Well, friends, if you’ve been following the saga of the Venice Beach BID for what seems like forever but has only been at least in the most recent iteration about two years, you’ll know all about how BID ED Tara Freaking Devine is not only overpaid as a BID consultant but she’s a liar and a damned liar and a lawbreaker and a damned lawbreaker and it took her and her white supremacist board of directors freaking forever to get their BID up and running.

Now, this kind of behavior on the part of a BID is bad enough, but from the City’s point of view the only really bad part is that the BID started 18 months ago and they’ve been collecting money from the property owners and they’re not spending it on the activities they’re meant to spend it on. Oh yes, and BIDs are also required to submit quarterly reports to the City and, this last by the actual state law regulating BIDs, an annual planning report to the City as well.1

And you surely won’t be surprised to learn that by March 19 of this year the damn BID hadn’t done any of that stuff at all. But what is surprising is that the City of Los Angeles decided to actually enforce their contract and the law. In furtherance of this worthy goal City Clerk Holly Wolcott sent VBBID boss honcho Mark Sokol a zinger of a letter stating that the BID was out of compliance and they had better get their act together quickly or else the City was going to hold a hearing to disestablish the BID per the PBID law at §36670.

Maybe this marks the start of a new policy, where the City of LA will actually encourage or maybe even force BIDs to follow the damn law. They’ve been absolutely unwilling to do this when it comes to CPRA compliance, but more recently have shown some teeth e.g. with respect to the contractual requirement to publish newsletters. Anyway, whatever’s going on there’s a transcription of Wolcott’s letter after the break and, as an extra special bonus, some discussion of some astonishingly whiny emails by Tara Devine about the noncompliance letter.

John Walker Of The Studio City BID Asked Rita Moreno Of The Clerk’s Office For Advice On A CPRA Request I Made And She Gave Him A Detailed, Thoughtful, Largely Correct Response Despite The Fact That Doing So Directly Contradicts Her Boss, The Mendacious Ms. Holly Wolcott, Who Has Asserted Time And Again That “the Clerk’s office [does not] have the authority to control/direct the records management practices of … BIDs”

In the great and good2 City of Los Angeles, business improvement districts are overseen by the City Clerk‘s office. They have a whole subsection of their website about BIDs; how to form one, what they are, and so on. And not only that, but as part of their oversight process, each BID signs a contract with the City Clerk’s office. These are all about the same as one another, and if you want to look at one, here’s a link to the Studio City BID’s contract.3

And, like every one of these contracts between the City and its BIDs, this one contains, in Section 16.3, the following fairly unequivocal requirement: “… Corporation and the Board of Directors are also subject to and must comply with the California Public Records Act.” Finally, buried deep down in this website, they have published a stunning little item called the Service Operations Summary, which purports to explain the City’s role in relation to its BIDs.

In particular, in Section 5, this document claims that:4 “THE [CLERK’S] OFFICE PROVIDES CONTINUOUS CONTRACT COMPLIANCE ASSISTANCE. Staff monitors the use of revenue in order to ensure that assessments paid by district members are used appropriately and in accordance with contractual, budgetary, statutory and City regulations and procedures.”

Now, it’s a tragic aspect of the CPRA that the only remedy for noncompliance that the legislature has seen fit to provide is a lawsuit. However, it seems at least plausible from the foregoing that if a BID is not complying with the CPRA, it’s the duty of the office of the Clerk to ensure that they do comply with it. Acting on this theory, and hoping to avoid a bunch of damn lawsuits,5 once upon a time in 2016 I tried to get Ms. Holly Wolcott to mediate between me and uppity non-CPRA-compliant BIDs.

But she, almost certainly acting on the advice of rogue deputy city attorney Michael Joseph Dundas, denied that the City had any power whatsoever to compel BIDs to comply with the law, despite what the above-quoted Service Operations Summary claimed. Despite the fact that the City has a contract with each BID and the contract requires CPRA compliance. And she didn’t just deny it, she denied it vehemently:, stating in an email to me6 that:“…the Clerk’s office [does not] have the authority to control/direct the records management practices of the various BIDs which are entities wholly separate from the City.”

