More Than Two Months After Its Business Improvement District Came Into Being, The Venice Beach Property Owners’ Association Has Not Yet Signed An Administration Contract With The City Of Los Angeles, But A Comparison With Other Recent BID Establishments Suggests That This May Not Mean Much

Carl Lambert, officer of the Venice Beach Property Owners Association, as he might have appeared on the cover of the late lamented Berkeley Barb which, given the parallel tragedies which have befallen both Berkeley and Venice, is kind of appropriate in a way sorta kinda..
Well, since the first of the year, I have been obsessively checking the contract search tab of the City Clerk’s Council File Management System for any sign of an agreement between the City and the Venice Beach Property Owners Association, as that criminal conspiracy between Carl Lambert and his unindicted co-conspirators Mark Sokol and Steve Heumann is known to the world, for the administration of the Venice Beach BID. The CFMS1 is an essential tool, but its built-in search engine is freaking horrible, and it seems even horribler2 when searching contracts. So the fact that no contract popped up day after day after day didn’t exactly fill me with confidence in the theory that no such contract existed.

But today, after two freaking months with no sign of it, I finally emailed the ever-helpful3 Shannon Hoppes to ask if there was a contract or not. She answered quickly and told me that there was not yet any such thing. Well, hope springs and so on. Into my head sprang joyous visions of Carl Lambert and his infernal BID-buddies Mark Sokol and Steve Heumann being so overwhelmed with the furor and pushback called into being by their infernal BID that they took their BID-ball and went home. They are being sued, their shadowy BID consultant, the Divine Ms. Tara Devine, has as shaky a grasp on the law and also on the truth and also on basic human decency as her freaking clients, and maybe the pressure was all just too much for them, mused I.

But it also occurred to me that maybe it didn’t mean anything, and it was just runna-the-mill incompetence and sloth. So I decided to check out other recent BID establishments and compare. What I found proves that, while there has been a longer than average delay between the establishment of the VBBID and the signing of the contract, it’s not an outlier, nor is it the longest such lag time among property-based BIDs established in the last few years. Thus while this at-least-two-month delay between the BID establishment may yet turn out to be a sign of good things to come with respect to this BID, for now it’s not possible to draw any conclusions at all about it. Open Letter To Holly Wolcott and Miranda Paster Concerning Tara Devine’s Misleading Everyone With Her Discredited “Zoning Not Use” Theory

Here’s a letter I sent this morning to Holly Wolcott and Miranda Paster about Tara Devine misleading everyone with respect to the question of whether commercial properties were necessarily included in the Venice Beach BID. There’s a transcription after the break, as always, for the PDF averse.

This is a fairly serious matter, and actually illegal if it turns out to be the case that Tara Devine was required to register as a lobbyist last year, as I have alleged that she was. The point is that since the Clerk’s office is supposed to oversee BIDs, they ought to oversee BID consultants as well, and since both honesty and integrity are explicit criteria for qualifying as a BID consultant perhaps these two ought to look into whether Tara Devine is actually qualified. How I Reported Shadowy BID Consultant Tara Devine To Los Angeles City Attorney Mike Feuer For Knowingly And Fraudently Deceiving Mike Bonin With Regard To A Material Fact Pertinent To The Establishment Of The Star-Crossed Venice Beach BID

“I’ll be damned if I’m ever going to say, ‘It’s not my job,’” Feuer told the Times editorial board. We like that attitude. All L.A. residents should.
If you want to skip the explaining and go straight to the complaint, here it is.

Friends, take a look at the exceedingly fascinating LAMC § 48.04(B). This lovely little slab of ethicalliciousness illegalizes any occasion when a lobbyist might:

Fraudulently deceive or attempt to deceive any City official with regard to any material fact pertinent to any pending or proposed municipal legislation.

And of course, you recall what a lobbyist is, it’s a technical term in this setting.4 Lobbyists are defined in LAMC §48.02 to be:

any individual who is compensated to spend 30 or more hours in any consecutive three-month period engaged in lobbying activities which include at least one direct communication with a City official or employee, conducted either personally or through agents, for the purpose of attempting to influence municipal legislation on behalf of any person.

Well, as you may recall, I spent the last two months assembling a highly detailed argument that Tara Devine met this definition. If that’s right, and I certainly think that it is, she’s also forbidden from fraudulently deceiving Mike Bonin, e.g., about material facts in regard to the formation of the Venice Beach BID which, as I’m sure you know, requires legislation for the BID to be brought into existence.

The argument is that she got everyone to believe that it was required under state law to include commercially zoned properties in the BID, even though not only is this not true, not only did she know it was not true, but her having convinced everyone of this led to more properties being in the BID, which increased the amount of money under the control of her clients, the Venice Beach Property Owners Association. Shadowy BID Consultant Tara Devine Moonlights As A Planning And Zoning Lobbyist, Also Unregistered!

