First the substance. I just uploaded about a thousand emails between the Downtown Center BID and either Kindel Gagan or the Downtown News. There are a few other kinds of items in there as well. This material came to me as MSG files and I converted it into an MBOX and also exported the emails individually as PDFs. If you have trouble getting the attachments out of the MBOX file drop me a line and I’ll get you started. Now on to the mockery!!

First of all, take a look at this item from February 2017: Nicole Kuklok-Waldman and Kate Hennigan Join Kindel Gagan. A run-of-the-mill announcement that two more urbanist-capitalist-developerist plague-carrying zombies have sold what passes for their souls by becoming partners at Kindel Gagan, a lobbying firm that’s so deeply fucked up that I can’t even think of nasty names to call it because none of them are even close to nasty enough:

United Downtown Los Angeles Conspiracy: How The Entire Board Of Directors Of The Central City East Association Egregiously Violated The Brown Act Except For Andy Bales, Richard Gardner, And Sylvia Kavoukjian, Who Don’t Seem To Have Been Invited Into The Secret Clubhouse For Some Reason — And How I Will Ask Them Nicely Never To Do It Again!

Background: You can read my previous stories on the Skid Row Neighborhood Council formation effort and also see Jason McGahan’s article in the Weekly and Gale Holland’s article in the Times for more mainstream perspectives.

Perhaps you’ve been following the story of the recent massive release of emails from the Downtown Center BID that has, so far, led to such revelations as the fact that Estela Lopez was at the heart of the United Downtown LA conspiracy, that she used her DLANC email address to further the conspiracy, and not least that six DLANC board members were covertly involved in that same conspiracy.

But we’re not done with the material yet! There’s still tons of interesting information to be gleaned. For instance, it turns out that 9 out of the 12 members of the Board of Directors of the infamous Central City East Association are on the United Downtown Los Angeles conspiracy mailing list.1 This, of course, makes the email discussion an awful lot like an illegal meeting of the board, according to the Brown Act.

It’s a serious violation, too. The Brown Act at §54959 states that:

Each member of a legislative body who attends a meeting of that legislative body where action is taken in violation of any provision of this chapter, and where the member intends to deprive the public of information to which the member knows or has reason to know the public is entitled under this chapter, is guilty of a misdemeanor.

As far as I know, no one has ever been prosecuted under this clause, but if someone’s going to be first, I won’t be surprised if it turns out to be the infamously thuggish CCEA. And it’s a hard case to make that quality of life crimes, e.g. public drinking, are more harmful than this kind of covert conspiratorial shenanigans. One’s unaesthetic at worst. The other degrades the very fabric of our open society.

Keep that in mind the next time you hear a bunch of BIDdies bitching about crime Downtown and turn the page for the evidence and a detailed analysis of the violation!

More Than Ten Thousand Emails! Downtown Santa Monica BID And Downtown Center BID! Two Unbelievably Rich Sets Of Records!

This is just a short note to announce two massive sets of emails that I’ve obtained over the last couple weeks. There’s so much material here that it’s taken an unusual amount of time to get it processed and published. I will be writing about this material over the next few weeks. There’s so much, and it’s so rich, that it’s going to take me a while to get it all sorted out, so I thought it’d be best to make it available to you right away:

  • Downtown Santa Monica BID — Emails between the City of Santa Monica and the Downtown Santa Monica BID from January 1 through September 8, 2017.
  • Downtown Center BID — Assorted emails from the Downtown Center BID, mostly from 2017.

Like I said, there’s so much here that it will take a while to get it sorted through. Meanwhile, though, turn the page for some interesting stuff you can begin to look for on your own.

How Kerry Freaking Morrison And A Bunch Of Other Bad BIDdies Helped Gut AB-1479, An Essential Improvement To The California Public Records Act, And It Seems, If You Believe Them (Although Why Would You, Really?), To Be All My Freaking Fault For Being So Freaking Mean To Them On The Freaking Internet And Being “Intent On Bringing [Their Freaking] Organization To Its [Freaking] Demise”!

In February 2017, California State Assemblymember Rob Bonta of Oakland introduced AB-1479, which would have amended the California Public Records Act to allow judges to assess civil penalties of between $1,000 and $5,000 to punish flagrant CPRA violations. The bill sailed through the Assembly and almost made it through the Senate until a shitstorm of opposition, including from many Los Angeles BIDs, some of whom cited this blog as part of their parade of horribles, hired high-powered lobbyists Gonzalez, Hunter, Quintana, & Cruz and thereby sank the most important part of the bill, leaving only a tragic and fairly useless husk.

According to a staffer of Bonta’s who is in charge of this bill it’s essentially irredeemable this term, but they’re going to try again next year. Also, she was kind enough to send me a huge selection of letters received, pro and con, including a bunch from many of our Los Angeles BID friends. If we can’t beat them, well, at least we can publish their ravings and then mock them, right? The whole collection is available on Archive.Org. You should definitely read through it if you’re interested. The support letters are fabulous, but I don’t have time to discuss them here.

Good Lord, there’s too much to describe, but this is a rich, rich set of documents. I spent more than two hours at City Hall this morning scanning this nonsense, and here it is, in the rawest possible form. There are gems in that mine, friends, but until I have time, you’ll have to scratch them out your own self. For now they’re all up on our Archive.Org account. There’s stuff about the Venice Beach BID, and Carol Schatz‘s lil baby, the Downtown Center BID got audited in 2013, Daniel Halden and Kerry H. New Documents: Shadowy BID Consultant Tara Devine Earns Another $17,000 From South Park, Contractual Relations Between Carol “The Queen Of Downtown” Schatz’s Pet BID And Homeless Outreachers PATH

Perhaps you recall that I recently put a bunch of transaction records from the South Park BID up on Archive.Org because they’re both intrinsically interesting and also exceedingly useful in estimating how much shadowy BID consultant Tara Devine gets paid to drop yet another BID on our fair City; about $80,000, if my chain of inference is correct. Well, just recently I received SPBID’s transaction log from July 1, 2016 through January 31, 2017, which adds another $17,635 to Tara Devine’s running total. This makes more than $95,000 that the South Park BIDdies have paid Tara Devine. It’s probably not all for their BID renewal, though. As I reported the other day, the two South Park BIDs1 are evidently merging into one big bad BID, and Tara Devine is shepherding them through the sausage factory City Clerk’s office, so probably that’s mostly what she’s being paid for at this point. I have more requests in that may help us sort out the details.

And additionally I finally prepared and uploaded a bunch of documents concerning the relationship between the Downtown Center BID and PATH2, which is a private group that contracts with a lot of BIDs and even Council Districts to provide something they call “outreach” to homeless people. The Year-Long Saga Of How It Is My Fault That Devin Strecker Was Forced By Kerry Morrison’s Scorched-Earth Anti-CPRA Policies To Tell Lisa Schechter That The Hollywood Property Owners Alliance Did Not Use Dropbox Even Though Everyone Else In The Entire Freaking Universe Uses It

It is all my fault that Devin Strecker is no longer allowed to use Dropbox at work!
Oh dear friends, what a long story I have to tell you this afternoon! And I hope it will repay (or more than) your attention.1 It’s all about how Kerry Morrison is willing to make her job and the jobs of her minions progressively more impossible for absolutely no better reason than to thwart my research. I’ve written about various stages in this process before, and here’s a brief timeline:

  • March 2016 — Kerry Morrison amends HPOA document retention policy to require destruction of emails after 90 days unless intentionally kept, unilaterally, retroactively, and illegally redefines emails as not subject to CPRA.
  • June 2016 — Kerry Morrison rewrites contract with Andrews International so that A/I work product is no longer the property of the HPOA and therefore, she wrongly thinks, is no longer subject to CPRA.

And I just recently acquired an October 2016 email from Devin Strecker to Lisa Schechter of the Media District BID2 which shows yet another dimension of this phenomenon: Devin Strecker has to tell Lisa Schechter that he is not allowed to click on a link because the HPOA does not use freaking Dropbox.

A demonstration of the HPOA’s forthcoming records retention policy: everything that can’t be stored in human memory will be recorded in the form of knotted strings, presently unreadable by anyone on earth. Take *that*, CPRA users!
Of course, he is not allowed to use Dropbox because of yet another policy instituted by Kerry Morrison to thwart my inquiries, although it’s really not clear what effect this is supposed to have.3 If this trend continues, she will eventually have all HPOA communication carried out by trained mnemonists who will memorize her messages and recite them in person to the recipients to avoid creating disclosable records. If data must be recorded in tangible form she will only record it by quipu, using the original Inca encoding methods which, conveniently, no one alive today is able to understand. Quick summary: Venice Beach BID hearing in August was messed up due to habitual arrogance of City Council. Heroic civil rights lawyer calls bullshit. City Attorney sees potential liability for City and advises a do-over. A bunch of other shenanigans, too many to name-check at this point, ensue. This morning the do-over hearing was held. You can watch it here on YouTube.

So everyone made their comments, and they weren’t all that different from the first time, although Mike Bonin managed not to lose his shit and compare the BID opposition to Trump supporters.1 But nevertheless, there were a few surprising moments. Recall that the first hearing was invalidated because third-smartest-guy-in-the-room Herb Wesson cut off public comment too early. So this time, Mitch Englander, who is Council president pro tem,2 after all the speaker cards had been called, announced to the world at large:3

I wanna be extra careful on this one given the problems with the last public hearing. Is there anybody here who filled out a card or tried to speak or
[unintelligible] has not been heard yet?

And then the other one, Wesson or Englander, seeing that sanest of habitual gadflies, Eric Preven, indicating that he would like to speak, announced:

Ah, Mr. Preven, you actually spoke to the Council already for your maximum of three minutes per the Council rules.

And Preven said no. And everyone in the room wondered whether they were really going to take the risk of messing everything up for a second time just to prevent Eric Preven from speaking for one more minute after we’d all been there almost an hour already. Well, the Deputy City Attorney told the two prezzes to CTFO, and they folded, for Christ’s sake, and let Eric Preven speak.

But far more interesting than that was Bonin’s victory speech.4 In particular, maybe since he was feeling a little conciliatory, he said:
