Background: You can read my previous stories on the Skid Row Neighborhood Council formation effort and also see Gale Holland’s article in the Times for a more mainstream perspective.

Scott Gray of major Skid Row property owner Capital Foresight, likely behind-the-curtain string-puller for the covert anti-SRNC lobbying campaign, was famously quoted in the Downtown News in March 2017 with respect to the Skid Row Neighborhood Council formation effort to the effect that:

…the pending proposal to divide Downtown Los Angeles into separate geographic districts will have significant fiscal and far-reaching economic impact on the entire city

Anyone who attends to the shady world of Los Angeles real estate development can easily imagine in the abstract the kinds of things Scott Gray means, but there has hitherto been very little specific information about what he was talking about.

It turns out that in November 2016 Blair Besten’s megadeveloper bosses at the Historic Core BID had their heavy artillery aimed at Skid Row and had begun soliciting the usual array of sleazy under-table giveaways, such as tax abatements, relaxed zoning, and so on. It’s no surprise at all, then, that when the Skid Row Neighborhood Council Formation Committee’s proposal was approved by the Department of Neighborhood Empowerment in January 2017 they flipped out to the astonishing degree that they did. More than 200 MB Of New Hand-Scanned Documents From Figueroa Corridor BID and North Hollywood BID, Heavily Redacted For No Discernable Reason, But Interesting Nevertheless!

For the last few months I’ve been posting a lot of records from:

But I haven’t discussed the fact that these releases weren’t complete. In each case, Aaron Aulenta of Urban Place Consulting, who seems to be in charge of both of these BIDs, claimed numerous exemptions to the Public Record Act and told me that there was a bunch of material that he was printing out and redacting by hand on the basis of these exemptions.

Well, for various reasons I wasn’t able to get over to the offices of the FCBID to look at this stuff until Tuesday. Aaron Aulenta was kind enough to let me scan it instead of paying the usual outrageous copying fees that BIDdies habitually claim to be allowed to collect, and, after some minimal processing, I’m pleased to announce that it’s now available on Archive.Org. There’s some pretty interesting stuff in there, but it turns out that in this case the most interesting stuff is what’s not in there.

That is to say, the most interesting aspect of this release is what Aaron Aulenta thought that he was justified in redacting. Perhaps you recall that the California Public Records Act only allows for material to be redacted or withheld if one or more of the explicit enumerated exemptions to be found in the statute applies. There’s one exception to this principle, to be found in the infamous §6255(a), which states:

The agency shall justify withholding any record by demonstrating that the record in question is exempt under express provisions of this chapter or that on the facts of the particular case the public interest served by not disclosing the record clearly outweighs the public interest served by disclosure of the record.

As you can imagine, BIDdies¹ freaking love this last bit. It’s the most abused section of the law, with BIDdies, stoned out of their minds on white privilege and steeped in their delusional² theory that laws are written and enforced for no better reason than to preserve and augment their power and wealth, claiming randomly that pretty much any piece of information they feel might embarrass them or their lackeys is exempt under this so-called public interest exemption.

For your future reference, there are at least two dispositive signs that this clause is being misused. First, they will refuse to state what public interest they feel is clearly being served by their withholding of the information. You’ll note that the law requires them to make this judgment on the particular facts of the case, which do not, can not, include a vague wave of the hand towards a claim of “I don’t heart that.”

Second, they will state semantically empty summary phrases which purport to refer to actual exemptions but, in fact, do not. Aaron Aulenta’s favorite of these seems to be “the benefit does not outweigh the burden.” It’s not exactly clear what the hell he’s thinking when he says this, and getting my hands on all these redacted documents has made it less rather than more clear, as you will see from the specific examples to be found after the break.

Greetings, friends! If you’ve been wondering what you were going to do this morning after finishing off the Times crossword¹ here are a bunch of new public records for your reading pleasure. There’s no single document here that’s mind-blowingly important, but, as I have mentioned many and many a time, we all are strong believers around here in the Mosaic Theory of Intelligence Gathering, and these are just more puzzle pieces, some of them quite important qua puzzle pieces!²

