On October 10, 2020, LAPD Chief Michel Moore sent an email to a bunch of police luminaries with the subject line CM Marqueece Harris-Dawson Tweet – Ridiculous. The outline is in the headline and the full text is below. But first, is anyone still wondering who actually runs this City?

After the City Council choosing layoffs and furloughs over even freezing LAPD’s budget, let alone reducing it? After seeing police officers surround and intimidate CD 7 rep Monica Rodriguez? After the LAPPL’s disingenuous attacks on CD11 rep Mike Bonin?

If so, they won’t be wondering after reading Michel Moore tell more than twenty five of his subordinates that he “expect[s] better” from Councilmember Harris-Dawson, that he’s “committed to holding [politicians] accountable,” that after their conversation Harris-Dawson had the “ridiculous” tweet, apparently neither written nor approved by him, deleted and replaced “with a positive and supportive message.” Here’s a transcription of the email:

Council District 8 Rep Marqueece Harris-Dawson Has A Private Gmail Account That He Uses To Conduct City Business — And His Chief Of Staff Solomon Rivera Uses City Resources To Arrange For Harris-Dawson To Purchase Rams Tickets — Straight From Joe Furin — The General Manager Of The Coliseum — And A Bunch Of Other Interesting Emails From CD8!

Council District 8 representative Marqueece Harris-Dawson has a private Gmail account at mharrisdawson@gmail.com that he uses to conduct official business. In this practice he is, sadly, not at all alone. Earlier investigations have revealed that at least four other City Councilmembers and one high-ranking LAPD officer use private email addresses in this way:

I learned about this from this June 2016 email conversation between Harris-Dawson’s chief of staff Solomon Rivera, his senior field deputy for Baldwin Hills and surrounding areas Dina Andrews,1 and Harris-Dawson himself at the Gmail address. This email, by the way, is part of a small but juicy set I got today from Rivera. You can browse the whole thing here on Archive.Org.

The subject matter of this particular email isn’t that interesting.2 It has to do with former actor Bennett Liss trying to get Harris-Dawson to be interviewed for a documentary directed by Liss’s son about how to cure homelessness by selling the backs of freeway signs for advertising.3 But what is of the utmost interest, of course, is that Andrews doesn’t use an lacity.org email address to communicate with Harris-Dawson. Instead she uses his Gmail address.

The use of private email addresses by public officials is a shameful and secretive practice, and ought to be, if it isn’t already, illegal. Fortunately the 2017 California Supreme Court opinion in City of San Jose v. Superior Court held that such emails were public records, no matter what kind of account they’re in or device they’re on,4 but in order to apply that holding it’s necessary to find the accounts in the first place. I have found a bunch of them, but it’s painful and time-consuming work.

Bunches of creepy Trumpian fascists are rightly and regularly criticized in the national press for exactly the same practice, and yet, at least so far, this is a complete nonstory in Los Angeles.5 And this is far from the only interesting item in this set. Just for instance, there’s a conversation between Rivera and Joe Furin, general manager of the Coliseum, and Sherry Caldwell, the Coliseum’s director of ticketing, trying to arrange for a pair of Rams tickets for Harris-Dawson to purchase at $255 each. Oh, and after all the talk, Harris-Dawson doesn’t even end up wanting the tickets!

The University of Southern California calls its security guards the Department of Public Safety. It seems to be not so widely known that, with the explicit consent of the City of Los Angeles, USC security operates on public streets in a huge area surrounding the campus. And as you might expect from a troublesome and troubled institution such as USC their policing is both troublesome and troubled. It’s demonstrably racist and demonstrably outside the bounds of what the law allows them to do as security guards. And if you still don’t believe that USC DPS is out of control, watch this video of Los Angeles City Councilmember Marqueece Harris-Dawson responding to a constituent concerned about their racist policing by revealing his own personal experiences with their racial profiling. There is, of course, a transcription after the break.1

And this revelation raises a really serious question. If even Marqueece Harris-Dawson gets treated like an “undesirable” by USC DPS, why hasn’t the City of Los Angeles done something to stop them? Why hasn’t Marqueece Harris-Dawson done something to stop them? The logistics wouldn’t be hard. What’s hard is finding political support for a solution.

The City of Los Angeles is deeply invested in the racist policies of its own police force, so how are they going to expend political capital shutting down the racist policies of their little partners at USC? USC DPS is furthering the goals of the City of Los Angeles as implemented by LAPD.

And whether out of deference to his colleague at CD9, Curren Price, in whose district USC situates, or out of respect for the wants and needs of the zillionaires who eventually come to control every council office, Harris-Dawson has made his choice to do nothing. It may not be possible to explain, but it’s so commonplace a situation in LA politics that it doesn’t really need explanation.

For about two months now I’ve been looking into the practice of Twitter users being blocked or muted by official City of Los Angeles accounts. I’m still gathering evidence, but yesterday it came out that Police Commission president Steve Soboroff blocks a bunch of users who’ve never even interacted with him, so I thought it’d be timely to write up the information I have so far. This issue is of special interest in these latter days given that in 2018 a federal judge ruled that it is unconstitutional for Donald Trump to block users on Twitter.

What I can offer you today, friends, is Twitter block/mute information for eleven of the fifteen council districts, the City Attorney, the Mayor, and a small selection of official LAPD accounts.1 There’s also an interesting line of hypothetical bullshit from deputy city attorney Strefan Fauble2 about some pretty technical claims about CPRA exemptionism,3 but that, being übernerdlich, is way at the end of the post.

Most of the accounts blocked are porn or spam, but Jose Huizar and David Ryu are notable exceptions. Both reps block accounts that are obviously controlled by actual individual people. Huizar’s list is by far the most extensive, and includes wildly inappropriate blocks like @oscartaracena and @BHJesse.

A Motion In City Council Asks The HHH Citizens’ Oversight Committee To Recommend Ways To Speed Up Development Of Housing For The Homeless, Creating An Unacknowledged But Not Unexpected Conflict Of Interest For Members Kerry Morrison And Blair Besten, Whose Salaries Are Paid By Real Estate Developers For The Express Purpose Of Advocating For Their Interests With The City

In November 2016 the voters of Los Angeles approved Measure HHH, which provided a huge amount of funding for housing homeless people. The measure also created a Citizens’ Oversight Committee, putatively for the purpose of making sure the money was well-spent. Subsequently, Eric Garcetti appointed Hollywood BIDdie and famous mayoral pookie-pie Kerry Morrison and some other people to the Committee and the City Council appointed Downtown BIDdie and famous José Huizar pookie-pie Blair Besten to the Committee.

These appointments meant that 2 of 7 committee members work for business improvement districts,1 which was bad enough in itself given that one of the main purposes of BIDs is to banish the homeless from their districts and to basically waste public money in the form of their assessments while doing that. But on Wednesday matters got immeasurably worse.

What happened is that Marqueece Harris-Dawson and Mitchell Englander introduced a motion proposing to expand the remit of the CoC to include making

comprehensive recommendations to the Homelessness and Poverty Committee regarding changes to the permanent supportive housing process and funding structure to enable a more expedited delivery of homeless housing.

That is, the Committee is now charged with weakening the funding process and the permitting and building approval process for projects that will help house the homeless. This sounds superficially like a good thing, but there’s at least one huge problem with it. Blair Besten’s employers, Kerry Morrison’s employers, are huge commercial property owners and developers and weakened processes are their bread and butter. They know exactly how to turn weakened processes into strengthened profit margins.

At least some of them, e.g. Ruben Islas, make immense amounts of money from building and owning housing for the homeless. Blair Besten has lobbied the City intensively on relaxing zoning codes and on granting psychotically expansive tax breaks to such developers. This new proposal, therefore, would grant Blair Besten and Kerry Morrison the power to make recommendations directly to City Council on issues that they are already paid by developers and property owners to lobby the City over.

Housing Committee Hears Cedillo/Harris-Dawson Just Cause Eviction Motion, Public Comments From Opposition Continue To Make No Damn Sense Whatsoever, Motion Scheduled For Full Council On June 28

This is just a short (very late, sorry) report on the progress of the Cedillo/Harris-Dawson motion (found in CF 17-0454) to extend the same protections against arbitrary evictions granted to tenants in buildings covered by the Rent Stabilization Ordinance to all tenants in the City. The motion was heard by the Housing Committee at its June 21 meeting. A report was approved (transcription after the break) and sent to the full Council, where it is on the calendar for June 28.1 The motion instructs HCIDLA to report back to the Council on the feasibility of preparing an ordinance. It looks like it’s headed for passage, and it looks like Cedillo is pushing it hard, but there’s a lot to be done before we have a law in place.

Anyway, I downloaded the audio of the meeting from the City and put it up on Archive.Org if you’re interested. This item starts at 1:28:58.2 It’s definitely worth a listen. Both Cedillo and Harris-Dawson are actually willing to argue with the opposing comment-makers, which is refreshing behavior from our Council, and they don’t seem willing to compromise about this ordinance, which bodes well for its success.3 In particular, Gil Cedillo repeatedly makes the point that it makes no sense at all to have one level of protection for poorer tenants in RSO buildings and another, weaker level for tenants in non-RSO buildings.

Meanwhile, it’s instructive to listen to the opposing public comments, if only to understand the class rage and the sense of entitlement of the property-owning classes in Los Angeles. They’re so used to getting their way that they don’t seem to even feel like their arguments have to make sense. Just for instance, listen to this comment by Valley landlord and former bandleader Horace Heidt, Jr. (transcription after the break). His argument seems to be that if they’re required to have reasons for evicting tenants, the construction of new units will halt completely. It’s not the worst comment, it’s not the meanest comment, but it’s unique in that he makes no attempt whatsoever to connect the two propositions. Why would this happen? Being a zillionaire, it seems, means never having to explain what the heck you’re talking about.

Gil Cedillo and Marqueece Harris-Dawson Introduce Measure To Prohibit Evictions Of Renters In Non-Stabilized Units Except For Just Cause As Defined In The RSO

This story is way off my beat, but it’s interesting and I haven’t seen it covered anywhere else, so I thought I’d write a short note about it.1 On April 19, Gil Cedillo and Marqueece Harris-Dawson initiated Council File 17-0454 with this motion, which instructs HCIDLA to recommend to the Council an ordinance which would prohibit landlords from evicting tenants in units NOT subject to the Rent Stabilization Ordinance without “just cause.”2

Just cause would be defined as it is in the RSO, which at §151.09 gives a list of 14 allowable reasons for eviction. Laws like this are being adopted throughout the Bay Area, and the motion instructs HCIDLA to ask cities up there how they’re doing it.

This ordinance won’t solve everything, and of course there are some loopholes, most notably in paragraph 10, which essentially duplicates the much-abused, much-reviled Ellis Act, allowing evictions in case the owner is going to demolish the structure or remove it from the rental market. But nothing’s perfect, and a law like this would be far, far better than nothing. It will be interesting to see what kind of pushback the zillionaires apply. My guess is that it’s too politically harmful for them to come out explicitly against it, so they’ll support it and rely on loopholes and an always-sympathetic City government to be sure that it won’t actually apply to them at all.

Revealed: The Actual Technical Means By Which José Huizar, Who By The Way Is A Liar And A Deceptive Sneaky Little Creep, Destroyed The Skid Row Neighborhood Council Formation Effort, Quite Possibly At The Behest Of Michael Delijani, Whose Family Has Given José Huizar $25,000 Over The Years




When I first started working on this post, I meant it to be a typical humorous take on a comment that Grayce Liu made at the March 20 meeting of the Board of Neighborhood Commissioners, much like the nonsense I wrote the other day.

But in preparation for mocking the arrogant rich white supremacists who turned out at every meeting about the SRNC to bumble their whiny way through their idiotic decontextualized lies about “outreach” and “voter participation” and “united Downtown” and fucking “inadequate notification,” I listened to a recording of the March 22 meeting of the Rules and Elections Committee, which sickened me to the point that I lost any taste for making jokes about any of this.1 Huizar’s behavior is not funny, and I’m in no state of mind to make fun.2 He is a horrible person.3

In particular, here’s what I learned. Much of this information has been published before, but as far as I can tell, not all of it has:

  • Huizar decided to change the rules for the SRNC formation election to allow online voting. The change took place merely two weeks before voting began, even though he almost certainly had his mind made up weeks if not months earlier. If he had implemented the decision when he had made it at least there would have been time for the SRNC proponents to address this dispositive change in the rules.
  • He did this in the face of explicit testimony that online voting would disadvantage homeless people, who have extremely limited internet access. Even worse, he knew that the online voting system to be used by the Department of Neighborhood Empowerment would preregister more than 1000 DLANC and HCNC voters from 2016, thereby overwhelming any online voters that the SRNC-FC might manage to register in two weeks and thus dooming any SRNC-FC online registration effort to irrelevance.
  • Huizar made this change unilaterally. It’s true that it was passed by the Rules and Elections Committee and then by the full Council, but if you listen to the recording.4 You will hear Huizar reading out his proposal and Herb Wesson pronouncing it adopted with neither discussion nor a vote.
  • Huizar ignored all the warnings he heard against allowing online voting with respect to the SRNC, but he took them all into account for other NC elections by stating explicitly that SRNC would be the only election to use online voting until further notice. This proves yet again that as far as the City of Los Angeles is concerned, rules do not apply to poor people. They’re not usually this overt about it, though.
  • Somehow Huizar allowed multiple polling locations distributed widely in both space and time. He did this in the face of Grayce Liu’s explicit statement that one polling place open for four hours is absolutely standard in NC elections. Again, Huizar unilaterally changed the rules for Skid Row.

The Story Of How The Central City East Association Evidently Violated City Ethics Laws Restricting Campaign Contributions, Gave Illegally To Mitch O’Farrell and Marqueece Harris-Dawson In 2015, Lied About It On Their Tax Form, And I Turned Them In To The IRS And The Ethics Commission

CCEA: The truth may be out there but it’s not out there on our tax forms.
This story begins with the fact that the Central City East Association, which runs the infamous Downtown Industrial District BID, contributed $700 each to two City Council candidate campaigns in 2015. The money was given to Mitch O’Farrell of CD13 and Marqueece Harris-Dawson of CD8. You can see the record at the City Ethics Commission and also if it’s more convenient, here is a PDF of the same information.

This turns out to be a huge problem for a number of unrelated reasons. First and most simply, the CCEA is a nonprofit 501(c)(6) organization. Unlike the more famous 501(c)(3) organizations, 501(c)(6) groups are allowed to engage in lobbying, but it’s unclear whether they’re allowed to support candidates for office.1 However, irrespective of any restrictions on donations, there are very clear reporting requirements.

Take a look at the CCEA’s 2015 tax form. In particular, take a look at question 3 of part IV, found on page 3 of the form. It asks unambiguously:

Did the organization engage in direct or indirect political campaign activities on behalf of or in opposition to candidates for public office?

And, as you can see in the image that appears somewhere near this paragraph, the CCEA unambiguously stated that they did not. It’s hard to imagine a less ambiguous form of direct political campaign activities than giving actual money, amirite? Hence I turned them in to the IRS and also to the Franchise Tax Board for this lacuna. Stay tuned in case anything happens!