Anyway, a couple weeks ago, I sent a CPRA request to the Studio City BID, asking for a bunch of stuff. When the material showed up yesterday, I found an exchange between John Walker and Rita Moreno, a City Clerk staffer in charge of many aspects of BIDs, discussing my request. Basically he was all like do we have to do it because expensive and time-consuming. And she was all like … well, turn the page to read all the emails and see exactly what she was all like, but suffice it to say she was all like DIRECTING him to do it because of the law. That is, she was doing precisely what her boss, the famous Ms. Holly Wolcott, said that the City would never do and didn’t even have the power to do.

Highland Park BID Executive Director Misty Iwatsu Wanted To Apply For A Job In Culver City But Thought Culver City Is Part Of Los Angeles — Thank Goodness The Leaders Of Los Angeles Have Chosen To Appoint To Its Positions Of Influence And Power Persons Of Such Deep Wisdom And Knowledge About The Politics, Society, And History Of Our City!

Tonight I have for you another juicy morsel from the recently announced set of emails from the Highland Park BID. Our story begins with this email from the BID Consortium to all of its zombie-like followers who, it seems, include Misty Iwatsu. The email was a listing of job opportunities for the LA BIDdie community, ensubjectified “Announcement:::BID Opportunities” and containing, in pertinent part, the following likely little slab of puckey:

Culver City Arts District BID – Executive Director

The Culver City Arts District is looking to hire a part-time Executive Director to help manage the programs and Board. The position will only be about 20-25 hours a month ($45-50 an hour). They are hoping to find someone that can assist with the business outreach, events, board administration, oversee a marketing consultant and generally keep things humming along. It is fairly low-key – and relatively flexible – though the board is looking for a self-starter with exceptional communication skills that can keep things moving along without a lot of oversight.

And friend Misty Iwatsu evidently read that and thought something along the lines of “I’m gonna cut me a slice of that cake!” because, somewhat less than three days later, she sent this cheerful little missive off to City of Los Angeles employed BIDmeisterin Rita Moreno, whom so many of our BIDs rely on for her good sense and relative sanity,7 asking for some job-related info and, in the process, fatally revealing the fact that she thought Culver City was somehow a part of Los Angeles when everybody who’s actually paying attention knows it’s its own damn place, got their own damn mayor, their own damn city council, their own damn muni code. It’s just like a real city, only smaller!

A Bunch Of Emails Between The Los Feliz Village BID And The City Of Los Angeles Reveal A Number Of Interesting Issues, Not Least Of Which Is City BID Analyst Giving The BID Legal Advice On CPRA Requests Contrary To Holly Wolcott’s Position That This Does Not Happen

The other day I received a big pile of emails between the Board of the Los Feliz Village BID and people at the City of Los Angeles. They’re available here on Archive.Org. Note that the BID produced these by using some kind of bulk forwarding utility for Gmail to send these to their attorney, uniquely repetitive chair of the famed Hollywood Chamber of Commerce, Mr. Jeffrey Charles Briggs Esq.

Attorney Briggs then exported the forwarded emails as MSG files and passed them along to me. Unfortunately this process mangled the metadata and made it more trouble than it seems to be worth to sort and rename the files by date and time. Sr. Briggs seems to be willing at least to consider instructing his clients to provide actual exact copies of emails in the future, but for now we’ll work with what we got, especially since the whole process has taken more than six months to get to this point. Maybe you’re familiar with §54954.1 of the Brown Act, which requires BIDs8 to notify anyone in advance of their meetings and send them agendas and other materials at the same time this material is distributed to the BID’s board.9 Another crucial bit is found at §54954.2(a)(1), which requires posting of agendas on BIDs’ websites.10

And it will be no surprise to anyone who reads this blog to discover that Blair Besten and her weirdo criminal conspiracy, the Historic Core BID, have consistently ignored these two requirements since time immemorial. Of course, no shock. Many members of the BID’s board of directors are criminals. Blair Besten herself breaks the law with relish and impunity.

So I asked Blair Besten in May to inform me of the BID’s meetings. She ignored me for the May meeting. I asked her yet again.11 She ignored me again. A little bird told me that they had a meeting scheduled for tomorrow, June 29, so I walked by the BID office yesterday, where they had partially complied with the law by posting an agenda in the window. Too much!

New Documents! East Hollywood BID Quarterly Reports, Media District BID Emails, Media District BID Materials About Andrews International Security Switcheroo Including Emails, Draft Contracts, Price Matrices, And So On!

Yesterday I received a bunch of new records from Hollywood BIDboy attorney Jeffrey Charles Briggs, acting on behalf of the East Hollywood BID and also the Media District BID. Some of the stuff had to do with the Media District’s early renewal, which I wrote about yesterday, and today I’m mostly just announcing the balance of the material, which is available from our Archive.Org collections. In particular, we have:

  • East Hollywood BID quarterly reports 2012-2016 — BIDs are required by their contracts with the City to submit quarterly reports with updates on how they’ve been spending their money.12 These are useful to have on hand for reference. There’s nothing in these that stands out right now, but I haven’t read them carefully yet nor even looked at all of them.
  • Media District emails with the City of LA — And also a few from the Hollywood Property Owners Alliance folks, although nothing substantial. Again, it’s essential to have this material on hand for reference. There doesn’t seem to be much of special interest here, although there’s a lot more evidence of Rita Moreno’s uncharacteristically activist style as a BID analyst with the Clerk’s office, which is abstractly a good thing, although certainly she’s not going to be an activist if it upsets the BIDs too much.
  • Media District emails about Andrews International Security contract — The Media District BID is in the process of hiring infamous private security monolith Andrews International as its security provider, to begin July 1. These are some emails about the process. The most interesting things here are the attachments, which include A/I’s standard contract as well as proposed pricing matrices and so on. Andrews International famously runs the infernal Hollywood BID Patrol for the even-more-infernal Hollwood Property Owners Alliance just North of the Media District, so everything about them is interesting. There is much more material to come regarding this matter, and I will write about it in detail as it comes in, but it’s essential enough that I thought I’d better publish what I had immediately.

So that’s the new stuff, all except for one little email which didn’t exactly fit into any of those categories. It appears to constitute attorney/client communications, and perhaps it was handed over in error. But legally handed over it was, so I’m publishing it, and you can see a copy and read all about it after the break!

South Central Hollywood Racketeer Influenced And Corrupt Organization Officially Known As Larchmont Village BID Appears To Give Up Outlaw Ways, Start Announcing Meetings And Change Their Illegal Bylaws, Perhaps In Response To Yesterday’s Scathing MK.Org Post About Them And Rita Moreno!

But DAMN, it feels good to be a gangsta!
Well, I have been chronicling my troubles with the so-called Larchmont Village BID for at least six months now, starting with their stubborn recalcitrance in releasing records having to do with their accursed signal box art contest, to, more recently, my six month long battle to get a copy of their bylaws out of them, to my eight month struggle to get them to notify me of their damnable meetings as required by the Brown Act at §54954.1, to their appearance in a reprehensible series of emails between City employee Rita Moreno, a BID analyst with the City Clerk’s Neighborhood and Business Improvement District Division, nominally tasked with overseeing BIDs but, in actuality, engaged in enabling their misbehavior and lawlessness.

The thing about those emails was that, along with a bunch of other criminal BIDs, the Larchmont Village BID didn’t post its agendas on its website, even though the Brown Act at §54954.2(a)(1) requires it to do so. And Rita Moreno, rather than telling the lawless BIDs that they were breaking the freaking law, handed out gold stars to the ones who were following it.

Well, that’s where the situation stood until 4:48 p.m. this evening, when I received an email from some entity calling itself office@larchmontvillagebid.com. Attached to this anomalous little missive was the agenda for a BID meeting on Tuesday, May 2. Thus, for whatever reason, just one day after my scathing post calling out the City for not enforcing its laws, its contracts, against these serial South Central Hollywood outlaws, they change their ways. How’s that for activist journalism?! Anyway, there’s tons of interesting stuff to say about this situation that’s a lot more nerdish than that, and you can turn the page if you’re interested.

Yet Another Example Of City Of LA Indifference To Illegal BID Shenanigans: City Clerk BID Analyst Rita Moreno Hands Out (Literal) Gold Stars To BIDs For Minimal Brown Act Compliance But Doesn’t Do Or Even Say Anything To BIDs Who Are Not Only In Violation Of The Law But Have Been Flouting It For Years On End

Yesterday evening, BID-lawyer-to-the-stars Jeffrey Charles Briggs passed along almost 200 emails between Media District BID executive director Lisa Schechter and various people at the City of Los Angeles. These are available en masse at Archive.Org. As always, there’s a lot of chaff in there and a few super-interesting things.13 Perhaps today’s story is an example of the latter.