Assorted Fashion District Emails 2017 — These are emails to/from people at the Fashion District BID and various other correspondents. There are no real blockbusters here compared to, e.g., last month’s momentous release of Skid Row Neighborhood Council emails, but there is some interesting stuff. Perhaps most interesting is this set, which includes a bunch of conspiratorial nonsense from the Central City Association as well as a detailed report-out from the BID’s Board retreat in March. This latter document will certainly turn out to be essential in at least one project I’m pursuing in relation to lobbying by BIDs, a sadly and almost surely illegally unregulated activity.
Fashion District Transactions February through April 2017 — More transaction reports. These are essential in ways that are hard to predict in advance. The big surprise here is that the Fashion District has recently spent $1647³ consulting with downtown legal beagles Bradley & Gmelich, the same law firm that the criminal conspiracy known as the South Park BID seems recently to have hired to (mis)handle its CPRA affairs and practices.⁴

Here’s a brief summary of the background: Late last year, on the basis of my complaint to the Police Commission, the City of LA resumed enforcement of LAMC 52.34 against BID security forces.¹ Since then I’ve been tracking the progress of this massive project via various CPRA requests. In November 2016 the Police Commission informed all BIDs of the registration requirement. In December 2017 the Police Commission told the BIDs to quit whining and comply with the law.

Yesterday, after numerous failed attempts on her part,² Suzanne Holley of Carol Schatzie’s baby-doll of a Downtown Center BID, sent me a bunch of emails between her staff and the LAPD. You can get all of these at Archive.Org in various useful formats.³ Amongst these was yet another copy of Eugene Shin’s email to all BIDs directing them to get their security patrols registered with the Police Commission.

But much more interesting than that was DCBID Executive Directrix Suzanne Holley’s response, sent precisely 59 minutes later, informing Eugene Shin that…well, I’ll let Suzanne Holley tell you in her own words, right after the break!

Yesterday evening, BID-lawyer-to-the-stars Jeffrey Charles Briggs passed along almost 200 emails between Media District BID executive director Lisa Schechter and various people at the City of Los Angeles. These are available en masse at Archive.Org. As always, there’s a lot of chaff in there and a few super-interesting things.¹ Perhaps today’s story is an example of the latter.

It began on February 28, when Rita Moreno, newly of the Neighborhood and Business Improvement Division of the City Clerk’s office, the unit that’s meant to oversee the operations of BIDs and make sure that they follow the law and stuff, emailed a bunch of BIDdies to introduce herself and note that only a few of them had their meeting times posted on their websites. Of course, the Brown Act explicitly requires BIDs to notice their meetings on their websites,² but that’s actually not why Rita was on about this. She was just trying to find out when they met so that she could attend. In fact, it’s not even clear that Rita Moreno knew about the Brown Act requirement.

However, the very next day, our old friend Lisa Schechter of the Hollywood Media District BID, who is not generally known for her law-abiding behavior but who has by now been educated by years of our intense scrutiny to the point where, I hope, she’s beginning to realize that it’s just easier to follow the law,³ wrote back to Rita Moreno, fishing for praise from this unlikely authority figure:

Dear Rita:

Just to reiterate, all of our meetings are posted in accordance with the Brown Act (Committee as well as Board) – Further you have been placed on our automatic distribution list which triggers and [sic] email directly to you for all of our meetings. If you should require any further information please do not hesitate to contact myself or our operations manager, Jim Omahen.

And, a couple hours later, Rita Moreno replied:

Yes…you got a star ★

And if you’re new to BID studies, you’re probably wondering why this puerile exchange is not just idiotic, sycophantic, and moronic, but also deeply offensive and discouraging to anyone who cares about the rule of law in Los Angeles. Well, read on!

So much new material to announce!

Emails from Fashion District BID about Skid Row Neighborhood Council — This is clearly the most important item I have to announce today so I’m putting it first. If you’re interested at all in how the Downtown zillionaire elite crushed the SRNC formation effort you’ll want to read this stuff. There is what appears to be new evidence about the identities of the people behind the infamous United Downtown LA front group that hired Rocky Delgadillo to write a demand letter to City Council over the SRNC, although there’s still no smoking gun. I will be writing more about this material, but it may take a few days, and I wanted to get it before you as quickly as possible.
Figueroa Corridor BID emails — Between the BID and the City of LA, also USC, also Securitas. Various time ranges.
North Hollywood BID emails — City of LA and their security provider. Various date ranges.
Figueroa Corridor BID tax forms — From 2013 through 2015. It’s interesting to learn here that the Figueroa Corridor BID has been “IN THE PROCESS OF DEVELOPING A CONFLICT OF INTEREST POLICY, WHISTLEBLOWER POLICY, AND DOCUMENT RETENTION AND DESTRUCTION POLICY.” at least since 2013, with no sign of actually producing anything. Ah, sigh.
North Hollywood BID tax forms — From 2013 through 2015. It’s interesting to learn here that this BID and the Figueroa Corridor BID, both of which are administered by our old friends at Urban Place Consulting, turns in copypasta from the FCBID on their tax forms. Just for instance, they too have been “IN THE PROCESS OF DEVELOPING A CONFLICT OF INTEREST POLICY, WHISTLEBLOWER POLICY, AND DOCUMENT RETENTION AND DESTRUCTION POLICY.” at least since 2013, with no sign of actually producing anything.

