Wesson, Cedillo, and Martinez Introduce Motion Instructing City Attorney To Write A Civil Rights Law Prohibiting Various Kinds Of Discrimination And Establishing A Commission To Enforce It — Demonstrating Yet Again How Our City Council Members Are Liars Even When Every Word Out Of Their Mendacious Mouths Is True

This is just a quick note to call attention to this motion, introduced in Council this morning by Herb Wesson, Gil Cedillo, and Nury Martinez (there’s a transcription of the PDF after the break). The motion, which has been assigned CF 18-0086, instructs the City Attorney with assistance from some other offices to draft a new civil rights law. The proposed law has two main parts.

First, it would prohibit “discrimination, prejudice, intolerance and bigotry that results in denial of equal treatment of any individual” and would do this by banning discrimination based on:

  • race
  • color
  • ethnicity
  • creed
  • age
  • national origin
  • citizenship status or perceived status
  • gender
  • gender identity or expression
  • sexual orientation or perceived orientation
  • disability
  • marital status
  • partnership status
  • employment status
  • source of income

in the areas of

  • employment
  • housing
  • medical services
  • businesses
  • other establishments1

Second, it would establish a new commission, to be called the Civil and Human Rights Commission, which would enforce the law. Now, I am completely opposed to all these kinds of discrimination, and, as you might have guessed, I’m completely in favor of establishing any kind of new venue for me to complain about BIDs to.2 However, as is so often the case with our City Council, things are probably not exactly what they seem to be on the surface.

Worst-Of-The-Bunch Ethics Commission Veep Serena Oberstein, Who’s Paid $87,500 Annually By Her 501(c)(3) Employer Vision To Learn, Both Of Whom Were Poised To Reap Benefit From Version Of Municipal Lobbying Ordinance Revision Pushed Hard By Serena Oberstein, Suspiciously Neglected To Mention This Fact In Any Of The Literally Zillions Of Public Forums Held On The Matter

It hasn’t even been two weeks since the Los Angeles Ethics Commission put our City’s Municipal Lobbying Ordinance in danger of being made meaningless, primarily at the instigation of worst-of-the-bunch Commission Veep Serena Oberstein, with respect to 501(c)(3) nonprofits, so it’s not surprising that all the ramifications of their misfeasance have not yet been completely understood. Along those lines, therefore, here’s another episode from the ethical Twilight Zone in which at least some members of the Commission seem to dwell in these latter days.

You see, Serena Oberstein is not just the City’s most corrupt Ethics Commissioner, what with her sub rosa agenda-pushing for her nonprofit buddies Shyaam Subramanian3 and Nancy Berlin, amongst others, not to mention her refusal to agendize a perfectly reasonable request that her Commission disclose their ex parte communications,4 she’s also the Chief Operating Officer of some Westside do-gooder outfit called Vision to Learn.

And while I had some inchoate notion that her involvement with 501(c)(3) nonprofits might explain at least some of her motivations in the recent fiasco, whereby mostly at Serena Oberstein’s instigation, the Commission ended up recommending to the Council that all 501(c)(3)s with gross annual revenues under $2 million be exempt from registration as lobbyists, I hadn’t taken the time to investigate. But recently it occurred to me to look at Vision to Learn’s5 Form 990s to see how the modifications pushed by Serena Oberstein would affect her employer.6 I published the last few years here on Archive.Org, or you can go directly to the PDFs here:

Los Angeles Ethics Commissioners Fail To Understand Their Powers And Duties Under The City Charter And Thereby Inadvertently (??) Set The Stage For Exempting Nearly All 501(c)(3) Tax Exempt Organizations In Los Angeles From The Municipal Lobbying Ordinance

It seems like forever now, although it’s only been two years, that the Los Angeles Ethics Commission has been discussing proposed changes to the Municipal Lobbying Ordinance (MLO). At this point I just don’t have it in me to summarize the discussion any more, although you can find links to most of my posts on the subject in this post on the penultimate phase of the matter.

At the Commission’s meeting on Tuesday, which you can watch in its entirety right here (or here on Archive.Org if you prefer), there were only two matters left to settle. One was the issue of detailed reporting of contacts between lobbyists and City Officials. I hope to write on what happened with that later on. The other, and the subject of today’s post, had to do with exemptions from the MLO for 501(c)(3) nonprofits. You can watch the whole discussion beginning here. These organizations enjoy some exemptions now by virtue of LAMC §48.03(E,F). You can read the statute for yourself, but essentially it exempts 501(c)(3)s7 which have “… the purpose of representing the interests of indigent persons and whose primary purpose is to provide direct services to those persons…”

As they are wont to do, the staff, in the persons of Director of Policy Arman Tarzi and Mark Low, head of the lobbying program, provided the Commission with a detailed set of recommendations. There were four different options given that had to do with nonprofits, which you can read in the proposal. Of these, three were developed by staff and the fourth8 was provided by nonprofits and proposed to exempt all nonprofits, no matter what they do, which have gross annual receipts of under $2.5 Million.

Never content to leave well enough alone, these hyperorganized nonprofits presented the Commission with a so-called “Option 5,” which they circulated at the meeting. This option proposed to modify LAMC §48.03(E) to exempt from the MLO:

E. Any organization exempt from federal taxation pursuant to Section 501(c)(3) of the Internal Revenue Code that:
1. Provides assistance, such as food, clothing, shelter, child care, health, legal, vocational, relief, educational, and other similar assistance to disadvantaged people for free or at a significantly below-market rate; OR
2. Has gross receipts of less than $2.5 million.
This exemption also applies to the organization’s employees and board members while engaged in official duties. This exemption does not apply when an organization is seeking funding, property, or a permit from the City on its own behalf.

The Central City East Association Had To Fire 30% Of Its BID Security Officers After Failed Background Checks In 2016–2017! CCEA Security Überhoncho Greg Foster Confirms That Resumed Police Commission Oversight Of BID Patrol Officers Was Due To MK.Org Investigation!

On Monday morning I was honored to attend the 2017 annual meeting of the Central City East Association, run by the voodoo queen of Skid Row, Estela Lopez herself. Of course I recorded the whole thing,9 and you can watch it either on YouTube or else on Archive.Org, depending on your personal preference. I usually can’t make it to the CCEA’s meetings because of having to go to my damned job, but for whatever reason my schedule was open Monday morning, and how lucky that turned out to be!

You may recall that in 2016 I discovered that the City of Los Angeles had failed to enforce LAMC §52.34 against BID security for more than fifteen years and that due to my reporting the City resumed enforcement in 2017. But aside from one phone call from Police Commission officer Ernesto Vicencio, who was in charge of the reimplementation of the law, the City has refused to provide me with any information about the process.10 So how fascinating it was to hear Greg Foster, who’s CCEA’s chief of security,11 explicitly attribute the change to my work! As he said:

… the website, [unintelligible], MichaelKohlhaas.Org, began to generate documentation that this particular municipal code is not being adhered to by the City of Los Angeles, and it should be. For many many years this went on, in and out of regulation. A gentleman by the name of [Mike] began to get a bit of momentum and challenge the City in 2016 to have this reinstated.

You can listen to this segment here and of course there’s a transcription after the break. Now, LAMC §52.34 has two main effects. First, it establishes Police Commission oversight of BID security officers. Second, it requires all BID security officers to undergo annual background checks before they can be permitted to operate on public streets. The most stunning, and brand-new, piece of information to come from Greg Foster’s revelations, was this:

That day on June first, 2017, every public safety BID across the City had to go before the Police Commission and have every single public safety officer vetted and pass the background check. As you can imagine, that was challenging, not just to our particular BID but to every BID across the City. There was a drop of thirty percent of personnel staff for Allied’s [unintelligible].

That is to say, before the City reimplemented enforcement on June 1 of this year, 30% of CCEA’s security officers were unfit for duty according to the law. Remember THAT the next time you hear some damned BIDdies ranting and raving about how much they respect the damned law! BIDs love to go about the place crowing about how their damnable security patrols make the City’s streets safer, but it seems that before my work removed illegal, unqualified officers from our public streets, the BIDdies were actually making things more damned dangerous! OK, yay! And you’re welcome, City of Los Freaking Angeles, amirite fam?!

