Homeless people need cell phones to survive, and charging them is a perennial problem. Although the City of Los Angeles could very, very easily put electrical outlets on streetlights they refuse to do so, which leads to the dangerous but necessary practice of makeshift rewiring by unhoused people. As revealed by this newly obtained email conversation, in March 2019 this was happening regularly in Chinatown.

LAPD Officer Stephen Nichols told George Yu, the unhinged megalomaniac leader of the reprehensible Chinatown Business Improvement District, that if Yu gave him a list of affected lights he would personally deal with the unauthorized wiring. But Yu told him not to do that. Yu cited a recent electrocution death in Westlake and told Nichols:

“Lets let BSL do their work. I would prefer natural selection like the Westlake incident to happen as that will be the only way that the City will take care of business.”

When Nichols finally got Yu’s point, which took a surprising amount of discussion, he thought it was hilarious. Nichols’s entire response: “☺☺☺☺☺☺☺☺☺☺☺☺” Here we see the thoroughly disgusting spectacle of an LAPD officer, sworn to protect and to serve, sharing a laugh with a notorious psychopath over the tactical political utility of mass electrocutions of homeless people.

By now the whole world knows that John Lee, Los Angeles City Councilmember for District 12, formerly chief of staff to now-indicted former CD12 rep Mitch Englander, accompanied his boss to Las Vegas in June of 2017 to be plied with liquor, money, and sex in exchange for the usual list of favors to real estate developers. And Lee, known as City Staffer B in the indictments issued so far, admits going on the trip but denies receiving anything untoward or engaging in suspect or illegal activities.

And even though Englander’s indictment doesn’t mention anything leading up to that June 2017 trip, it’s clear that he and surely also John Lee had to have been conspiring with the developer for a while. Without a lot of prior discussion and understandings how would these conspirators have trusted one another enough to offer and accept such blatantly corrupt incentives? The indictment refers repeatedly to text messages between Englander, Lee, and the corrupt developers, so at least some of the pre-Vegas communication probably took place via cell phone.

And the City issues cell phones to Councilmembers and selected staff. While most criminals can probably understand that it’s a bad idea to arrange crimes on your work phone, it’s not impossible that Lee1 didn’t realize this at first. Regardless of the wily criminal tendencies of these political thugs they’re not bright people or at least have astonishingly poor impulse control. So perhaps early on Lee did use his work phone to communicate with his co-conspirators?2 And maybe at some point he realized that he might be leaving evidence by doing so? Which is speculation, of course.

But speculation or not it would certainly explain the highly suspicious fact that in January 2017 Lee asked his aide Brandy Turnbow if it were possible to get detailed billing records for his work phone from Verizon. By that time he’d worked for the City of Los Angeles for more than 20 years and yet the question hadn’t come up for him before his boss was running a criminal conspiracy out of City Hall. So Turnbow emailed Matthew Webster of Verizon asking him about it. And after a lot of tedious discussion he sent her the information she requested as an email attachment.

Which was tremendously good luck, because of course City emails and their attachments are public records. Which is how I laid hands on one of the most remarkable documents I’ve had the good fortune to receive during my long career of requesting public records. This is a detailed 300+ page3 call-by-call log of CD12 work phone activity from October 2016 through January 2017.4 It has all of Mitch Englander’s work phone calls, all of John Lee’s, and also other staffers. It includes not only the number called but the location of the caller’s phone when the call was made.

I apologize for having neglected the Lunada Bay Boys case lately, but I’ve just been so overwhelmed with the Skid Row Neighborhood Council matter that I haven’t had time for much else. There have, however, been a number of interesting developments in this matter as well.

