UPDATE: Today, February 7, 2020 Judge Beckloff changed his mind about the bench warrant for technical reasons that I don’t understand. Not sure what’s going to happen next and even though it remains quite likely that George Yu will be hauled off in chains in the near future, it won’t be because of the warrant that was issued on Wednesday. Here’s a copy of today’s order.

In 2018 Katherine McNenny and I sued the Chinatown Business Improvement District over their failure to comply with the California Public Records Act. And for the last 18 months neither BID director George Yu nor anyone else from the BID has appeared in court at all. In due course they lost, Judge Mitchell Beckloff issued an order to them to hand over the records, and they ignored that as well. Late last year we moved to have Yu held in contempt for his failure to obey the order, and the judge issued an order for Yu’s arrest and suspended it pending a hearing at which he ordered Yu to appear in person and explain why he shouldn’t be held in contempt.

That hearing was held this morning. Perhaps predictably, Yu didn’t show up today either, and the judge released the arrest warrant.1 Apparently this isn’t the kind of warrant where the cops go out and hunt down the offender, but if he’s pulled over or a cop has some other reason to enter his name into a computer, this will come up and he’ll be arrested and hauled before the judge. The Chinatown BID is in CD1, Gil Cedillo’s little kingdom, and as do all BIDdies with their Councilmembers, Yu has hitherto enjoyed Cedillo’s unconditional love. But having the guy arrested and hauled by force before a judge to explain why he refuses to obey the law may, just may, not saying for sure, erode that affection, that tolerance, just a bit. We can hope!

Fee Motion Filed In Public Records Act Suit Against The Chinatown Business Improvement District — Asks For More Than $51K In Costs And Fees — George Yu And The Rest Of The BIDdies Have Hitherto Failed To Participate At All — And Now It Is Time For Them To Pay For Their Crimes

In August 2018 Katherine McNenny, with the able assistance of Abenicio Cisneros and Anna von Herrmann, filed a lawsuit against the Chinatown Business Improvement District because they had ignored our various requests for public records concerning such clearly weighty matters as their involvement in the appalling zillionaire conspiracy against the Skid Row Neighborhood Council. They continued to ignore the requests, and in fact they ignored the lawsuit altogether.

And in July 2019 we prevailed over them and the judge, Mitchell Beckloff, subsequently issued an order requiring that they produce the damn records, which they have also ignored. It is well known that the California Public Records Act requires government agencies to pay legal fees to prevailing requesters, which requires a motion to be filed with the court asking to be paid.

Our attorneys filed just such a motion last week, asking for more than $51,000 from George Yu’s BID.1 I don’t know if the BID is going to ignore this or not, but I can’t imagine we’re not going to get it or something close to it. The hearing is scheduled for February 5, 2020 at 9:30 a.m. in Beckloff’s courtroom, Department 86 in the Stanley Mosk Courthouse. Get a copy of the motion here and stay tuned for details!

My Public Records Act Lawsuit Against The City Of Los Angeles — CD11 In Particular — Is Settled — The City Handed Over The Records And Will Pay My Attorney $12K For Her Trouble — Gotta Wonder Why They Think This Is Better Than Just Complying With The Law

Maybe you remember that in June of this year I was forced by the unhinged intransigence of various CD11 staffers with respect to compliance with the public records act, with the able assistance of the incomparable Anna von Herrmann, to file suit against the City of Los Angeles. The issue was over emails mostly involving planters illegally placed on the public sidewalks of Venice by the usual Klown Kar Krew of psychopathic housedwellers, aided and abetted in their absolute flouting of the law by various CD11 staff members.

And unlike e.g. the Venice Beach BID, at least the City of Los Angeles knows when they’re beat and they started handing over records immediately. And although I still have some issues with the City’s compliance, especially over the formats in which they choose to produce emails, this wasn’t the time to fight those battles, and they do at least know when they’re beat.

A lot of the material they produced in response to this suit was quite important. Not least e.g. was this story about how former and not-really-well-missed Bonin staffie Taylor Bazley not only abetted angry housedwellers in another crazed anti-homeless hostile landscaping project but even discouraged them from planting trees because, spake Bazley, homeless people like shade.

And just recently the settlement agreement was finalized, and you can get your copy here. As is the way with such material it’s really not that interesting. But there is one really interesting bit and that is that the City of Los Angeles agreed to pay von Herrmann $12,665 for her labors.

Judge Beckloff Signs Judgment Granting Writ Of Mandate In Our California Public Records Act Petition Against The Chinatown BID — This Puts His Earlier Order Into Force And Gives The BID 30 Days-Ish To Produce The Damn Records — But I’m Guessing They Will Ignore This Too — So We Will See What Happens!

The latest development in the ongoing saga of Katherine McNenny’s and my California Public Records Act suit against the Chinatown Business Improvement District is that the judge signed a judgment granting our petition for a writ of mandate.1 You can get a copy here on Archive.Org.2 This gives the BID 30 days to comply, and we shall certainly see what happens.

Note that the signing of this judgment is not unexpected news, as we prevailed in court last month, but without this step, putting last month’s order into force, there’s no way to compel the BID to comply, which it seems pretty clearly is going to be necessary since they have shown no signs of being willing to comply in the absence of compulsion.

Without the excellent and relentless work of our lawyers, Abenicio Cisneros and Anna von Herrmann, by the way, none of this would have happened. Cisneros has also blogged about the victory from the lawyerly point of view, absolutely worth reading. Stay tuned for further developments.

Greater Leimert Park Village BID Settles My CPRA Suit Against Them — Agrees To Pay $9,000 In Legal Fees And Costs — And Of Course To Produce Previously Requested Records — In Very High Quality Electronic Format Too — Which Is Wonky But Exceedingly Important — Especially For Future Requests

As you may recall, last November, due to their refusal to even so much as respond to my requests for material under the California Public Records Act, I was forced to file a writ petition against the Greater Leimert Park Village Business Improvment District.1 I haven’t written much about it since because it’s mostly been stalling and negotiation. However, I am pleased to announce that the other day we finally settled the damn thing!

They have agreed to pay my lawyer, the incomparable Anna von Herrmann, $9,000 for her time and also to produce the records. As importantly, they’ve agreed to produce the emails I asked for in EML format.2 At first the BID wanted to include a freaking nondisparagement clause and a nondisclosure clause in the agreement, but I refused and they didn’t insist. After all, disclosure and disparagement are two of the four pillars on which this blog stands!3

City Of Los Angeles Sued To Enforce Compliance With The California Public Records Act — In Particular CD11 Has Ignored My Requests For Months On End — Has Blown Through Their Self-Imposed Deadlines — And Are Likely Doing So To Hide Their Complicity In Planter-Placing In Venice — I Am Seeking Emails Between CD11 Staff And Angry Housedwellers — Twitter Blocks And Mutes — And Constituent Communications Done Via The “Romulus” Platform — Read The Masterful Petition Here! — And Confusion To Our Enemies!

Everybody knows about those damn planters in Venice, but we’re just beginning to learn the depth of the City’s complicity with the angry housedwelling planter-placers. And fairly recently I obtained some emails that proved that Mike Bonin’s staff, if not Bonin himself, have been very complicit indeed, which led me to file a complaint with the City Ethics Commission against one of them, Taylor Bazley.1

I obtained those emails by accident, in response to a request to the LAPD that I made for a fairly different reason, but I have actually been trying to get planter-related stuff from CD11 at least since December 2018 and have been completely, utterly, thoroughly, and even literally ignored by Mike Bonin’s staff since then. They have not produced a single record in response to my requests.

And, as you surely know by now, the legislature has left the people of California only one remedy to enforce their rights under this law, and that is to file a petition asking a judge to order the neglectful ones to get it together and comply. So that, this very day, is what I did with our friends at CD11. You can get a copy here, powerfully written by the incomparable Anna von Herrman, and there’s a transcription below.

Basically there are three classes of requests. First I asked for emails between CD11 staff and various suspects in the planter-placing and other anti-homeless psychopathy with some names culled from especially angry NextDoor comments. These included both Mark Ryavec and George Francisco.

Next, as part of a series I was working on at the time, I asked for a list of all official CD11 Twitter accounts and also lists of users blocked or muted by those accounts. And finally, I asked for data from CD11’s use of the so-called Romulus Constituent Services software, which someone had told me Bonin used to talk to people outside of more predictable channels like email.

This last request Krista Kline, Mike Bonin’s deputy chief of staff in charge of something shady, refused to fulfill, claiming that it was “overly voluminous,” and the others she initially promised to produce records in response to but then did not.2 All of this material is of great, practically incalculable, public interest with respect to not only the planters but also for understanding how the City decides which encampments to sweep, and many other things besides. George Yu And The Chinatown Business Improvement District Continue To Refuse To Participate In Our CPRA Lawsuit Against Them — Motion To Compel Response To Discovery Filed Yesterday — Along With Ex Parte Motion To Set An Earlier Date For Hearing Motion To Compel — How Did Anyone Decide That This Whiny Little Poobutt Should Be In Charge Of A Multi-Zillion Dollar Publicly Funded Enterprise?!

I mean, at this point all these posts about our1 lawsuit against the Chinatown Business Improvement District are turning out about the same. We do something and he ignores it and doesn’t show up for court or file papers or do whatever he was supposed to do. And the last such item was the discovery we served on the BID in January. And he just wouldn’t answer!

Well, the trial is coming up on July 24 and our lawyers have to have the opening brief in on May 24. So yesterday we filed a motion to compel the BID to answer the discovery and also to pay $3,160 in costs incurred because of Yu’s intransigence. But there’s an extra problem, which is that there’s no room on the court’s calendar for hearing the motion until July.

This would leave no time to incorporate the discovery information into the opening brief, so we’re doing an ex parte application to hold the hearing on the motion to compel sooner.2 It’ll be heard this Thursday, May 2, at 8:30 am in Department 86 of the Mosk Courthouse. Psychopathic Rageball George Yu Of The Chinatown Business Improvement District Continues To Refuse To Participate In The Case Against Him — So We Slapped A Bunch Of Written Discovery On Him — Including A Set Of Requests For Admission — Which He’s Got To Answer Or Else Look Out George Yu! — Sample: “Admit that YOU have a pattern and practice of failing to lawfully respond to California Public Records Act” — Let’s See What You Make Of That, George Yu!

Let’s have a recap! In August of 2018 Katherine McNenny and I filed a petition against psychopathic rageball George Yu, the supreme leader of the Chinatown BID, for his failure to respond at all to a whole series of requests for records under the California Public Records Act. Then in September the BID failed to file a response to the petition before the deadline and in November no one from the BID showed up at the trial setting conference.

And to this very day George Yu has done nothing at all to even acknowledge that there’s this case pending against his damn BID. Of course a legal system isn’t a viable proposition if people can just ignore it. Obviously at some point they can be made to participate. And according to the lawyers,1 step one towards this end is to serve a bunch of discovery on them! And that is just what they did this very day! Today’s kind of discovery comes in three flavors, and here they are:

  • Requests for Admission — This kind of written discovery, as explained by the Wiki, is “a set of statements sent from one litigant to an adversary, for the purpose of having the adversary admit or deny the statements or allegations therein.” I find these super-entertaining, so there’s a transcription after the break.
  • Special interrogatories — This is a list of questions that the BID has to answer, like e.g. “Please state ALL actions YOU took prior to August 15, 2018 to locate ALL of the RECORDS that Petitioners requested.”
  • Requests for production of documents — Just like what it sounds like — Hand over the goodies, NOW!

Anyway, one hopes that this will get things moving over at the BID. George Yu can’t go on ignoring the situation forever, and there’s no such thing as a psychopathic rageball defense, at least not in a civil matter. The next step is a motion to compel, and after that, who freaking knows?! What we really want here is the records and to establish a viable workflow for future requests. VICTORY!! On Advice Of Carol Humiston, The World’s Angriest CPRA Lawyer, Melrose And Westchester BIDs Both Agree To Pay My Even-Tempered Attorney, The Incomparable Anna von Herrmann, Beaucoup De Bucks To Settle CPRA Petitions Brought Due To The Weirdo Incompetence Of Donald Freaking Duckworth, Their Hatchet-Faced Goblin Of A Zeck Dreck — Perhaps They Will Be More Compliant In The Future? — Perhaps The City Of Los Angeles Will Intervene And Enforce Compliance To Stop BIDs Bleeding Public Money Out Of Arrogance And Inability? — Probably Not, But I Can Dream

Of course you recall that in June of this year, my hand forced by the bizarro-world intransigence of BIDdological freak show specimen Donald Duckworth, executive director of both the Westchester Town Center BID and the Melrose BID, I had no recourse but to file a couple of writ petitions asking a judge to splain them that it wasn’t cool to openly flout the California Public Records Act just because they happen to be a gang of zillionaires and zillionare-associated minions. Soon thereafter El Duckworth suffered a severe attack of conscience and handed over all the disputed records.1

This development was good in at least two senses. First of all and most importantly it was good for the immortal soul of Mr. Duckworth, although as he was pretty clearly motivated by his anticipation of exposure and/or punishment his contrition was imperfect. Second of all it was good for my case because if a previously noncompliant agency, such as a BID, hands over records as a result of a petition being filed, the petitioner, such as me, automatically wins and the judge is required to award attorney’s fees.

This nondiscretionary outcome gives the respondent a powerful motive to hurry up and settle once records have been produced. Since they’re going to have to pay the petitioner’s attorney their best move is to minimize the amount of work done by opposing counsel. El Duckie’s two BIDs hired Carol Humiston, the world’s angriest CPRA attorney. And those, after a lot of characteristically Humistonian bluster and bullshit, are precisely the lines along which she seems to have advised her clients, which is why they have agreed to hand over a lot of damn money in exchange for settling the case.

This of course is a great victory for the forces of good, the side of the better angels of this City of Angels, and so on. Now let’s hope that this development along with the high costs that other BIDs have already paid,2 will convince them that it’s cheaper, easier, and more responsible to just hand over the damn records when I ask for them rather than fooling about wasting other people’s money in a series of ultimately futile and expensive attempts to keep the goods away from me just because they don’t like being called mean names on the Internet.

Also we can hope that this victory along with the others, past and future, will convince the City that if the BIDs can’t act responsibly they need to be made to do so. Chinatown Business Improvement District Sued To Enforce Compliance With California Public Records Act — The Brick-By-Brick Dismantling Of Pyschopathic Rageball George Yu’s Backwater Cult-Like Totalitarian Empire Has Begun!

On Friday a petition was filed in LA County Superior Court against George Yu’s corrupt little empire, the Chinatown Business Improvement District. You’ll recall George Yu, of course,as the caudillo of Chinatown, the man who screams at people for legally filming his meetings without approval, the man who had me ejected from his glorified strip mall for daring to defy his unlawful orders, the man who smugly admits to serious legal violations on camera because history has taught him that there will be no consequences.

Well, it turns out that he’s also the man who thinks that he can ignore people’s requests for public records for more than a year without even answering. We’re hoping this petition, which is a little different from most of the ones I report on here in that Katherine McNenny and I filed it jointly, will teach him the error of his ways, at least with respect to the CPRA.

The whole thing started in May 2017 when, after it became clear that George Yu had played a central role in the Downtown BIDs’ underhanded conspiracy to torpedo the Skid Row Neighborhood Council subdivision effort, Katherine McNenny requested a bunch of records on this topic from the Chinatown BID.1 He did not even respond, and has not responded yet, which is a clear violation of the law.2

Independently of Katherine McNenny’s requests but for the same purpose, in March 2018 I sent George Yu three requests also, slightly broader than hers but still focused on the SRNC formation effort and George Yu’s role in sinking it. He also ignored these requests. To date he has not even made the initial response required by §6253(c). For reasons I will never understand George Yu3 thinks its better to break the law repeatedly and then pay potentially tens of thousands of dollars as a consequence than to just comply in the first damn place.
