Today’s post is an update on my December 2019 lawsuit against The Accelerated Schools. As of now all settlements are off the table and we’re going to trial! Attorney Skeels filed the trial brief last week, and here’s some background from an earlier post:

… Which brings us to that shady criminal conspiracy known as I’ve written a lot about these folks and their cartoonishly wicked white supremacy but, you may have noted, none of it has been based on public records apart from this very first thing I did in April 2019.

So I sent them a few [CPRA] requests … and they made a few desultory stabs at answering me in compliance with the law and then stopped responding at all. But as you’re probably aware, the situation with this Klown Kar Krew has grown ever more urgent, more of public interest than ever before.

What, that is, with their retaliatory firing of long-time employee Hilda Guzman and subsequent unfair labor practices complaint by her union, with repeated community protests at their infernal board meetings, and the unexpected1 recent petulant rage quit by now thankfully former board chair Juli Quinn. We need to be able to understand what these folks are up to! Which is why their special variety of unhinged intransigence can’t go unanswered, not if we expect government of, by, and for the people to not perish from this earth.

Remember all the way back in December 2019 when I was forced to file yet another lawsuit seeking to enforce the California Public Records Act against yet another white supremacist gentrifying charter, this one known as The Accelerated Schools? Well, it happened. And after fooling around for almost a year, TAS2 produced a bunch records in October 2020.3 Exciting, of course, but they were up to their usual no-good nonsense and the production was deficient in a number of essential ways.

Larchmont Village BID Ordered To Pay $42K In Attorney Fees In My Public Records Suit Against Them! — Their Weirdo Lawyer Tom Cairns Savagely Rebuked By Judge For His Dishonest Nonsense! — I Hope Other BIDs Will Learn Their Damn Lesson From This Stunning Victory And Stop Obstructing Access To Public Records!

You will no doubt recall that in June of this year the creepy little South Central Hollywood white supremacist criminal conspirators over at the Larchmont Village BID crashed, burned, and utterly lost the public records lawsuit I was forced by their unhinged intransigence to file against them back in early 2018.

And the chariot of justice is creeps slowly along its path as if pulled by snails, friends, but it eventually gets where it’s going. Thus did it happen that yesterday, November 21, I found myself once again at the Stanley Mosk Courthouse, right there in Department 82, represented by the incomparable Abenicio Cisneros, arguing for the fees which he so righteously earned in this righteous cause!

South Central Hollywood Racketeer Club Larchmont Village BID Loses Public Records Act Lawsuit!! — Ordered By Judge Mary Strobel To Stop Fooling Around And Do An Adequate Search For The Damn Records!! — Their Kooky Legal Strategy Dismissed Out Of Hand!! — Apparently Their Kooky Lawyer Thomas Cairns Misrepresented Facts To The Court — Motion For Fees Likely To Follow — A New Request For Records Already Filed!

Long story short. The weirdos over at the Larchmont Village BID completely ignored my 2017 requests for records, so in March 2018 I had to file a petition against them. They failed to file an answer to the petition and then showed up at the trial setting conference whining about how mean I was and asking for extra time to file an answer. Well, they never filed anything, and in March 2019 my lawyer, the incomparable Abenicio Cisneros, filed a smashing opening brief.

And then on May 16 of this year we all showed up for the trial. And even Thomas Cairns showed up, twitching like a tweaker, half-empty pack of Marlboro Reds in his briefcase, prescription aviator shades perched on his surreally toupeed brow. And the judge, Mary Strobel, called the case. And Cairns began babbling some crazed stream of consciousness in which he seemed to be representing that he didn’t actually appear before the court in 20181 and therefore everything should be tossed on a technicality.

The judge seemed skeptical, like really, really, really skeptical, of Cairns’s claim. But she decided to put off the hearing for a couple weeks while she ordered up a transcript to check Cairns’s assertions. The new hearing was held last Tuesday, June 4, 2019. And it turned out that in 2018 Cairns didn’t say anything like what he claimed he said. It was all a big fat lie.

And when the judge explained this to him he had the nerve to ask for another 30 days to file a response to my brief! Strobel said no way, friend, and ruled against the BID on all of my causes of action. You can read her ruling here and there is a transcription below.

Also, don’t forget that if a requester, that’s me, prevails, as I did, in a CPRA action then the respondent, that’s the BID, has to pay my lawyer’s fees and also all the costs involved in filing the suit. That doesn’t happen automatically, though. There’s a whole new set of proceedings, which will start with filing a motion asking for the money, about which I will let you know when it happens.

And finally, finally, this victory means that I am free to start requesting records from these Larchmontane criminals once again. Sent some askyness off to these gangsters the instant I learned of the ruling! And read it here! Looking forward to receiving, reading, publishing, analyzing, and, of course, mocking the holy hell out of these goodies!

Of course you remember in July 2018 when Superior Court judge Mary Strobel splained in terms that were anything at all but uncertain to Hollywood Superlawyer Jeffrey Charles Briggs that his client, the freaking Hollywood Media District BID, was going to have to pay my lawyer $30,000 in fees essentially because both they and their lawyer are a bunch of loserific morons?1

Anyway, since the ruling, Jeffrey Charles Briggs and, presumably, his clients, have been stumbling about the place not paying and mumbling semicomprehensible nonsense about how they were going to appeal, about perversions of justice,2 and so on, the upshot of all of which mumbling is that, by God, they weren’t gonna pay. But a court order is a scary, scary thing. So yesterday, September 26, 2018, they paid the damn money to my lawyer, the incomparable Colleen Flynn!

