Sadly, for he is one of the most satirogenic figures in all of BIDlandia, we have not heard much from pirate king Donald Duckworth around these parts lately except, of course, for the fact that he, complacently steeped in his outlaw ways, forced me to file a pair of writ petitions against two of his baby BIDs because he, complacently steeped in his unhinged arrogance, flat-out and unaccountably refuses to comply with his statutory obligations under the California Public Records Act1 even though, if the past is prologue,2 it’s very likely to cost his BIDs a lot of damn money that they can probably ill afford to waste.

But regardless of Cap’n Donald’s law-flouting noncompliance it is occasionally possible to obtain records, or at least emails, involving him by the simple expedient of getting them from the other side of the correspondence.3 And recently a friend of this blog got a small pile of emails between Mr. Don Duckworth and Los Angeles City Clerk staff, and you can read the whole set here on Archive.Org.4 And there’s pretty much interesting stuff in there, but tonight I’m focusing on just three items.

June 9, 2018 email from Don Duckworth to Laura Aflalo about record inspection — Melrose property owners Laura Aflalo and Richard Jebejian want to come inspect records. Don Duckworth says sure you can but why would you want to, isn’t it a waste of your time?

It Appears That The City Of Los Angeles Will No Longer Sign Petitions For BID Establishment Or Renewal Until 50% Of Non-City Petitions Have Come In — If True This Would Be A Radical Change In The City’s BIDscape — Just For Instance The Venice Beach BID Would Never Have Been Established — San Pedro Would Never Have Been Renewed — If This Is True It Would Seem To Be Impossible For Venice Or San Pedro To Renew Again In Their Present Forms

I just wrote this morning on the surprising fact that it seems the LAUSD will no longer automatically approve BID establishment/renewal petitions. This in itself is a monumental development, which may make it somewhat more difficult for BID establishment to happen. The emails on which that earlier post were based, between staffers at the Byzantine Latino Quarter BID and various parties including their renewal consultant Don Duckworth, are available here on Archive.Org, are an extremely rich set, and there is much of interest in there.

Now, recall that in order for the City to move forward with the BID renewal process it’s required by the Property and Business Improvement District Act of 1994 for the proponents to collect petitions in favor of renewal signed by property owners holding more than 50% of the proposed assessed value, which is known in the jargon as 50%+.5 Hitherto, in accordance with an ordinance adopted by the City Council in 1996, the City of Los Angeles would always sign petitions for establishment.

However, at least according to what is clearly the most consequential item in this release, and one of the most consequential records in my entire collection, which is this May 1, 2018 email from BID consultant Don Duckworth to BLQ BID staffers Moises Gomez and Rebecca Drapper, that policy may no longer apply. Therein Duckworth is informing his clients of the status of their ongoing petition drive. Up until May 1, Don Duckworth and the staffers working with him had taken the City’s support for granted, as would be expected. However, that morning, says Duckworth, everything changed:

The City Clerk’s Office informed me this AM that the City Petitions count
[sic] not be counted until the overall total of all other Petitions was 50% or more. (That’s a new practice.) This does affect our methodology for completion of the Petition Drive as shown below. We still have some work to do!

If this is accurate, and I don’t know why it wouldn’t be, it raises two monumental questions. First of all, how is it legal for the Clerk to adopt a policy like this without City Council approval given that it seems to contradict the 1996 policy, which was approved by the City Council? I am in the process of investigating this and I’ll get back to you on it if I learn anything.

Second, what will happen to BIDs with extraordinarily high proportions of City property, included by BID proponents to take advantage of the City’s automatic approval policy? The BLQ BID only has around 2.5% City property in it, so it wasn’t hard for the proponents to get to 50%+ without the City’s petitions.

However, some BIDs, and the Venice Beach BID and the San Pedro Historic Waterfront BID are two of the most egregious examples, don’t seem to have any hope at all of hitting 50% approval without the City’s petitions. Two-Fer Tuesday: Westchester Town Center BID And Melrose BID Both Sued To Enforce Compliance With The California Public Records Act

Remember Don Duckworth? Big bad BID boss of both the Melrose BID and the Westchester Town Center BID?? We haven’t heard from Mr. Duckworth here on the blog in a long old time even though he is quite an interesting character, what with his BID analyst switcheroos and his kooky Brown-Act-flouting bylaws and that whole Calabasas episode and so forth.

His absence from my literary life has not, however, been by choice.6 The fact is that circa last June the guy just decided to stop responding to my CPRA requests altogether. No records, no answers, no nothing from Don Duckworth. Hence no joyously mocking blog posts and so on. Well, friends, that’s about to change, and change big-time!

You see, my lawyer, the incomparable Anna von Herrmann, recently filed two petitions, one for each of Duckworth’s BIDs, to compel compliance with the CPRA. You can find them here on Archive.Org on pages which I will update if/when the cases generate more paper:

Hundreds Of Emails Between Melrose BID And The City Of LA Include (1) Definitive Proof That Executive Director Don Duckworth Violated The Municipal Lobbying Ordinance In 2013 But Unfortunately The Statute Of Limitations Has Effectively Run And (2) More Brown-Act-Violating Bylaws That No One At The Clerk’s Office, For Shame, Seems To Have Even Noticed

Donald Duckworth, who runs both the Westchester Town Center BID and the Melrose BID, is slow but, it seems, pretty steady about fulfilling my incessant CPRA requests. And thus, just yesterday I received from him four jumbo-sized mbox files just chock-full of gooey email goodness! This batch comprises 2016 emails between the City of LA and the Melrose BID, and can be found in various useful formats here on Archive.Org.

I will be writing about various items in this document dump soon enough,7 but today I just want to focus on a couple of interesting items, supplied to me as attachments to some of these emails and cleaned up a little for ease of reading.8 Here’s the short version, and you can find details and the usual ranting mockery after the break:

  • Melrose BID Formation Project Hourly Charge Breakdown — Don Duckworth not only runs the Melrose BID, he was also the consultant who oversaw its establishment, for which he seems to have been paid $80,000 by the City. This is a detailed breakdown of his hours and charges over the course of the project formation. If you’ve been following my ongoing project, aimed at turning in BID consultants for not registering as lobbyists,9 you’ll recognize how astonishing and how important this document is. Unfortunately Don Duckworth’s work on this project wound down in the Summer of 2013, which means that the four year statute of limitations for violations of the Municipal Lobbying Ordinance has essentially run out. The document will be endlessly useful, though, in estimating time spent by consultants on their other projects.
  • Melrose Business Improvement Association bylaws — The Melrose Business Improvement Association is the property owners’ association that administers the Melrose BID. These are their bylaws. I discovered recently that the freaking Larchmont Village BID had bylaws that directly contradicted the Brown Act. Now it turns out that the Melrose BID has precisely the same problem. It’s possible that Larchmont Village changed their ways, but so far, anyway, there’s no reason to suspect that Melrose has done.

Yet Another Example Of City Of LA Indifference To Illegal BID Shenanigans: City Clerk BID Analyst Rita Moreno Hands Out (Literal) Gold Stars To BIDs For Minimal Brown Act Compliance But Doesn’t Do Or Even Say Anything To BIDs Who Are Not Only In Violation Of The Law But Have Been Flouting It For Years On End

Yesterday evening, BID-lawyer-to-the-stars Jeffrey Charles Briggs passed along almost 200 emails between Media District BID executive director Lisa Schechter and various people at the City of Los Angeles. These are available en masse at Archive.Org. As always, there’s a lot of chaff in there and a few super-interesting things.10 Perhaps today’s story is an example of the latter.

It began on February 28, when Rita Moreno, newly of the Neighborhood and Business Improvement Division of the City Clerk’s office, the unit that’s meant to oversee the operations of BIDs and make sure that they follow the law and stuff, emailed a bunch of BIDdies to introduce herself and note that only a few of them had their meeting times posted on their websites. Of course, the Brown Act explicitly requires BIDs to notice their meetings on their websites,11 but that’s actually not why Rita was on about this. She was just trying to find out when they met so that she could attend. In fact, it’s not even clear that Rita Moreno knew about the Brown Act requirement.

However, the very next day, our old friend Lisa Schechter of the Hollywood Media District BID, who is not generally known for her law-abiding behavior but who has by now been educated by years of our intense scrutiny to the point where, I hope, she’s beginning to realize that it’s just easier to follow the law,12 wrote back to Rita Moreno, fishing for praise from this unlikely authority figure:

Dear Rita:

Just to reiterate, all of our meetings are posted in accordance with the Brown Act (Committee as well as Board) – Further you have been placed on our automatic distribution list which triggers and [sic] email directly to you for all of our meetings. If you should require any further information please do not hesitate to contact myself or our operations manager, Jim Omahen.

And, a couple hours later, Rita Moreno replied:

Yes…you got a star


And if you’re new to BID studies, you’re probably wondering why this puerile exchange is not just idiotic, sycophantic, and moronic, but also deeply offensive and discouraging to anyone who cares about the rule of law in Los Angeles. Well, read on!

Don Duckworth, Executive Director Of The Westchester BID, Doesn’t Like Negative Obstacle-Creating Problem-Looking-For City Clerk BID Analyst Rick Scott One Little Bit, Asks Miranda Paster To Replace Him With Far More Congenial Bicycling BID Buddy Eugene Van Cise To Benefit Everybody’s Life (And That’s Just One Of 300+ Emails Now Available!)

Just yesterday, Mr. Don Duckworth of the Westchester Town Center BID sent me a big steaming heap of emails, comprising the BID’s correspondence with the City of Los Angeles for 2016.13 I am here to tell you, there is a ton of good stuff in there! This is very, very exciting! I will be writing about items from this release for a good while to come, and the City Ethics Commission is going to be hearing about a whole lot of it as well! But this evening, in addition to this general announcement that the material is available, I want to share a gossipy little item from January 2016, which has its locus classicus right here in this email from Don Duckworth to Miranda Paster.

It seems that WTCBID Boss Man Duckworth wasn’t too happy with BID Analyst Rick Scott, felt that he “approaches me and our work in administering the Westchester Town Center BID in a very negative manner.” In fact, sez Le Duckworth, “[i]t’s as if he’s looking for problems or obstacles to create that interfere with a constructive work flow.” Not only that, but, according to the Donald, “[h]e doesn’t approach our work with recommended solutions for mutual gain or a sense of team work.”

And what’s Don Duckworth’s recommended solution to this negativity and problem-slash-obstacle-seeking behaviour? Why, “[i]f it is possible to request a BID Analyst transfer to Eugene, I would like to do so.” Of course, “Eugene” is Eugene Van Cise, famous in these parts for having ridden his bike around the Gateway to LA BID inspecting their litter. No wonder Don Duckworth likes him better than Rick Scott who, as far as we know, does not do two-wheeled litter inspections of his BIDs. New Documents: Central City East Association Tax Returns 2012-2015, Westchester Town Center BID Agendas and Minutes

Once and future queen of the Central City East Association, Ms. Estela Lopez herself yammering on about something to someone.
I have a couple new sets of documents to announce tonight. First there are tax returns from the Central City East Association from 2014 and 2015, and you can get them:

There’s a little puzzle hidden away in the two new ones. If you can spot it, drop me a line before I write a post on it14 and win a prize! I won’t approve any comments that give it away, though. No spoilers!

Also, in the face of the incredible, probably illegal, intransigence displayed by CD11 Councilmember Mike Bonin and his weirdo staff with respect to CPRA requests, I am making requests of the BIDs in CD11 for emails to/from lacity.org. Most of these are likely to be with Bonin or his staff, which will let us keep track of what’s going on in the District Office even if CD11 just actually won’t answer CPRA requests at all. It might be interesting, it might be useful, but there’s no way to know until we get the goods. The very first installment of this material comes from the Westchester Town Center BID, specifically from its Executive Director Donald Duckworth.15 Just tonight he handed over minutes and agendas from 2016, with a promise of a lot of emails to follow. 2014 VBBID Emails Reveal, Among Other Things, That Bonin Staffer Debbie Dyner Harris Was On Venice Beach BID Steering Committee Since 2014 Despite Consistent Denials of City Involvement In Formation Process

Here are eleven pages of emails from 2014 released to me yesterday by Miranda Paster of the Los Angeles City Clerk’s office.16 These provide a unique17 window into the process by which BIDs are created in the City of Los Angeles. It’s clear from these emails that, despite the fact that everyone in the City government denies it, the BID formation process is encouraged, facilitated, and inextricably interwoven with City action at every stage. Of course, this confirms precisely what the California Court of Appeal found in its landmark decision in Epstein v. HPOA: that “by giving the BID the legal breath of life, the City breathe[s] life into the POA as well.”18
