A Flurry of Filings in Mitchell et al. v. City of LA et al. Suggests that Homeless Advocates May be Trying to have City Enjoined from Enforcing Newly Amended LAMC 56.11

California-centralMitchell v. Los Angeles, the latest in a series of suits filed by homeless people who’ve had their property illegally confiscated by the City (see Gale Holland’s recent article for an excellent summary) took an interesting turn today, when a flurry of filings hit PACER. First of all, the plaintiffs asked the court for a preliminary injunction and a temporary restraining order enjoining the City from confiscating their property while the case is on. They filed a huge number of declarations and other evidence in support of this application, many although not all of which can be found on our page dedicated to the case. The City asked for extra time to respond and the court granted them some.

The Hollywood BID Patrol’s Intransigence on Transience Provides Yet Another Performative Demonstration of David Graeber’s Theory of Violence, Stupidity, and Interpretive Labor

An astounding number of BID Patrol officers on Ivar Avenue by the library, June 30, 2015, milling around not being charged criminally for degrading everyone's quality of life by, through their open display of guns, passively threatening to kill anyone who disobeys them.
An astounding number of BID Patrol officers on Ivar Avenue by the library, June 30, 2015, milling around not being charged criminally for degrading everyone’s quality of life by openly displaying their guns and their self-evident willingness to use them, thus creating the imminent fear that they’ll kill anyone who disobeys them.
Watch here for the final bit of a Hollywood BID Patrol operation on Ivar Avenue on June 30, 2015. There are about 12 of them milling around on the sidewalk after, evidently, having kicked out a bunch of homeless people, most probably on the basis of suspected violations of disgraceful LAMC 41.18(d). Of course, if you know the spot you’ll know that there are homeless people there essentially all the time, only very rarely getting kicked out by the BID Patrol.

So what horrific incident was it that required the presence of about a dozen of Hollywood’s finest1 on a pleasant Tuesday afternoon on Ivar Avenue? Murder, rape, homeless encampment, street-preaching? The amazing thing is that no one there seemed to know for sure except, we assume given that the principle of charity requires us to assume that the BID Patrol both has reasons for its actions and at the same time knows what those reasons are, the officers themselves.

A witness to the June 30, 2015 incident who also had no firm idea of the BID Patrol's intention, but was willing to exert effort to come up with a shared theory that fit the known facts, proving that he, unlike the Patrol, has not yet placed himself outside of normal human society.

One witness, though, spent the time and the effort to share his theory on the BID Patrol’s motivation with our correspondent. This is what David Graeber calls “interpretative labor,” an activity which, as Graeber has it, “much of the everyday business of social life” comprises, an activity in which people with guns, made stupid by their own potential for state-sanctioned violence, do not typically engage, as they clearly do not in this case:2

Thank you for filming, cause they only pulled up when I started talking about God and Jesus. I was just talking about God and Jesus and taking the Illuminati down, and every day they don’t never bother nobody, and let them sit here, right? Well, all of a sudden today I came and started talking about God and Jesus and taking down the Illuminati, cause I’m in the middle of a documentary, all of a sudden they get a hundred calls a day. God bless us all, the Holy Spirit, in Jesus’ name.

HPOA-Backed Anti-Street-Vending Agents Provocateurs Exposed, Mocked in Boyle Heights; Kerry Morrison Characteristically Misses Point, Whines About Incivility

The release of the HPOA’s quarterly newsletter is always an interesting time here at MK.org secret headquarters. On the one hand we’re always aghast at the latest stupidity, cupidity, mental rigidity, and white privilegidity on display. On the other hand, we always end up with a bunch of topics about which to write. The Summer 2015 issue is no exception.

As every regular reader of this blog knows by now, the HPOA is hysterically opposed to the legalization of street vending in Los Angeles. They’ve entered into conspiracies with the abhorrent Central City Association to subvert the democratic process through astroturfing and mendacity. And, according to Kerry Morrison, writing in the newsletter:

Devin Strecker, Alyssa Van Breene, Kerry Morrison, and a bunch of unindicted co-conspirators

Before an ordinance is drafted, the CLA [Chief Legislative Analyst] staff presided over a series of public hearings to gain input from the community. Staff representing both BIDs, along with board members, attended each of these hearings and expressed the concerns of the business community. However, members of the business community were outnumbered easily 10:1 at these hearings.

Hollywood board member Alyssa Van Breene and staffer Devin Strecker attended the first meeting on May 28 in Boyle Heights. When they tried to share their concerns the audience booed. Though there were no boos or hissing at the second hearing on June 11 in Van Nuys, the audience was unruly and disrespectful to those testifying against the ordinance or speaking on behalf of small business.

Now, Kerry is well-known for her bluenosed Mrs. Grundyism, and we’ve grown somewhat accustomed to it, but this is really over the top, even for her. Let’s restate this in human language, shall we?

The Utopia of Rules and the Violent Stupidity of the BIDs

David Graeber's fine book of essays provides theoretical tools essential to the understanding of the violence of the BIDs, the utter, abject stupidity of the BIDs and their minions, and the both correlative and causal links between them
David Graeber’s fine book of essays provides theoretical tools essential to the understanding of the violence of the BIDs, the utter, abject stupidity of the BIDs and their minions, and the both correlative and causal links between them
David Graeber is one of my eternal intellectual heroes, and I recommend most highly to anyone who can read his stunning, transformative work, Debt: The First 5000 Years. His most recent book, a collection of essays entitled The Utopia of Rules: On Technology Stupidity, and the Secret Joys of Bureaucracy is, while less sweeping than Debt, essential reading. In particular, for the purpose of understanding the violence of the BIDs and the utter, abject stupidity of the BIDs and their minions, one essay, Dead Zones of the Imagination, stands out above the rest.
David Graeber, looking as brilliantly ironic and as ironically brilliant as ever he has done.
David Graeber, looking as brilliantly ironic and as ironically brilliant as ever he has done.
I’ll run through the premises and argument after the break, but a crucial conclusion that Graeber reaches here, and one whose relevance will be immediately obvious to sane readers of this blog, is that

…violence is so often the preferred weapon of the stupid. One might even call it the trump card of the stupid, since (and this is surely one of the tragedies of human existence) it is the one form of stupidity to which it is most difficult to come up with an intelligent response.

Andrews International BID Patrol: Welcome to Hollywood, Now Fuck You!

According to Andrews International, BID Patrol officers "are demonstrating what can be accomplished through sensitivity, compassion, and proactive outreach." In other words, Fuck you!

According to Andrews International:

[B]udgetary constraints leave local police little choice but to focus primarily on reactive enforcement, [but] CAPS officers have the resources and support to actually serve as agents of change in the community. In partnership with law enforcement and assisted by community interest groups, social services agencies, and local businesses, CAPS officers focus on bridge building and problem solving.

Note that “CAPS officers” are how Andrews International refers to BID Patrollies when they’re trying to bullshit their way into more work like they do for the HPOA. And just look at the BID Patrol guy to your right, serving as an agent of change in the community, building bridges, solving problems!
A BID Patrol officer serving as an agent of change in the community, building bridges, solving problems. In other words, Fuck you!

And they’re not just flipping off one another back in BID Patrol secret headquarters during their weirdo macho team-building rituals, they’re out on the street, arresting people for things that aren’t crimes in sane places, like drinking beer on the street, and flipping off their victims, too.

Hollywood Farmers’ Market Patrons Can Even Wash Hands After Not Shitting In Public Street

Not only are porta-potties provided for patrons of the Hollywood Farmers' Market, two portable hand-washing fountains are provided as well. But, as Lady Macbeth knew too well, some things don't wash off so easy.
Not only are porta-potties provided for patrons of the Hollywood Farmers’ Market, two portable hand-washing fountains are provided as well. But, as Lady Macbeth knew too well, some things don’t wash off so easy.
We’ve written before about the shameless hypocrisy of the Hollywood Property Owners Alliance, whose bully-boy BID patrol agents arrest homeless people on a regular basis for relieving themselves on the public street.

We’ve argued that the HPOA consciously chooses to deprive the homeless of access to bathrooms, and is thus culpable for the broken lives and pain caused by the collateral consequences of these hundreds of arrests over the years. We’ve discussed the fact that the HPOA not only sets these people up for arrest by not having public restrooms available and then compounds their crime by arresting them, but they also mock them for the fact that they’re forced to shit in the streets.

Lady Macbeth discovering that water isn't always enough to wash away sins from the hands that committed them.

Anyway, this morning, we noticed, strolling through the pleasant environs of Ivar and Selma, that not only are there porta-potties provided for the rich folk who shop at the Market, but there are even portable hand-washing stations, shown in the images above. We expect the porta-potties. That’s an expected level of hypocrisy. And we do appreciate hand-washing, both in ourselves and in others. We expect that the BID Patrol will arrest homeless people for sitting on the sidewalk but not even warn Farmers’ Market patrons for violating the same law.

Smarmy BID Patrol Officer Baxter Performs Now-Illegal Creepy Cop Trick Live on Camera

What if you entered a building intending to steal something and you stole it and then someone died because it wasn't there and that person would have invented a way to prevent any baby anywhere in the world from dying ever?? You'd be responsible for all those deaths!! How does that make you feel, you miserable little creep?? Bzzzztttt!!!!
What if you shoplifted but it was really felony burglary and then someone died because of what you done and that person would have invented a way to prevent an asteroid from hitting the earth and killing EVERYONE?!? You’d be responsible for genocide under the FELONY MURDER LAW!! You know you’re not supposed to commit genocide, don’t you, you maniac?!
Look and listen here as a smarmy, self-satisfied little BID Patrol guy whose name seems to be Baxter interrogates his victim, who evidently stole a bottle of Justin Timberlake™ perfume of some sort. (NOTE: We made the video private at the request of the subject. The transcript is accurate, and you can obtain a copy from Kerry Morrison under the CPRA like we did if you want one)

In the video (complete transcription after the break), Baxter, in his smarmy cop interrogation tone of voice, gets the man to admit that he entered the store intending to shoplift. This used to be a favorite creepy cop trick for inflating minor charges beyond all reasonable proportion. Once on a time California Penal Code §459 could be used to charge such an act as burglary instead of mere theft. Security minions such as Baxter, not content with merely protecting the interests of their employers, would routinely use this nasty little loophole to overcharge people. Why? That’s just what they do, these icky little lawboys. It’s how they keep score in their psychotic little game.

Of course, as with all such nonsense, it ends up being the people of California who pay the price. Not just the petty criminals who get overcharged into oblivion, whose lives get ruined by undeservedly severe criminal records and the horrific collateral consequences that ensue, but also the taxpayers who have to support prisons full of nonviolent people, support courts and jails and probation offices and all the apparatus necessary to track and control the people dumped into the justice system by creepy private security henchmen who are so pleased with their delusory cleverness that they film themselves in the act so they can laugh about it later with all their cop buddies…

Well, as will sometimes happen, the people of California got wise to this nonsense and fed up with it as well and, in 2014, passed Proposition 47 which, among other things, added the following language to the penal code:

BID Patrollies Mischarge Obviously Innocent Man, Display Habitual Arrogant Unprofessionalism, Disregard for Law, Decency

A man restrained in BID Patrol car and riding along with two BID Patrollies. He’s clearly mentally ill. They’re putatively trained professionals. Why are they being delusional?
Look here to see a man restrained in a BID patrol car after having been arrested for trespassing. But on the way to the station it turns into something else entirely.

Man: You let me go or you die.

BID employee: Why would I die?

Man: You let me go or I’ll get hurt.

BID employee: How are you gonna hurt us?

Man: [Unintelligible] … but you will let me go, it’s not valid.

BID employee: Well we can’t let you go, that would be you, uh, trying to subvert the legal process…by your…

Man (interrupting): Whaddaya mean you can’t let me go? OK [Unintelligible]

BID employee: We’re required by law to deliver you to the Los Angeles Police Department.

Man: For what?

BID employee: We, we tried to keep you out of that business. You kept disrupting the business…

Man: [Unintelligible] Why did you fucking put me in this car, you punks? What if I kick you in your head right now? What if I kick you right in your head, you little punk? What if I kick you right in your head? You let me out of this car, now. And you don’t bring me to jail or I will kick you somewhere.

BID employee: OK, we’ll take you to the office and get you out there.

Man: You better…you better not put me in no jail cell, punk.

BID employee: OK, we won’t…we won’t.

Man: I didn’t say nothing wrong to you or him. I’m arguing with him. I argued with that last one in the store. I did nothing illegal or wrong.

BID employee: OK.

Man: Now you’re fucking harassing me. Don’t you fucking take me to jail in this car. If you harass me at all I won’t forgive you. I never will. You’re gonna pay. You’re gonna pay with your life. Cause I’m gonna kill you with a knife. [Lengthy unintelligible part]

BID employee: You know, when you whisper, I can’t hear you. My hearing’s bad.

Man: [Continuing to be unintelligible]

BID employee: You’re gonna find me and burn me up? Is that what you said?

Man: [Continuing to be unintelligible]

BID employee: Ah, you realize you’re making terrorist threats, right?

Monica Yamada, minion of corporate scofflaw CIM Group, reports to HPOA on continuing efforts to criminalize all aspects of the lives of non-rich people
CIM Group, widely known for sending out demolition teams in the dark of night to tear shit down in violation of their building permits,1 leading a judge to invalidate those permits after tenants had already moved in to the building, deputes minion Monica Yamada to serve as its representative to the Joint Security Committee of the Hollywood Entertainment District BID and the Sunset-Vine BID.

The purpose of the Joint Security Committee is, we suppose, to oversee the operations of Andrews International Security, with whom the BIDs contract to provide patrol services. The mission the BIDs have given to A/I2 is explained in the 2014-15-WORK-PLAN-FINAL-VERSION1-1:

Monica Yamada and the Hollywood Vicinage

We ♥ James Madison!
We James Madison!
The 6th amendment guarantees the right to “by an impartial jury of the State and district wherein the crime shall have been committed.” This was the result of a compromise away from a right to trial in “the vicinage” where the crime was committed, fought for by James Madison but ultimately compromised in order to allow the constitution to be ratified.