And in honor of their new-found, belated and, sadly, coerced, commitment to actually following the damn law and also to making it continue to be economically feasible for lawyers to help me encourage the City of Los Angeles and its damnable business improvement districts to actually follow the laws that regulate them, I have issued this commemorative coffee mug! Judge Mary Strobel Rules That The Media District BID Must Pay $30,000 In Fees To My Attorney In My CPRA Case Against Them!! — Huge Fail For Hollywood Superlawyer Jeffrey Charles Briggs And His Bizarro-World Argument That I Deserve To Lose Cause I Am So Mean To His BIDdie BFFs — Briggs’s Other BID Clients Ought To See That It Is Time To Choose Between Coughing Up The Records And Coughing Up The Benjamins!!

As I’m sure you’re aware I was forced in 2016 by the arrogant intransigence of the Hollywood Media District BID to file a writ petition against them asking that they be ordered to follow the damn law.1 The petition was granted in part on January 30, 2018 and the BIDdies had to hand over some emails to me. I wrote about those goodies here and here.

What happens then is exceedingly clear under the law. The CPRA §6259(d) states that: The court shall award court costs and reasonable attorney fees to the plaintiff should the plaintiff prevail in litigation filed pursuant to this section.

The “shall” means that a fee award is mandatory. The judge is not allowed not to award fees to the requester if the requester prevails. Of course, we have to consider what it means to prevail, but this has been settled by the courts in Belth v. Garamendi, which states: We further hold that the plaintiff has prevailed within the meaning of the statute when he or she files an action which results in defendant releasing a copy of a previously withheld document.

So the fact that the judge ordered the BID to give me those emails in February pretty much sealed their fate. Of course, they weren’t going down without a fight. My lawyer, the incomparable Colleen Flynn, asked them for $48,000 in fees. Briggs filed a response saying essentially that we shouldn’t get any fees but if we did it shouldn’t be nearly that much.

Flynn filed a simply brilliant rejoinder to that, and this very morning the judge rejected every last one of Hollywood Superlawyer Jeffrey Charles Briggs’s arguments, including his incredibly, embarrassingly whiny oral argument, and handed down a ruling awarding $30,000 in fees to Flynn. Ironically, before the ruling, Flynn offered to settle for significantly less than that and was roundly rejected by Attorney Briggs. Larchmont Village Trial Setting Conference Today Essentially Anticlimactic But With A Few Interesting Aspects — Judge Mary Strobel Grants Respondents 30 Days Extra To File Response

As I’m sure you recall, in April I was forced by their bizarro antisocial intransigence and utter failure to comply with the California Public Records Act to file a petition for writ of mandate against the kooky little backwater Larchmont Village BID in the heart of South Central Hollywood. They don’t seem to be interested in settling right now, and so this morning we all had to haul our tired bones out to the Stanley Mosk courthouse for the trial setting conference.1

It was the incomparable Abenicio Cisneros appearing for me and for the BID it was some dude who goes about the place passing himself off as J. Thomas Cairns, although I don’t know anyone who’s seen his ID. You may already know, but these conferences tend to be fairly routine, although sometimes something interesting happens, and a couple things happened here.

A couple weeks ago I wrote about an email that self-proclaimed Hollywood superlawyer Jeffrey Charles Briggs had released to me in response to a CPRA request but later claimed that it was exempt from release as a result of his having solemnly intoned the words “deliberative process” three times while standing on his hands naked at a crossroads at midnight on the Summer Solstice, which is about the level to which the CPRA has descended in this fair City in these latter days.

I mentioned at that point that he and his infernal client, the Hollywood Media District Property Owners Association, had been ordered by the Hon. Mary Strobel to hand over a whole passel of other emails which they’d claimed were exempt for various reasons.1 So finally I received these emails from le super-avocat de Hollywood lui-même, and now you can read them too!

An Unforced Error By Self-Proclaimed Hollywood Superlawyer Jeffrey Charles Briggs Provides Unique Insight Into The Thoroughly Cynical, Thoroughly Bogus Nature Of BIDs’ Use Of The Deliberative Process Exemption To The California Public Records Act — They Even Used It In One Case To Cover Up A Blatant Brown Act Violation

One of the biggest flaws in California’s Public Records Act is that the various local agencies that constitute our government are trusted to search their own records, decide without oversight what’s responsive to requests and, worst of all, decide what’s exempt from production. My general feeling about BIDs and record searches is that they purposely don’t find everything, about their exemption claims that they’re mostly lying.

Unfortunately, without a lawsuit, it’s not realistically possible to get a look at records for which they’ve claimed exemptions.1 Hence it’s not usually possible to check how closely this feeling corresponds to reality. However, due to an interesting confluence of events, I recently obtained a number of emails between various people at the Hollywood Media District BID for which their lawyer, Jeffrey Charles Briggs,2 had claimed exemptions, thus making it possible to compare his claims with the actual records. Unsurprisingly the exemption claims turned out to be 99\frac{44}{100}\% pure and unadulterated nonsense. You can find the emails and some analysis after the break, but first I’m going to ramble on a little about some tangentially related issues.

Like many policies, this default assumption of honesty on the part of local agencies no doubt works when it works, but when it comes to the BIDs of Los Angeles, who are staffed, for the most part, with the most unscrupulous bunch of pusillanimous chiselers ever to engorge their bloated reeking tummies at the public piggie trough, it doesn’t work at all.3 They lie, they confabulate, they delude themselves and others, and generally display utter and overweening contempt for the rule of law.4

And nowhere does their misbehavior reach a more fevered pitch than in the use of the so-called “deliberative process” exemption to the CPRA. In short, this is an exemption that courts have built up out of the “catch-all” exemption to CPRA, found at §6255(a), which says:
