Burbank BID Violated Brown Act In 2016 By Voting To Donate $50,000 To A Political Campaign Without Having Agendized The Matter — Local Activist David Spell Calls For Disestablishment — Burbank City Attorney Forced To Address The Question Of Whether BID Assessments Are Public Funds — Answers With A Resounding “Maybe”!


So it turns out that a major scandal involving a business improvement district has been brewing up in Burbank since September 2016. The short version of the story is that a Burbank BID violated the Brown Act and may have violated State laws forbidding the use of public funds in political campaigns. A local activist, David Spell, turned them in to the LA County DA and the Fair Political Practices Commission.1

In December 2016 the Burbank City Attorney published a fascinating report on the episode,2 which may shine a great deal of light on the legal status of BID assessments as public funds. Furthermore, Spell called for the Burbank City Council to hold a disestablishment hearing as required by Streets and Highways Code §36670(a)(1).3

If this money does turn out to be public, a lot of really interesting consequences would ensue, which is another part of what makes this episode so important. As always when BIDs and the law intersect, the details are unavoidably technical, which is no doubt why the L.A. Times skips over them and also why I’m hiding them below the fold!

Occasionally people in my position find that actual factual matters are weirder than we could have even imagined. It’s hard to make fun of people whose publicly revealed antics are not only stranger than fiction but stranger even than satire. The great Mark Russell used to call this kind of material “rip and read.”1

The Disturbing Gun Worship of Kerry Morrison and the Hollywood Property Owners Alliance: Glocks, Sigs, 1911s, Rifles, Shotguns, Tasers, to Say Nothing of the Pink Lady-Guns

With recent events in this country1 reinvigorating the national debate over gun control, we thought it was an opportune time to present this singularly weird email from Hollywood Property Owners Alliance Executive Director Kerry Morrison to the members of the Joint Security Committee inviting them to join her out at the Andrews International Training Center in Burbank to try out the Firearms Training Simulator, pop off a few rounds at the shooting range, and eat some sandwiches provided by Andrews International catering director and senior vice president Bill Farrar.

According to Kerry Morrison, she’s gone out there to shoot multiple times, and evidently wants to share this “very humbling” experience with her compatriots on the Joint Security Committee.2 We know it sounds made up, but the text does not lie, friends:

For some time we’ve promised you an opportunity to visit the Andrews International training facility in Burbank where they have a shooting range and a FATS simulator. FATS stands for Fire Arms Training Simulator, and it presents a realistic training experience. I’ve tried this a couple times and it is very humbling and helps us all appreciate the split second judgements that must be made by law enforcement.

If any of you would like to participate, we are going to venture up to their facility next Wednesday, February 19 at 11 a.m. Bill Farrar will bring in sandwiches and everyone will have an opportunity to experience both FATS and the shooting range, if you would like. We should be ready to return to Hollywood by 1:30-2 pm.

Please RSVP to me by Monday afternoon so we can plan for food. I will also send out address and parking instructions next week.

Defendants in Street Vending Lawsuit (City of LA, Fashion District BID, etc.) Granted Extension to February 25, 2016, to File Response to Complaint

This is not a big deal, but I just thought I’d mention it. On Tuesday all the parties to the street vending lawsuit filed a stipulation asking Judge O’Connell to extend the deadline for the defendants to answer the initial complaint until February 25, 2016. Today the judge filed an order granting that request. The reason for the delay is the settlement conference scheduled for February 11, 2016. You read it here first, friends!
