The entrance to the Archives is by the loading dock in the mid-right area of the image.A recent trip to the lovely City Archives on Ramirez Street, my absolute favorite of all city agencies,1 yielded up a bunch of really interesting stuff from 2001–2003. So much so that I started a new page for it. It took me three hours to look through two boxes of BID records (out of more than 400), so I’m sure there will be much more of this stuff to come. There’s a list of some highlights after the break, but check it!
In 2003 the BID’s expiring security contract with Burke Security, the predecessor of Andrews International, was put out for bids. Aaron Epstein, yes, the same one whose nuclear bomb of a lawsuit established the subjection of BIDs to both the Brown Act and the California Public Records Act, thereby making this blog possible, and a large group of his fellow Hollywood BID stakeholders2 sent a letter to then-mayor James Hahn complaining that they:
believe[d] that the District’s board of directors and executive director have not conducted a fully open and competitive process to ensure that property owners receive the finest security service for the lowest competitive price (the current two year contract exceeds $2 million). Moreover, we believe that the board and executive director have failed to be objective in the process and have allowed the contractor, Burke Security, to function in ways that do not provide the maximum benefits to the property owners and merchants.
Even in 2003 the BIDs had captured the regulatory function of the City Clerk’s office to the point where they were warning Kerry Morrison that people were scrutinizing her sketchy behavior rather than using the power of the purse to make her be not so shady. The fox wasn’t guarding the henhouse–the lunatics were (and are) running the asylum.
If you read the letter you’ll see that they’re talking about practices that are still retained by the current BID Patrol: custodial arrests rather than observe-and-report, unseeming over-coziness with the staff of the HPOA, and so on.3 The copy I obtained came with a couple of handwritten notes4 from a Clerk’s office employee suggesting that they warn Kerry Morrison that people were watching so she should follow the rules. This, obviously, is not the kind of behavior one would expect from a regulatory agency. Why didn’t they tell Kerry Morrison to follow the rules because the law required her to? Despite appearances, Ms. Morrison evidently did not throw that pencil at anyone during this meeting.Recall that last month the Hollywood Property Owners Alliance spent a good 40 minutes yammering on about a misbegotten plan of Peter Zarcone’s and Bill Farrar’s to have their armed minions, the BID Patrol, stay out way past everyone’s bed-time in order to put the old kibosh on the herds of outta-control dark-skinned people who, at least in the BIDsies’ fantastically fretful obsessive delusional view of things, occupy the Boulevard on weekend nights. Well, Zarcone got transferred, Steve Seyler backed off the plan, and Kerry Morrison told the Central Hollywood Coalition on March 8: “Yeah…it’s not happening.” A good friend of this blog wrote to Mitch O’Farrell asking him not to pay for this nonsense, and we found out just a couple days ago that as early as February 22, O’Farrell staffers Rodriguez and Halden had concerns about the plan that they took to their boss. We can’t say for sure (yet) what drove the dispositive stake through the heart of Bill Farrar’s vampire baby, but whatever it was, evidently no one explained the full extent of the deadness to John Tronson.

On Thursday, February 18, 2016, the Board of Directors of the Hollywood Property Owners Alliance met. The main topic of conversation was a request from LAPD Captain Peter Zarcone, commanding officer of Hollywood Station, to the BID to arrange for the BID Patrol to work until 4 a.m.1 The idea seems to be that this would relieve the LAPD somewhat. The HPOA has been in conversation with Mitch O’Farrell, who is said to be eager to pay for some or all of this project out of his discretionary funds. There was also a brief mention of plans to deputize the BID Patrol so that they would be able to issue citations. I will be writing much more about this, but I wanted to get it up here soonest, since it ended up taking far longer than I expected to transcribe the discussion, which went on for over forty minutes. Peter Zarcone, the missing link between Mitch O’Farrell’s press conference and the BID meetings where the plot was hatchedWell, the Los Angeles Times reported yesterday that Mitch O’Farrell, accompanied by LAPD Hollywood Boss-o-Rootie Peter Zarcone, gave a press conference out on the Boulevard explaining that nightclubs are really bad and if they break the laws, they’re going to be treated like homeless people and subjected to laser-focused nit-picksy iron-fisted enforcement. And the Weekly reported the same story but with much saucier photographs. O’Farrell even used the motherfricking Q-word:
This culture is diminishing the quality of life for people who live here and we are determined to bring them into compliance or shut them down.
Pro-tip: Whenever anyone ever under any circumstances in any official capacity says the Q-word, not only are they lying, but they’re going to be aiming a gun at you quite soon. Mitch O’Farrell: The BIDs say “hit!” and he says “How hard?”
But none of these news stories reported on why Mitch is doing this and why he’s doing it now. Long-time readers of this blog will recall exactly where we have heard this nonsense before. That is, only at EVERY freaking BID meeting we’ve ever attended. There was the one where they hated on nightclubs cause their clientele is too dark-skinned and poor and the one where they conspired with Zarcone to institute hyper-enforcement in an effort to get liquor licenses pulled and so on. Mitch isn’t cracking down on nightclubs because anyone who lives in Hollywood cares. He didn’t even ask anyone who lives in Hollywood. This is nothing more than the latest delusional scene in the fevered psychodrama of Kerry Morrison’s and John Tronson’s and jittery little psychopath Carol Massie’s neurotic mental relationships with the wrong kind of people having the wrong kind of fun in public in Hollywood. What they’re saying when Mitch O’Farrell’s mouth is moving is that their ideal Hollywood denizens are white people who spend a lot of money quietly and go home in an orderly manner before midnight. Yesterday we began discussing the June 11 meeting in Van Nuys by considering Kerry Morrison’s statement. Today we move on to John Tronson. We’re just going to look at John’s statement one piece at a time.
Good evening. My name is John Tronson. I’m a member of the Hollywood Entertainment District, which is a property-owner based business improvement district in Hollywood.
All these people start off by saying something true. It’s meant to lull your suspicions. Don’t let it. Some people think that because they pay taxes with their own money, the taxes they pay are still their own money after they’re paid. If they start taking this idea too seriously they’re likely to wake up one morning to find a bunch of people wearing this badge while knocking down their door with a battering ram.We spend three and a half million dollars a year of our own money to clean the streets of Hollywood, to trim the trees, to provide additional public safety and paint out graffiti.
The way a property-based BID works is this: If the majority of the property owners in a district agree, the city adds an extra assessment to their property tax, keeps some part of the money raised for administrative overhead, and distributes the rest back to the BID to spend on specific kinds of services in the district. There are two important points to remember. First, a BID can be established over the objection of individual property owners. Only a majority need approve. Second, once a BID is established, the assessment is no longer voluntary. It is compulsory. Non-payment is punishable by the full range of state action2 up to and including violent confiscation of property. In other words, this assessment, once paid, is a tax. After all, income tax might be considered voluntary in this same sense. The Sixteenth Amendment to the Constitution was put in place by elected representatives, so in a way, the people to be taxed consented to the taxation. But now that it’s in place, income tax is no longer voluntary, just as BID assessments are no longer voluntary. This is consistent with the standard definition: Al Capone, yet another guy who confused “taxes” with “his own money” and had to have the distinction explained to him in a fairly forceful manner.Tax: A compulsory contribution to the support of government, levied on persons, property, income, commodities, transactions, etc., now at fixed rates, mostly proportional to the amount on which the contribution is levied.3
Now, everyone who pays taxes has, at one point or another, thought of that money as still their own. But really, it’s not. Try telling a cop not to give you a ticket because you pay their salary with your “own money.” Try telling a professor at UCLA they have to give your kid an A+ because it’s your “own money” that supports them. It’s a losing argument. Taxes, once paid, belong to the public, not to the people who paid them. BID assessments are taxes. BID assessments are public money. Now, as to John’s statement about what they do with that public money, it’s true as far as it goes. That’s not all they spend the money on, but they do spend it on that. We won’t argue. Onward! We’ve written about the HPOA’s scheme to send its agents to public meetings in the ill-concealed guise of concerned citizens opposing the ordinance. Today we report on Kerry Morrison’s recent discussion of her experience orchestrating that whole fiasco. We’ll analyze it line by line, and you can watch the whole thing here and/or read a transcription after the break.
