Recently I obtained some emails which proved that the Los Angeles Police Department was complicit in the placement of illegal anti-homeless planters in Venice. Officers coordinated with local housedwellers to remove homeless encampments in order to facilitate planter installation. You can read that story here.

The planters are illegal for a number of reasons, but two interesting laws being violated in this context are LAMC 56.11 and LAMC 56.12. LAMC 56.11 is, of course, the famous anti-homeless ordinance banning the storage of so-called bulky items on public sidewalks. The other section, LAMC 56.12, requires property owners or other people in control of property¹ to keep adjacent sidewalks free of unpermitted obstructions.

Not only that, but LAMC 11.00(m) states that “[e]very violation of this Code is punishable as a misdemeanor unless provision is otherwise made…” It turns out that LAMC 56.11 does make another provision, so that violation of that section isn’t a misdemeanor, but this isn’t the case with 56.12. If a property owner allows unpermitted planters to stay on the sidewalk they’re committing a misdemeanor.

And thus when the police ask homeless people to move so that unpermitted planters can be placed, or even when they hang around watching while Sanitation destroys encampments so that unpermitted planters can be placed, they’re facilitating the commission of a whole series of misdemeanors by the people who own or control the property adjacent to the planters.

And it’s even worse than that. LAMC 11.00(j) declares that “[w]henever in this Code any act or omission is made unlawful it shall include causing, permitting, aiding, abetting, suffering or concealing the fact of the act or omission.” That is, not only does LAMC 56.12 forbid property owners from leaving the planters in place, it actually forbids any person from “permitting, aiding, abetting, [or] suffering” the planters to remain.

So when the police do nothing about the planters, they’re actually violating LAMC 56.12 themselves. And per 11.00(m) this violation is a misdemeanor. So it’s really much worse than it would be if LAPD officers were merely complicit in other people’s violations of the law, which is already intolerable. They are themselves violating the law.

It is intolerable to have police, given extraordinary powers up to and including the power of killing people in the service of their goals, violating the very laws they’re sworn to enforce. So I wrote this complaint against all the police I know to be involved and sent it to LAPD Internal Affairs, asking them to investigate the officers and punish them if appropriate. The anti-homeless planters placed all over Venice by hitherto unknown parties have received a great deal of media coverage in the last year, from the Hollywood Reporter to LA Magazine to Capital and Main to KFI radio to Venice Update. There’s no question that these planters are illegal. The Los Angeles Municipal Code at §62.118.2 requires revocable permits for any installations on public sidewalks. Los Angeles Magazine has reported that not only do these planters not have permits, but that the City’s Bureau of Engineering states that they would not issue permits for them.¹

And although that Venice Update story names Venice Gauleiter Mark Ryavec as a funding source for the planters at Lincoln and Palms, the other stories are careful either to avoid saying who’s responsible for planter installation or else to state explicitly that no one knows who’s putting them in. It seems obvious that some factions in the City of Los Angeles have been involved in planter installation, though. LA Sanitation’s sweeps of encampments in places targeted for planters seem coordinated with installation, and the LAPD seems always to have representatives present when the sweeps are happening.

And if you’re familiar with the way the City of Los Angeles is run you know that it is actually not possible that projects like these can be implemented, that there could be any kind of coordination between departments, that illegal planters could persist, without at least the passive support of the local Councilmember. In the case of Venice, which is in CD11, that is Mike Bonin. And yet Bonin’s office has consistently denied that it is involved at all.

For instance, in November 2018, KFI reported that “A spokesman for Councilman Mike Bonin, who represents the area, said he was not aware of any city department’s involvement in the placing of the planter boxes.” In May 2018 Bonin staffie Taylor Bazley explicitly told a concerned resident, Adam Smith, that CD11 “certainly [is] not involved” in planter installation. Here you can watch Chief Michel Moore stating that the planters are not an area of LAPD responsibility.

However, an email conversation that I recently obtained from the City via the California Public Records Act shows conclusively that both Bonin’s unnamed spokesperson and his loyal staffie Taylor Bazley were lying when they said CD11 was not involved. Bazley was involved, Mark Ryavec was involved, and LAPD officers James Roberts, James Setzer, Javier Ramirez, and Kristan Delatori were involved.

Michel Moore may not have been lying when he said that LAPD wasn’t responsible for planters, but these emails show that he was at least misinformed or uninformed by his subordinates at Pacific Division. For instance, LAPD Captain James Roberts enlisted Mark Ryavec’s aid in asking Taylor Bazley to authorize LAPD to move homeless people away from an installation site.² These emails are evidence, therefore, that multiple City offices are working together to violate the law in order to placate angry housedwellers and that at least Mike Bonin’s office is lying about it.

And there’s a lot of other important information here. For instance, the Los Angeles Homeless Services Authority is required by City protocol to participate in all encampment sweeps in the City. They’re widely touted as playing “a critical role in minimizing any negative health effects in our communities, while also offering our homeless neighbors access to a path out of homelessness.” Bazley, however, in an email to anti-homeless psychopath Mark Ryavec, describes their role quite differently: “LAHSA needs to attempt to demonstrate rendering of services by visiting the site 3 documented times”³ There’s a real contrast between “offering our homeless neighbors access to a path out of homelessness” and “attempt[ing] to demonstrate rendering of services.”

On March 1, 2019 Klaus Moeller, the extraordinarily whiny, privileged, and entitled owner of the extraordinarily anti-human Ben and Jerry’s franchise on the Boardwalk, posted some not-so-extraordinarily whiny, privileged, and entitled nonsense on the extraordinarily anti-human white supremacist bulletin board Nextdoor.Com.

And there among the assorted delusional rants about how the entire government of the City of Los Angeles is conspiring against the poor beleaguered zillionaires of Venice to prevent them from opening even more cute restaurants so that there will be more space for homeless people¹ was an actual important piece of information. According to El Moeller, his “daughter just came back from a small round table meeting with 20 people at the Erwin Hotel. The meeting was called for by the Mayor’s office and the Venice Chamber of Commerce.”

So this is news, right? The Mayor’s office is holding top secret invite-only meetings with Venice zillionaires in the white supremacist paradise known as the Hotel Erwin! And other people were interested in the story besides me! And someone fired off a CPRA request to David Harrison, who seems to be one of the Mayor’s lawyers.² And wow! Just yesterday the Office of the Mayor sent over 8 pages of emails explaining what happened, and containing a really unexpected gift!

What it was was a “business summit” organized by the Venice Chamber of Commerce in the person of Chamber CEO Donna Lasman. And what was it meant to be about? Well, here’s what Lasman said to Garcetti staffers Robert Park and Ami Fields-Meyer about it:

I am pleased to inform you that we have secured a location for our business summit on Friday, 3/01. The event will be at Hotel Erwin – 1697 Pacific Avenue = and will be organized into 2 sessions. The first session will be located in Larry’s Loft from 9:00 am – 1030 am and will consist of your presentation.

We have sent invitations to approximately 50 business leaders in the community from diverse business sectors and representing the various areas in Venice – Abbot Kinney, Lincoln Blvd., Ocean Front Walk, Rose Avenue and Washington Square. We expect approximately 30 people to attend.

As we discussed during our meeting, we are interested in hearing an assessment on the current business climate and trends for the Westside community, issues and initiatives that the Mayor’s office is working on, and how business leaders in Venice can partner with the Mayor’s office to work on issues that support a thriving economy in Venice.

The second session from 10:30 am to 12:00 pm will be a focus group/planning session with about 15 stakeholders. Our goal for this segment is to identify priorities for our business community and create actionable items for mobilizing our business community. Well, for God’s sake. Mike Bonin, councilcrumpet in charge of that formerly holiest of holy neighborhoods, the late lamented Venice, seems to have just noticed that independent businesses as opposed to chain stores can contribute a great deal to the character of the community. With that in mind he introduced this motion in Council this morning instructing the City Planning Department and the City Attorney to study the possibility of preventing chain stores from ruining everything even more than it’s already ruined by copying San Francisco’s anti-chain-store zoning laws.

