How is this Even Legal? BID Patrol Attacks a Sitting Man, Forcibly Handcuffs Him, and Then, With Full Cooperation of LAPD, Arrests Him for Kicking one of Them During Putative “Arrest”

This would be unbelievable if the whole thing weren’t captured on video. On November 23, 2015, at least four BID Patrol security guards (Mike Coogle, along with Wissman, Tizano, and Cox) confronted a man who was sitting on the sidewalk in front of the Metro Red Line station at Hollywood and Vine. They talked to him for almost four minutes, during which time he didn’t answer their questions and mostly ignored them. At 3:55 in the video one officer says to another “you want him?” The other says yes, so they grab him and push him over.

Soon all four of them are piled on top of him and trying to put handcuffs on him. Coogle claimed that the man kicked him during this episode, and ultimately they didn’t even arrest him for violating LAMC 41.18(d). Instead they arrested him for battery for kicking Coogle. When LAPD officers Adams (#34837) and Galicia (#41404) showed up and accepted the man into custody with the approval of their supervisor, LAPD Sgt. Chuck Slater. You can read the full story in the arrest report, although it doesn’t answer the main question I have about this incident: How did the LAPD decide to arrest Jones for battery rather than the BID Patrol officers?

Now, I have heard repeatedly that these BID Patrol officers have no arrest powers beyond those that every private citizen has. Kerry Morrison has even said this to me in person while schoolmarmishly waggling her finger in my face. If this is true, and I think it probably is, then there are two possibilities. Either these BID Patrol officers are breaking the law on camera here or else it’s actually legal in the City of Los Angeles for private citizens to form up into gangs of four people, physically jump on top of anyone they see sitting on the sidewalk, and force them into handcuffs. In fact, Ms. Kerry Morrison has confessed in print to violating LAMC 41.18(d) but neither got arrested by her own BID patrol nor got jumped on and handcuffed by a gang of vigilantes.

With recent events in this country1 reinvigorating the national debate over gun control, we thought it was an opportune time to present this singularly weird email from Hollywood Property Owners Alliance Executive Director Kerry Morrison to the members of the Joint Security Committee inviting them to join her out at the Andrews International Training Center in Burbank to try out the Firearms Training Simulator, pop off a few rounds at the shooting range, and eat some sandwiches provided by Andrews International catering director and senior vice president Bill Farrar.

According to Kerry Morrison, she’s gone out there to shoot multiple times, and evidently wants to share this “very humbling” experience with her compatriots on the Joint Security Committee.2 We know it sounds made up, but the text does not lie, friends:

For some time we’ve promised you an opportunity to visit the Andrews International training facility in Burbank where they have a shooting range and a FATS simulator. FATS stands for Fire Arms Training Simulator, and it presents a realistic training experience. I’ve tried this a couple times and it is very humbling and helps us all appreciate the split second judgements that must be made by law enforcement.

If any of you would like to participate, we are going to venture up to their facility next Wednesday, February 19 at 11 a.m. Bill Farrar will bring in sandwiches and everyone will have an opportunity to experience both FATS and the shooting range, if you would like. We should be ready to return to Hollywood by 1:30-2 pm.

Please RSVP to me by Monday afternoon so we can plan for food. I will also send out address and parking instructions next week.

An Open Letter to Mitch O’Farrell Regarding Plans to Fund Andrews International BID Patrol Operations in Hollywood

Dear Councilmember O’Farrell,

I am writing to you regarding plans that the Hollywood Property Owners Alliance and the Los Angeles Police Department are making to extend the patrol hours of the Andrews International BID Patrol in the Hollywood Entertainment District until 4 a.m. In particular, I heard at the last HPOA board meeting that you were considering funding all or part of this program from your discretionary money. If this report is accurate, I hope that you will ultimately decide not to fund an expansion of BID Patrol hours in Hollywood. Here are a number of reasons why I think your funding this project would be a bad idea:

1. Regardless of the intention, it looks like a way to evade Police Commission oversight of law enforcement in Hollywood: This expansion of the BID Patrol’s operations is apparently being planned at the request of Hollywood Divison’s Commanding Officer Peter Zarcone. If it’s implemented it will therefore create a City-funded group of quasi-police assembled at the City’s request who are not subject to any kind of civilian oversight or control. I understand that in some technical sense the BID Patrol aren’t police, but this plan makes that seem even more like a distinction without a difference than it already does.

Kerry Morrison Confessed to a Crime in the Pages of the LA Weekly in 2011 but Remained Unarrested by the BID Patrol

In 2011 the Andrews International BID Patrol arrested 103 people in Hollywood for violating the despicable LAMC 41.18(d), which, truly truly, outlaws sitting on the sidewalk in the absence of a parade. We have written oh so many times about how the BID Patrol does not arrest non-homeless violators of this law, and how this selective enforcement is particularly egregious in the case of the Hollywood Farmers’ Market. Well, imagine then, our surprise to read in an L.A. Weekly article from January 2011, our own Kerry Morrison, discussing how, even though she does not live in Hollywood at all and is probably far more at home at the Larchmont Market, held for some reason only zillionaires can grok at the same time as the Hollywood one, she thinks people who do live in Hollywood are a bunch of zombie NIMBYs from Hell cause they didn’t want to move the iconic Hollywood Farmers’ Market to some random parking lot due to the toys-from-pram whinging of the Film School at Sunset and Ivar. The point she seems to be making is that if the Market was moved, there would be more room for everyone and it would be a win-win situation all round, especially if you only ask the zillionaires, which seems to be Kerry’s modus operandi in such matters. Says Kerry, vis-a-vis crowded conditions:

Sometimes I actually have to sit on the curb to eat my pupusa. It seems like there’s so much opportunity for some expansion and breathing room — i don’t personally see how that would affect the urban charm.”

The BID Patrol Walked Through Hollywood Farmers Market 50 Times in 2013 and Neither Warned Nor Arrested Non-Homeless Cosmo Street Sidewalk Sitters

A search of the newly released 2013 daily activity logs of the BID Patrol reveals 50 mentions of the Hollywood Farmers’ Market. You can read all of these with links to the logs at the bottom of this post. Now, we have written before about how the BID Patrol only arrests and warns homeless people for violating the abhorrent LAMC 41.18(d). Finally we have conclusive proof that this is true on a massive, previously unsuspected scale, and it comes from the BID Patrol’s own logs.
Here is just one example out of many, many, many. On March 11, 2013 at 11:50 AM, BID Patrol Officers Courtney Kanagi (badge #130) and G. Merkens (badge #112) recorded the following activity:

1150 BACK-UP FB3: FARMER’S MARKET (IVAR/SELMA); INFORMATION BOOTH CALLED RE: A MALE TRANSIENT AGGRESSIVELY PANHANDLING; OFFICERS MET UP WITH THE SECURITY AND FB3; OFFICERS ADVISED MALE OF HIS VIOLATION; COMPLIED BY LEAVING THE AREA WITH NO FURTHER INCIDENT.

In other words, Kanagi and Merkens were in the Farmers’ Market at 11:50 AM and did not arrest, warn, or even mention the gangs of people who appear every single Sunday and sit on the sidewalk on Cosmo Street north of Selma to eat. But during this same watch they warned 37 (thirty-fricking-seven!) “TRANSIENTS” (their word) outside of the Market for violating LAMC 41.18(d). Three of these warnings took place a mere 15 minutes after Kanagi and Merkens logged their presence in the Market:

1205 CONTACT (3): HOLLYWOOD/CAHUENGA; OFFICERS OBSERVED 3 TRANSIENTS SITTING; ADVISED OF THEIR LAMC VIOLATION; COMPLIED BY STANDING UP AND LEAVING THE AREA WITH NO FURTHER INCIDENT.

Hollywood Farmers’ Market Patrons Can Even Wash Hands After Not Shitting In Public Street

We’ve written before about the shameless hypocrisy of the Hollywood Property Owners Alliance, whose bully-boy BID patrol agents arrest homeless people on a regular basis for relieving themselves on the public street.

We’ve argued that the HPOA consciously chooses to deprive the homeless of access to bathrooms, and is thus culpable for the broken lives and pain caused by the collateral consequences of these hundreds of arrests over the years. We’ve discussed the fact that the HPOA not only sets these people up for arrest by not having public restrooms available and then compounds their crime by arresting them, but they also mock them for the fact that they’re forced to shit in the streets.

Anyway, this morning, we noticed, strolling through the pleasant environs of Ivar and Selma, that not only are there porta-potties provided for the rich folk who shop at the Market, but there are even portable hand-washing stations, shown in the images above. We expect the porta-potties. That’s an expected level of hypocrisy. And we do appreciate hand-washing, both in ourselves and in others. We expect that the BID Patrol will arrest homeless people for sitting on the sidewalk but not even warn Farmers’ Market patrons for violating the same law.