It began on February 28, when Rita Moreno, newly of the Neighborhood and Business Improvement Division of the City Clerk’s office, the unit that’s meant to oversee the operations of BIDs and make sure that they follow the law and stuff, emailed a bunch of BIDdies to introduce herself and note that only a few of them had their meeting times posted on their websites. Of course, the Brown Act explicitly requires BIDs to notice their meetings on their websites,14 but that’s actually not why Rita was on about this. She was just trying to find out when they met so that she could attend. In fact, it’s not even clear that Rita Moreno knew about the Brown Act requirement.

However, the very next day, our old friend Lisa Schechter of the Hollywood Media District BID, who is not generally known for her law-abiding behavior but who has by now been educated by years of our intense scrutiny to the point where, I hope, she’s beginning to realize that it’s just easier to follow the law,15 wrote back to Rita Moreno, fishing for praise from this unlikely authority figure:

Dear Rita:

Just to reiterate, all of our meetings are posted in accordance with the Brown Act (Committee as well as Board) – Further you have been placed on our automatic distribution list which triggers and [sic] email directly to you for all of our meetings. If you should require any further information please do not hesitate to contact myself or our operations manager, Jim Omahen.

And, a couple hours later, Rita Moreno replied:

Yes…you got a star


And if you’re new to BID studies, you’re probably wondering why this puerile exchange is not just idiotic, sycophantic, and moronic, but also deeply offensive and discouraging to anyone who cares about the rule of law in Los Angeles. Well, read on!

Miranda Paster Whitewashed Homelessness Out Of The Hollywood Media District BID’s 2017 Annual Planning Report, Thereby Unilaterally Altering The BID’s Proposed Activities And Yet Again Putting The Lie To Holly Wolcott’s Often-Used But Thoroughly Discredited Excuse That The City Of LA Has No Control Over BIDs

One of the many interesting documents contained in the yield of a recent CPRA request to the Hollywood Media District BID is their 2017 Annual Planning Report, the final revised version of which was filed by executive director Lisa Schechter with the City Clerk’s office on December 14, 2016.16 The annual submission of these reports is required by §36650 of the California Streets and Highways Code, part of the Property and Business Improvement District Law of 1994, which regulates the establishment and governance of BIDs in California.

One of the purposes of these reports is to keep the City updated on what the BID plans to do during the new year. In particular, at §36650(b)(2) the law states:

The report shall be filed with the clerk and shall refer to the property and business improvement district by name, specify the fiscal year to which the report applies, and, with respect to that fiscal year, shall contain all of the following information: … The improvements, maintenance, and activities to be provided for that fiscal year.

So for instance, the Media District’s plan explains what they’re going to do about cleaning and security, which are two of the core functions of BIDs. Here’s part of their statement on cleaning:

Other expenditures anticipated include tree trimming, purchase of additional trash receptacle, and other similar projects to beautify the District in accordance with the approved Management District Plan.

And part of their statement on security:

Safe Committee meetings address a full range of issues: loitering, public urination, drinking in public, prostitution, vandalism, graffiti, and quality of life issues.

Edited to add: The list that Miranda Paster sent me isn’t even the list I asked for, as discussed in the story below. It’s an edited version of the publicly available ballot tabulation sheet. It is unbelievable that these people are so unwilling to release what are obviously public records and that their unwillingness is so clearly in the service of their political agenda. On the other hand, the fact that they so vigorously defend their secrecy makes it seem even more likely that they’re concealing serious and exploitable weaknesses.

Three weeks ago I wrote about how neither the City Clerk nor CD11 was willing to hand over a list of the property owners in the proposed Venice Beach BID with contract information. CD11 told me to ask the Clerk and the Clerk told me to ask Tara Devine and Tara Devine ignored me (and continues to ignore me). The Clerk’s rationale was that they didn’t have anything to do with mailing out the petitions, so that the Public Records Act didn’t apply to the mailing list.

Now, if you’re not familiar with the act, you may not be aware that (at section 6252(e)) public records are defined fairly expansively to be any “writing containing information relating to the conduct of the public’s business prepared, owned, used, or retained by any state or local agency.” So I made the argument to the Clerk’s office that since they were orchestrating the process, the mailing list was being used by them even if they didn’t own it or retain it themselves. No dice on that, though.

So imagine my pleasure and surprise to discover on August 14 that, upon perusing Government Code section 53753 for the zillionth time (this is the same law used to such marvelous effect ten days later by the incomparable Shayla Myers of LAFLA to derail the whole BID process) that the freaking City Clerk’s office is required to notice the property owners by mail:
