As you probably know, last year Katherine McNenny and I were forced by the unhinged intransigent refusal of psychopathic rageball George Yu to comply with the California Public Records Act to file a lawsuit against his Chinatown Business Improvement District. For reasons known only to himself, George Yu not only refused to comply with the statute, he refused to participate in the lawsuit at all.

We were seeking a writ of mandate from the judge ordering Yu to hand over the documents. It turns out that, in California at least, courts are not allowed to issue such orders merely because the respondents don’t show up.1 It’s still required that the petitioners prove their case. Which, of course, we were able to do, because it was righteous. So last Wednesday, July 24, 2019, the trial was held, before which the judge issued a tentative ruling granting us our every wish.

The whole trial lasted about 30 seconds and consisted of the judge asking our lawyer if he wished to be heard on the tentative. He said that he did not. The judge adopted the tentative as final and told the lawyer we could have our notebook back. There are a bunch more steps before everything’s done. We have to serve the final ruling on the BID, the judge has to sign the order, we have to file a motion to get paid, probably will have to file more stuff to enforce all that stuff. These wheels have been turning very slowly since August 2018 when we filed, and they continue to turn slowly, but they’re crushing everything in their path as they turn.

An enraged George Yu out of his chair and walking aggressively toward a public commenter because Yu didn’t like what the person was saying. This is the kind of unhinged anger that Yu brings to his BID. This is one of many reasons why George Yu and his damn BID need to get out of Chinatown, out of Los Angeles.
George Yu, executive director for life of the Chinatown Business Improvement District, is well-known for his defiance of the law in BID-related matters. For instance, he has utterly refused to participate in a lawsuit brought against the BID to enforce the California Public Records Act.1 And he cannot keep his mouth shut about his outlaw proclivities, like for instance last year at a BID board meeting he announced that he had broken the law by spending BID money on harassing homeless human beings outside the boundaries of the BID.2

So, you know, I went to today’s meeting expecting more of the usual George Yu crapola. But what actually happened was far, far more important than the stuff on the agenda. During the section of the meeting on public safety, long-time Chinatown residents Zen Sekizawa and Mario Correa had a few things to say to Yu and to the public at large about multiple attacks on them by George Yu and, at his direction and with his support, the BID’s off-the-chain security forces. And unhoused Chinatown resident Theo Henderson was there as well. And as George Yu’s desperate and pathetic verbal attacks on Sekizawa and Correa escalated, Henderson gave a fiery speech putting Yu’s lies in the context of his own experience. George Yu has beset Henderson for years, marshaling the LAPD, the City Attorney, and his own BID security forces against him, and Henderson called him out for the world to hear:


It’s been a fluff piece about how great this gentleman is, however, what I have understood is that he has an antipathy against unhoused people. He calls them bums. He stalks. He surveils. He does everything in his power to make it uncomfortable. I am the gentleman that was on that quality of life issue the previous meeting. So I decided to come and have my side of the story because obviously this
[unintelligible] has been posted everywhere. I have heard several different crazy stories. If I had not known it was about me I would be understandably afraid. So let us not excuse his behavior and try to de-escalate or invalidate these people’s concerns. These are legitimate. These are homeowners. These are community members. I have been a community member. I have lived over here over ten years before I became unhoused. So I have as much of a right as anybody else in here. He doesn’t even live here. He lives way out in some gated community. So this is the issue that community members that sit here and listen to him and hang on to his every word need to understand. We do not want him or his business improvement district employees here. He is a terrorist to people that are working class, an elitist, and an outright bully. And it is unacceptable. I am tired of it, and I want the community to understand and to do something about it.

George Yu did not like what he heard. Not. At. All. George Yu argued, accused, tried to derail, and when he could not shut down the flow of truth, adjourned the meeting unexpectedly and rose out of his chair in anger and walked aggressively toward Theo Henderson, another member of the public giving comment. This is a turning point in the history of this BID, maybe of all BIDs in Los Angeles. George Yu has long been unhinged, but now he’s decompensating.

