A few weeks ago I sent the Studio City BID a Brown Act demand letter insisting that they stop breaking the law in four specific ways. According to the Brown Act at §54960.2 the BID can avoid litigation by responding to such a demand with an unconditional commitment to refrain from violating the specific statutory sections in the future. And on Monday, October 15, the SCBID Board met and decided to do just that.

And amazingly enough, the next day, this letter showed up in my inbox! So they weren’t just blowing smoke, it seems. The BID hired Bradley & Gmelich to represent them, which definitely means Carol Freaking Humiston, the world’s angriest Brown Act attorney, almost certainly wrote the letter. And it is written in her inimitable style,1 which essentially consists of variations on the following narrative in six acts:

  1. You’re wrong about what the law says.
  2. Because you’re stupid.
  3. Nothing in the law requires us to do what you demand.
  4. You thought it did because you’re wrong and stupid.
  5. So shut up.
  6. We’re complying with your demand.

The four issues I raised in the letter were first that IDs were required to attend the Board meeting, second that the Board didn’t adequately describe the subject of its closed session, third that the Board didn’t reconvene in open session after the closed session, and fourth that a majority of the Board members had at one time discussed a matter via email instead of in public.

The BID’s response letter was overflowing with a lot of sound and fury2 and belligerent bluster but essentially contained adequate unconditional commitments never ever to do three out of the four. The third item, though, on reconvening in open session, for some reason they declined to commit not to violate. With respect to that, well, I’m studying my options and stay tuned for updates.

Last Friday, May 18, Devine And Heumann Got Called On The Carpet At City Hall To Get Yelled At By Wolcott, Hoppes, Moreno, Bazley, And Possibly Molnar! — We Have A Copy Of The Refund Affadavit Letter Being Sent To VBBID Property Owners! — As Of This Wednesday, May 23, Tara Devine Still Hadn’t Submitted The Freaking Annual Planning Report — Moreno Coming At Her All Salty! — And Rightly So!

A bunch of new documents for you this morning, friends! You can look through the whole pile of them here on Archive.Org, and read on for some selected gems!

First of all, recall that the Venice Beach BID is being required by the City to refund most of the money collected from property owners in 2017 because they were too damn arrogant and/or incompetent to actually do anything other than pay themselves salaries with the almost two million dollars the City handed over to them.1

You can read this copy of the letter to property owners along with instructions for filling out the necessary affadavit. This was scheduled to be sent out on May 11. What’s more interesting, though, is this email exchange from May 8 between Tara Devine and Rita Moreno about when this letter was to be sent. First Rita Moreno emailed Tara Devine at 3:20 p.m. and said:

Hi Tara,

For your information, attached is the notice and instructions that will be mailed out on Friday. Also included will be the actual Affidavit and the return envelope.

Let me know if you have any questions.

A mere seven minutes later2 the shadowy one fired off this intemperate reply:

Thank you. To clarify, we want to sit down before anything is mailed . It is important that we understand the entire process.

I’m working now to schedule something as early as possible next week. (Monday is launch, so it can’t be Monday.)

Amazingly, Tara Devine does not seem to understand that she’s not in charge of this situation. She and her BIDdies out in Venice have messed up far, far beyond what’s acceptable to the City, and it takes an awful lot to get to that point. She does not have the leverage to set terms. Which is essentially what Rita Moreno said to her in reply.

Lobbyists Are Made, Not Born — How Carol Schatz, The Zillion Dollar Queen Of Downtown, Is Raising Up Her Newly Anointed Little Princess Jessica Lall In The Methods And Practices Of The Influence-Peddling Trade

Yesterday I loosed mere anarchy on the world in the form of about 3500 emails between the Downtown Center BID and the seething stew of evil goop known to the world as the Central City Association. The release came in two parts, the unredacted and also the redacted.

Now, I know that not everyone in the world is obsessed with these BIDdies as I am, so let me just remind you all that in September 2016, Queen of Downtown and Zillion Dollar Woman Carol Schatz retired from her lofty post as supreme commanderette of the CCALA. She subsequently anointed the former big bad bossietta of the South Park BID, Jessica Lall, as Princess of Downtown and Schatz’s successorette at CCALA, effective January 3, 2017.

With this background in mind it turns out that this little gem from February 6, 2017, is not, by far, the least interesting item in the new release. In short, what happened is that on January 13, 2017, just ten days after she assumed the throne, Jessica Lall made an appointment to go to City Hall on February 9, 2017 with Carol Schatz, presumably to get shown the ropes and be introduced personally to the tame Councilpets by the master Counciltamer herself.

Of course, February 9, 2017 was a Thursday, which revealed Jessica Lall to be the inexperienced ignoramus that everyone Downtown mostly knew that she was.1 Carol Schatz, though, as much as this faux pas might have made her wish she’d elevated anybody but Ms. Jessica Lall to the crown, gritted her teeth and decided to teach her error-prone little protégé a lesson. Fortunately for us and for history, she did this via an email.

A couple weeks ago I wrote about an email that self-proclaimed Hollywood superlawyer Jeffrey Charles Briggs had released to me in response to a CPRA request but later claimed that it was exempt from release as a result of his having solemnly intoned the words “deliberative process” three times while standing on his hands naked at a crossroads at midnight on the Summer Solstice, which is about the level to which the CPRA has descended in this fair City in these latter days.

I mentioned at that point that he and his infernal client, the Hollywood Media District Property Owners Association, had been ordered by the Hon. Mary Strobel to hand over a whole passel of other emails which they’d claimed were exempt for various reasons.1 So finally I received these emails from le super-avocat de Hollywood lui-même, and now you can read them too!

For extra behind-the-scenes CPRA thrills, compare them to Jeffrey Charles Briggs’s summaries and aggressively hallucinated exemption claims in the declaration and log he filed with the court. Los Angeles BIDs To Be Audited by the City Every Three Years According to City Clerk’s April 2016 RFQ, Published At Direction of Council. Also City to Spend $250,000 Promoting BIDs and Training BID People.

One of the advantages that zillionaires have over humans with respect to City politics is that they can hire innumerable minions to keep up with the firehose of crap spewed forth by City Hall, certainly in an effort to keep the minion-deprived majority too busy to address everything. Which is my half-serious, half-silly1 excuse for only having noticed this evening the two matters addressed in this post.

First we have Council File 14-0903, in which Holly Wolcott asked for and received an “amount not to exceed $100,000 …for a period of two years with two one-year extensions to assist with the creation and implementation and coordination of a Public Information Campaign” having to do with how fricking great BIDs are for the City of L.A. Additionally they’re getting “an amount not to exceed $150,000 … for a period of two years with two one-year extensions to assist with the creation and implementation of a capacity building and leadership training series relative to business improvement districts and create public/private partnerships with other nonprofit organizations..” None of this seems like very much money given (a) the amount of truth they’re going to have to overcome in order to achieve the first goal and (b) the amount of sheer incompetence and bloody-mindedness to achieve the second. Brace yourself for the incoming propaganda!

Second, and much more interesting, we have this Request for Qualifications, issued by the Clerk in April 2016 asking for people to submit proposals to audit BIDs. There must be a council file associated with this item, but I can’t locate it. Here’s some background. First of all, the standard contract that BIDs sign with the City allows the City to audit BIDs at will.2 This is rarely done. In fact, as far as I can tell, it has only happened twice, both times in 2005, when then-Controller Laura Chick audited both the Central City East Association and also the Westwood Village BID. The details of those audits are worth reading, although I’m not going to write about them tonight.3 However, Controller Chick made some observations then that are still relevant today:

Maybe you remember our semi-recent post about the July 28 meeting of the Joint Security Committee, in which some genius of a Sheriff’s deputy poured forth a never-ending stream of genius-level similes, including a comparison of sidewalk vendors at MacArthur Park with “too many animals in one cage.” Well, with all the furor over Hollywood nightclub totalitarianism, we’ve been too busy to get back to that video until this morning. Take a look here as our friends on the committee and some random cop discuss the Rusty Mullet. As always, a complete transcription may be found at the end of this post, but here is essentially what was discussed in this metaphorically smoke-filled back room.

Fred Rosenthal, of friendly neighborhood electronics retailer Ametron, who’s evidently the chair of this committee, noted that there was no one there from the City Attorney’s office to make a report. Kerry Morrison, who’s keeping track of the progress of the BID’s ongoing conspiracy against Hollywood bars and nightclubs whose patrons don’t match her favored color scheme, announced that they were busy downtown at the Rusty Mullet CUP revocation hearing.

Some random cop from the Hollywood Division then proceeded to ramble on about how the LAPD is targeting the Rusty Mullet, complete with can-I-get-a-witness hallelujah-interjections in four part harmony by John Tronson. After that, Kerry Morrison, as pictured above, actually giggled and counted down the remaining Hollywood nightclubs on her fingers. Of course, those aren’t all targeted for destruction by her and her cronies. Some, after all, cater to white people and are owned by former HPOA Board Member John Lyons, so those can stay. Due to some kind-hearted click bait1 bestowed by loyal FOMs Esotouric, my colleagues’ recent post on the resurgence of the long-dormant proposed Echo Park Business Improvement District has turned out to be one of our most popular posts of 2016. The colleagues left out some absolutely essential information and so I’m following up on their behalves. Also I used the whole situation as an excuse to ride the 704 Eastbound to Echo Park Avenue and Sunset Blvd. to check out the situation on the ground.

First the essential info: This thing is on the agenda for the Economic Development Committee meeting on Tuesday, May 10, in room 1010 in City Hall. You can go tell them what you think about it. Unfortunately I have other commitments, and I’m sure approval is a foregone conclusion, but there’s the info if you want it.

Second, as you can see from the images accompanying this post, if the BID’s approved a lot of stuff is going to change out there. They’re going to chase off taco trucks. BIDs hate taco trucks with a passion that’s hard to understand. They even, believe it or not, hate taco trucks parked on private property. Showing an astonishing ignorance of the rights of property owners in a free society, they’ve been known to express amazement that they’re not against the law.

If the BID is approved, sidewalk signs have got to go. BIDs freaking hate sidewalk signs. In fact, one of the very first things Kerry Morrison did in the 1990s after the Hollywood Entertainment District BID was established was to go after businesses with signs on the sidewalk. Why? Who the hell knows? It offended her sense of order or something. Why should Echo Park expect anything different.
