Mitch O’Farrell’s Malcriado Anti-Playground Motion, Propounded At The Behest Of Ms. Kerry Morrison, Is Now Batting 0 for 2 As Lincoln Heights Neighborhood Council Weighs In With Unanimous Eighteen To Zero Opposition

If the Lincoln Heights Neighborhood Council has its way, and really, why should they not, this park will remain free and open to the public at large.
You may recall that this L.A. Times editorial kicked off a somewhat misguided firestorm of opposition to Mitch O’Farrell’s recent Council motion 16-1456 seeking to develop a legal tool for banning adults without children from playgrounds in parks in the City of Los Angeles. The Eagle Rock Neighborhood Council weighed in a couple weeks ago with a unanimous statement of opposition, and that trend continued last night as the Lincoln Heights Neighborhood Council filed its own unanimous statement of opposition.

Lincoln Heights has a unique take on the issues involved in banning people without kids from a playground:

Limiting teenager and young adult access to swings and limited park space in areas where there is already limited access to green open space is unfair to our young adult population. If a 17 year old wants to swing on a swing or study in the grass under a tree, they should not be prevented from doing so. In Lincoln Heights, there is already limited activities for teenagers and denying them the use of park space is discriminatory There is no differentiation between playgrounds and the grass that surrounds it.

This is a completely reasonable point, and one that as far as I can see has not yet been made on the public record. And the fear that such bans will be enforced against teenagers is not imaginary.

I spent about three hours yesterday in City Hall and at the LAPD Discovery office scanning stuff. There are thousands of pages of stuff here, some of it quite important. It will take a long time to go through it and write about the highlights, so I thought I’d put it up on the Archive in (very, very) raw form immediately. Here’s what we have today:

The Year-Long Saga Of How It Is My Fault That Devin Strecker Was Forced By Kerry Morrison’s Scorched-Earth Anti-CPRA Policies To Tell Lisa Schechter That The Hollywood Property Owners Alliance Did Not Use Dropbox Even Though Everyone Else In The Entire Freaking Universe Uses It

It is all my fault that Devin Strecker is no longer allowed to use Dropbox at work!
Oh dear friends, what a long story I have to tell you this afternoon! And I hope it will repay (or more than) your attention.2 It’s all about how Kerry Morrison is willing to make her job and the jobs of her minions progressively more impossible for absolutely no better reason than to thwart my research. I’ve written about various stages in this process before, and here’s a brief timeline:

  • March 2016 — Kerry Morrison amends HPOA document retention policy to require destruction of emails after 90 days unless intentionally kept, unilaterally, retroactively, and illegally redefines emails as not subject to CPRA.
  • June 2016 — Kerry Morrison rewrites contract with Andrews International so that A/I work product is no longer the property of the HPOA and therefore, she wrongly thinks, is no longer subject to CPRA.

And I just recently acquired an October 2016 email from Devin Strecker to Lisa Schechter of the Media District BID3 which shows yet another dimension of this phenomenon: Devin Strecker has to tell Lisa Schechter that he is not allowed to click on a link because the HPOA does not use freaking Dropbox.

A demonstration of the HPOA’s forthcoming records retention policy: everything that can’t be stored in human memory will be recorded in the form of knotted strings, presently unreadable by anyone on earth. Take *that*, CPRA users!
Of course, he is not allowed to use Dropbox because of yet another policy instituted by Kerry Morrison to thwart my inquiries, although it’s really not clear what effect this is supposed to have.4 If this trend continues, she will eventually have all HPOA communication carried out by trained mnemonists who will memorize her messages and recite them in person to the recipients to avoid creating disclosable records. If data must be recorded in tangible form she will only record it by quipu, using the original Inca encoding methods which, conveniently, no one alive today is able to understand. New Documents: StreetPlus Proposal And Contract With SLAIT BID For Security Services, 2016 Emails Between Lisa Schechter And Kerry Morrison/Devin Strecker

StreetPlus seems to be taking over the BID security business from Universal Protection Service at a fairly rapid rate, so it’s beginning to seem worthwhile to collect records about them.
Today I have two new sets of documents to announce. First, the South Los Angeles Industrial District BID recently dropped Universal Protection Service5 as its security provider and hired StreetPlus to replace them. This seems to be a trend amongst our LA BIDs, probably encouraged by the fact that unlike UPS and Andrews International, StreetPlus specializes in BID security rather than security in general.

Other recent switchovers are the Downtown Center BID, the Historic Core BID, and both South Park I and II. Also the HPOA switched its cleaning contract to StreetPlus last year. This company is turning out to be a crucial player in the LA BID game, so I’ll be focusing some attention on them from now on. The first fruits of this are the 2016 proposal and resulting contract between StreetPlus and the SLAIT BID. There are some ancillary materials included there as well. This material is not only intrinsically interesting, but it has a lot to tell us about security in other BIDs. There’s some discussion and some more links after the break.

Also, I have 29 emails between Lisa Schechter of the Hollywood Media District BID and Kerry Morrison/Devin Strecker of the HPOA. These are mostly negatively interesting for their extreme lack of content. I’m guessing this is due to them switching as much of their communication as possible to phone calls and other off-the-record media. This, in turn, demonstrates, I’m still guessing, the feeling that my constant CPRA requests have engendered amongst local BIDs that they are operating in a minefield.

Well, good. They are. And the fact that they laid these mines themselves with their arrogance, disrespect for the law, and generalized idiocy, but still for some reason manage to act surprised at the negative consequences of stepping on the mines speaks volumes of their assumptions of privilege and delusions of immunity. A few weeks ago, Rory Carroll published an excellent article in The Guardian on how the City of Los Angeles has used gang injunctions as a tool of gentrification in Venice. Of course, this is not news to anyone who’s been paying attention since the injunction began in 2000. Even at the time it seemed clear that the injunction was a response to the wave of gentrification that began in Venice in the late 1980s and underwent unprecedented acceleration through the 1990s. Of course, everyone who’s smelting gold out of the housing stock of Oakwood in a blast furnace fueled by the burning bodies and lives of the poor people, the dark-skinned people, fed into the hopper by the LAPD, denies this every which way.

And these arguments have been repeated so often I have nightmares about them. “The cops would never ever do such a thing.” “There’s no conspiracy to chase out darkies.”6 And so on and on and on. But Venice’s own muse of slavering psychopathy, the very king of the gentrifiers, the universally acknowledged whitest man in Venice, Mark Ryavec himself, has distilled all of them, every last threadbare tin-foil-hat characterization, into one bitter pithy little ball. As Rory Carroll puts it:

For Mark Ryavec, head of the Venice Stakeholders Association, the notion that police act as gentrification agents is “a bunch of radical bullshit”.

Well, first of all, it’s not actually bullshit.7 The arguments against the idea that the City uses the LAPD to promote gentrification are mostly based on the (probably) factual assertion that (a) the City never mentions gentrification as a purpose for the gang injunctions and (b) that the assertions they make in support of the injunctions have to do with very real problems of violent crime (real at the time when the injunctions are being sought, anyway). There are a number of problems with this line of reasoning.

In 2015 Bonin Aide Debbie Dyner Harris Sought To Leverage “Extremely Unusual” Outsized City Assessment For Venice Beach BID Into Voting Seat On Board Of Directors But City Attorney Said No! Freaking! Way! Conflict! Of! Freaking! Interest!

I’ve written before on how the City of Los Angeles arranges for itself to be lobbied by BIDs for various reasons. Now it appears that even this usual arrangement wasn’t enough for Mike Bonin and Debbie Dyner Harris at CD11 with respect to the Venice Beach BID. In particular, during the formation process, in December 2015, Dyner Harris emailed Miranda Paster asking if she could have a voting seat on the BID Board of Directors:

Hi Miranda, how are you? I hope all is well. I am checking on something we had discussed a while ago, but I can’t find in my notes. I wanted to confirm whether or not the City, as 1/3 paying member of the BID,8 is allowed to be a voting member on the BID board.

Miranda Paster replied a few days later, stating:

We opt out of sitting on the Board because it may appear to be a conflict of interest. We can sign the petition for a BID and we cast a ballot for the Prop 218 balloting. However, we do not sit on the boards and vote.

Debbie Dyner Harris doesn’t like this at all. City of Los Angeles Sued Over 8150 Sunset Blvd, Also Vast Collection Of Stay-Away Orders For Hollywood Entertainment District Arranged By Neighborhood Prosecutor Jackie Lawson And Others

Although I don’t really have time to cover land use issues here, sometimes they have an intersection, however tenuous, with public records activity. Also, since BIDs are universally in favor of all development, no matter how illegal or stupid it might be, and they talk about it incessantly at their meetings in between planning to deport homeless people to Manzanar or whatever, it seems useful to collect some material on these issues here. One such instance is the stupidly huge development at 8150 Sunset Blvd.,10 recently approved by the LA City Council over the objections of freaking everybody.

So an organization called Fix the City11 sued the City on Thursday12 over various aspects of the 8150 Sunset project.13 I’m going to collect the filings on this case, starting with the verified petition filed Thursday, and you can get them via the menu structure or also:

Also, you may recall that in February 2015 I asked the LAPD for material on stay-away orders for the Hollywood Entertainment District. By October of this year they had not yet even responded to my request, leading to my filing a complaint with LAPD internal affairs over this dereliction of duty. There’s no news on the complaint yet,14 but they did finally send me a bunch of the actual orders. There’s a lot of material here, so for now they’re only available via our Archive.Org collection. Quick summary: Venice Beach BID hearing in August was messed up due to habitual arrogance of City Council. Heroic civil rights lawyer calls bullshit. City Attorney sees potential liability for City and advises a do-over. A bunch of other shenanigans, too many to name-check at this point, ensue. This morning the do-over hearing was held. So everyone made their comments, and they weren’t all that different from the first time, although Mike Bonin managed not to lose his shit and compare the BID opposition to Trump supporters.16 But nevertheless, there were a few surprising moments. Recall that the first hearing was invalidated because third-smartest-guy-in-the-room Herb Wesson cut off public comment too early. So this time, Mitch Englander, who is Council president pro tem,17 after all the speaker cards had been called, announced to the world at large:18

I wanna be extra careful on this one given the problems with the last public hearing. Is there anybody here who filled out a card or tried to speak or
[unintelligible] has not been heard yet?

And then the other one, Wesson or Englander, seeing that sanest of habitual gadflies, Eric Preven, indicating that he would like to speak, announced:

Ah, Mr. Preven, you actually spoke to the Council already for your maximum of three minutes per the Council rules.

And Preven said no. And everyone in the room wondered whether they were really going to take the risk of messing everything up for a second time just to prevent Eric Preven from speaking for one more minute after we’d all been there almost an hour already. Well, the Deputy City Attorney told the two prezzes to CTFO, and they folded, for Christ’s sake, and let Eric Preven speak.

But far more interesting than that was Bonin’s victory speech.19 In particular, maybe since he was feeling a little conciliatory, he said:

Good morning, friends!! It has been almost exactly two months since last I wrote to you with technical-geek-news about the successes and winnerousness of your heroes here at MK.org relative to the failures and loserosity of your zeroes over there at the Hollywood Property Owners Alliance. Well, things are going from bad for them to worse for them and from better for us to really really exceedingly better for us!

First of all, they have let their domain expire! See it parked at Godaddy in the screenshot above. Now, this is probably not a permanent situation. Indeed, their whois record from this morning shows that the domain was renewed yesterday, and I suppose it will once again point at their website as soon as the DNS records propagate. However, things must be all falling to pieces over there for this even to have happened. Kerry Morrison has long been the kind of leader about whom even her detractors will concede that she will keep the metaphorical trains running on time, and keeping a domain name registered is one of the simplest trains of all. Is there not autorenewal at Godaddy? Did someone let their credit card expire? Enquiring minds wanna to know!20 Of course, even without evidence we are happy to take credit for this lapse and any other chaos they may be experiencing over there at their secret headquarters. They are like those little bugs that scurry all about when their subterranean antics are exposed to public view by having their rock lifted up by curious students of slimy undergrounditude!

And as long as I am writing about this domain name expiry drama, I thought I would take another look at their Alexa rankings in relation to our Alexa rankings. You may recall that two months ago they were doing badly and we were doing betterly. In particular, they were at 682,470 in the U.S. and we were at 657,525. Furthermore, we were at 4,630,498 in the world.21 Well, now check it out!