Evidently he can no longer disguise his mental illness, his intermittent explosive disorder. He is exposing himself to the world now, to his masters in the City government, and it’s not pretty. It’s quite possibly George Yu’s have-you-no-sense-of-decency moment, the beginning of the end for him. Perhaps this is that will force the City, as complicit as it has been in the privatized violence perpetrated on its behalf by BIDs, to acknowledge that its BID program is essentially welfare for psychopaths, that it is no longer sustainable, if only as a matter of public relations. So yesterday I went all over the damn City fetching public records from various agencies and told the story in this Twitter thread. And one of my stops was at the City Attorney’s office in City Hall East where I was menaced by a cop and subjected to extensive elevator therapy and then no one knew where the records were so I had to leave and then come back and finally I got them! And now you can get them too, right here on Archive.Org!

What I asked for here were emails to and from Tia Strozier, who is a newly appointed neighborhood prosecutor in Downtown Los Angeles. In that role, despite the mendacious utopian rhetoric of her lying boss Mike Feuer, she mostly works as an abject minion to business improvement districts and other zillionaire-facing organizations, her main job being to direct the full majesty of the law against whoever the zillionares desire, mostly homeless human beings who happen to live within the effective range of the considerable legal weaponry at her disposal.

One such person is Theo Henderson, a resident of Chinatown who, for reasons best known to the imaginary psychiatrist of unhinged racist1 psychopathic rageball and Chinatown BID kingpin George Yu, found himself squarely in the crosshairs of Yu’s rage. So much so, in fact, that activist residents of Chinatown rallied around Henderson, among other things, starting a Facebook group to discuss his plight.

And the story that these newly-obtained emails tell about George Yu, Tia Strozier, and the toxic misuse of municipal power, is not a pretty story. It shows Strozier marshalling her resources, convening meetings with Yu, other BIDdies, LAPD officer Elizabeth Ortega and other cops, City officials from Recreation and Parks, Ricardo Flores from CD1 representative Gil Cedillo‘s office, and so on, to discuss how to persecute Henderson.

And perhaps the most offensive part of this offensive, possibly unlawful, series of events is Strozier’s weaponization of the language of compassion, so common and yet still so appalling, among anti-homeless forces in Los Angeles, evinced here in her repeated insistence that she’s arranging for “outreach” for Henderson when it’s clear from the context that what she means by “outreach” is ultimately forcible removal from Chinatown, his neighborhood, where he lives. George Yu And The Chinatown Business Improvement District Continue To Refuse To Participate In Our CPRA Lawsuit Against Them — Motion To Compel Response To Discovery Filed Yesterday — Along With Ex Parte Motion To Set An Earlier Date For Hearing Motion To Compel — How Did Anyone Decide That This Whiny Little Poobutt Should Be In Charge Of A Multi-Zillion Dollar Publicly Funded Enterprise?!

I mean, at this point all these posts about our1 lawsuit against the Chinatown Business Improvement District are turning out about the same. We do something and he ignores it and doesn’t show up for court or file papers or do whatever he was supposed to do. And the last such item was the discovery we served on the BID in January. And he just wouldn’t answer!

Well, the trial is coming up on July 24 and our lawyers have to have the opening brief in on May 24. So yesterday we filed a motion to compel the BID to answer the discovery and also to pay $3,160 in costs incurred because of Yu’s intransigence. But there’s an extra problem, which is that there’s no room on the court’s calendar for hearing the motion until July.

This would leave no time to incorporate the discovery information into the opening brief, so we’re doing an ex parte application to hold the hearing on the motion to compel sooner.2 It’ll be heard this Thursday, May 2, at 8:30 am in Department 86 of the Mosk Courthouse. Morrie Goldman is a former Council staffer who now runs a lobbying firm called Urban Solutions. Of course lately he’s much-discussed because of his person-of-interest flavored links to José Huizar. And it turns out that Goldman hasn’t just been spending quality time with Huizar, but that he’s a regular dining companion of Gil Cedillo as well.

I recently obtained a whole slew of calendars from some of Cedillo’s staffies and, importantly, Cedillo himself. Take a look at what I have so far and especially see Cedillo’s appointment calendar from 2013 through 2018. The PDF is searchable, and just for kicks, search it for “Morrie.” You’ll see 25 hits, all for meetings with Morrie Goldman, at the finest restaurants, with clients, for drinks, and so on. This, of course, is evidence. It’ s just not yet clear what it’s evidence of.

Some of the clients are listed, e.g. Clear Channel is in there a lot, probably because everyone who’s not a politician hates them. United American Properties, which was, maybe still is, developing property in Westlake, also makes an appearance. But many of the listings don’t identify the issues to be discussed, some don’t even identify the clients whose issues Goldman is to lobby Cedillo on. Which is why calendars are always just a starting point. Emails are what’s needed!1

And not only did I manage to obtain these calendars, but I also got this fabulous spool of emails, mostly between Debbie Kim and Morrie Goldman, with special guest appearances by Goldman’s fellow Huizar-scandal-person-of-interest Art Gastelum!2 And there’s all kind of action in those emails, believe me! And some of the action involves an old friend of this blog, everybody’s favorite psychopathic rageball, Mr. George Yu of the Chinatown BID! Apparently the BID, or to be precise the property owners association, is Goldman’s client.3

And Goldman goes with Yu to meet Cedillo and eat lunch and talk about things like street vending, which all BIDdies hate, but which Yu hates more than the average BIDdie, cause, in addition to rage, Yu is just that much more than average filled with hate. From the evidence I have Goldman and Yu met with Cedillo three times since 2015 over street vending (one, two, and three). And what did Cedillo have to say about it to the BIDdies, especially given that he’s on the record as supporting legal street vending in Los Angeles? Well, I don’t know.4

And the emails also show that on January 29, 2016 Goldman sought a meeting for representatives from Lightstone with Cedillo. Lightstone is, of course, famous for its Fig + Pico project, right smack in the middle of Huizar’s CD14. This is the project for which the City agreed to more than $100 million in tax rebates. And why was Goldman so eager to introduce his clients to Cedillo when they were building in CD14?

Well, Goldman says in the emails that it’s because “they are actively looking at other sites” but I’m willing to bet some money that it had more to do with the fact that at that time Cedillo was on the Economic Development Committee, which voted to move the project forward on February 9, 2016, less than two weeks after Goldman started arranging the meeting.5

And finally there’s this snazzy little number from 2017, wherein Morrie Goldman invites Gil Cedillo to take part in a press conference that his client Clear Channel, the most criminally inclined billboard company in the history of billboard companies, is putting together to celebrate National Missing Children’s Day.6 But Cedillo staffers Fredy Ceja and Arturo Chavez, even though they agree that missing children are a good cause and so on, don’t think “the perception” is good for their boss. Psychopathic Rageball George Yu Of The Chinatown Business Improvement District Continues To Refuse To Participate In The Case Against Him — So We Slapped A Bunch Of Written Discovery On Him — Including A Set Of Requests For Admission — Which He’s Got To Answer Or Else Look Out George Yu! — Sample: “Admit that YOU have a pattern and practice of failing to lawfully respond to California Public Records Act” — Let’s See What You Make Of That, George Yu!

Let’s have a recap! In August of 2018 Katherine McNenny and I filed a petition against psychopathic rageball George Yu, the supreme leader of the Chinatown BID, for his failure to respond at all to a whole series of requests for records under the California Public Records Act. Then in September the BID failed to file a response to the petition before the deadline and in November no one from the BID showed up at the trial setting conference.

And to this very day George Yu has done nothing at all to even acknowledge that there’s this case pending against his damn BID. Of course a legal system isn’t a viable proposition if people can just ignore it. Obviously at some point they can be made to participate. And according to the lawyers,1 step one towards this end is to serve a bunch of discovery on them! And that is just what they did this very day! Today’s kind of discovery comes in three flavors, and here they are:

  • Requests for Admission — This kind of written discovery, as explained by the Wiki, is “a set of statements sent from one litigant to an adversary, for the purpose of having the adversary admit or deny the statements or allegations therein.” I find these super-entertaining, so there’s a transcription after the break.
  • Special interrogatories — This is a list of questions that the BID has to answer, like e.g. “Please state ALL actions YOU took prior to August 15, 2018 to locate ALL of the RECORDS that Petitioners requested.”
  • Requests for production of documents — Just like what it sounds like — Hand over the goodies, NOW!

Anyway, one hopes that this will get things moving over at the BID. George Yu can’t go on ignoring the situation forever, and there’s no such thing as a psychopathic rageball defense, at least not in a civil matter. The next step is a motion to compel, and after that, who freaking knows?! What we really want here is the records and to establish a viable workflow for future requests. So you might recall that in August Katherine McNenny and I were forced by the unhinged intransigence of psychopathic rageball George Yu of the Chinatown BID to file a writ petition asking that the court compel him and his thuggish little weirdo henchies in the BID to obey the freaking law and hand over the records we asked for. And then you might recall that in September he and his damnable minions failed to even answer the petition.

