I’ve been collecting copies of bylaws from the property owners’ associations that run BIDs for a while now, and some interesting stuff has turned up. Most egregiously we have the cases of Brown Act violations actually written into the bylaws of the Larchmont Village BID and essentially the same problem with the Melrose Avenue BID. Well, the other day, Rena Leddy, executive directrix of the Fashion District BID, was kind enough to send me a copy of her BID’s bylaws, last amended in 2003, and very interesting they are, indeed!

For one thing, these bylaws reveal that, unlike every other BID that I know of, the property owners in the Fashion District elect their Board of Directors by direct weighted vote.1 Most BIDs seem to be run by self-perpetuating boards, in which the directors choose their successors without any input from anyone else. This is interesting, and may save the FDBID from the kind of stagnation and undue staff influence that one finds in so many of our local BIDs.2

Most interesting, though, are the two places in these bylaws where it appears that the BID didn’t know whether or not their rules would violate the Brown Act, so they wrote language stating that the rules only applied pending determinations of their legality by the City Attorney of Los Angeles. This contradicts the stance currently taken by City Clerk Holly Wolcott, who insists that BIDs are beyond the City’s power to control due to their status as private corporations. She refuses even to tell BIDs to perform explicit requirements of their contract. How strange, then, to see evidence that in 2003 the City Attorney of Los Angeles was making decisions about whether or not the Fashion District BID’s bylaws were Brown-Act-compliant.

Once upon a time in 2016 an organization called Hot Import Nights was going to host a car show in Downtown San Pedro. This would seem to be a natural fit, since San Pedro is nestled between such motorhead meccas as Torrance and Gardena and Carson and Long Beach, famed hot spots of both formal and informal Southern California car culture due not in small part to the feverish and innovative automotive, aerospace, and marine manufacturing activities centered in the subregion for more than a century at this point.

But if there’s a BID in the woodpile they’re going to have an opinion, either puritanical, stupid, or both, on any proposed activities within their jurisdiction, whether it’s any of their concern or not. And it’s well-known to those who know it well that Downtown San Pedro is cursed by being chronically subject to the tender mercies of the San Pedro Historic Waterfront BID. And thus it is no surprise that the BID weighed in on the car show. And it’s no surprise that they hated it. It’s exactly the kind of thing that knee-jerk puritanical real estate minions will hate.

But what is a surprise is that they changed their little minds and came to love it. They loved it so darn much that they signed an MOU with it and agreed to lobby the City on its behalf. But there’s no such thing as a free lunch and white supremacy will exact payment for any favors it bestows. In exchange for the BID’s aid and comfort, the car show had to agree not to play any rap music or hip hop at their event, and a bunch of other, as weird but possibly less racist, conditions as well.

This unreasoned, or at least publicly unreasoned, hatred for all things insufficiently caucasian, is for whatever reason, a signature element of BIDolatry in the City of Los Angeles. Over the years we’ve uncovered, e.g., the fact that the Hollywood Property Owners Alliance really, really hates Chicano-associated art genres as well as music that attracts dark-skinned patrons. The freaking HPOA even hates Peruvians if they seem like they’re getting too comfy in Hollywood.

These weird, crypto-racist attitudes are not just the province of our frenemies at the HPOA. They are evidently shared by BIDs all over the City. Thus it’s really no surprise to find that the San Pedro BIDdies are a bunch of cultural crypto-racists as well. But, as always, it’s still surprising, still disconcerting, to see the details figured plain as though upon a lighted screen. Turn the page for the story in detail with extensive documentation!

Donald Duckworth, who runs both the Westchester Town Center BID and the Melrose BID, is slow but, it seems, pretty steady about fulfilling my incessant CPRA requests. And thus, just yesterday I received from him four jumbo-sized mbox files just chock-full of gooey email goodness! This batch comprises 2016 emails between the City of LA and the Melrose BID, and can be found in various useful formats here on Archive.Org.

