Mitch O’Farrell Introduced A Motion To Put A Homeless Shelter In The Hollywood Recreation Center At Lexington And Cole — Heroic Activist Org KTown For All Rightly Wonders If This Will Lead To Intensified Enforcement Of Anti-Homeless Laws Around The Park — Which Seems Likely To Me Given CD13’s Appalling Deference To The Well-Organized Unhinged Local NIMBY Psychopaths — Who Would Have To Have Been Placated Before The Motion — This Klown Kar Krew Includes Kanye Producer Anthony Kilhoffer — Who Threatened Sean Starkey With Vigilante Action If The City Didn’t Get Rid Of The Unhoused Human Beings — “If it’s not handled in a week I’ll go through [throw] them out myself”

The Los Angeles City Council Homelessness and Poverty Committee met today, October 8, 2020 and considered, among other things, a Mitch O’Farrell motion to use the Hollywood Recreation Center as interim housing for the homeless. The incomparable Ktown for All livetweeted the meeting and raised the possibility that O’Farrell would use such housing as an excuse for enhanced enforcement of anti-homeless laws in the vicinity.

This is not a baseless fear. Councilmembers universally try to gain the approval of unhinged anti-shelter housedwellers by promising intensified criminalization of homelessness. O’Farrell did precisely that in 2018 with the Hollywood Bridge Housing project, for instance.

Also, the Hollywood Rec center is gang turf, claimed by a particularly violent crew of absolutely genocidal NIMBYs who continually threaten to attack homeless encampments near the park. This deranged mob is led by weirdo Kanye West producer Anthony Kilhoffer, who owns a rental property at 1149 Cole Avenue, directly across the street from the Rec Center.

How I Went To The Bureau Of Engineering To Check On Permits For Anti-Homeless Planters On Cahuenga Boulevard — And Discovered That There Were No Freaking Permits — And Not Only That But The Man Who Helped Me Said That Planters Aren’t The Kind Of Thing They Issue Permits For Anyway

Remember those infernal anti-homeless planters that are appearing on our sidewalks across the City from Venice out to Hollywood and beyond? Well, the Los Angeles Municipal Code is very, very clear about private people installing stuff on the damn sidewalk. It is required to get a permit before the installation goes in. This requirement is found at LAMC 62.118.2.

And it turns out that the existence of such a permit, called an R-permit, is completely a matter of public record. So I determined to check out the legality of the four arrays of planters on Lillan Way and Cahuenga Boulevard that I wrote about on Twitter at the end of February. Last week, mislead by the damn internet, I went to the Public Works Building at 12th and Broadway, but that turned out to be totally the wrong place.

The people there were really helpful, though, and they told me the department I wanted was at 201 N. Figueroa. I didn’t have time that day to continue the journey, but this morning I did. I found the right office and talked to two really helpful people, both of whom confirmed that none of these planters had permits, and that therefore none of them were legal.

Here’s a list of the addresses with illegal planters, and the next stop is the Bureau of Street Services to try to get an investigator out there. Also, read on for a description of the exact steps I took to check on permits, so you can do it too. Note that the relevant code section, LAMC 62.45, requires permits for fences, too. So you can check these out if you’re interested.

• 6350 Santa Monica Blvd. — NO PERMIT — ILLEGAL!
• 1000 N. Cahuenga Blvd. — NO PERMIT — ILLEGAL!
• 720 N. Cahuenga Blvd. — NO PERMIT — ILLEGAL!
• 706 N. Cahuenga Blvd. — NO PERMIT — ILLEGAL!

Emails From CD13 Reveal Identities Of People Who Installed Anti-Homeless Planters In Hollywood Along Cahuenga Blvd And Lillian Way — And Their Absolutely Appalling Conversations About — For Instance — Denying Homeless People Food To Encourage Them To Move — So Far There’s No Evidence That CD13 Was Directly Complicit — But They Sure Didn’t Do Anything To Stop Them — And Hollywood SLO Eddie Guerra — The Illegal Donation Solicitor — Certainly Was Complicit — Eddie Guerra: “Unfortunately We Are In The Displacement Business” — Eddie Guerra: “[Homeless Displacement] Is Too Sensitive To Discuss Over Email.” — Eddie Guerra: “Power Washing Doesn’t Chase Away Homeless, It Just Makes The Sidewalks Cleaner And They Like It!”

A quintessential slogan of my mother’s generation of feminists is that the personal is political. And this is as true and as profound as it ever was. But it’s also worth remembering that the political is personal. The powers of government are tools, weapons, wielded by individual human beings making daily conscious choices to use these public resources to further their personal goals, no matter how much they want to pretend otherwise, that they’re doing the will of the people or some other abominable abstraction.

And one of the things I do here at MK.Org is to expose these choicemakers, to smoke them out of the holes in which they huddle, all carefully camouflaged round with weighty principles and abstract whatnot, to reveal the little men crouching behind those shimmering curtains.1 This project is viable because, well, you know all that bad stuff that “the City of Los Angeles” does? It’s all being done by individual people, mostly organized via email, and therefore subject to the California Public Records Act.

And one of these bad things that these privilege-addled sociopaths do is to install illegal and appalling planters and fences on our public sidewalks so that there’s no room for tents. They’ve done this in Venice, they’re doing it in Koreatown, and they’re doing it in Hollywood as well. So I asked my good friends at CD132 if they could give me all their emails about these Hollywood ones and, today, they gave me a bunch!3 You can find them all here on Archive.Org, along with a bunch of pictures I took of the planters.4

One of the things we learn from these emails is that the people who attack homeless residents of our streets by installing these antisocial planters do it for really stupid reasons. For instance, Jennifer Mullen of Quixote Studios just doesn’t like the smell of marijuana, at least not if homeless people are smoking it. She thinks it gives customers the wrong impression of her business. Her email address is jenniferm@quixote.com.

And Andrea Kim of Lucky Scent, located at 726 N. Cahuenga Blvd 90038, doesn’t like the fact that homeless people own bikes and sometimes ask people for money. Even people who arrive in Ubers! Her colleagues Adam Eastwood and Franco Wright agree with her that this is intolerable behavior. Their email addresses are, respectively, andrea@luckyscent.com, adam@luckyscent.com, and franco@luckyscent.com.

As for Abbey Jackloski of the Hollywood Production Center, well, she doesn’t even feel like she needs to give reasons for her hatred of the homeless residents of Lillian Way.5 She just tells the thoroughly corrupt LAPD officer Eddie Guerra that “that would be amazing” if he could just get rid of them so they can install more planters. Her email address is abbey@hollywoodpc.com.

And last but in no way at all least we have the freakishly hip post-creatives6 at HQ Creative Office Freaking Space, who own this rusty space alien at 720 N. Cahuenga Blvd. And they also don’t need a reason. Their in-house sorceress of hipness, Na’ama Termechi, sends an email to disgraced SLO Eddie Guerra and is all like “Homeless exist. Squelch them, please.” And he does and says put in some plants when they’re gone and then Termechi and her conspirators put in the meanest, rustiest, horriblest appropriators of public space imaginable, as pictured at the top of the post. Her email address is naama@hqdevelopment.net.

But none of that nonsense is as interesting as this months-long email conversation7 between LAPD officer Eddie Guerra and a bunch of people who own property along Cahuenga Blvd and Lillian way north of Melrose and south of Santa Monica Blvd. He tells them to put in planters, he tells them how to put them in, and off they go, talking about getting donations from local nurseries and pushing homeless people away to somewhere else.

Rita Moreno Thinks The “Boundaries Of A BID Must Be Contiguous” — Misty Iwatsu Agrees!! — No! Wait! Rita Moreno Thinks “There’s No Legal Requirement That The Boundaries Be Contiguous”! — Whichever It Is, We Think That Rita Moreno (A) Is Practicing Law Without A License And Ought To Stop It Right Now Cause It’s Illegal And She’s Confusing Everybody And (B) Does Not Know What The Word “Contiguous” Means

OK, I’m sorry, this post is on kind of a technical subject, but I think it’s important and also it reveals a kind of weird off-handed incompetence amongst the City Clerk’s BID analyst staff that I think is worth memorializing. The central issue is whether the Property and Business Improvement District Act of 1994 requires a BID to be in one piece. I’m going to use the technical term “connected” here.1

It’s not just an idle question, either. You may recall that the proposed Hollywood Route 66 BID runs up Santa Monica Blvd. from Vine Street to Hoover Street. The problem is that Vermont Avenue crosses Santa Monica right in the middle of that stretch, and every building that touches Vermont is already included in the East Hollywood BID.

Regardless of what the PBID law has to say about connectedness of BIDs, it’s very, very clear on the fact that BIDs can’t overlap.2 Hence commercial buildings on both Santa Monica and Vermont must be excluded from the Hollywood Route 66 BID, which leaves its territory disconnected. Plausibly, also, the EHBID could cede those buildings to the Route 66 BID, but, interestingly, doing so would leave the EHBID disconnected, so nothing would be gained. Here’s a copy of the map if it’ll be useful.

Thus a correct understanding of what the law allows is essential for the formation of at least that BID, and probably others in the future. And I’m not a lawyer, but I read the whole damn PBID law about a zillion times and the connectivity of a BID is not mentioned in there at all. It’s my not-a-lawyer understanding that if a law doesn’t explicitly forbid something then that something is allowed.

But the famous Rita Moreno of the City Clerk’s Neighborhood and Business Improvement District division didn’t agree with me in 2017! Then she did agree with me in 2018! And Misty Iwatsu spent some time in 2016 babbling on about the matter and thought 2017 Rita Moreno was right! And Rita Moreno didn’t just think, she advised! And it strikes me that her advice looked an awful lot like practicing law without a license, which is illegal in California!3

And of course you want to see details! And primary sources! Turn the page and there they are!!

Simple Error In Propositional Logic Defeats Evil, Illegal Anti-RV Scheming of Mitch O’Farrell, Mike Bonin, and the Hollywood Media District BID But It’s Probably Irrelevant In The Real World Anyway

The sign, located on Lillian Way between Santa Monica Blvd and Melrose, says “and” but it was meant to say “or.” Does this matter in the real world? Probably not.
Last summer, Mitch O’Farrell, at the illegal request of Media District ED Lisa Schechter, supported by anti-RV-crusader-on-steroids Mike Bonin, introduced the despicable Council File 16-0967, seeking to ban oversized vehicle parking in the Media District BID. Of course, the thing passed, because this kind of thing always passes, and the ordinance was approved, and up went the signs.

There was one small problem, though. The ordinance, as do all of these little slabs of class warfare, bans:

…the parking of vehicles that are in excess of 22 feet in length or over seven feet in height, during the hours of 2:00 am and 6.00 am…

For some reason, despite what the ordinance actually passed by City Council says, it is still legal to park things like this in most of the Hollywood Media District.
But the signs, when they went up, said something different.1 They banned vehicles that are in excess of 22 feet in length AND over seven feet in height. See the problem? At first I wondered if this were nothing more than an uncharacteristically lapse into honesty by the class warriors at the BID. Perhaps, I thought, they wanted to keep it legal to live in limousines, even if RVs were to be banned, banned, banned.

The Actual Mechanism By Which Suzanne Holley And The Central City Association Strangled The Incipient Street Vending Ordinance In Its Cradle By Sneaking In Unilateral Councilmember Opt-Out On Behalf Of BIDs, The Role In This Debacle Played By Criminal Conspirators Jessica Borek and Matt Rodriguez, And How The Council Messaged It To BIDs