And as much as I hate Mike Bonin, and as much as I don’t go to Venice any more because I’m not a freaking necrophiliac, I think these kind of laws are a good thing. The City of Los Angeles gives so much power to zillionaires and their BIDological sock puppets to shape the character of the neighborhoods they’ve colonized and almost no power at all to the residents. Super-restrictive zoning laws like the ones proposed here can take some of that power away from the property owners and shift it over to individual non-zillionaire residents who, after all, are the ones that made their neighborhoods desirable and so whose opinions really ought to be heeded.

So even though I’m sure that Mike Bonin’s motives are despicable, and even though I’m sure all his reasons are wrong, toxic, and repellent, nevertheless, even as a hundred monkeys with typewriters sometimes produce a coherent blog post,¹ so it seems does Mike Bonin occasionally propose an at least superficially laudable motion. The big question though that this raises is where is Gil Cedillo? Where is José Huizar?²

Highland Park, mostly in CD1, and Boyle Heights in CD14, also two of the holiest holy neighborhoods of this grand and holy City, are being raped, killed, and eaten just as Venice was raped, killed, and eaten starting some thirty years ago. But it’s not too late to stop the damage there before it’s irreversible. Cedillo and Huizar have the opportunity to do what e.g. Ruth Galanter, on whose watch Venice started circling the drain down which it’s long since disappeared, was unwilling to do to save these irreplaceable neighborhoods with whose care they’ve been entrusted.

Why aren’t they right up there with Mike Bonin asking staff to study how to save Highland Park, how to save Boyle Heights? Why aren’t they seconding Bonin’s motion instead of Paul Freaking Krekorian? Rhetorical questions, of course. They’re not saving Highland Park or Boyle Heights because it’s worth too much money to destroy them. Because Bonin’s zillionaire Venice constituents will get what they want but the poor, the working class, residents of Highland Park and Boyle Heights have no money and therefore no leverage at all with their Councilmembers. In thirty years, no doubt, their successors will be proposing exactly this same kind of motion, too late to raise the reeking corpses. As usual there’s a transcription of the motion after the break.

Peggy Lee Kennedy and the Venice Justice Committee advocate for the rights of homeless people on the Venice Boardwalk. The LAPD has regularly threatened Kennedy with arrest for illegal vending in violation of the ordinance regulating such activities on the Boardwalk, that is to say, LAMC §42.15. Thus in February 2016 Carol Sobel filed suit in federal court on behalf of the activists. The suit survived a motion to dismiss after an August 2016 hearing in which not only did the City’s oral arguments seem pathetically pro forma but the judge, Dean Pregerson, seemed openly skeptical of the City’s position.

And that’s pretty much where things stood for over two years until yesterday, Wednesday, October 10, 2018, when the City of Los Angeles passed a motion agreeing to settle the case. The terms are excellent for the plaintiffs. The City agrees to rewrite the relevant section of LAMC 42.15 to explicitly state that activities protected by the First Amendment, including the use of a table, are expressly allowed on the Boardwalk until midnight. There Is At Least One Substantial Way In Which Slavering Psychopath Mark Ryavec Is Not Like Donald Trump And That Is That We Have His Freaking Tax Returns

Something is happening and you don’t know what it is, do you, Mr. Jones?

This has nothing much at all to do with businesss improvement districts, but it’s Saturday night and I just felt like laying some Form 990s on you. These five beauties are from slavering psychopath Mark Ryavec’s agressively moronic Venice-based gang of subliterate meatheads, known to the mundane world as the Venice Stakeholders Association. They are available here on Archive.Org for your reading and researchical pleasure.

These items are interesting for any number of reasons. One is that they show that the VSA is not just a vision of sugar plums dancing ‘neath the fevered brow of Mark Ryavec, but that there are actual real-life other people involved:¹ Michael King, Bonnie Felix, Anil Comelo, Robert Feist, Richard Myer(s).² Had they appeared in another context I’d have been willing to bet that these names were merely selected from the myriad to be found in Ryavec’s floridly diverse collection of multiple personalities, but I don’t know many people, even the really, really, crazy ones, who have a lack of foresight sufficient to cause them to swear under penalty of perjury in a document submitted to the Federal government that the names of their imaginary friends represent real-life actual human beings.³

Another interesting thing is that the forms contain descriptions of accomplishments the VSA deems significant enough to brag about to the Federal government. These have the perhaps unintended effect of revealing both the breadth and the depth of the slavering psychopathy at work out there in the lorn, lost, lamented, former utopia west of Electric Avenue. Cory Palka giving a performative demonstration of the fact that Mark Ryavec is not only a slavering psychopath, he’s also either clueless or a liar or both.

A few weeks ago, Rory Carroll published an excellent article in The Guardian on how the City of Los Angeles has used gang injunctions as a tool of gentrification in Venice. Of course, this is not news to anyone who’s been paying attention since the injunction began in 2000. Even at the time it seemed clear that the injunction was a response to the wave of gentrification that began in Venice in the late 1980s and underwent unprecedented acceleration through the 1990s. Of course, everyone who’s smelting gold out of the housing stock of Oakwood in a blast furnace fueled by the burning bodies and lives of the poor people, the dark-skinned people, fed into the hopper by the LAPD, denies this every which way.

And these arguments have been repeated so often I have nightmares about them. “The cops would never ever do such a thing.” “There’s no conspiracy to chase out darkies.”¹ And so on and on and on. But Venice’s own muse of slavering psychopathy, the very king of the gentrifiers, the universally acknowledged whitest man in Venice, Mark Ryavec himself, has distilled all of them, every last threadbare tin-foil-hat characterization, into one bitter pithy little ball. As Rory Carroll puts it:

For Mark Ryavec, head of the Venice Stakeholders Association, the notion that police act as gentrification agents is “a bunch of radical bullshit”.

Well, first of all, it’s not actually bullshit.² The arguments against the idea that the City uses the LAPD to promote gentrification are mostly based on the (probably) factual assertion that (a) the City never mentions gentrification as a purpose for the gang injunctions and (b) that the assertions they make in support of the injunctions have to do with very real problems of violent crime (real at the time when the injunctions are being sought, anyway). There are a number of problems with this line of reasoning.

More gifts to Mike Bonin, prominently displayed in his City Hall office on Wednesday, October 12, 2016.

Did you even know that the members of our esteemed City Council all send one another and various other people gifts in the putative holiday season? Well they do, and evidently it’s just another thing that the pretty people do when they’re all drinking, thinking that they got it made.¹

The City Ethics Commission requires City officials to keep track of these presents, and so, in response to a CPRA request, I received these records from Chad Molnar the other day, despite his claim that fulfilling my more substantial requests would make CD11 constituents suffer. Perhaps he sent these items along because they aren’t likely to make the constituents, who thrive in darkness and secrecy and evidently include outlaw BID proponents Mark Sokol and Carl Lambert, suffer too much, because they have very little content. City of Los Angeles Sued Yesterday Over Mike Bonin’s Plan To Convert Westminster Park Senior Center To Homeless Property Storage

Yesterday, an organization called Venice Kids Count filed suit against the City of Los Angeles seeking to prevent Mike Bonin’s plan to use the former Senior Center at Westminster Park in Venice for a homeless property storage facility. Bonin’s motion is Council File 15-1138-S8 if you want to read the history. They are also seeking a temporary restraining order. Here is a copy of their verified petition, and here is a copy of the 1950 condemnation order dedicating the park for recreation use only. Homeless storage is absolutely essential, but following the law is more essential than anything, and Mike Bonin¹ gives the impression that he doesn’t feel himself bound in the least by the law. Expressive activity on the Venice Boardwalk.

Tonight the City of Los Angeles filed a reply in support of its motion to dismiss the lawsuit filed in February by the Venice Justice Committee. Recall that the motion to dismiss was filed in June and last week the plaintiffs responded to that motion, noting among other things that Abbott Kinney gave the Boardwalk to the City for use as a public sidewalk in perpetuity.

This makes the City’s repeated assertion throughout tonight’s filing that the Boardwalk is a public park particularly galling. If it’s an error, it’s careless beyond belief. The principle of charity compels me to assume it’s more of the dark sarcasm so favored by Feuer’s minions. They just don’t give a fuck, and why should they? They probably already have the million dollar payout to Carol Sobel budgeted for. But I’m getting ahead of the story.
