The Hollywood BID Patrol’s Intransigence on Transience Provides Yet Another Performative Demonstration of David Graeber’s Theory of Violence, Stupidity, and Interpretive Labor

Watch here for the final bit of a Hollywood BID Patrol operation on Ivar Avenue on June 30, 2015. There are about 12 of them milling around on the sidewalk after, evidently, having kicked out a bunch of homeless people, most probably on the basis of suspected violations of disgraceful LAMC 41.18(d). Of course, if you know the spot you’ll know that there are homeless people there essentially all the time, only very rarely getting kicked out by the BID Patrol.

So what horrific incident was it that required the presence of about a dozen of Hollywood’s finest1 on a pleasant Tuesday afternoon on Ivar Avenue? Murder, rape, homeless encampment, street-preaching? The amazing thing is that no one there seemed to know for sure except, we assume given that the principle of charity requires us to assume that the BID Patrol both has reasons for its actions and at the same time knows what those reasons are, the officers themselves.

One witness, though, spent the time and the effort to share his theory on the BID Patrol’s motivation with our correspondent. This is what David Graeber calls “interpretative labor,” an activity which, as Graeber has it, “much of the everyday business of social life” comprises, an activity in which people with guns, made stupid by their own potential for state-sanctioned violence, do not typically engage, as they clearly do not in this case:2

We’ve written before about the cataclysmic flood of white privilege rage rants unleashed by Fabio Conti’s cri de coeur for the BID Patrol to stop coddling the homeless and start, we don’t know, killing them or whatever it takes to get them out of Hollywood, and the present post concerns yet another boulder in that avalanche of angst. We’re going to comment on the unnamed white privilege rage ranter’s rant (you can see the fellow’s picture somewhere in the vicinity of this sentence) one line at a time. One is at least plausibly laudable. The other is a violation of the United Nations Convention on the Prevention and Punishment of the Crime of Genocide. Also, your metaphor is deeply flawed. Salmon like swimming upstream. It’s what they’re born to do. It’s the crowning glory of their lives. They surely, if they could speak, wouldn’t be whining about it.

You know, we have the state and the city working against us by allowing people to sleep on the sidewalk, you know, all night long, because it’s the humane thing to do.

No. The state and the city are not allowing anyone to sleep on the sidewalk because it’s humane. The state doesn’t have the first thing to do with municipal laws and the city has been FORCED by the United States Court of Appeals for the Ninth Circuit in its landmark decision Jones v. City of Los Angeles, where it found that the city’s law against sitting on the sidewalk, LAMC 41.18(d), violates the Eighth Amendment to the United States Constitution. That is, it’s the Constitution of the United States that allows people to sleep on the sidewalk, Mr. Unnamed white privilege rage ranter. The city of Los Angeles fought this case every step of the way, and Charlie Beck and presumably other city officials can’t wait to start enforcing it again as soon as the terms of the settlement are met. By the way, your use of the word humane here is infelicitous; as Albert Einstein once said,1 sarcasm is the language of the Devil. Note that we’re skipping some of the technicalities of the Jones case here, but the simplified outline is true enough.

At the July 9, 2015 Joint Security Committee meeting, BID Board member Fabio Conti, after Andrews International Security head BIDdie-boy Steve Seyler told a what-passes-for-heartwarming story about shipping some homeless lady out of state on a bus, flipped the fuck out about heavily armed and dangerous homeless people on the streets of Hollywood and how A/I ought to stop with the rapport-building, bus-ticket-buying, and donut/sandwich handing-out and start arresting all of them right now. Says Fabio: STOP BEING SO NICE TO THE HOMELESS!!! The “the purple guys” downtown “…keep the area pretty clean…” of homeless human garbage. The Hollywood BID Patrol must do the same!

Under ordinary circumstances a faux pas like Fabio’s would probably be politely overlooked but these are no ordinary times, it seems. Instead it triggered an avalanche of white-privilege-rage-ranting that derailed the meeting for what seemed like an eternity and was actually over 30 minutes of this approximately 70 minute long meeting. The asylum was so being-run-by-the-inmates that Hollywood Entertainment District BID Board President Monica Yamada, not habitually the most aware person in the room, had to shut it down. But not before the display of an unbearable montage/barrage of peel-the-face-off shots that had most of the attendees showing their true colors in a remarkably nauseating performative contradiction of Jesus’s usually on-target admonition about the truth. Mostly the truth will make you free but sometimes it just makes you sick.

