This post is about a confidential email conversation between Deputy City Attorneys Mike Dundas and Strefan Fauble and CD13 staffer Dan Halden about a CPRA request of mine. If you’d like to read the email without reading my nonsensical rantings about it you can find it here on Archive.Org.

If you spend any time at all asking the City of Los Angeles for copies of public records you’ll have realized that compliance with the Public Records Act is not a high priority of theirs. They violate it constantly, in small ways and large, intentionally and out of sheer careless indifference. They violate it because they can afford to pay out any number of settlements and most people won’t sue them. They violate it even though compliance with the CPRA is a fundamental right guaranteed by the Constitution of California.1

And now, although I’ve long suspected it to be true, I have proof that the City Attorney’s office actually advises them to decide whether to violate it based on whether or not they think the requester will sue them which, as Strefan Fauble so succinctly puts it in a top-secret confidential April 2019 email conversation, “would involve a lot more work.”

But it takes resources to sue them, so effectively this policy favors rich requesters and corporate requesters, even though the Constitution2 guarantees access to every person, which clearly means equal access. It’s surely no coincidence that rich people and corporations are much, much less likely to be critical of the City. This story begins with a request I sent to Dan Halden on March 12, 2019. Quick update time! Psychopathic homeless-hating housedwellers in Venice have been illegally dropping anti-encampment planters all over the damn place. I obtained some emails via the California Public Records Act that proved that Mark Ryavec, Carlos Torres and assorted other members of their fashy little beerhall fight clubs, the Venice Stakeholders Association and Venice United, were behind the planters with the avid assistance of a bunch of LAPD cops and Taylor Bazley, who is Mike Bonin‘s field deputy for Venice.

Then I turned all the cops in to LAPD Internal Affairs since cops are supposed to enforce the law rather than help a bunch of zillionaires violate the law. But that move, as satisfying as it was, left smarmy little creepy little avid little licker of the dung-encrusted boots of zillionaires Taylor Bazley unreported anywhere for anything to do with his part in the ongoing civic tragedy that is the connivance of our City officials with these illegal planter-placers. Which is a gap in the cosmic order that could not allowed to remain!

And thus, this very morning, I filed a complaint against Bazley with the Los Angeles Ethics Commission. The facts are the same as in the above-mentioned complaint against the cops, but the violations alleged are different because Bazley, at least as far as we know, is not a cop, so he has fewer restrictions on his relations with lawbreaking.

A quintessential slogan of my mother’s generation of feminists is that the personal is political. And this is as true and as profound as it ever was. But it’s also worth remembering that the political is personal. The powers of government are tools, weapons, wielded by individual human beings making daily conscious choices to use these public resources to further their personal goals, no matter how much they want to pretend otherwise, that they’re doing the will of the people or some other abominable abstraction.

And one of the things I do here at MK.Org is to expose these choicemakers, to smoke them out of the holes in which they huddle, all carefully camouflaged round with weighty principles and abstract whatnot, to reveal the little men crouching behind those shimmering curtains.1 This project is viable because, well, you know all that bad stuff that “the City of Los Angeles” does? It’s all being done by individual people, mostly organized via email, and therefore subject to the California Public Records Act.

And one of these bad things that these privilege-addled sociopaths do is to install illegal and appalling planters and fences on our public sidewalks so that there’s no room for tents. They’ve done this in Venice, they’re doing it in Koreatown, and they’re doing it in Hollywood as well. So I asked my good friends at CD132 if they could give me all their emails about these Hollywood ones and, today, they gave me a bunch!3 You can find them all here on Archive.Org, along with a bunch of pictures I took of the planters.4

One of the things we learn from these emails is that the people who attack homeless residents of our streets by installing these antisocial planters do it for really stupid reasons. For instance, Jennifer Mullen of Quixote Studios just doesn’t like the smell of marijuana, at least not if homeless people are smoking it. She thinks it gives customers the wrong impression of her business. Her email address is jenniferm@quixote.com.

And Andrea Kim of Lucky Scent, located at 726 N. Cahuenga Blvd 90038, doesn’t like the fact that homeless people own bikes and sometimes ask people for money. Even people who arrive in Ubers! Her colleagues Adam Eastwood and Franco Wright agree with her that this is intolerable behavior. Their email addresses are, respectively, andrea@luckyscent.com, adam@luckyscent.com, and franco@luckyscent.com.

As for Abbey Jackloski of the Hollywood Production Center, well, she doesn’t even feel like she needs to give reasons for her hatred of the homeless residents of Lillian Way.5 She just tells the thoroughly corrupt LAPD officer Eddie Guerra that “that would be amazing” if he could just get rid of them so they can install more planters. And last but in no way at all least we have the freakishly hip post-creatives6 at HQ Creative Office Freaking Space, who own this rusty space alien at 720 N. Cahuenga Blvd. And they also don’t need a reason. Their in-house sorceress of hipness, Na’ama Termechi, sends an email to disgraced SLO Eddie Guerra and is all like “Homeless exist. Squelch them, please.” And he does and says put in some plants when they’re gone and then Termechi and her conspirators put in the meanest, rustiest, horriblest appropriators of public space imaginable, as pictured at the top of the post. But none of that nonsense is as interesting as this months-long email conversation7 between LAPD officer Eddie Guerra and a bunch of people who own property along Cahuenga Blvd and Lillian way north of Melrose and south of Santa Monica Blvd. He tells them to put in planters, he tells them how to put them in, and off they go, talking about getting donations from local nurseries and pushing homeless people away to somewhere else.

Eddie Guerra Update Finally! — He’s The Cop Who Took A Personal Check In 2016 For $400 From The Media District BID Ostensibly For Some Charity — And Then I Wrote About It In January 2017 — And Filed A Complaint With The Ethics Commission — Who Didn’t Do Anything As Usual — But Cory Palka Read That Blog Post! — And Told Now-Chief Michel Moore! — And Guerra Was Moderately Busted! — And I Just Found This Out Because It Took The LAPD Two Freaking Years To Fulfill My CPRA Request — And A Special Surprise! — Cory Palka Uses A Private Email Address To Conduct City Business!

In the Fall of 2016 LAPD officer Eddie Guerra asked the Hollywood Media District BID to give him $400 ostensibly for some charity. He asked by return email right after they thanked him for getting rid of some homeless people at their express request. Context matters, and this struck me as particularly shady, so I did three things. First, I turned Officer Guerra into the Ethics Commission for violating LAMC 49.5.5(a), which forbids misusing public power for private gain. Second, I wrote a blog post about the incident. And third, I made a request to the LAPD for more records.

And because the LAPD is slow as paint when it comes to filling CPRA requests they didn’t get back to me until two years later on December 31, 2018,1 when they sent me this little spool of puckey in response. And, as is often the case with released records, most of them are completely worthless or else I already had them. But, as is also often the case with released records, some of this material was really essential!

Just, for instance, take a look at this series of emails between Hollywood mega-muckety Cory Palka, friend of white supremacists and of scientologists, and his superior officers, including now-chief Michel Moore, wherein Palka sends links and gives credit to this very blog (!) for breaking the story of Guerra’s misfeasance and they end up recommending a 1.28, which is evidently some kind of LAPD complaint form. Michel Moore, the current chief of police, agreed and then said that “corrective action/training/counseling is warranted.”

Oh, snap, amirite?! Now that I know he reads this blog and sends links to future chiefs of police, well, next goal, get @CoryPalka to follow me on Twitter! And amazingly enough, Cowboy Cory Palka is revealed by these emails to use the private email address cpalka@me.com to conduct City business, which puts him in the august company of Mitch O’Farrell, David Ryu, Gil Cedillo, and (spoiler alert) Paul Koretz!2 You will definitely be hearing more about this, but not necessarily soon.

Almost 1200 More Newly Published Media District BID Emails Now Available

There’s not much to this morning’s post, but I did manage to get another 1200 Media District emails converted to PDF and posted on the Archive. These are highly miscellaneous both in terms of subjects and senders/recipients. As with the previous batch I was not able to batch-export the attachments. However, because the emails came to me as .eml files I am able to reconstitute attachments individually,1 so if you spot any that you need drop me a line and I’ll forward it/them along to you.

Latest Entry in LAMC 49.5.5(A) Project: Hollywood Media District BID Seems To Have Paid LAPD Hollywood Division SLO Eddie Guerra $400 In Exchange For Homeless Encampment Cleanups (Ostensibly As A Charitable Donation), But Why Was The Check Made Out To Him Personally?

How much does a private nonprofit organization have to pay an LAPD officer in exchange for him running off some homeless people who are having a barbecue on the sidewalk and scaring the neighborhood zillionaires? Newly received evidence suggests that the going rate is $200 per running-off incident.

It has been more than two months since the last entry in our ongoing LAMC 49.5.5(A) project, in which we report various City employees to the Ethics Commission in an attempt to discover exactly what the most fascinating ordinance ever,1 LAMC 49.5.5(A), actually prohibits. It’s high time for another report, and this is it. First, recall what the law actually says:

City officials, agency employees, appointees awaiting confirmation by the City Council, and candidates for elected City office shall not misuse or attempt to misuse their positions or prospective positions to create or attempt to create a private advantage or disadvantage, financial or otherwise, for any person.