A recently discovered shadowectomized portrait of shadowy BID consultant Tara Devine by French Fauvist painter Raoul Dufy, who never drew a shadow in his entire career.
As Karl Marx so wisely pointed out once upon a time5 crime is a career like any other. One reason is that there’s a learning curve. It takes some experience to be able to make crime pay. And the same, it seems, is true for unregistered lobbyists like our perennial subject, shadowy BID consultant Tara Devine. I reported last week that I had turned Tara Devine in to the Ethics Commission based on exhaustive research that indicated that she had spent more than 30 compensated hours over three consecutive months in 2016 lobbying for the Venice Beach BID without having registered with the City.

And I really thought I had found most of the relevant evidence,6 but it turns out that I was ever so wrong. Just last night I discovered, never mind how, that Tara Devine not only does shadowy BID consultancy, she also represents permission-seeking clients before planning boards. CPRA Goes Meta: Holly Wolcott Refuses To Release Some Records But Ends Up Releasing Advice Email From Deputy City Attorney Mike Dundas Authorizing Her Refusal

Holly Wolcott reimagined as a child of the 60s, chanting the Nam Myoho Renge Kyo of her people, which goes like this: “CPRA does not obligate me to answer questions. Only to provide records. CPRA does not obligate me to answer questions. Only to provide records.” HEY HOLLY!! CPRA also does not obligate you to not answer questions…
Perhaps you remember the long and winding narrative of how I spent almost half of last year trying to get the City Clerk’s office to cough up mailing addresses for the property owners in the Venice Beach BID, which they finally did do. There is a reasonable summary with links right here. Today I can reveal a little behind-the-scenes episode in that story.

A few weeks ago, in the middle of about a thousand pages of emails that the City Clerk’s office finally handed over, only about six months after I asked for them, I found this little gem of an email chain. Most of it is me hassling various Clerk staffies for the list of addresses, but right in the middle of it all, there’s an interlude between Holly Wolcott and Deputy City Attorney Mike Dundas, who’s evidently some kind of CPRA specialist over there in City Hall East.7

The TL;DR is that she goes: “Mike, do I gotta give him the goods?” and Mike’s all: “Nah, Holly, you don’t gotta because reasons.” It’s also interesting that the reasons he gives her are specious, providing, among other things, yet another example of how the Property and Business Improvement District Law of 1994 (which makes BIDs subject to CPRA) seems not to be understood so well over at City Hall. How I Reported Shadowy BID Consultant Tara Devine To The City Ethics Commission For Failing To Register As A Lobbyist Based On Her Work For The Venice Beach Property Owners Association

The TL;DR is that I believe that in the course of her consultancy with the Venice Beach BID, Tara Devine qualified as a lobbyist within the meaning of the Los Angeles Municipal Lobbying Ordinance, was therefore required to register with the Ethics Commission, and failed to do so, putting her in violation of the law. If you know what all those terms mean, you may want to go straight to the complaint (Warning: 23MB PDF). For a detailed explanation of the background, though, read on!

The key is found in Section 48.07, which states that “An individual who qualifies as a lobbyist shall register with the City Ethics Commission within 10 days after the end of the calendar month in which the individual qualifies as a lobbyist.” After all, anyone can search the Ethics Commission’s database and see that Tara Devine has never registered as a lobbyist. So the question is whether Tara Devine is “An individual who qualifies as a lobbyist.” This turns out to be a fairly complicated thing to determine.

The first place to start when interpreting any law is with the definitions. In the case of the Municipal Lobbying Ordinance (henceforth “MLO”) they are found at LAMC §48.02. In particular, we will find that the word “lobbyist”:

means any individual who is compensated to spend 30 or more hours in any consecutive three-month period engaged in lobbying activities which include at least one direct communication with a City official or employee, conducted either personally or through agents, for the purpose of attempting to influence municipal legislation on behalf of any person.

And in order to see whether this applies to Tara Devine, we need to understand the following terms:

  • Lobbying activities
  • Municipal legislation
  • Attempting to influence


And once we understand what those three phrases mean, we have to show that Tara Devine was paid for 30 or more hours lobbying on behalf of someone else. The details, as always, are after the break!

Shadowy BID Consultant Tara Devine Unilaterally Removed A Commercially Zoned Parcel From The Venice Beach BID In 2015 And Then Told Unhappy Property Owners In 2016 That She Was Not Allowed To Remove Parcels From The BID If They Were Commercially Zoned

The Venice Post Office; zoned commercial. Now it’s in the BID! Now it’s out of the BID! Now it’s back in the BID!
I recently wrote in excruciating detail about how everyone involved with the BID formation process denies, almost certainly wrongly, that they have any power at all over which parcels are included in a BID. Thus, e.g., did Tara Devine inform unhappy property owner William Kuel in this email from August 2016 that his property, which is zoned commercial but used for residential purposes, must be included in the Venice Beach BID. She went so far as to tell him explicitly that “neither the Engineer nor I can remove your parcel from the proposed BID.” This phenomenon has been hugely controversial in the formation of the Venice Beach BID, and is the basis of a lawsuit filed against the City by Venice residents upset over the inclusion of their property in the BID.