I will be writing about various items in this document dump soon enough,1 but today I just want to focus on a couple of interesting items, supplied to me as attachments to some of these emails and cleaned up a little for ease of reading.2 Here’s the short version, and you can find details and the usual ranting mockery after the break:

  • Melrose BID Formation Project Hourly Charge Breakdown — Don Duckworth not only runs the Melrose BID, he was also the consultant who oversaw its establishment, for which he seems to have been paid $80,000 by the City. This is a detailed breakdown of his hours and charges over the course of the project formation. If you’ve been following my ongoing project, aimed at turning in BID consultants for not registering as lobbyists,3 you’ll recognize how astonishing and how important this document is. Unfortunately Don Duckworth’s work on this project wound down in the Summer of 2013, which means that the four year statute of limitations for violations of the Municipal Lobbying Ordinance has essentially run out. The document will be endlessly useful, though, in estimating time spent by consultants on their other projects.
  • Melrose Business Improvement Association bylaws — The Melrose Business Improvement Association is the property owners’ association that administers the Melrose BID. These are their bylaws. I discovered recently that the freaking Larchmont Village BID had bylaws that directly contradicted the Brown Act. Now it turns out that the Melrose BID has precisely the same problem. It’s possible that Larchmont Village changed their ways, but so far, anyway, there’s no reason to suspect that Melrose has done.

Friends, in my role as investigative journalist I put myself in a lot of dangerous situations for the sake of finding out and publishing the truth. But TBH, the most frightened I ever am in this job is when a story takes me down to the mean streets of South Central Hollywood. There’s no scarier place in this City, friends.

Just for instance, starvation is evidently rampant in this racially segregated food desert, as evidenced by the fact that I regularly see adult human beings weighing less than 90 pounds, running through the streets in what appears to the trained anthropological eye to be sheer terror. The fact that they’re mostly women just goes to show that the patriarchal social norms prevalent in South Central Hollywood lead the men to withhold scarce and expensive food from their females, whom they see purely as chattels.

And I’m not kidding about scarce and expensive. Last time I foraged for food in South Central Hollywood I ended up being charged $22.95 for a California Roll, something which can be obtained in more fortunate parts of the City for about $3. And it only had six slices! It’s well-known, of course, that hunger brings on the kind of hopelessness that makes people with nothing to lose, no future that they can see, attack randomly. So I’m always cautious in South Central Hollywood! But nothing can keep me from reporting the truth.

You may recall that on Friday I discovered that, for the first time in their long lawless history, the Larchmont Village BID was going to try to comply with the Brown Act by noticing their meetings as required by law. But DAMN, it feels good to be a gangsta!
Well, I have been chronicling my troubles with the so-called Larchmont Village BID for at least six months now, starting with their stubborn recalcitrance in releasing records having to do with their accursed signal box art contest, to, more recently, my six month long battle to get a copy of their bylaws out of them, to my eight month struggle to get them to notify me of their damnable meetings as required by the Brown Act at §54954.1, to their appearance in a reprehensible series of emails between City employee Rita Moreno, a BID analyst with the City Clerk’s Neighborhood and Business Improvement District Division, nominally tasked with overseeing BIDs but, in actuality, engaged in enabling their misbehavior and lawlessness.

The thing about those emails was that, along with a bunch of other criminal BIDs, the Larchmont Village BID didn’t post its agendas on its website, even though the Brown Act at §54954.2(a)(1) requires it to do so. And Rita Moreno, rather than telling the lawless BIDs that they were breaking the freaking law, handed out gold stars to the ones who were following it.

Well, that’s where the situation stood until 4:48 p.m. this evening, when I received an email from some entity calling itself office@larchmontvillagebid.com. Attached to this anomalous little missive was the agenda for a BID meeting on Tuesday, May 2. Thus, for whatever reason, just one day after my scathing post calling out the City for not enforcing its laws, its contracts, against these serial South Central Hollywood outlaws, they change their ways. How’s that for activist journalism?! Anyway, there’s tons of interesting stuff to say about this situation that’s a lot more nerdish than that, and you can turn the page if you’re interested.

Yesterday evening, BID-lawyer-to-the-stars Jeffrey Charles Briggs passed along almost 200 emails between Media District BID executive director Lisa Schechter and various people at the City of Los Angeles. These are available en masse at Archive.Org. As always, there’s a lot of chaff in there and a few super-interesting things.1 Perhaps today’s story is an example of the latter.

It began on February 28, when Rita Moreno, newly of the Neighborhood and Business Improvement Division of the City Clerk’s office, the unit that’s meant to oversee the operations of BIDs and make sure that they follow the law and stuff, emailed a bunch of BIDdies to introduce herself and note that only a few of them had their meeting times posted on their websites. Of course, the Brown Act explicitly requires BIDs to notice their meetings on their websites,2 but that’s actually not why Rita was on about this. She was just trying to find out when they met so that she could attend. In fact, it’s not even clear that Rita Moreno knew about the Brown Act requirement.

However, the very next day, our old friend Lisa Schechter of the Hollywood Media District BID, who is not generally known for her law-abiding behavior but who has by now been educated by years of our intense scrutiny to the point where, I hope, she’s beginning to realize that it’s just easier to follow the law,3 wrote back to Rita Moreno, fishing for praise from this unlikely authority figure:

Dear Rita:

Just to reiterate, all of our meetings are posted in accordance with the Brown Act (Committee as well as Board) – Further you have been placed on our automatic distribution list which triggers and [sic] email directly to you for all of our meetings. If you should require any further information please do not hesitate to contact myself or our operations manager, Jim Omahen.

And, a couple hours later, Rita Moreno replied:

Yes…you got a star ★

And if you’re new to BID studies, you’re probably wondering why this puerile exchange is not just idiotic, sycophantic, and moronic, but also deeply offensive and discouraging to anyone who cares about the rule of law in Los Angeles. Well, read on!

So much new material to announce!

  • Emails from Fashion District BID about Skid Row Neighborhood Council — This is clearly the most important item I have to announce today so I’m putting it first. If you’re interested at all in how the Downtown zillionaire elite crushed the SRNC formation effort you’ll want to read this stuff. There is what appears to be new evidence about the identities of the people behind the infamous United Downtown LA front group that hired Rocky Delgadillo to write a demand letter to City Council over the SRNC, although there’s still no smoking gun. I will be writing more about this material, but it may take a few days, and I wanted to get it before you as quickly as possible.
  • Figueroa Corridor BID emails — Between the BID and the City of LA, also USC, also Securitas. Various time ranges.
  • North Hollywood BID emails — City of LA and their security provider. Various date ranges.
  • Figueroa Corridor BID tax forms — From 2013 through 2015. It’s interesting to learn here that the Figueroa Corridor BID has been “IN THE PROCESS OF DEVELOPING A CONFLICT OF INTEREST POLICY, WHISTLEBLOWER POLICY, AND DOCUMENT RETENTION AND DESTRUCTION POLICY.” at least since 2013, with no sign of actually producing anything. Ah, sigh.
  • North Hollywood BID tax forms — From 2013 through 2015. It’s interesting to learn here that this BID and the Figueroa Corridor BID, both of which are administered by our old friends at Urban Place Consulting, turns in copypasta from the FCBID on their tax forms. Just for instance, they too have been “IN THE PROCESS OF DEVELOPING A CONFLICT OF INTEREST POLICY, WHISTLEBLOWER POLICY, AND DOCUMENT RETENTION AND DESTRUCTION POLICY.” at least since 2013, with no sign of actually producing anything.

And turn the page for beaucoup de bylaws and some interesting preliminary material on the privatization of public space in the San Fernando Valley. Most interestingly, there is a very rare appearance of some new material from the outlaw stronghold known to the world as the Larchmont Village BID!

Los Feliz used to be a normal place, and maybe someday it will be again!
Just a quick note to announce a bunch of new materials. Most importantly, the Los Feliz Village BID, in the person of BID boss Rafik Ghazarian, sent me an Excel spreadsheet with mailing addresses for everyone in the BID. Given the months-long, dentaloextractivist-level dramatics created by the City of Los Angeles in the persons of asylum-running lunatics Miranda Paster and Holly Wolcott over e.g. the Venice Beach BID mailing list and the SLAIT BID mailing list,1 this is a surprising and welcome development. It’s especially laudable given that the Los Feliz Village BID has been the target of at least one significant attempt to destroy it, and, given that it’s a merchant-based BID, and thus required to renew each year, will certainly be so yet again.

I also have tax returns from the creepy little apartheid stronghold in South Central Hollywood known to the world as the Larchmont Village BID, as well as a bunch of assorted jive-ass nonsense from Mr. Mike out in Wilshire Center. Turn the page for links and descriptions.

After I spent some time looking into the Central Avenue Historic BID in the context of potential political goals for the post-approval Venice Beach BID, I thought it would be interesting to learn more about this newborn BID.1 The meetings are held at CD9’s district office at 4301 S. Central,2 so on a very pleasant evening last Thursday, I took the 210 out of Hollywood to MLK and Crenshaw, where I boarded the 705 to Central and Vernon from whence a couple blocks North on Central to watch the Board of Directors conduct their business.3 The meeting was scheduled to start at 5:30, but that evidently included some preliminaries, because when I got there at about 10 to 64 they hadn’t started yet.

Anyway, take a look at the agenda. You can see that they’re talking about the kind of things that one would expect BIDs to talk about from, e.g., reading the Wikipedia page on BIDs,5 like branding and marketing, cleaning the streets, having Halloween events, and so on. And watch this short clip of the meeting.6 That’s Sherri Franklin of the Urban Design Center, the BID consultant, who also seems to be functioning as executive director, talking about some kind of partnership the BID’s working on with Hollywood Community Housing Corporation involving affordable housing at the corner of Central and Jefferson.7

And then you can watch here as BID security director Allan Muhammad introduces his employees, and then they proceed to hand out sample Halloween bags to everyone in the room. They didn’t once discuss custodial arrests, handcuffs, social engineering, mass relocations, self-aggrandizing 5150 holds, or any of the other hard-edged tactics of which the City’s older and ever so much more dangerous BIDs are so enamored. And even though I only got 15 minutes on tape of the 90 minutes I was there8 they didn’t really have anything objectionable to say even during the parts of the meeting I didn’t record. They talked about parking, they talked about their phone bills, they talked about how it was hard for the BID to patronize local businesses because they mostly only accepted cash.9

Could this be what a BID looks like as BIDs were intended to look? Well, the very question is based on a false assumption. And there were foreshadowings of bad news to come. And on the way home, and for the last few days, it’s got me thinking about what BIDs were meant to be,10how BIDs11 evolve under selective pressure, and how it’s probably inevitable that this BID is going to end up like the worst of the Downtown BIDs, the worst of the Hollywood BIDs. The short version is that BIDs probably started out as helpful tools, but as a wise woman once said, “every tool is a weapon if you hold it right.” So turn the page if you’re still interested…

Last Summer we broke the story of the Hollywood Property Owners Alliance’s anti-Latino signal box art contests and of CD13 Councildude Mitch O’Farrell’s willing complicity in this disgraceful episode, along with his stubborn doubling-down through silence in the face of what1 seems like some pretty cogent criticism. The story has dropped off the blog, but not off our agenda. The last thing I discovered, but did not write about until now, was that the Google revealed2 that the kooky little backwater BID in Larchmont Village, that old-school Southern California Apartheid throwback3 ritz-o-rama neighborhood in South Central Hollywood,4 had also held a signal box art contest, and it had also included the very phrase made famous by its ethnic-cleansing big sisters to the North: “No cartoon images or graffiti work of any kind will be considered.”

Well, naturally, I was going to investigate this phenomenon, the point being to find ground zero of this pernicious nonsense,5 so on August 6, 2016, I fired off a CPRA request to Heather Duffy Boylston, whose email address is linked to in the BID’s contact form. Wait a while. Crickets. I spent the next couple months firing off more emails to various co-BIDspirators,6 making phone calls, leaving voicemails and messages, offering to stop by offices, whatevers, and still…just silence. I asked Miranda Paster to intervene. I asked Holly Wolcott to intervene. Nothing. So finally, even though I hate to spend the money, but who can sit around doing nothing7 while zillionaires flaunt their characteristic indifference to truth, justice, and the rule of law, I hired a lawyer to fire off a demand letter. That woke them up, and they sent me a whole bunch of nonsensical irritating junk about their signal box art contest. You can browse through it in the usual places:
