My Public Records Act Suit Against The Venice Beach BID Is Finally Over — They Handed Over The Records And Paid My Lawyer $21,000 — A Purely Avoidable Waste Of Money — But What Do They Care? — Not Their Damn Money

Well, in case you missed it, in February 2017 I sent a request to the Venice Beach BID for various public records, and they ignored me and ignored me and ignored me, and finally I hired a lawyer, the incomparable Abenicio Cisneros, and in April 2018 he filed a suit against them seeking to enforce compliance with the damn law.

And now, finally, the case is done with the signing of this settlement agreement. Notably, the BID handed over the records and paid Cisneros $21,435 for his work on the case. This payoff is one hundred percent wasted money that the BID could have saved had they only complied with the law in the first place. But they did not. And I have another request in to them, so we’ll see if they learned their lesson. Meanwhile, behold a partial transcription of the agreement:

Venice Beach BID Security Director Azucena Vela Declares That BID Patrol Must Violate Law In Order To Enforce It — Laws Are For The Homeless, Not For The BID Patrol — According To Her The BID Patrol Need Not Follow The Laws Of The City Of Los Angeles As Long As They Are Wearing Their Silly T-Shirts — Will Continue To Ride Their Bikes On The Boardwalk Even Though It Is Completely And Unquestionably Illegal

Yesterday was the second Friday of the month, so I hauled myself out West on the 733 to listen to the Venice Beach BIDdies babble on about whatever it is they’re talking about out there on Main Street, just inches from the Southern border of the City of Santa Monica. And naturally I videotaped the whole thing, and you can watch it here on YouTube or here on Archive dot Org as you prefer.

As always there was a lot of interesting stuff going on, and I’ll have at least one more post for you about it, but today’s topic is the security report by BID Patrol boss Azucena Vela of Allied Universal security. Here’s how it all went down. First, famous-in-Venice member of the Neighborhood Council Colleen Saro spoke during the newly attenuated public comment period. You can watch her here. She had a lot to say, but the salient bit was her comment on the BID Patrollies riding their damn bikes on the Boardwalk:

Your security guys first of all shouldn’t be on a bike on the boardwalk on a bike because that’s illegal so it’s kind of difficult for them to enforce if they’re breaking the law…

And if you know anything about Venice you know that, first, bikes on the Boardwalk are a big problem. People who ride them there are your basic antisocial psychopaths who are so fixated on their own convenience that they don’t care at all about running over children, old people, wheelchair riders and other human beings who can’t dodge quick enough. Also, second, it is actually against the law to ride a bike on the Boardwalk. It says so explicitly at LAMC §56.15(2):

No person shall ride, operate or use a bicycle or unicycle on Ocean Front Walk between Marine Street and Via Marina within the City of Los Angeles, except that bicycle or unicycle riding shall be permitted along the bicycle path adjacent to Ocean Front Walk between Marine Street and Washington Boulevard.

Steve Hudson, Deputy Director Of The California Coastal Commission, Reports Back On Whether The Venice Beach BID Falls Into Coastal Commission Jurisdiction — Short Answer Is Not Right Now But Maybe In The Future — Surprising No One, Steve Hudson’s Report Shows Tara Devine Is A Damned Liar


Recall that on April 11, Venice Beach BID opposition activist Margaret Molloy spoke before the California Coastal Commission, urging them to conceptualize the formation of the BID and the BID’s activities as development under the Coastal Act. Her argument was sufficiently convincing that commissioner Effie Turnbull Sanders directed Commission staff to report back on whether the BID fell within the Commission’s jurisdiction.

And at the Commission’s May 11, 2018 meeting, Deputy Director Steve Hudson did just that. You can watch his entire presentation here on YouTube, and, as always, there’s a complete transcription after the break. Mostly the guy, who’d evidently talked to boss BIDdie Tara Devine at great length, parroted BID propaganda about how they’re just going to clean sidewalks and not hire security guards, but just so-called safety ambassadors who are going to mostly give directions to tourists and so forth.

Given that the BID hasn’t actually even started doing anything, it’s pretty hard right now to expose these bogus claims as the blatant self-serving lies that they obviously are, but eventually we’ll be able to. And here’s just one example of the Tara-Devinean parrotry if you don’t feel like reading the whole speech below. In a weirdly contemptuous display of Kool Aid drinking, Steve Hudson, perhaps inadvertently, revealed much about the utter inhuman contempt that Tara Devine and her nightmare employers on the BID board have for our homeless brothers and sisters in Venice. Note that the transcribed laughter is quite real. Listen for yourself:

I spoke with the president of the nonprofit association. She indicated that these security guards and police do not target homeless or any segment of the population. They’re there to provide information, so for instance if they saw a crime occurring or, the example they gave me is if someone was urinating in a doorway they would ask them to stop and direct them to the appropriate facilities. Ah ha ha ha ha. So it would not be an operation intended to target or displace the homeless.

Beachslapped!! — Los Angeles City Clerk Holly Wolcott Wrote To Mark Sokol And Tara Devine On April 18, 2018 Stating That More Than $1.3 Million Of The Venice Beach BID’s Unused 2017 Assessments Will Be Refunded To Property Owners Starting In July 2018 — A Monumental Development Considering The City’s Extreme Reluctance To Get Involved With Overseeing BIDs At All

At their March 9, 2018 meeting the Venice Beach BID Board of Directors discussed refunding some or all of the $1.8 million collected from property owners in 2017, most of which is unspent because the BIDdies took so long to get moving. You can read the minutes here, and there’s a transcription of the salient item after the break.

It appears from the minutes that the BID only agreed to inquire of the City whether a refund was possible. However, when City Clerk Holly Wolcott responded to the BID’s inquiry in an April 18, 2018 letter, she wrote as if the refund was a done deal. And since her office controls the money, it seems that it is a done deal. Wolcott says that refunds will issue beginning in July 2018.

This strikes me as yet another vote of no confidence in the beleaguered Venice Beach BID as run by Mark Sokol, Tara Devine, and the rest of their horrow-show crew. Although it’s well-known that under Wolcott the City of Los Angeles has essentially been completely unwilling to police BID activity in any way, she seems to be coming around to the idea that there’s something really, really wrong in Venice. Venice Beach BID Sued To Enforce Compliance With The Public Records Act

Yeah, perhaps you recall that in February 2017 I sent a public records act request to the newborn Venice Beach BID and executive directrix Tara Devine has been conscientiously ignoring it ever since. And so I hired a lawyer. And the lawyer filed this petition in Los Angeles County Superior Court. And served the petition on the BID yesterday.

Of course, this is the same course of action that the Larchmont Village BID recently thrust upon me. I wish there was some way to get these BIDdies to follow the law other than by filing petitions against them but the State Legislature, in its inscrutable wisdom, has made this the only remedy. Venice Activist Margaret Molloy’s Public Comment To The Coastal Commission On April 11 Led Commissioner Effie Turnbull Sanders To Ask Staff To Report Back On Whether The Activities Of The Venice Beach BID Constitute Coastal Development And Therefore Require A Permit From The Commission — Chief Counsel Chris Pederson Thinks It’s Possible That BID Activities Are Subject To Commission Review

The California Coastal Commission was created in 1972 by the California Coastal Act and charged with implementing and enforcing that monumental law, one of the main purposes of which is to “[m]aximize public access to and along the coast and maximize public recreational opportunities in the coastal zone.”1

A major way in which the Commission exercises this power is through the issuance of coastal development permits, about which the law states:2 … in addition to obtaining any other permit required by law from any local government or from any state, regional, or local agency, any person … wishing to perform or undertake any development in the coastal zone … shall obtain a coastal development permit.

The Act’s definition of “development,” found at §30106, is quite broad. It includes, e.g., “change in the density or intensity of use of land as well as “change in the intensity of use of water, or of access thereto.” It also requires at §30253(e) that new development “… protect special communities and neighborhoods that, because of their unique characteristics, are popular visitor destination points for recreational uses.”

Well, that last bit applies to Venice if it applies to any neighborhood in this state. Based on these requirements, therefore, anti-BID activists in Venice have been working out a very plausible theory that the establishment of the BID, and especially the BID’s private security force patrolling the public spaces adjacent to the beach, constitute development under the Coastal Act and that therefore they require a coastal development permit to be authorized.

And we can hope that such a permit would be unlikely to be authorized because whatever else BIDs may do, they certainly erode, attack, and destroy the unique characteristics of the neighborhoods they inhabit. This isn’t illegal in most parts of the City, but the Coastal Act preempts municipal law, so maybe BIDs are illegal in the Coastal Zone, or at least can be forced to severely limit their activities in order to obtain a coastal development permit.

And thanks to the persistence of this brave band of devoted activists, this idea gained a great deal of traction at the Coastal Commission’s meeting a couple weeks ago. Margaret Molloy gave a public comment outlining the theory and Commissioner Effie Turnbull Sanders,3 in direct response, asked Commission staff to research and report back on whether the Venice Beach BID or its activities constitute development.

Furthermore, Commission Chief Counsel Chris Pederson then stated:“I do not believe that the formation of the BID in and of itself qualifies as development. It may then engage in activities that qualify as development that would be subject to Coastal Commission review.” Audio of both of these parts of the meeting is available here and there are transcriptions (and a little more commentary) after the break.

Full Recording Of Yesterday’s Venice Beach BID Meeting Now Available For Scholarly Analysis And Weekend Hatewatching!

This is just the briefest of notes to announce that, thanks to a faithful friend of this blog, I’m able to make available a complete recording of the April 13, 2018 meeting of the Board of Directors of the Venice Beach Business Improvement District. I will watch this 90 minute monstrosity this weekend and report back on highlights, but I wanted to provide links as soon as possible. It’s available both on YouTube and also on Archive.Org.

Like I said, I haven’t watched it yet, but my first impression after skimming around in the depths of this invaluable item is that President & CEO Tara Devine is even more unhinged than I had originally thought, and that’s saying an awful damn lot.

Video Clips Of January 5, 2018 Meeting Of Venice Beach BID Board Available — In Conjunction With December Letter To Property Owners These Clips Suggest That They’re Egregiously Violating The Brown Act — President Tara Devine Is Even More Horrifically Offensive, Irritating, Mendacious, And Reprehensible Than Hitherto Suspected

As you may recall, the Venice Beach Business Improvement District putatively began its existence on January 1, 2017. However, the BID did nothing whatsoever for most of its first year except cash its zillion dollar checks from the City. In late December 2017 the BID finally announced a public meeting both through a letter sent to property owners on December 22, 2017 (there’s a transcription of this PDF at the bottom of the post) and via an email sent to the BID’s MailChimp list on January 2, 2018.

Well, the meeting took place, although I was not able to attend. The indefatigable Margaret Molloy recorded some selections, though, and has published them on her YouTube Channel. I have not watched all of them yet, but I’ve watched some of them, and it’s not a pretty sight, friends. These Venice BIDdies are a bunch of bad, bad babies.

So here’s what I have for you tonight. After the break, along with the promised transcription of devious little chump Mark Sokol’s letter to property owners, there’s also a reproduction of Margaret’s directory of these clips along with direct links through to them. Perhaps you recall that the infamous Venice Beach Business Improvement District has been nonoperational for an entire year after the second-time’s-a-charm reapproval by City Council, whose blindingly arrogant indifference to both law and decency necessitated this expensive and amateurish do-over.

Well, they’re operational now, friends! Yesterday morning the VBBID CEO, AKA President-For-Life Tara Devine, transmitted in interstate commerce1 an announcement of the BID’s first-ever meeting. Here are the documents involved:

How I Reported Shadowy BID Consultant Tara Devine To The City Ethics Commission For Failing To Register As A Lobbyist Based On Her Work For The South Park BID In 2017

So you may recall that I’ve been working on establishing the fact that BID consulting constitutes lobbying as defined in the Municipal Lobbying Ordinance. I kicked off this project in February with shadowy BID consultant Tara Devine, whom I reported to the Ethics Commission for working as a lobbyist but failing to register as a lobbyist. Meanwhile, if you have no idea what I’m talking about, here is a reasonable introduction to the concepts of both BID consultancy and why it’s almost certainly the kind of thing for which registration with the Ethics Commission is required.

My theory gained some credibility with the discovery that some BID consultants in Los Angeles do register as lobbyists. Since February I’ve been collecting evidence against Ed Henning for his work with the San Pedro BID and also against Urban Place Consulting for their work on Fashion District BID renewal and also Media District BID renewal.

And, of course, against Tara Devine for her ongoing work with the South Park BID. Finally, a few weeks ago I completed a generic argument1 that BID consultancy constitutes lobbying. And this morning I’m pleased to announce that, despite the twisted CPRA-defying machinations of South Park BID director of operations2 Katie Kiefer and her less-than-competent lawyers,3 I have submitted yet another complaint to the Ethics Commission against Tara Devine, this time for her BID consulting for South Park.