So what a surprise it was to find, buried amongst thousands of pages of nonsense in this latest pile of emails between Tara Devine and various employees of the City Clerk’s office, this June 30, 2015 missive from Tara Devine to a bunch of people, stating that she was unilaterally removing a commercially zoned property from the BID for, seemingly, no particular reason:

I will also re-send the database as we made one tiny change. After a discussion with Ed, we removed the federal USPS parcel (Venice post office.) It was on the edge of the BID and was not required for a contiguous boundary, so we just removed it from dbase and other docs.

Leaving aside the evident fact that Tara Devine doesn’t know the difference between contiguous and continuous, isn’t this interesting? She “just removed” a piece of property from the BID. And then a year later she was telling property owners that she didn’t have the power to remove parcels, and some of those property owners are now suing the City partially on the basis of this claim she8 has been pushing about her powerlessness. It will be interesting to see if this turns out to be evidence in the lawsuit!9 It’s extremely interesting to see that she told a bunch of City Clerk employees that she’d done this and not one of them questioned her ability to do it, which is in stark contrast to Holly Wolcott’s 2016 assertions that no one was empowered to remove properties.

Tara Devine’s justification for her unwillingness to exclude property has been that commercially zoned parcels cannot be removed,10 so perhaps this property isn’t zoned commercial? Well, good old ZIMAS will let us investigate this matter more thoroughly. This and some other issues with the property, including its current status with respect to BID inclusion, are discussed in painfully obsessive detail after the break.

New Documents: More Emails Between Tara Devine and the L.A. City Clerk’s Office, More Emails Between LAPD Captain Peter Zarcone and the HPOA, A Bunch of CPRA Requests to L.A. Sanitation

Is Mike Bonin A Liar Or A Fool? Which Is Holly Wolcott? Tara Devine? They’ve Acted As If There Was No Effective Way To Remove Residential Properties From The Venice Beach BID Without Rezoning When They Must Or Should Have Known That State Law Explicitly Empowers City Council To Do So Unilaterally

Did Mike Bonin lie about his ability to remove properties from the Venice Beach BID? Or did he just not care enough to read the law governing BID formation? Or both?
One of the most contentious issues in the very, very contentious formation of a business improvement district in Venice has been the existence of properties with commercial zoning that are used solely for residential purposes that were included in the BID and therefore assessed. This is the basis of a recently filed lawsuit against the City as well as a significant number of other protests against the BID.

For instance, in May 2016, Venice homeowner12 Louis Traeger wrote to the City protesting the inclusion of his home in the BID. On June 1, 2016 Los Angeles City Clerk Holly Wolcott answered him, stating:

In address of your request to remove said property from the proposed Business Improvement District, the City Clerk does not have the authority to remove or add properties in a Business Improvement District. However, we will forward your request and this information to the Engineer conducting the survey and analysis for the creation of the Venice Beach Business Improvement District.

Further, you requested notice of any hearing concerning the approval of the Venice Beach Business Improvement District in order to submit your written opposition. If your property is ultimately included within the Business Improvement District boundaries, a notice of the City Council hearing date will be mailed to you. At the hearing, an opportunity will be provided to protest the establishment.

As far as I can tell13 what Holly Wolcott says is the truth and it’s nothing but the truth, but it is in absolutely no way at all the whole truth. Her statement that “the City Clerk does not have the authority to remove or add properties in a Business Improvement District” is true. When she follows it up with a statement that she will “forward your request and this information to the Engineer conducting the survey and analysis” she is certainly creating the impression that ONLY the engineer is empowered to remove properties. This is not true. It’s really badly not true, as I will demonstrate below.

In 2015 Bonin Aide Debbie Dyner Harris Sought To Leverage “Extremely Unusual” Outsized City Assessment For Venice Beach BID Into Voting Seat On Board Of Directors But City Attorney Said No! Freaking! Way! Conflict! Of! Freaking! Interest!

I’ve written before on how the City of Los Angeles arranges for itself to be lobbied by BIDs for various reasons. Now it appears that even this usual arrangement wasn’t enough for Mike Bonin and Debbie Dyner Harris at CD11 with respect to the Venice Beach BID. In particular, during the formation process, in December 2015, Dyner Harris emailed Miranda Paster asking if she could have a voting seat on the BID Board of Directors:

Hi Miranda, how are you? I hope all is well. I am checking on something we had discussed a while ago, but I can’t find in my notes. I wanted to confirm whether or not the City, as 1/3 paying member of the BID,15 is allowed to be a voting member on the BID board.

Miranda Paster replied a few days later, stating:

We opt out of sitting on the Board because it may appear to be a conflict of interest. We can sign the petition for a BID and we cast a ballot for the Prop 218 balloting. However, we do not sit on the boards and vote.

Debbie Dyner Harris doesn’t like this at all.