This is just a super-quick note to provide you with a copy of an email that Mitch O’Farrell sent out this morning from his mitch@mitchofarrell2017.com email account doubling down on his recent endorsement of upstart hippy bike-rider CD1 candidate Joe Bray-Ali, who is benefitting mightily, it seems, from the under-the-bus-throwing behavior to which his opponent, incumbent Gil Cedillo, has been subjected by the zillionaire elite of Los Angeles.

Just yesterday, Mr. Don Duckworth of the Westchester Town Center BID sent me a big steaming heap of emails, comprising the BID’s correspondence with the City of Los Angeles for 2016.¹ I am here to tell you, there is a ton of good stuff in there! This is very, very exciting! I will be writing about items from this release for a good while to come, and the City Ethics Commission is going to be hearing about a whole lot of it as well! But this evening, in addition to this general announcement that the material is available, I want to share a gossipy little item from January 2016, which has its locus classicus right here in this email from Don Duckworth to Miranda Paster.

It seems that WTCBID Boss Man Duckworth wasn’t too happy with BID Analyst Rick Scott, felt that he “approaches me and our work in administering the Westchester Town Center BID in a very negative manner.” In fact, sez Le Duckworth, “[i]t’s as if he’s looking for problems or obstacles to create that interfere with a constructive work flow.” Not only that, but, according to the Donald, “[h]e doesn’t approach our work with recommended solutions for mutual gain or a sense of team work.”

And what’s Don Duckworth’s recommended solution to this negativity and problem-slash-obstacle-seeking behaviour? Why, “[i]f it is possible to request a BID Analyst transfer to Eugene, I would like to do so.” Of course, “Eugene” is Eugene Van Cise, famous in these parts for having ridden his bike around the Gateway to LA BID inspecting their litter. No wonder Don Duckworth likes him better than Rick Scott who, as far as we know, does not do two-wheeled litter inspections of his BIDs. I just recently received a few hundred pages of emails from Estela Lopez, voodoo queen of the Central City East Association, and they are available on Archive.Org and also directly from static storage. Most of it is the unmitigatedly tedious bullshit with which these BIDdies fill their lives and their inboxes, but, as usual, there are a few interesting items. I already wrote the other day about Estela Lopez’s aggressive foray into CPRAlandia, and here are a few other items that are worth looking at individually:

Estela Lopez flirting with LAPD Sgt. Michael Flanagan — by calling him “Sarge.” Doesn’t it just make your knees etc. go all ooshly-gooshly when badge-BIDdies call cops by overly familiar swackety-swickety-nackety-nicknames? Our beloved Ms. Kerry Morrison is famous for this. Something about heavily armed protectors of the property rights of zillionaires brings it out of them, I guess.
Batty little fusspot Blair Besten to E. Lopez on a recent CPRA decision — by the California Supreme Court making it very clear that public records on private devices are still public records. I’m glad to see Blair Besten is keeping up with the laws on public records. If only she would start following the laws as well as keeping up with them! Note also how she doesn’t need to explain to Estela why she’s sending this information. She’s sending it because of me.
A long discussion between E. Lopez, General Jeff — and Mike Fong of DONE about meeting locations for the Skid Row Neighborhood Council thing, with Estela Lopez demonstrating her characteristically poker-faced ice-water-veined terroristic civility. New Documents: Lisa Trifiletti and Omar Pulido Emails, Wilshire Center BID And East Hollywood BID Emails To/From City Of LA From February 2017

This is just a short note to announce three new sets of documents for your entertainment, your edification, and, if you’re interested, a little puzzle for you to solve.

First we have a couple of monthly sets of emails between BIDs and the City of Los Angeles. This turns out to be a useful request for keeping finger on pulse, often leading to unexpected discoveries, so I make it every month of all my favorite BIDs.¹ Perhaps there are some lurking here:

Emails between the Wilshire Center BID and the City of LA — February 2017. I haven’t looked through these in detail yet.
Emails between the East Hollywood BID and the City of LA — February 2017. There’s at least one gem in here, which I’m going to write about later this morning. But lately everything about this BID is interesting.
