What To Press For After The Venice Beach BID Is Approved

palm_trees_at_venice_beachBecause it will be approved. We know that. But we also know that Mike Bonin might be susceptible to political pressure. He even thought about moving the hearing date, presumably in response to political pressure and cogent criticism. Maybe the same tactics can help improve what’s presently looking like it’ll be yet another version of the worst that this City’s BIDs in Hollywood and Downtown have to offer. So here are some things which might be attainable politically and which might help mitigate some of the worst excesses to which BIDs are prone.

First of all, maybe you remember the recent tumult over the Arts District BID. If not, there’s a1 version of the story here. In short, some property owners got a judge to dissolve the BID, there was a big fuss about getting a new BID formed, and in order to settle the controversy, José Huizar stepped in and brokered a compromise involving the composition of the Board of Directors. As the L.A. Business Journal put it:

City Councilman José Huizar, whose district includes the neighborhood, on Tuesday announced that the Arts District Community Council Los Angeles has agreed to drop its application to create a BID and support an application sponsored by a group called Arts District Los Angeles. The ADLA, in turn, agreed to give Community Council representatives at least four seats on an expanded 23-member board. In addition, the area’s homeowners association will get three additional seats on the board.

If Huizar can negotiate seats on the Arts District BID Board, Mike Bonin can certainly change the composition of the Board of Directors of the Venice Beach BID if he wants to.2 The composition of the Board is a political matter which can be influenced by political tactics. The Arts District dissenters got four seats out of 23, not enough to change things, although by no means an empty victory. A vote, four votes, is not nothing in such a closed-off political entity. Another moral is that the homeowners association got seats on the Board. That is, Huizar got people who live in the BID a voice on the Board. This is also not trivial.

But one of the City’s newest BIDs, the Central Avenue Historic District BID, suggests an even more promising goal, one which would go a long way toward making something not so bad out of the presently horrifying prospect of the VBBID.

Newly Obtained Email Proves That Mike Bonin Considered Moving Venice Beach BID Hearing To November 29 From Disputed Date of November 8

After a chaotic hearing on the Venice Beach BID in August,1 after Legal Aid Foundation of Los Angeles powerhouse attorney Shayla Myers pointed out that the process was legally flawed, and after City Attorney Mike Feuer accepted her argument and told the City Council that they’d better have a do-over, after all that, the rehearing on the abhorrent BID was scheduled to be approved considered in Council on November 8, 2016. This, of course, is also the day that Americans will be deciding the future of the world, which takes up a lot of time. Venice being Venice, there has been a lot of speculation about whether Bonin did this on purpose to make it difficult for detractors to testify. Venice also being Venice, there has been an organized effort to get Bonin to postpone the hearing.

Such protests usually fall on what seem like deaf ears, but in this case, an email that I obtained last night from the City Clerk’s office proves that, in September 2016, Mike Bonin was considering moving the hearing from the disputed date of November 8 to the presumably more acceptable dates of November 29 and 30. How The Racist Cancer Of The HPOA Signal Box Art Contest Rules Spread To The Ritzy Little Apartheid Stronghold of Larchmont Village, Forcing Me To Hire A Lawyer To Pry The Evidence Out Of Their Secretive Grasping Scofflaw Zillionaire Fingers

Last Summer we broke the story of the Hollywood Property Owners Alliance’s anti-Latino signal box art contests and of CD13 Councildude Mitch O’Farrell’s willing complicity in this disgraceful episode, along with his stubborn doubling-down through silence in the face of what1 seems like some pretty cogent criticism. The story has dropped off the blog, but not off our agenda. The last thing I discovered, but did not write about until now, was that the Google revealed2 that the kooky little backwater BID in Larchmont Village, that old-school Southern California Apartheid throwback3 ritz-o-rama neighborhood in South Central Hollywood,4 had also held a signal box art contest, and it had also included the very phrase made famous by its ethnic-cleansing big sisters to the North: “No cartoon images or graffiti work of any kind will be considered.”

Well, naturally, I was going to investigate this phenomenon, the point being to find ground zero of this pernicious nonsense,5 so on August 6, 2016, I fired off a CPRA request to Heather Duffy Boylston, whose email address is linked to in the BID’s contact form. Wait a while. Crickets. I spent the next couple months firing off more emails to various co-BIDspirators,6 making phone calls, leaving voicemails and messages, offering to stop by offices, whatevers, and still…just silence. I asked Miranda Paster to intervene. I asked Holly Wolcott to intervene. Nothing. So finally, even though I hate to spend the money, but who can sit around doing nothing7 while zillionaires flaunt their characteristic indifference to truth, justice, and the rule of law, I hired a lawyer to fire off a demand letter. That woke them up, and they sent me a whole bunch of nonsensical irritating junk about their signal box art contest. You can browse through it in the usual places:

A couple of days ago I announced MK.Org’s latest project, which aims to experimentally determine the scope of the extraordinary LAMC 49.5.5(A), which states, rather succinctly, that:

City officials, agency employees, appointees awaiting confirmation by the City Council, and candidates for elected City office shall not misuse or attempt to misuse their positions or prospective positions to create or attempt to create a private advantage or disadvantage, financial or otherwise, for any person.

Anyway, today’s episode involves the California Public Records Act and Mike Bonin’s Chief of Staff, Chad Molnar. Since August, I’ve been making CPRA requests of CD11. At first they more or less complied with the law, but after the chaos at the first Council hearing in August and the subsequent humiliation caused by the City’s having to redo the whole BID approval process, they completely stopped complying.

In fact, they not only stopped complying, but when I wrote to them asking them if they were going to comply, Chad Molnar wrote back with one of the most extraordinarily confused responses I’ve ever received to a CPRA status request. He not only agreed that they hadn’t complied, but he said explicitly that they weren’t going to comply, and that he believed that they did not have to comply because to comply would make their constituents suffer, and he didn’t think that the intent of CPRA was to make their constituents suffer. VICTORY!! All Los Angeles BID Security Patrols To Register With Police Commission Per City Attorney, BID Patrol Excessive Force Complaint Under Investigation By LAPD; Direct Result of MK.Org Reporting!

Earlier this afternoon I spoke with Ernesto Vicencio, who is an LAPD investigator assigned to the Police Commission. He told me that the City Attorney either has sent or will soon send a letter to all Los Angeles Business Improvement Districts informing them that their security patrols are required to register with the Los Angeles Police Commission per LAMC 52.34.

This incredibly welcome development is a direct result of my discovery in the Summer of 2016 that it was likely that BID security registration had inadvertently ceased in 2000 due to an oversight. I don’t believe I mentioned it at the time, but in addition to writing a number of posts on the subject, I also sent a petition to the Police Commission asking them to look into the matter and to conclude that BID security ought in fact to register with them.

According to Officer Vicencio the City Attorney has decided to implement this request.1 This development is hugely important, not least because LAMC 52.34 requires private patrol services to have a procedure for investigating citizen complaints. It also grants the Police Commission a great deal of regulatory power over the activities of security patrols who are required to register.

Which brings us to the second stunning and absolutely unexpected thing that Officer Vicencio told me. You may recall that I recently reported on what seemed like a clear use of excessive force by members of the Andrews International Hollywood BID Patrol. Well, about three weeks ago I submitted a report on this matter to Kerry Morrison of the HPOA and also to the Police Commission, as instructed by the Commission’s executive director, Richard Tefank.

Today Vicencio told me that he is handling this matter. He has tried, without success so far, to locate the victim, and he is going to investigate further. Obviously there’s no guarantee that any of these officers will suffer any consequences,2 but again, the larger implications of the fact that they’re being investigated by the City are huge. This means that the Police Commission agrees that they have jurisdiction over citizen complaints against BID security. This changes everything.

Complaint Against Mark Sokol And Carl Lambert For Illegal Campaign Contributions Filed With Los Angeles City Ethics Commission; Get Your Copy Here

A couple weeks ago I published an open letter to various City politicians asking them to return shady contributions to their campaigns by shady Venice Beach Business Improvement District proponents Carl Lambert and Mark Sokol. There’s been no discernable response so far, but it’s important to remember that at least as far as I can tell the politicians didn’t actually break the law by accepting the contributions. In fact it was Sokol and Lambert who broke it by making the contributions.

The relevant laws are Section 470(c)(12)(A)(i) of the City Charter,1 which says:

The following persons shall not make a campaign contribution to any elected City official, candidate for elected City office, or City committee controlled by an elected City official or candidate: A person who bids on or submits a proposal or other response to a contract solicitation that has an anticipated value of at least $100,000 and requires approval by the City Council.

Listen! A sower went out to sow. He filled his hand and cast the seed. Some fell on the road; the birds came and ate the seed. Others fell on the rock, sprouted, and dried up. And others fell on the thorns, which choked them and insects ate them. And others fell on the fertile ground of freaking Tony Hoover, founder of freaking Red Line Tours, and multiplied a freaking zillionfold into a veritable magic freaking beanstalk of crazy.

Well, the disciples of Jesus also didn’t get what he was talking about, so I guess I shouldn’t feel bad about having to fill in some backstory.

See, last week, according to the Beverly Press, Councilmoppet Mitch O’Farrell announced that he and now-retired-from-his-position-as-clean-government-poster-boy-but-still-active-as-Councilmember-more’s-the-freaking-pity David Ryu of CD4 had introduced a motion in Council to put an end to what they claim to see as the desperate, wanton, willful, and ongoing destruction of what passes for the quality of life of people who actually live in Hollywood by tour bus operators on the Boulevard, mostly between Orange and Vine. It’s something about how they try to hand you flyers and ask you where you’re from even though you are obviously from Los Angeles.2

Well, if you’ve been paying attention to this blog at all, you will immediately suspect that (a) neither Mitch O’Farrell nor David Ryu give the first flying fuck about tour buses on Hollywood Boulevard and (b) they are channeling the concerns of that master covert lobbyist and famously blue-nosed Mrs. Grundy whose nom de Hollywood is Ms. Kerry Morrison.3 Kerry Morrison is, as is her wont, concerned about what she calls “civility on the public right of way” and the rest of us call “killing off or at least arresting everyone who scares her or doesn’t have a lot of money.”

I have not yet had time to track down records pertaining to the current incarnation of Kerry Morrison’s obsession with tour buses.4 But the story in the paper reminded me that I had a bunch of unprocessed material from the City Attorney from 2012 on this very subject. So I put that all together and put it up on the Archive (as well as locally if you prefer), where you can read it at will. It concerns a so-called “Tour Bus Working Group,” put together by Kerry Morrison and including the usual representatives of the City and the Hollywood zillionaire elite.

It’s mostly not that interesting, although there is evidence there that Kerry Morrison has been obsessed with tour buses for the entire twenty years that she’s been the Hollywood BID-boss.5 It culminated in November 2012 with a report to Eric Garcetti and Tom LaBonge about what should be done about tour buses6 and an ordinance addressing a tiny part of her concerns, written, of course, by LaBonge and Garcetti. However, there is one shining gem of craziness, written by Tony Hoover, self-proclaimed “founder” of Red Line Tours. That, I have to discuss in detail!

The Homeless Industrial Complex: How CIM Group, Monica Yamada, Kerry Morrison, Steve Seyler, And Their Assorted Minions And Cronies Eat What They Kill In Hollywood And Beyond

This morning’s L.A. Times features an excellent story about how CIM Group defrauds its tenants in poverty-stricken but gentrifying areas of the City, telling them that they’re about to be evicted and offering them small amounts of money to sign releases. Of course, in Los Angeles, most low-cost rental units are covered by rent control laws which give these tenants significant protections which they don’t know about. CIM Group takes significant and soon-to-be-illegal advantage of this ignorance.

CIM Group is famous for its criminal behavior, which has shown no sign of slowing down.1 This latest revelation won’t surprise anyone who’s paying attention. And remember that gentrification creates homelessness, and evictions create homelessness. In short, CIM Group creates homelessness. Monica Yamada creates homelessness. And they make a lot of money by making people homeless.

But these homeless people don’t go to waste, no. Some of them end up in Hollywood, where they generate a great deal of economic activity. They don’t share in the wealth they create, but that’s no surprise. First, they end up as the the subject of arrests and other interventions by Steve Seyler and his cheerful gang of good-will ambassadors. Those boys2 earn $1.5 million per year dealing with these homeless people. No homeless people, no $1.5 million.

2014 VBBID Emails Reveal, Among Other Things, That Bonin Staffer Debbie Dyner Harris Was On Venice Beach BID Steering Committee Since 2014 Despite Consistent Denials of City Involvement In Formation Process

Here are eleven pages of emails from 2014 released to me yesterday by Miranda Paster of the Los Angeles City Clerk’s office.1 These provide a unique2 window into the process by which BIDs are created in the City of Los Angeles. It’s clear from these emails that, despite the fact that everyone in the City government denies it, the BID formation process is encouraged, facilitated, and inextricably interwoven with City action at every stage. Of course, this confirms precisely what the California Court of Appeal found in its landmark decision in Epstein v. HPOA: that “by giving the BID the legal breath of life, the City breathe[s] life into the POA as well.”3