there were a series of four hearings that the chief administrative office staff held on the… the sidewalk vending ordinance. … It’s just this kind of amorphous set of hearings, which were completely dysfunctional, disrespectful, and almost, um, resembled a circus. Kerry’s been on before about this issue, people not treating her agents provocateurs to what she delusorily imagines to be the duly appropriate level of forelock-tugging, although she hits a new high note1 here. We mean, we weren’t at the hearings, but it’s hard to imagine that they were dysfunctional. It’s easier to imagine that perhaps Kerry’s mistaken the purpose. It’s hard to see how a public hearing can be disrespectful without being told towards what or whom it’s disrespectful. Does she mean the hearing was disrespectful towards her minions? What is it that they’ve done to earn anyone’s respect? Perhaps she means something else. And as for the hearings “almost…resembl[ing] a circus,” well, we imagine that’s nothing more than the reaction of someone who has done her illegal best to make sure that the public doesn’t feel welcome at the meetings she’s the boss of to finding out that she’s not the boss of every meeting in Los Angeles and, just possibly, maybe not so welcome at all of them her own self. On the one hand we’re always aghast at the latest stupidity, cupidity, mental rigidity, and white privilegidity on display. On the other hand, we always end up with a bunch of topics about which to write. The Summer 2015 issue is no exception.
As every regular reader of this blog knows by now, the HPOA is hysterically opposed to the legalization of street vending in Los Angeles. They’ve entered into conspiracies with the abhorrent Central City Association to subvert the democratic process through astroturfing and mendacity. And, according to Kerry Morrison, writing in the newsletter: Devin Strecker, Alyssa Van Breene, Kerry Morrison, and a bunch of unindicted co-conspirators
Before an ordinance is drafted, the CLA [Chief Legislative Analyst] staff presided over a series of public hearings to gain input from the community. Staff representing both BIDs, along with board members, attended each of these hearings and expressed the concerns of the business community. However, members of the business community were outnumbered easily 10:1 at these hearings.
Hollywood board member Alyssa Van Breene and staffer Devin Strecker attended the first meeting on May 28 in Boyle Heights. When they tried to share their concerns the audience booed. Though there were no boos or hissing at the second hearing on June 11 in Van Nuys, the audience was unruly and disrespectful to those testifying against the ordinance or speaking on behalf of small business.
A veteran of a foreign war in the process of getting arrested on Hollywood Blvd. by power-hungry BID Patrol officers, putting the lie to John Tronson’s disingenuous, self-serving, mendacious contention that “the LAPD or the BID Patrol, nobody is gonna ask anybody to move who’s just resting for a couple minutes cause they need to rest. “We’ve written previously about John Tronson, who, for whatever reason, is no longer president of the Hollywood Entertainment District BID Board of Directors, and his disingenuous, self-serving, mendacious contention that the state of California has no need for the saintly Senator Carol Liu‘s recently introduced SB608, the Right to Rest Act. According to Tronson:
You know, I mean, it, the, the, the reality, the LAPD or the BID Patrol, nobody is gonna ask anybody to move who’s just resting for a couple minutes cause they need to rest. This is just another vehicle to, you know, allow permanent, facilitate, the living on the sidewalk. Falsus in uno, falsus in omnibus, as the judge will instruct Tronson’s jury at the time when all accounts are settled.
He’s talking, of course, about the despicable LAMC 41.18(d), which prohibits sitting on sidewalks in the absence of a parade and which the Right to Rest Act is meant to send to a well-deserved oblivion. But, you know, perhaps we’re being too harsh on John Tronson. Perhaps it’s really true that the BID Patrol will not arrest people just for sitting on the sidewalk. We mean, the evidence seems to suggest that, on the one hand, they will arrest homeless black people for it but, to be sure, they will not arrest non-homeless, non-black people for it. Here’s the story.
The JSC was, as usual, blethering on about how nightclubs are ruining everything and had pretty much agreed that the problem was lack of enforcement of the terms of liquor licenses. The issue is that type 47 licenses, which require a bona fide food service establishment, are being used as type 48 licenses, which do not require food to be served. Berkeley BID Patrol officer giving a performative demonstration of Homer’s maxim that “the blade itself incites to violence.”The Downtown Berkeley Association is the shell corporation that runs the Downtown Berkeley BID, founded in 2011. By now you’ve probably seen the video, filmed by a brave citizen journalist, of a Berkeley BID Patrol officer1 punching a homeless man over and over and over again because he felt “disrespected” by him. The story made the international press.
Now, Berkeley is far, far off our beat, and, deep down, despite the divers desperate, damp dreams of our local Hollywood BIDs about the gentility and grace of our silicon-addled red-headed stepchildren to the north, we generally find ourselves unable to give even the teensiest shit about what shenanigans they get up to north of Pacoima. However, this case requires comment, shedding some light as it does on the ultimate source of the lies with which we who cover the BIDs are habitually showered.
