It’s well-known that the economic destruction wrought by the COVID-19 pandemic is putting already severely rent-burdened tenants at even greater risk of eviction and homelessness. Activists have been pleading with Los Angeles City officials for months now to find ways to mitigate this looming crisis while the officials spend their time whining about how they don’t have the power to solve the problem.

The very few measures the City has actually implemented are overly complex, slanted towards landlord interests, half-assed, and very likely to require court intervention as part of the process.1 Not only are the City’s putative solutions entirely insufficient to meet the looming need, but the City only allocated $100 million to the program, which is so inadequate an amount that the City is going to distribute it by lottery.

Our present situation highlights about as clearly as can be the complete contempt, or at least clueless indifference, with which City officials approach the needs of non-zillionaire angelenos. And it’s not just residential tenants that are economically endangered by the pandemic. It’s also been hell on retail businesses, who are also having possibly insurmountable problems covering the rent.

In turn this threatens the income of their zillionaire commercial-property-owning landlords, who are therefore worried about their ability to cover their own expenses, including mortgages and property taxes. But the City government of Los Angeles is neither contemptuous not cluelessly indifferent towards the interests of zillionaires, of course, and their lack of contempt is demonstrated clearly by their attitude toward business improvement district (“BID”) assessments in the City.

The City of Los Angeles has more than forty BIDs. These operations are funded by assessments paid by commercial property owners in the districts. The assessments are not voluntary. They appear on the owners’ county property tax bills and are subject to the same kinds of draconian collection measures used to enforce payment of any tax. But unlike ordinary property taxes, which are paid to and collectable by the County of Los Angeles, these BID assessments belong to the City.

Which I suppose gives City officials some power over how and when they’re collected, or at least that’s the only way I can make sense of a statement made by Dr. Kris Larson, executive director of the Hollywood Property Owners’ Alliance at their recent board meeting. Larson told his board that “while property owners are technically still on the hook to pay their assessments the City is not penalizing those that are late collected.”

Beachslapped!! — Los Angeles City Clerk Holly Wolcott Wrote To Mark Sokol And Tara Devine On April 18, 2018 Stating That More Than $1.3 Million Of The Venice Beach BID’s Unused 2017 Assessments Will Be Refunded To Property Owners Starting In July 2018 — A Monumental Development Considering The City’s Extreme Reluctance To Get Involved With Overseeing BIDs At All

At their March 9, 2018 meeting the Venice Beach BID Board of Directors discussed refunding some or all of the $1.8 million collected from property owners in 2017, most of which is unspent because the BIDdies took so long to get moving. You can read the minutes here, and there’s a transcription of the salient item after the break.

It appears from the minutes that the BID only agreed to inquire of the City whether a refund was possible. However, when City Clerk Holly Wolcott responded to the BID’s inquiry in an April 18, 2018 letter, she wrote as if the refund was a done deal. And since her office controls the money, it seems that it is a done deal. Wolcott says that refunds will issue beginning in July 2018.

This strikes me as yet another vote of no confidence in the beleaguered Venice Beach BID as run by Mark Sokol, Tara Devine, and the rest of their horrow-show crew. Although it’s well-known that under Wolcott the City of Los Angeles has essentially been completely unwilling to police BID activity in any way, she seems to be coming around to the idea that there’s something really, really wrong in Venice. The $80,000 woman and famed co-conspirator of shady contributors and City Attorney lawsuit targets, liar and sneaky deceiver and putter of words into Mike Bonin’s mouth and subject of investigations, shadowy BID consultant Tara Devine, was the guest of honor at Wednesday’s meeting of the third creepiest BID downtown. Her appearance was recorded for this blog by an intrepid correspondent.1 The background is that the South Park BID and its little mutant offspring the South Park II BID are going to merge next year. The process is essentially as complex as starting a brand-new BID, and Tara Devine is the consultant leading the faithful through the slough of despond City bureaucracy. The South Parkies are going to miss some mandated deadline, which will cause the first year’s assessments to be billed and collected by the Los Angeles City Clerk’s office rather than by the County Assessor.

And this so-called “manual billing” has various consequences for the BID’s income that differ in various ways from what happens when the assessment is collected by the County of Los Angeles. State Judicial Council Gets “No Benefits From BID,” Refuses to Pay Assessments Since 2009

If you look here you will find correspondence between HPOA Executive Director Kerry Morrison and various people with the California State Judicial Council, which has not paid its assessments since 2009. It’s well worth a read if only to see Kerry’s hapless rhetorical sallies counterposed with the calm authority of the state’s lawyers.