First of all, recall that the cell phone of Bay Boys defendant Michael Papayans was in LAPD custody after his notorious arrest for beating up a man in the parking lot of Dodger Stadium. Once the LAPD gets its hands on evidence it seems that they don’t give it up so very easily, and thus, in July, the Honorable Rozella Oliver, magistrate judge in the case, ordered them to hand it over for analysis. Well, they evidently did so, and, on October 9, a bunch of text messages from the phone were filed with the court. You must read these texts! It seems to me that they pretty much prove the plaintiffs’ case. Here are some highlights:

  • Yeah get down there I’ll be up as soon as I can my dad should be going out soon
  • Yea, only 5 guys out and he’s out, I’m going
  • I hate this guy
  • Are they in the water
  • He’s in the water. Only five guys out. Get down here boys. I’m out there
  • Kooks up there
  • Get him Charlie, just go shake his hand, tell him we missed him and can’t believe he didn’t make any of these latest headlines, he should be ashamed
  • Lol ok I’m on my way !
  • Michelle get to the bay and rouste [sic] those kooks
  • there are two kooks he’s got a little baldheaded white guy with them he looks like a boogie board or to fuck what a joke!

And the other news is that the hearing on sanctions against defendants Charlie and Frank Ferrara and Sang Lee for discovery shenanigans took place on Thursday as scheduled. What a wild ride!

City of PVE And Jeff Kepley And The PVE Police Officers’ Association File Opposition To Motion Because They Don’t Want To Hand Over Text Messages From Cops’ Personal Phones — No One Seems To Be Discussing The Fact That The California Supreme Court Decided In March That Work Information On Personal Phones Is Public Record

Last week the plaintiffs in the Lunada Bay Boys case asked magistrate judge Rozella Oliver to sanction the City of PVE because they refused to hand over work-related text messages. Oliver subsequently denied this motion on technical grounds. At roughly the same time the plaintiffs filed a motion for administrative relief, essentially asking Judge Otero to deny the zillions of defense motions for summary judgment because of various discovery failures on the part of the defense.

And tonight the City of PVE and Jeff Kepley filed their opposition to that motion. The most important item is this memorandum of points and authorities which has, as these all seem to, a good discussion of the facts of the dispute.

The main issue seems to be, though, that the plaintiffs’ asked for material from the personal phones of PVE cops and the cop union intervened and said via their lawyer, Howard A. Liberman, that they weren’t going to hand it over because it would violate the officers’ privacy and also it would violate their contract with the City of PVE. The City also argues that they can’t hand it over since they don’t have control over it.

Judge Rozella Oliver Orders LAPD To Hand Over Michael Papayans’s Cell Phone For Forensic Analysis

Maybe you recall that Lunada Bay Boy defendant Michael Papayans, buddy of Backstreet Boys and anger management dropout, has been unable to hand over his cell phone to the plaintiffs because the LAPD had it as evidence from when Michael Papayans and his mom got arrested for beating up a Mets fan in the parking lot of Dodger Stadium.

Well, all the parties asked Rozella Oliver to make the LAPD release it, and today she issued an order requiring them to do just that. They’re going to get his texts, his photos, his GPS records, every damn thing, including such deleted content as is still recoverable. This must be a horrifying prospect for the guy even though I have zero sympathy for him. He’s even got to pay for the data extraction.

There is, of course, a transcription of the PDF after the break. In other Lunada Bay Boys news, there’s a telephonic hearing with Judge Oliver scheduled for tomorrow at 10 a.m., so perhaps something interesting will come of that.

Ah, goodness, how can this case get any weirder? Well, here’s today’s episode. The parties filed this joint stipulation asking the Honorable Rozella Oliver to order the LAPD to lend them defendant Michael Papayans’ cell phone so that the plaintiffs can carry out a forensic analysis as part of the discovery process. And the request is uncontroversial from all sides, since the LAPD told the parties that they’d be happy to hand it over in response to an order from the court. So I’m expecting an actual order soonest.

But the rest of the story is pretty interesting. It seems that Michael Papayans isn’t just a localist surf-thug, he’s a multitalented all-round generic thug as well. You see, the LAPD has the phone because Michael Papayans was arrested in 2016 for helping his mom beat up a Mets fan in the parking lot of Dodger Stadium.1 And evidently even this isn’t the limit of the guy’s thuggery…