Ethics Commission Veep Serena Oberstein Announces That She Is Very Excited To Have Found A Way To Evade The Public Records Act While Claiming That She’s Evading It “In The Spirit Of Transparency Which The Ethics Commission Represents.”

The Los Angeles Ethics Commission held its December meeting this morning, and I recorded the whole thing12 and you can watch it either on YouTube or else on Archive.Org. Of course the main event was the last two items to be discussed regarding proposed updates to the Municipal Lobbying Ordinance, and I’ll have something to say about that whole mishegaas later in the week I hope. And there was also an instance of silence speaking louder than words, as the Commission completely ignored my recent request that they consider adopting a disclosure rule for ex parte contacts between Commissioners and those who would influence them.

Such contacts, of course, are a serious problem with our Ethics Commissioners, not least Serena Oberstein, the lobbyists’ best friend, who was involved in a minor yet horrifying interlude at this morning’s meeting which is the subject of tonight’s rant. The issue was whether and how the Ethics Commission’s investigators should disclose to the targets of their investigations that the investigations have become inactive.

This came up at the October meeting, and you can watch the whole episode here if you’re interested. The short version is that the investigators presently do not inform investigative targets when they’ve stopped investigating due to confidentiality mandated by the City Charter. Commissioner Serena Oberstein is deeply concerned that all these targets are going to be unsettled and anxious by not knowing that they’re not being actively investigated and she wanted staff to issue closure letters.

Such letters turned out not to be legally or politically possible, but at today’s meeting Sergio Perez, Director of Investigations, presented this proposal, adopted unanimously by the Commission, which recommended that policy be changed to allow oral notice to those being investigated that their investigations had become inactive. This recommendation putatively avoids the confidentiality requirement by invoking LAAC §24.29(c)(2), which states that:

How Weirdly-Bearded Oswald-Mosely-esque Facebook Hero, DLANC Board Member, And Self-Proclaimed Radiologist Joshua Albrektson Threatened To Expose My Darkest Secrets If I Didn’t Stop Blogging And Making CPRA Requests So I Turned Him In To The FBI For Violating 18 USC §875(d)

Maybe you’ve been following the loony-tunes saga of DLANC Board member Joshua Albrektson and how he can’t follow the freaking law to save his life. Well, it gets weirder, friends. The other day, this self-proclaimed radiologist sent me this exceedingly bizarre email, threatening me with some kind of exposure if I didn’t stop blogging and making CPRA requests:

Just you and me on this e-mail. You actually have pissed off a TON of people. And one of them has collected every misogynist or other bad article you have ever written. That person has almost had enough of you and is thinking of going public to the LA Times and calling the president of ■■■■■■■■■. So I would think very hard about the next time you send a public request.

As for me, I don’t appreciate the accusations you have done against me and some of my friends. So this is just my personal warning to you. Every time you publish an article, any article, from this second forward someone you wouldn’t want reading your work will find out what you are writing about. It could end right now with you and ■■■■ being the only people at ■■■■■■■■ who know about your articles. Or not. Your choice.

Leave aside the surreal assumption that there are people I “wouldn’t want reading” work that I myself consciously publish on the open Internet, what do we have here but a thuggish attempt, however misguided, to intimidate me into not writing about Joshua Albrektson’s friends by threatening to, I don’t know, destroy my reputation?

I don’t know what you would do, but I turned the guy in to the FBI for violating 18 U.S.C. §875(d), which criminalizes this kind of conduct for reasons that you can read about in detail after the break!

How I Reported DLANC’s Douchebaggiest Development Diva, Lover-Of-Non-White-Women, And DTLA Dustbowl Refugee Josh Albrektson To The Los Angeles County District Attorney For Violating The Brown Act With Evidence Provided By His Own Confession Against Interest Published, For Peak Derp, On Freaking Facebook

Anyone who follows this blog regularly knows that we’re raking in big bucks from George Soros and similar sources to support our merciless over-coal raking and to-the-duly-constituted-authorities reporting of the propertied classes of Los Angeles and their eager brown-tongued lap-minions like, e.g., the six members of the Board of Directors of the Downtown Los Angeles Neighborhood Council who participated in a sub rosa, barely legal conspiracy to do in the recent Skid Row Neighborhood Council formation effort.

One of the many targets at which we direct this firehose of Sorosbux is the Facebook, where Internet amateurs and malcontents will gather to vent their collective spleens in the comfy company of their moronic six-fingered peers. In particular, we have a dedicated, Soros-funded, intern13 doing absolutely nothing all day but sifting through opposition Facebookery. And mostly it’s predictably dumb and sadly inconsequential, this material. The political equivalent, if you will, of kitten memes. Occasionally, however, a gem pops up in the feed, and when it does, well, we will write about it!

So you can well imagine our glee over here at MK.Org secret headquarters when this little slab of puckey was brought to our attention.14 The author is DLANC board member and erstwhile DTLA resident15 Joshua Albrektson, writing about his actions after receiving the grievance against DLANC board member Dan Curnow that I filed a few weeks ago:

This is his latest article. He sent a grievance to DLANC that was literally about 40 pages about Dan Curnow being on a e-mail chain of people opposing the Skid Row NC. In order to file a grievance, you have to be a stakeholder of the place. He attached a page stating he is a stakeholder because he investigates the BIDS. I told everybody that he lives in Hollywood and works in Whittier and doesn’t own property here. I don’t think anybody even read his grievance.

So what would you do if you read something like this? Well, what I did is to turn the guy in to the Public Integrity Division of the Los Angeles County District Attorney for violating the Brown Act. Turn the page for details!

Berman In The Face Of Any Matter That’s Not A Real Estate Development Approval Is More Than Mere Fecklessness, It’s Actually Some Kind Of Highly Evolved Defensive Tactic

Well, good lord friends! It seems like just yesterday that I filed a grievance against Dandy Dan Curnow, DLANC secretary and law-flouting bow-tie wearing flower-arranging dude about Skid Row for his egregious violations of the Brown Act in concert with piratical POS Jacob Douglas Van Horn. And, mostly, that’s because it was just yesterday.

So imagine my shocked surprise to receive, this very afternoon, less than 24 hours after I filed the durned thing, an email from DLANC President for Life Patti Berman informing me that, despite the fact that I had followed the procedures given in DLANC’s infernal bylaws to the very letter, nevertheless that procedure was in fact invalidated by some random law I’d never heard of and which has remained unincorporated in the Bylaws since it was passed by the City Council in May 2015. Unfortunately it turns out that she didn’t just make the whole thing up, and you can turn the page for a few details. Fortunately for the sane and the righteous, though, this complaint to the DA against Dandy Dan is still active.

How I Reported DLANC Board Member Dan Curnow To The LA County DA For Violating The Brown Act And Also Filed A Grievance Against Him For Violating DLANC Bylaws

Background: You can read my previous stories on the Skid Row Neighborhood Council formation effort and also see Jason McGahan’s article in the Weekly and Gale Holland’s article in the Times for more mainstream perspectives.

I reported a few weeks ago on how Downtown Los Angeles Neighborhood Council Board member Dan Curnow violated the Brown Act in April 2017 along with his late, unlamented colleague, moral dumpster fire, and wannabe vigilante, Jacob Douglas Van Horn. Jacob Douglas VH, of course, famously resigned from DLANC under a cloud some time ago and, by doing so, perhaps placed himself beyond the suffering of consequences for his evil ways.16 Dan Curnow, as far as anyone around here knows, though, has not (yet) resigned from DLANC and so is eligible to be complained about in every possible venue.

First of all, then, I sent this complaint about him to the Public Integrity Division of the Los Angeles County District Attorney, which is charged with enforcing Brown Act compliance in L.A. There’s not a whole lot of information in there which wasn’t in my original story, but maybe you’ll find it worth reading. The bigger news, though, is that I also filed a grievance with DLANC against Dan Curnow for violating the Brown Act.