Well, yesterday was the trial setting conference, way up north in the Stanley Mosk courthouse, in good old Department 86.1 And the Chinatown BID didn’t change up its strategy at all. No one showed up. Neither George Yu nor minion nor henchie nor lawyer nor counselor nor advocate nor consigliere. Just nobody. And did the judge do anything to them? Punish them in any way for their continued failure to respond? Nope. He continued the hearing until December 26. If they don’t get in trouble, how are they ever gonna learn? Chinatown BID Fails To File Answer To CPRA Writ Petition Before Deadline — Maybe George Yu Considers Himself Beyond The Reach Of The Law — Which Certainly Wouldn’t Be Uncharacteristic Of That Thuggish Little Weirdo

I mean I don’t know what it is with these thuggish little business improvement districts around Los Angeles. They won’t comply with the public records act and when I am thereby forced to file petitions against them they won’t even respond. This famously happened in May with that wonky little gang of white supremacists out in the Larchmont Village BID and now it just happened again with the Chinatown BID, due to the off-the-chain intransigence of which we were forced in August to file a petition.

Of course George Yu is well-known in these parts to be a screamer, a bully, and a freaking self-proclaimed criminal, so it’s not strange to learn that he doesn’t feel like he has to play by other rules of civil society. And for all that, the consequences of these failures may be minimal. In ordinary lawsuits if you don’t answer on time you just lose, but the California Code of Civil Procedure at §1088 rules out this result for writs of mandate, which is what we’re seeking. Also in July at the trial setting conference for the Larchmont BID petition, the judge granted the BID an extra 30 days to reply without them even having to explain their lapse.

So like I said, there may not be any consequences, or any serious consequences. But on the other hand there may be. We’ll see! Stay tuned and you can see also!

Chinatown Business Improvement District Sued To Enforce Compliance With California Public Records Act — The Brick-By-Brick Dismantling Of Pyschopathic Rageball George Yu’s Backwater Cult-Like Totalitarian Empire Has Begun!

On Friday a petition was filed in LA County Superior Court against George Yu’s corrupt little empire, the Chinatown Business Improvement District. You’ll recall George Yu, of course,as the caudillo of Chinatown, the man who screams at people for legally filming his meetings without approval, the man who had me ejected from his glorified strip mall for daring to defy his unlawful orders, the man who smugly admits to serious legal violations on camera because history has taught him that there will be no consequences.

Well, it turns out that he’s also the man who thinks that he can ignore people’s requests for public records for more than a year without even answering. We’re hoping this petition, which is a little different from most of the ones I report on here in that Katherine McNenny and I filed it jointly, will teach him the error of his ways, at least with respect to the CPRA.

The whole thing started in May 2017 when, after it became clear that George Yu had played a central role in the Downtown BIDs’ underhanded conspiracy to torpedo the Skid Row Neighborhood Council subdivision effort, Katherine McNenny requested a bunch of records on this topic from the Chinatown BID.1 He did not even respond, and has not responded yet, which is a clear violation of the law.2

Independently of Katherine McNenny’s requests but for the same purpose, in March 2018 I sent George Yu three requests also, slightly broader than hers but still focused on the SRNC formation effort and George Yu’s role in sinking it. He also ignored these requests. To date he has not even made the initial response required by §6253(c). For reasons I will never understand George Yu3 thinks its better to break the law repeatedly and then pay potentially tens of thousands of dollars as a consequence than to just comply in the first damn place.

Sadly, for he is one of the most satirogenic figures in all of BIDlandia, we have not heard much from pirate king Donald Duckworth around these parts lately except, of course, for the fact that he, complacently steeped in his outlaw ways, forced me to file a pair of writ petitions against two of his baby BIDs because he, complacently steeped in his unhinged arrogance, flat-out and unaccountably refuses to comply with his statutory obligations under the California Public Records Act1 even though, if the past is prologue,2 it’s very likely to cost his BIDs a lot of damn money that they can probably ill afford to waste.

But regardless of Cap’n Donald’s law-flouting noncompliance it is occasionally possible to obtain records, or at least emails, involving him by the simple expedient of getting them from the other side of the correspondence.3 And recently a friend of this blog got a small pile of emails between Mr. Don Duckworth and Los Angeles City Clerk staff, and you can read the whole set here on Archive.Org.4 And there’s pretty much interesting stuff in there, but tonight I’m focusing on just three items.
