I just recently received a few hundred pages of emails from Estela Lopez, voodoo queen of the Central City East Association, and they are available on Archive.Org and also directly from static storage. Most of it is the unmitigatedly tedious bullshit with which these BIDdies fill their lives and their inboxes, but, as usual, there are a few interesting items. February 2, 2017 Email From Eugene Shin Of The LA Police Commission To Nicole Shahenian Of The East Hollywood BID Confirms Continued Progress Of BID Patrol Registration Project But Leaves Unanswered Question Of Whether Or Not The EHBID Has A BID Patrol

You may recall that late last year, on the basis of my complaint to the Police Commission, the City of LA resumed enforcement of LAMC 52.34 against BID security forces.1 Since then it’s been possible to track the progress of this massive project via various CPRA requests. So in November 2016 the Police Commission informed all BIDs of the registration requirement and, at the same time, told them that their BID patrollies would be subject to arrest if they didn’t submit. In December 2017 the Police Commission told the BIDs to quit whining about it because the law is the law.

Well, just yesterday, as part of a larger release of records from the East Hollywood BID, I discovered a February 2017 email from Eugene Shin to Nicole Shahenian. Eugene Shin, as you may recall, is the Police Commission investigator that’s heading up the registration project. Nicole Shahenian is the Executive Director of the East Hollywood BID. The email confirms that not only is registration still ongoing, but that the Police Commission is pursuing it fairly aggressively. Turn the page for a transcription and some discussion.

Simple Error In Propositional Logic Defeats Evil, Illegal Anti-RV Scheming of Mitch O’Farrell, Mike Bonin, and the Hollywood Media District BID But It’s Probably Irrelevant In The Real World Anyway

The sign, located on Lillian Way between Santa Monica Blvd and Melrose, says “and” but it was meant to say “or.” Does this matter in the real world? Probably not.
Last summer, Mitch O’Farrell, at the illegal request of Media District ED Lisa Schechter, supported by anti-RV-crusader-on-steroids Mike Bonin, introduced the despicable Council File 16-0967, seeking to ban oversized vehicle parking in the Media District BID. Of course, the thing passed, because this kind of thing always passes, and the ordinance was approved, and up went the signs.

There was one small problem, though. The ordinance, as do all of these little slabs of class warfare, bans:

…the parking of vehicles that are in excess of 22 feet in length or over seven feet in height, during the hours of 2:00 am and 6.00 am…

For some reason, despite what the ordinance actually passed by City Council says, it is still legal to park things like this in most of the Hollywood Media District.
But the signs, when they went up, said something different.1 They banned vehicles that are in excess of 22 feet in length AND over seven feet in height. See the problem? At first I wondered if this were nothing more than an uncharacteristically lapse into honesty by the class warriors at the BID. Perhaps, I thought, they wanted to keep it legal to live in limousines, even if RVs were to be banned, banned, banned.

Urban Place Consulting Set To Earn $55,712.20 For Dealing With The 2017/2018 Fashion District BID Renewal Process According To Contract, Which May Also Shed Light On The Intersection Between BID Consultancy And L.A.’s Muncipal Lobbying Ordinance

The Fashion District BID in Downtown Los Angeles is set to expire at the end of 2018. This means that they’ll be collecting petitions roughly in the first quarter of 2018 and going to City Council approximately in the Summer of 2018. The process is complicated for property-based BIDs and usually requires a consultant, and the consultant has to start early. The Fashion District is using Urban Place Consulting.1 Work began on the process in January 2017.

Thanks to the competence, kindness, and evident commitment to transparency of the Fashion District BID’s executive director, Rena Masten Leddy,2 we have copies of (at least most of) the FDBID’s contract with UPC3 as well as the first three months worth of invoices. You can get these:

Crucially, the contract reveals that the Fashion District will pay UPC more than $55,000 over the course of the two year process. The contract is supposed to include a schedule of hourly rates and the invoices are supposed to include an hourly breakdown, but, at least so far, they do not.

Apart from the general interest created by the essential role that BID renewal plays in the life cycle of BIDs, this kind of data is also crucial to my ongoing study of the intersection between the BID renewal process in Los Angeles and the Municipal Lobbying Ordinance. The Actual Mechanism By Which Suzanne Holley And The Central City Association Strangled The Incipient Street Vending Ordinance In Its Cradle By Sneaking In Unilateral Councilmember Opt-Out On Behalf Of BIDs, The Role In This Debacle Played By Criminal Conspirators Jessica Borek and Matt Rodriguez, And How The Council Messaged It To BIDs

Recall that I’ve been tracking the hysterical, irrational opposition of LA’s business improvement districts to the ongoing process of legalizing (some aspects of) street vending in the City since the Spring of 2015. A truly astonishing level of bitching and moaning in 2015 stalled out the whole process for most of 2016 because, I believe, everyone was too freaking sick of the whining and the carefully orchestrated lying on any number of occasions and the City just needed a rest.
A man arrested, transported, and handcuffed to a bench by the Andrews International BID Patrol in Hollywood for selling umbrellas on the street. At least it appears that this horror show is over, although I wouldn’t be surprised if there are even more loopholes and it’s not over at all.
Until the November election of Donald Trump and his subsequent threats to deport essentially anyone, U.S. citizen or not, who’d ever smiled while thinking of eating a taco spurred the Council into action on at least the small part (small but in no way insignificant) of the plan to decriminalize illegal street vending so that, no matter how much trouble the zillionaires might cause the heladeros, at least they wouldn’t be subject to arrest and subsequent deportation. That bit seemed urgent enough to pass Council outright, and even the anti-vending forces of the zillionaire elite seemed to realize that they were just going to be exposed as the nasty little mean creeps that they are if they fought back on this particular issue. However, the Council put off acting on an actual legalization framework until later.

