The Brown Act famously forbids the Los Angeles City Council and its committees from meeting in secret1 to conduct its public business. The prohibition is found at §54952.2(b)(1), which states categorically that:

A majority of the members of a legislative body shall not, outside a meeting authorized by this chapter, use a series of communications of any kind, directly or through intermediaries, to discuss, deliberate, or take action on any item of business that is within the subject matter jurisdiction of the legislative body.

But anyone who pays even a little attention to meetings of the Los Angeles City Council or its committees can see that there’s some kind of collusion going on behind the scenes. There are too many unanimous votes, too many obviously scripted comments by Councilmembers responding to scripted comments by other Councilmembers when there’s no legal way for them to have known what their colleagues were planning to say, and just too much foreknowledge of the course of legislation.

It’s really unlikely that the Councilmembers themselves make all the arrangements. Almost surely the collusion is done by their staff. This doesn’t make it any less against the law. It’s exactly the scenario contemplated in the phrase “directly or through intermediaries.” So for instance, if 15 staff members, one from each Council district, got together to discuss pending motions, votes, or anything else within the subject matter jurisdiction of the City Council and then relayed information from the discussion to their bosses it’s a violation.2

One of my very long term projects is finding proof that the City Council does in fact engage in these illegal meetings and also to understand the means by which they do it. It’s slow going, though, and not just because of the City’s general unwillingness to comply with the Public Records Act. What I’m looking for is evidence of habitual and chronic outlawry, so the City has even more pressing reasons to withhold the records.3 But from time to time I come across something interesting and suggestive, and today I actually have two!

Newly Obtained Emails Between Richelle Huizar And Various CD14 Staff Show Jose Huizar Grooming Her To Run The Family Business — She Met With Constituents — Consulted With Chief Of Staff Paul Habib On Motions — Including One Relating To Tenants In Caltrans 710 Houses — Attending Executive Staff Meetings — Et Freaking Cetera — And It All Came Crashing Down About Them — As Castles In The Air Built By Lying Psychopathic Criminal Cheaters Will Do From Time To Time

Los Angeles City Councilmember Jose Huizar will soon be spending pretty much all his time working out with his new Club Fed Golf Team buddies and Richelle Huizar probably won’t be joining him1 even though arranging for her election to the seat he’s termed out of was apparently one of the goals of his corrupt conspiracy.2 See this excellent story from yesterday’s Times for a timeline of her role in the CM’s troubles. And as you can imagine, I’ve been after records involving her for some time now.

But Jose Huizar, credibly accused of ordering staff to alter or destroy material responsive to pending public records requests, has not been very forthcoming. The only remedy the California Public Records Act provides to compel compliance is for a requester to file a lawsuit, and I’ve had to file three against Huizar’s office. Two of these involved emails between him or his staff and Richelle Huizar. This one against the City’s Information Technology Agency is still very much pending, but the City’s about to settle the other one.

And of course we don’t settle these things unless they hand over the goods, which in this case amounted to about 150 pages of emails in PDF format.3 You can take a look at here on Archive.Org. And it turns out that there’s nothing really incriminating in them4 but nevertheless these emails illuminate aspects of Richelle Huizar’s role in CD14’s operations that I wasn’t previously aware of. She communicated directly with high level staff about motions, met with constituents, attended executive staff meetings, and so on. The context is hard to understand but it’s clear that Jose Huizar was readying Richelle Huizar to take over the family business.

By the way, I’m not critical of that fact in itself. That is, I don’t have a problem with elected officials hiring their spouses or using them as informal advisors.5 The other aspect of this material that’s important is that Jose Huizar originally claimed it was exempt from release. As you read it, you’ll see that such a claim is not merely indefensible, it’s also ludicrous. In other words, the real lead here6 is that Jose Huizar is a liar.

City Of Los Angeles Sued Yet Again To Enforce Compliance With The Public Records Act — This Time It’s Over CD14’s Obstinate Refusal To Produce Emails Between Staffer Joella Hopkins And Various City Officials — Mostly Having To Do With Homeless Issues — CD14 Commo Deputy Isaiah Calvin Risibly Claimed That Dozens If Not Hundreds Of Emails Were Exempt As Attorney Client Privileged — But I Obtained Some Of These From Other Sources And — He’s Lying — Or Confused — Or Both — But That Doesn’t Matter Under The Law — Hence This Petition

This is just a very quick note to announce that due to CD14’s well-known and weirdly intransigent refusal to comply with even the most minimal mandates of the California Public Records Act I have been forced to file a writ petition against these outlaw City officials seeking to enforce my constitutional right to read their damn emails.

On December 30, 2018 I asked Paul Habib and some other Huizar staffies for “emails between joella.hopkins@lacity.org or ari.simon@lacity.org and at least one of 34490@lapd.online or 32511@lapd.online or gita.oneill@lacity.org or kurt.knecht@lacity.org.” Note that the two police there are Marc Reina and Deon Joseph respectively. They hummed, hemmed, hawed, and noped and eventually produced 62 pages of ludicrously incomplete emails. For instance, they produced the first page of a 14 page thread about Night on Broadway but not the other 13 pages. And crazy stuff like that.

And they claimed, possibly due to the inclusion of Deputy City Attorneys Gita O’Neill and Kurt Knecht in my request, that they had withheld some material under the attorney/client privilege. But you know, and this is good CPRA practice, when possible I like to hit up as many agencies as possible for the same or overlapping material. It’s the best way not only to get complete sets of stuff but also to check whether responses are honest. And, sadly, often they are not.

José Huizar And City Of Los Angeles File Answers To Mayra Alvarez’s Complaint — Get Your Copies Here! — Also We Have A Copy Of Pauline Medina’s Complaint Against José Huizar — With Even More Stupid José Tricks!

On October 22, 2018, Mayra Alvarez, a former CD14 staffer, filed suit against her old boss José Huizar and the City Of Los Angeles, alleging that he created a bizarre, hostile, sexually threatening, and retaliatory work environment. The Times had a good article about it at the time and I published a copy of Alvarez’s complaint as well. And on December 20, 2018 Huizar and the City of Los Angeles both filed their replies to Alvarez’s petition. I finally managed to lay my hands on copies and you can get them here:

And I mean, don’t hesitate to read them, but the sad fact is that all of these petition answers are routine. Basically they all say (a) we didn’t do it but (b) if we did do it no harm was done and (c) if harm was done we’re legally not responsible but (d) if we are responsible the plaintiff brought it all on herself so we don’t owe money. It’s very ritualistic.

But tonight’s other news is not at all ritualistic. In the blinding light generated by Alvarez’s petition it’s easy to forget that she was not the only plaintiff who filed a complaint against Huizar in October. Again, David Zahniser at the Times had an excellent story on the matter, and again I have a copy of the complaint for you. This petition contains many of the same themes as Alvarez’s, but at least some very different factual allegations. Huizar again comes off as a domineering sexual aggressor as well as a petulant, vengeful, possessive, and borderline violent boss. Also newly revealed is the claim that Medina was first hired by Huizar in 2008 because she is the mother of his nephew.

Some of Medina’s allegations are familiar from Alvarez’s complaint, e.g. tension created by Huizar’s multiple affairs with his staffers, his demands for personal services, fundraising improprieties related to Bishop Salesian High, and so on. Indeed, some of the language is copied verbatim between the complaints. However, some of the allegations are quite different. Medina alleges, for instance, that Huizar routinely spent City money on family parties and other events unrelated to City business, which we didn’t see in Alvarez’s complaint.

Also, it seems that prior to August 2017 Huizar’s staffers were allowed to work from home at will, or even skip work without charging the time to vacation or sick leave. She says, though, that at that time Huizar, through his chief of staff Paul Habib, changed the policy to allow him to track the location of his current mistress.1 In particular Habib told Alvarez to quiz the staff on their intended whereabouts every morning and then send him an email telling him where they were going to be.

She also claims that through this new tracking duty and for other reasons she was forced into complicity with Huizar’s mistress’s lies to Habib about her attendance at work and that ultimately Huizar and Habib retaliated against her for complaining about these and similar matters.
