Mitchell v. Los Angeles, the latest in a series of suits filed by homeless people who’ve had their property illegally confiscated by the City (see Gale Holland’s recent article for an excellent summary) took an interesting turn today, when a flurry of filings hit PACER. First of all, the plaintiffs asked the court for a preliminary injunction and a temporary restraining order enjoining the City from confiscating their property while the case is on. They filed a huge number of declarations and other evidence in support of this application, many although not all of which can be found on our page dedicated to the case. The City asked for extra time to respond and the court granted them some.

The Hollywood BID Patrol’s Intransigence on Transience Provides Yet Another Performative Demonstration of David Graeber’s Theory of Violence, Stupidity, and Interpretive Labor
So what horrific incident was it that required the presence of about a dozen of Hollywood’s finest1 on a pleasant Tuesday afternoon on Ivar Avenue? Murder, rape, homeless encampment, street-preaching? The amazing thing is that no one there seemed to know for sure except, we assume given that the principle of charity requires us to assume that the BID Patrol both has reasons for its actions and at the same time knows what those reasons are, the officers themselves.
One witness, though, spent the time and the effort to share his theory on the BID Patrol’s motivation with our correspondent. This is what David Graeber calls “interpretative labor,” an activity which, as Graeber has it, “much of the everyday business of social life” comprises, an activity in which people with guns, made stupid by their own potential for state-sanctioned violence, do not typically engage, as they clearly do not in this case:2

HPOA-Backed Anti-Street-Vending Agents Provocateurs Exposed, Mocked in Boyle Heights; Kerry Morrison Characteristically Misses Point, Whines About Incivility
As every regular reader of this blog knows by now, the HPOA is hysterically opposed to the legalization of street vending in Los Angeles. They’ve entered into conspiracies with the abhorrent Central City Association to subvert the democratic process through astroturfing and mendacity. And, according to Kerry Morrison, writing in the newsletter:
Before an ordinance is drafted, the CLA [Chief Legislative Analyst] staff presided over a series of public hearings to gain input from the community. Staff representing both BIDs, along with board members, attended each of these hearings and expressed the concerns of the business community. However, members of the business community were outnumbered easily 10:1 at these hearings.
Hollywood board member Alyssa Van Breene and staffer Devin Strecker attended the first meeting on May 28 in Boyle Heights. When they tried to share their concerns the audience booed. Though there were no boos or hissing at the second hearing on June 11 in Van Nuys, the audience was unruly and disrespectful to those testifying against the ordinance or speaking on behalf of small business.
Now, Kerry is well-known for her bluenosed Mrs. Grundyism, and we’ve grown somewhat accustomed to it, but this is really over the top, even for her. Let’s restate this in human language, shall we?

The Utopia of Rules and the Violent Stupidity of the BIDs
I’ll run through the premises and argument after the break, but a crucial conclusion that Graeber reaches here, and one whose relevance will be immediately obvious to sane readers of this blog, is that
…violence is so often the preferred weapon of the stupid. One might even call it the trump card of the stupid, since (and this is surely one of the tragedies of human existence) it is the one form of stupidity to which it is most difficult to come up with an intelligent response.

Note that “CAPS officers” are how Andrews International refers to BID Patrollies when they’re trying to bullshit their way into more work like they do for the HPOA. And just look at the BID Patrol guy to your right, serving as an agent of change in the community, building bridges, solving problems!
And they’re not just flipping off one another back in BID Patrol secret headquarters during their weirdo macho team-building rituals, they’re out on the street, arresting people for things that aren’t crimes in sane places, like drinking beer on the street, and flipping off their victims, too.

Hollywood Farmers’ Market Patrons Can Even Wash Hands After Not Shitting In Public Street
We’ve argued that the HPOA consciously chooses to deprive the homeless of access to bathrooms, and is thus culpable for the broken lives and pain caused by the collateral consequences of these hundreds of arrests over the years. We’ve discussed the fact that the HPOA not only sets these people up for arrest by not having public restrooms available and then compounds their crime by arresting them, but they also mock them for the fact that they’re forced to shit in the streets.
Anyway, this morning, we noticed, strolling through the pleasant environs of Ivar and Selma, that not only are there porta-potties provided for the rich folk who shop at the Market, but there are even portable hand-washing stations, shown in the images above. We expect the porta-potties. That’s an expected level of hypocrisy. And we do appreciate hand-washing, both in ourselves and in others. We expect that the BID Patrol will arrest homeless people for sitting on the sidewalk but not even warn Farmers’ Market patrons for violating the same law.

Smarmy BID Patrol Officer Baxter Performs Now-Illegal Creepy Cop Trick Live on Camera
In the video (complete transcription after the break), Baxter, in his smarmy cop interrogation tone of voice, gets the man to admit that he entered the store intending to shoplift. This used to be a favorite creepy cop trick for inflating minor charges beyond all reasonable proportion. Once on a time California Penal Code §459 could be used to charge such an act as burglary instead of mere theft. Security minions such as Baxter, not content with merely protecting the interests of their employers, would routinely use this nasty little loophole to overcharge people. Why? That’s just what they do, these icky little lawboys. It’s how they keep score in their psychotic little game.
Of course, as with all such nonsense, it ends up being the people of California who pay the price. Not just the petty criminals who get overcharged into oblivion, whose lives get ruined by undeservedly severe criminal records and the horrific collateral consequences that ensue, but also the taxpayers who have to support prisons full of nonviolent people, support courts and jails and probation offices and all the apparatus necessary to track and control the people dumped into the justice system by creepy private security henchmen who are so pleased with their delusory cleverness that they film themselves in the act so they can laugh about it later with all their cop buddies…
Well, as will sometimes happen, the people of California got wise to this nonsense and fed up with it as well and, in 2014, passed Proposition 47 which, among other things, added the following language to the penal code:
