that they should therefore seek information from shadowy BID consultant Tara Devine. Tara Devine, of course, ignores all requests for information from anyone who seems to be even a little skeptical about the benefits of BIDs.

None of this is the final word on the matter. The only reason that the legislature even made BIDs subject to CPRA is that Aaron Epstein, a brave and determined property owner, sued the living shit out of the Hollywood Property Owners Alliance2 in the 1990s and the Courts determined, in a stunningly righteous decision, that BIDs were subject to both CPRA and the Brown Act. It’s quite possible, perhaps even probable, that if the courts were asked whether or not POAs were subject to CPRA before the contract was signed, they would find that they were. However, that’s not a struggle in which I presently have the resources to engage, so alternative methods of information collection are required.

Fortunately,3 Tara Devine is not a one-BID woman. See, in 2015 the South Park BID was up for renewal.4 The process of BID renewal is essentially the same as the process for BID establishment, with the huge difference that it’s carried out by a POA that’s already under contract with the City, and is thus subject to CPRA. Despite His Generally Sympathetic Rhetoric, It Turns Out That Since 2015 Mike Bonin Has Moved Or Seconded Almost 60% Of Anti-Homeless Oversize Vehicle Bans, Helping To Make Revised Ban On Car Sleeping Even More Draconian Than Anticipated

Here’s the story so far: Last year the City Council repealed its law against sleeping in cars, which it more or less had to do because the Ninth Circuit told them they couldn’t enforce it anyway. Then in November they passed a new version of the law, published as LAMC 85.02, which supposedly corrected the last version’s problems. The new law, according to guidelines published by the City of Los Angeles, purports to allow living in a vehicle under these circumstances:

  • Between 6:00 a.m. and 9:00 p.m. – more than one block (500 feet) away from licensed schools, pre-schools, daycare facilities, or parks.
  • Between 9:00 p.m. and 6:00 a.m. – in non-residentially zoned areas which are more than one block (500 feet) away from licensed schools, pre-schools or daycare facilities or parks.


When the law was passed last November, CD11 Councilmember Mike Bonin was quoted in the Times to the effect that these restrictions would leave half the streets in the City open to homeless car dwellers. More recently, the incomparable Gale Holland reported that, not only did the official City map only show about 10% of our streets open, but that that estimate didn’t even take into account so-called block-by-block restrictions. According to Gale Holland, Mike Bonin used this insufficiency as a reason to hurry along his proposed Safe Parking program, which would open up some City property for homeless parking. So I decided to look at these weirdly specific1 block-by-block restrictions, which seem to have been passed almost exclusively post-Desertrain, from 2015 on. There Is At Least One Substantial Way In Which Slavering Psychopath Mark Ryavec Is Not Like Donald Trump And That Is That We Have His Freaking Tax Returns

This has nothing much at all to do with businesss improvement districts, but it’s Saturday night and I just felt like laying some Form 990s on you. These five beauties are from slavering psychopath Mark Ryavec’s agressively moronic Venice-based gang of subliterate meatheads, known to the mundane world as the Venice Stakeholders Association. They are available here on Archive.Org for your reading and researchical pleasure.

These items are interesting for any number of reasons. One is that they show that the VSA is not just a vision of sugar plums dancing ‘neath the fevered brow of Mark Ryavec, but that there are actual real-life other people involved:1 Michael King, Bonnie Felix, Anil Comelo, Robert Feist, Richard Myer(s).2 Had they appeared in another context I’d have been willing to bet that these names were merely selected from the myriad to be found in Ryavec’s floridly diverse collection of multiple personalities, but I don’t know many people, even the really, really, crazy ones, who have a lack of foresight sufficient to cause them to swear under penalty of perjury in a document submitted to the Federal government that the names of their imaginary friends represent real-life actual human beings.3

Another interesting thing is that the forms contain descriptions of accomplishments the VSA deems significant enough to brag about to the Federal government. These have the perhaps unintended effect of revealing both the breadth and the depth of the slavering psychopathy at work out there in the lorn, lost, lamented, former utopia west of Electric Avenue. You probably thought that this place was nothing more than a colony of self-satisfied zillionaires and their floofly little dogs, just strolling around on the bluffs in their $1,400 Jimmy Choos, but it turns out that it’s a seething urban hell, generating crime wave after crime wave in the Palisades. Build that wall, Mr. Bonin!
OK, remember after the Venice Beach BID was approved for the second time and Mike Bonin gave a meandering, semi-sensical, victory speech, pronouncing definitively that he

…acknowledge[d] that there have been issues and problems with BIDs in other areas. But there have also been BIDs that have been very successful and have been great partners in solving homelessness. In Pacific Palisades we have a BID that has actually worked with the Pacific Palisades Task Force on Homelessness and has helped get people housed.

Combine this statement, just begging to be fact-checked, with the fact that Mike Bonin’s weirdo staff is engaged in a criminal conspiracy to violate the California Public Records Act, thereby bringing the legally authorized investigations of brave citizen journalists into the shady shenanigans of CD11 to a grinding halt, and how could I resist asking Mike Bonin’s darling Pacific Palisades BID for a bunch of public records?

Well, last night, PPBID executive directrix Laurie Sale, in addition to coming at me all salty with a bunch of copypasta lawyerese about how she wasn’t handing over anything unless God and the FBI told her she had to,1 also provided me with a year’s worth of agendas and minutes from her according-to-Mike-Bonin-exemplary little BID out there to the northwest of reality in zillionaireville. Of course I put it up on Archive.Org immediately. And there’s some fine craziness in there, friends.

Greetings homeless neighbors! On behalf of the Palisades BID I would like to announce that we are from the LAPD and we are here to help the old amongst you, especially those whose health has deteriorated!
First of all, with respect to the homeless population of the Palisades, which according to Mike Bonin this BID’s handling of is a pattern of enlightened BIDolatry, take a look here at the Minutes from February 3, 2016, where we read, in the words of Laurie Sale her own self, that:

Older homeless are receptive to services as their health deteriorates. On the enforcement front, Michael Moore will be here soon to attest to the fact that they’ve gotten a lot more support from LAPD. Have provided more air support and foot support and they’ve mapped out all of the encampments. The signage has helped and allowed them to go in and get people off of the bluffs. Currently have a count of approximately eighty (80) homeless in the area but no market
[sic] increase.