For instance, usually, of course, at these meetings and in other venues, Steve rattles on about how cuddlesy-warmsy-fuzzly-wuzzly his officers are but everyone there knows that that’s just the velvet glove over the iron fucking fist and that he’s just spreading the goodwill-ambassador bullshit for the delectation and over-the-eyes-wool-pulling of the public. This much is obvious to anyone with a fraction of the sense that God gave a good God-damned goose. In this instance, though, under relentless pressure from Fabio, whose position is that “we’re to a point where, you know, we cannot be kind,” Steve was forced to admit his homeless-people-on-the-sidewalk policy out loud, in public, on camera:

“…we’re gonna start out with a nice approach, hey, please, time to get up, businesses are open, you gotta get off the sidewalk, we’re here to help you, you know, blah blah blah blah, please, please, pretty please, and then, you know, ultimately we’re going to put the cuffs on you…”

Steve’s not usually so open about the fact that all the donuts, all the sandwiches, all the heartwarming coziness, it’s all just a formality. “…ultimately we’re going to put the cuffs on you…”

The only people in the room who talked and didn’t seem insane1 were two LAPD liaison officers (whose names, unfortunately, we didn’t catch), who patiently explained to everyone that “…the sky’s not falling…” However, as long-time readers of this blog are well aware, there is very little in this world that can get the attention of a white person who’s hell-bent on confusing comfort with safety. The LAPD guys were completely ignored. Sanity will not prevail, not in this room at this time.

On the front page of the Summer 2015 issue of the HPOA newsletter, our heroine and perennial source of subject matter, Kerry Morrison, has an article cynically entitled Discouraging News About Homelessness Surprises No One. Her subject is the 2015 homeless count results, released last month and showing that homelessness in Los Angeles County has increased by 12% over 2013, the year of the last count. In her piece, Kerry gives a number of delusional speculations on why this might have happened: more crazy people, good weather in LA, Prop 47 (srsly), people who, following the example of Jesus Christ, give money to panhandlers, the FREAKING ACLU?!!3

You’d never guess though, from reading this little essay, that the County’s approach to the problem of homelessness consists of anything more than a bunch of random but self-styledly-good-natured business-people chilling in their offices speculating benignantly about how hobos gossiping amongst themselves about how the livin’ is easy down by the LA River3 might possibly have to our current homelessness armageddon. There are actually agencies in Los Angeles whose entire purpose is “to support, create and sustain solutions to homelessness in Los Angeles County…”

I rot13-ed the filenames to protect people’s privacy somewhat.1 You can get the whole batch via bittorrent which, as always, is most efficient if you want local copies of these pictures. I’ll be organizing these into thematic PDF flip-books and publishing them at the Archive and on Amazon over the next few weeks, but as it may be a while I thought I’d make the raw images available now.

Long-time readers of this blog will recall the two HPOA BIDs’ obsessive crusade to end the human-to-human sharing of money on the streets of Hollywood, thereby decreasing the probability that our saviour will arrive soon. One aspect of this campaign, previously pushed quite vigorously by the BIDs, is the satanic contraptions known as “donation stations,” which are some kind of weirdo parking-meter-esque devices that tourists are supposed to put money in instead of handing it to homeless people. This kind of corporatization of the loving human act of sharing money is, of course, characteristic of Nazi thought and its wannabe adherents throughout history. Well, at today’s Joint Security Committee meeting, HPOA head Honcho-ette Kerry Morrison announced the suspension (or “parking,” to use the same abhorrent managerialism used by the author of the document in question) of the donation station project.

Long-time readers of this blog will recall that, last month, we broke the story of Hollywood Chamber of Commerce biggity-wig Marty Shelton’s bizarre distaste for black, brown, and poor people visiting Hollywood. Inspired by that, we recently wrote on the white supremacist roots of our beloved Hollywood sign and the inwrought caucasians-only policies of the real-estate development it once promoted. This line of inquiry got us interested in the jim crow history of Hollywood, which turns out to be quite rich.

For instance, a brief discussion in Scott Kurashige’s interesting book The Shifting Grounds of Race: Black and Japanese Americans in the Making of Multiethnic Los Angeles1 led us to read up in old LA Times articles on anti-Japanese hysteria in Hollywood in the early 1920s. It seems that in April 1923, the Hollywood Chamber of Commerce gave some advice to a bunch of angry white people. The article is here, but the short version is that some Japanese people bought eight lots in Hollywood, four near Bronson and Sunset and four on Tamarind and Gordon, and had the nerve to wish to build some apartment buildings and a church.

The white people got all in a tizzy, you can see one in the image above, and went to the Hollywood Chamber of Commerce screaming for help. The Chamber, as opposed to the presence of non-white people in Hollywood as they are today, directed the howling mob to the City Attorney to seek a restraining order and they also started circulating petitions “urging the residents to agree to restrict the use of land to those of the Caucasian race.”2 They were even inspired to poetry! See after the break for an especially creepy example.

HPOA Chooses Not to Arrest Law-Flouting Liquor Dealers, Proving its Selective Enforcement Intended to Eliminate Homeless Rather than Cut Hollywood Crime

We have previously noted that the Hollywood Property Owners Alliance arrests an awful goddamned lot of people for drinking in public. Furthermore, they maintain an utterly schizophrenic attitude about public drinking, arresting the homeless while not arresting the non-homeless for this most natural of human activities. We have suggested that the BID could solve this problem by merely ceasing to enforce this ridiculous law, but our finely crafted arguments have thus far been ignored, making us feel much as the habitually bad-rapped King Canute must have done when dealing with that whole wave thing.

But we’re not discouraged! We live to serve! We have more unsolicited advice for the HPOA. Even though we think their focus on Hollywood’s putative public drinking problem borders on either the delusional or the deliberate employment of the good old Große Lüge for the usual unsavory and genocidal purposes, we do understand that their livelihoods depend on keeping the arrest rates high. We figure that it’s at least plausible that they don’t want to stop arresting people because they’ll be out of a job if they do. As Albert Einstein1 used to say, “it is difficult to get a man to understand something, when his salary depends upon his not understanding it!”

First we need a little background on how the HPOA sees the purpose of the BID Patrol. According to executive directrix Kerry Morrison (in an email to our tireless correspondent which was almost certainly written, given its exquisitely lawyeresque quasi-literate lack of concrete content, by Minneapolitan Jeffrey Charles Briggs, the HPOA’s attorney for such matters) “they make citizen arrests with respect to conduct LAPD is empowered to cite but lacks resources or the command decision to do so.” The semantics is clear though the syntax is muddy. The BID Patrol arrests people that the LAPD could arrest but just doesn’t for some reason. The point, of course, is that the BID Patrol gets to be selective about who they arrest, wielding California’s overflowing cornucopia of stupid misdemeanors like a bloody scythe in the fields of Hollywood and thereby, they seem to think, discouraging homeless people from hanging out in the BID. This sentiment was stated even more clearly than Jeff Briggs (or Kerry Morrison, whoever it was) could bring themself to do by an anonymous BID Officer, who once chortled in both his joy2 and in range of a video camera that “You don’t challenge the BID officers. The BID officers have the authority to arrest you. What we do is blessed by the staff at Hollywood Division. We’re helping them out.

Now, we’re almost to the suggestion, which is based on the at-least-plausible theory that when trying to solve drug consumption problems it’s more effective to attack the supply side rather than the demand side. The BIDs have made some minor moves in this direction, evinced e.g. by an article in their Spring 2014 newsletter in which Kerry Morrison claims that “two owners of area liquor stores … are working with us to minimize sales to our homeless neighbors who suffer from alcohol addiction.” But, vide Canute again, this is never gonna happen. You can’t stop suppliers from fulfilling a demand by asking them nicely. That money’s not going to be left on the table. The BID knows this when it comes to the homeless. They could ask them nicely to leave, but they, reasonably given their goals, don’t bother. Instead they just fucking arrest them. It turns out, and now we’re at the point finally, that they could be doing the same thing to the liquor store owners and employees although, for whatever reasons, they choose not to.