The Wicked Witch of the Southeast corner of Wilshire and Hope giving instructions to her flying monkeys.
Recall that I’ve been tracking the hysterical, irrational opposition of LA’s business improvement districts to the ongoing process of legalizing (some aspects of) street vending in the City since the Spring of 2015. A truly astonishing level of bitching and moaning in 2015 stalled out the whole process for most of 2016 because, I believe, everyone was too freaking sick of the whining and the carefully orchestrated lying on any number of occasions and the City just needed a rest.
A man arrested, transported, and handcuffed to a bench by the Andrews International BID Patrol in Hollywood for selling umbrellas on the street. At least it appears that this horror show is over, although I wouldn’t be surprised if there are even more loopholes and it’s not over at all.
Until the November election of Donald Trump and his subsequent threats to deport essentially anyone, U.S. citizen or not, who’d ever smiled while thinking of eating a taco spurred the Council into action on at least the small part (small but in no way insignificant) of the plan to decriminalize illegal street vending so that, no matter how much trouble the zillionaires might cause the heladeros, at least they wouldn’t be subject to arrest and subsequent deportation. That bit seemed urgent enough to pass Council outright, and even the anti-vending forces of the zillionaire elite seemed to realize that they were just going to be exposed as the nasty little mean creeps that they are if they fought back on this particular issue. However, the Council put off acting on an actual legalization framework until later.

But recall, as I reported in January, the instructions for the report-back were altered from the original, and quite sensible,1 request for

A process to create special vending districts to be initiated by Council, the Board of Public Works, or petition (with signatures from 20 percent of property owners or businesses in the proposed district), based on legitimate public health, safety and welfare concerns that are unique to specific neighborhoods with special circumstances.

to a request for language

Providing the City Council the ability to opt out of certain streets by Council action.

At that time I didn’t understand yet how this had all taken place, but now I’ve accumulated enough documentary evidence that it’s possible to sketch out a picture. The short version is that in December 2016, Suzanne Holley, at that time acting Executive Director2 of the Schatzian horror show known as the Central City Association of Los Angeles, wrote a letter to the City Council telling them to make the change. This was distributed to the BIDs via the BID Consortium. They all told their pet Councilmembers to change it. It got changed, and all the BIDs rejoiced, some of them quite publicly. The consequences of this are going to be horrific, and whatever street vending framework gets put in place will be DOA. Details and evidence after the break.

Central Avenue Historic BID May Provide Insight Into The Process By Which BIDs Evolved From Whatever They Were Originally Conceived To Be Into Weaponized Shock Troops Of The Zillionaire Real-Estate Power Elite

Sherri Franklin of the Urban Design Center, consultant to the Central Avenue Historic BID, speaks at the November 2, 2016 meeting of the Board of Directors. I apologize for the crappy image quality. I didn’t plan to film.
After I spent some time looking into the Central Avenue Historic BID in the context of potential political goals for the post-approval Venice Beach BID, I thought it would be interesting to learn more about this newborn BID.1 The meetings are held at CD9’s district office at 4301 S. Central,2 so on a very pleasant evening last Thursday, I took the 210 out of Hollywood to MLK and Crenshaw, where I boarded the 705 to Central and Vernon from whence a couple blocks North on Central to watch the Board of Directors conduct their business.3 The meeting was scheduled to start at 5:30, but that evidently included some preliminaries, because when I got there at about 10 to 64 they hadn’t started yet.

Anyway, take a look at the agenda. You can see that they’re talking about the kind of things that one would expect BIDs to talk about from, e.g., reading the Wikipedia page on BIDs,5 like branding and marketing, cleaning the streets, having Halloween events, and so on. And watch this short clip of the meeting.6 That’s Sherri Franklin of the Urban Design Center, the BID consultant, who also seems to be functioning as executive director, talking about some kind of partnership the BID’s working on with Hollywood Community Housing Corporation involving affordable housing at the corner of Central and Jefferson.7

Allan Muhammad, security director for the Central Avenue Historic District BID.
Allan Muhammad, security director for the Central Avenue Historic District BID.
And then you can watch here as BID security director Allan Muhammad introduces his employees, and then they proceed to hand out sample Halloween bags to everyone in the room. They didn’t once discuss custodial arrests, handcuffs, social engineering, mass relocations, self-aggrandizing 5150 holds, or any of the other hard-edged tactics of which the City’s older and ever so much more dangerous BIDs are so enamored. And even though I only got 15 minutes on tape of the 90 minutes I was there8 they didn’t really have anything objectionable to say even during the parts of the meeting I didn’t record. They talked about parking, they talked about their phone bills, they talked about how it was hard for the BID to patronize local businesses because they mostly only accepted cash.9

Could this be what a BID looks like as BIDs were intended to look? Well, the very question is based on a false assumption. And there were foreshadowings of bad news to come. And on the way home, and for the last few days, it’s got me thinking about what BIDs were meant to be,10how BIDs11 evolve under selective pressure, and how it’s probably inevitable that this BID is going to end up like the worst of the Downtown BIDs, the worst of the Hollywood BIDs. The short version is that BIDs probably started out as helpful tools, but as a wise woman once said, “every tool is a weapon if you hold it right.” So turn the page if you’re still interested…

Crime Does Pay At City Hall: Anti-RV Resolution Introduced In Council This Morning At Behest of Media District BID Director Lisa Schechter, Acting in Apparent Violation of Her Post-Employment Lobbying Ban

RVs on Lillian Way between Santa Monica Blvd and Melrose Avenue
RVs on Lillian Way between Santa Monica Blvd and Melrose Avenue
This morning, CD13 Councilmember Mitch O’Farrell introduced a resolution seeking to impose restrictions on parking oversized vehicles in a semi-industrialized sliver of the Hollywood Media District BID located roughly between Cole Avenue and Vine Street west to east and Santa Monica Boulevard and Melrose Avenue north to south. There is a never-ending flow of these seemingly innocuous items in the agendas of our esteemed Council, but I just happen to know an awful lot about the backstory to this one, which is anything but innocuous, actually, and is the subject of today’s post.

The Media District BID is particularly attractive to people living in RVs because it’s industrialized, so no night-time neighbors to annoy, and it’s close to the center of Hollywood. Especially on Lillian Way and its cross streets, Romaine, Willoughby, and Waring, there has been a thriving but quiet community of RV-dwellers for years on end. But the Media District BID hates it. They just can’t deal with it. For instance, see this email chain from March 2015 where Hollywood cop Julie Nony discusses how to get rid of them with erstwhile Media District BID director Steven Whiddon and a bunch of overprivileged proprietors who don’t understand the concept of public space. But, probably not surprisingly, Steven Whiddon was unable to orchestrate any lasting action.

RVs on Lillian Way between Santa Monica Blvd and Melrose Avenue

So enter Lisa Schechter, employed by erstwhile CD4 rep Tom LaBonge until June 30, 2015. Sometime between then and October 2015 she was hired by the Media District to replace the departed but unlamented Whiddon. Very soon after that, in fact on November 5, 2015, Schechter and current Media District Board President Laurie Goldman met with O’Farrell’s Hollywood Field Deputy, Daniel Halden. Dan was kind enough to supply me with a copy of his notes from that meeting, wherein (on the second page) one can read the portentous words: “Oversized vehicles Resolution — MAP.” There’s no question that this meeting between Halden, Goldman, and Schechter, is the genesis of the resolution introduced this morning by Mitch O’Farrell.

Senior Lead Hollywood Cop Julie Nony on the Psychology of Homelessness and its Discontents: “The homeless are a lot like kids in a way” and LAPD Interactions with them “might seem strange and ugly at first.”

Julie Nony and Andrews International security boss Steve Seyler during happier times.
Julie Nony and Andrews International security boss Steve Seyler during happier times.
Those are actual quotes in the headline. They come from this email chain between bunches of people in the Media District BID, LAPD Hollywood Division Senior Lead Officer Julie Nony, and Dan Halden of CD13. Here’s more of the context, but you’ll have to read the whole thing to believe it. Chie Kobayashi, of yet another incomprehensible new media post-production outfit on Lillian Way between Santa Monica Blvd. and Melrose, wrote to Julie to complain in detail about homeless people. Julie wrote back:

We really need to get every business on the same page so this doesn’t continue to happen. It might seem strange and ugly at first but if you are new to the area and don’t know how things operate, this can get really out of hand. I will be out for the rest of the week, so I can not personally be there. Please call our front desk number if you should need to have a police unit come out (213-972-2971/2972/2973).

And of course call the B.I.D. first to see if they can handle it. The homeless are a lot like kids in a way. If we warn them and there is no follow through (like we did with the encampment) then they will test us and do what they can get away with. I would like to have a meeting with you, Vince Clothing, Red Studios, Milk, School PD, B.I.D., Vine Street Elementary and your neighbors just north of you. And whoever else you can think of. Lets [sic] all get together and share in the responsibility of keeping this area clean. Thank you!

Julie

We’re not sure where to start with this. We might note that it’s probably true that if kids get warned and there’s no follow through then they’ll test limits. But it’s not true because they’re kids, it’s true because they’re human. The instinct for testing limits is responsible for all human progress and is necessary for human survival.1 We might note that if your methods seem “strange and ugly at first…if you are new to the area” then there’s a reasonable chance that they are in fact strange and ugly. And their methods are very strange and very ugly. We’re not even new to the area and we think they’re strange and ugly. Some of us have grandparents who moved to Hollywood in 1908. Some of us have spent more than half a century in and around Hollywood. And yet we think the methods Julie’s talking about are strange and ugly.

The email reproduced above was in response to the following from Chie Kobayashi:

Kerry Morrison: I’m Not a Social Scientist, but I Play One on the Imaginary Television in my Head. Also, HPOA’s Own Survey finds that Hollywood Homeless Drink Significantly Less than General US Population!

People often ask us what the hardest thing about writing this blog is. It’s not pestering unwilling politicos for documents the publication of which will, if such a thing were possible, shame them before the world. It’s not attending and filming the public meetings of the BIDs and watching angry white people spitting and hissing at the world they think has done them so very wrong. It’s not thinking of nasty things to say about them. Lord, it’s not even resisting the temptation to say all the very, very nasty things we think of when confronted with them.
A picture of some ostensibly homeless people's tents on Homewood Avenue between Ivar and Vine Street, used by Kerry Morrison to illustrate a recent blog post on homelessness in Hollywood.

No, none of these. Right at this very moment, the hardest thing about writing this blog is stopping ourselves, all three of us, from running out onto the street, grabbing random people by the collar, and forcing them to read Kerry Morrison’s latest blog post on Hollywood homeless people, to subsequently acknowledge just how completely freaking batshit insane it is, and finally to join us in drinking ourselves rapidly into a stupor sufficiently deep to erase the last traces of this febrile outpouring of dangerous delusions from our long-suffering minds. We’re not doing any of that because we’re writing this essay instead, but we make neither promises nor representations concerning what we might do when we’re done with it.

Anyway, as usual, we’re going to mock this nonsense one piece at a time, with Kerry’s words in blue. The links are Kerry’s.

Full fathom five thy father lies; Of his bones are coral made; Those are pearls that were his eyes; Nothing of him that doth fade, But doth suffer a sea-change Into something rich and strange. Sea-nymphs hourly ring his knell: Ding-dong. Hark! now I hear them — Ding-dong, bell.

As we inch toward Labor Day, I realize that this summer will be characterized by the one issue that has dominated my attention: the increased evidence of homelessness in our city. Every day has involved phone calls with stakeholders, ad-hoc community meetings, or city and coalition task forces evaluating the factors at work and the solutions in play. So many people have suggested that we are in the midst of a new trend – a sea change of sorts – because what we are seeing does not resemble the face of homelessness five or ten years ago.

We’ll give her the first sentence. It’s even possible that it’s true that complaints about homeless people have dominated her attention. We’ll even give her the tacit condescension of a link to Wiktionary paired with the awkward little “of sorts” surrounding Ariel’s beautiful and much abused notion of a sea change. But pay close attention to her claim that what we are seeing does not resemble the face of homelessness five or ten years ago. Surely we’re going to see some evidence for this!