But recall, as I reported in January, the instructions for the report-back were altered from the original, and quite sensible,1 request for

A process to create special vending districts to be initiated by Council, the Board of Public Works, or petition (with signatures from 20 percent of property owners or businesses in the proposed district), based on legitimate public health, safety and welfare concerns that are unique to specific neighborhoods with special circumstances.

to a request for language

Providing the City Council the ability to opt out of certain streets by Council action.

At that time I didn’t understand yet how this had all taken place, but now I’ve accumulated enough documentary evidence that it’s possible to sketch out a picture. The short version is that in December 2016, Suzanne Holley, at that time acting Executive Director2 of the Schatzian horror show known as the Central City Association of Los Angeles, wrote a letter to the City Council telling them to make the change. This was distributed to the BIDs via the BID Consortium. They all told their pet Councilmembers to change it. It got changed, and all the BIDs rejoiced, some of them quite publicly. The consequences of this are going to be horrific, and whatever street vending framework gets put in place will be DOA. Details and evidence after the break.

Anxious Rich White Palisadeseans Are Reassured That Mike Bonin Won’t Allow Street Vendors To Besmirch The Lily-White Palisadesean Streets (Except For The Farmers’ Market Cause White People Like Farmers’ Markets) And Also LAPD Advises How To Get Rid Of Scary Fat Nasty Angry Black Homeless Male Man!

When last we peeked into the Minutes of the Board of Directors of the Pacific Palisades BID, we learned that they were all sitting around up there in Northwest Zillionaireville quaking in their super-pricy boots over the influx of gang members from urban Santa Monica. Today, well, there’s the serious matter of street vending to discuss, of course, but first, take a look at the minutes from January 4, 2017, where we learn about this:

Homeless issue – One person is a problem on Via de la Paz lately. He is a 300 lb., male black man with a nasty temper. Officer Moore recommends signing a “Trespass Arrest Authorization” form which was handed out.

Got it? He weights three hundred pounds.1 He’s black. And not only that, he is both male and a man. This is a truly frightening situation! I’m wondering if their trespass authorization form has a place to put the weight of trespassers that the cops are authorized to arrest? The standard form does not, but the LAPD is famous for deploying multiple helicopters to fly against the homeless in the Palisades. Are they going to refuse them a custom anti-homeless trespass form? Especially if they’re being overrun by a horde of three hundred distinct pounds of angry homeless black male man?

I mean, I know you can never be too rich or too thin, but that the Palisadesians are extra-scared of this man because “he is a 300 lb., male black man…” is somewhat unexpected, even though 300 lb. people can certainly “pose to be dangerous.” I would have thought that fear of the homeless would be measured more by the individual than by the pound, but I’m wrong again. Certainly this is why I can’t afford to live in the Palisades amongst the jittery little psychopathic self-interested zillionaire theorists of homelessness. My priorities are obviously really confused.

And if they’re going to pieces to this extent over one “300 lb., male black man,” how are they going to feel about the gracious shimmering snow-white streets of their little village2 being overrun by the herds of dark-skinned heladeros, frutateros, and eloteros that are even now massing at their borders just waiting for the City Council to give them the go-ahead to swarm in and start supplying their victims, the hitherto-uncorrupted-by-Mexican-ice-cream-treats Palisadeseans, with paletas de limón? Not good, I’m telling you that much. But their man on Spring Street, Mike Bonin, is there for them as he always is. Turn the page for details.

Unidentified Business Improvement District Seeks Free CPRA Advice From First Amendment Coalition, Does Not Get Answer They Are Looking For

The First Amendment Coalition is, in their own words,

… an award-winning, nonprofit public interest organization dedicated to advancing free speech, more open and accountable government, and public participation in civic affairs.

and their mission includes the fairly forthright statement that

The Coalition is committed to the principle that government is accountable to the people, and strives through education, public advocacy, litigation, and other efforts to prevent unnecessary government secrecy and to resist censorship of all kinds.

For instance, in furtherance of this mission, the FAC is presently suing the City of Los Angeles over Tom LaBonge’s immoral and idiotic destruction of records from his time as Councilmember. They were also a friend of the court in the recent momentous California Supreme Court decision making the personal email accounts of public officials open to CPRA for material that relates to the public’s business. This is not an organization that anyone sane would expect to be sympathetic to the whiny, entitled, and clueless complaints of a business improvement district that has been asked to comply with its legal obligations under the California Public Records Act, amirite?

One of the most useful services that the FAC provides is called Asked & Answered. People can send in questions about CPRA and the Brown Act and the FAC’s attorneys from Bryan Cave will answer them publicly and for free if they might interest a wider audience. These questions are usually from people frustrated by inane, self-serving, and illegal government obstructionism in the face of CPRA requests. So imagine my surprise when, a few days ago, this little gem of a question appeared:

Q: As a Business Improvement District, we are an agency of our local gov’t and subject to PRAs. I have submitted countless reports, minutes/agendas, financials and even a record of one full year of emails. Now I have been asked to submit the email database I have developed for communicating with my business members.

I am not comfortable giving this database to the public. While I have no problem disclosing my email correspondence, I do not feel right giving my email database to someone who can then send mass emails to these businesses.

Do I have to submit the database if requested through the CPRA?

Well, given the FAC’s general orientation towards CPRA, you can probably imagine the answer, and you can also read it, with some commentary and the usual uninformed speculation, after the break.
