This Is What Domestic Surveillance Looks Like In Los Angeles In The 21st Century: Muslims Lawfully Distribute Pamphlets, Private Security Guards Call The Cops, Cops Read Pamphlets, Pronounce Them Reputable And Acceptably Anti-Terror, Make Report To So-Called Major Crimes Unit Anyway

The other day the LAPD provided me with a massive release of emails between various Hollywood Boss Cops and CIM Group and the Hollywood Chamber of Commerce. There’s a lot of stuff, and I haven’t read all of it carefully yet,1 but a couple items stood out for sheer disconcertion.

In short, the story started with private security guards at a Rick Caruso hypermall in Glendale flipping out because someone was taking pictures and not shopping, escalated to an attempt to get the Glendale PD to stop the guy and identify him, and ended up in Hollywood with then Hollywood Station Boss Commander Peter Zarcone reading through legally distributed pamphlets, deciding that they were acceptably critical of bad Islamist stuff, and subsequently reporting the distributors, law-abiding Muslims from the Islamic Institute of Orange County, to the LAPD’s Major Crimes Division.

On the one hand, it’s absolutely ludicrous and surreally kooky that a few Muslims passing out literature on Hollywood Boulevard can lead the LAPD and a bunch of private security to generate dozens of emails at the highest levels, follow the Muslims around videotaping them and writing down their license plates, combing through their pamphlets, and so on. On the other hand, it’s absolutely chilling. That seems to be the world we’re living in, I guess. Surreally ludicrous, surreally chilling. As always, find details and documentation after the break.

Tons of New Documents: Gateway To LA BID Emails And Minutes, Also South Los Angeles Industrial Tract Minutes

This is just a brief note to announce the publication of a bunch of stuff from the Gateway to LA BID out by the Airport. Its executive director, Laurie Hughes, is a pleasure to work with. She’s calm, professional, has read the law, and abides by it. She and Mr. Mike Russell of the Wilshire Center are absolutely the two best BIDdies to work with when it comes to CPRA. There are also some minutes from the SLAIT BID. But enough fuzzies, and on to the goodies!

First, from the South Los Angeles Industrial Tract, we have Board meeting minutes from 2007 through Feb. 2016. I have a request out for the more recent ones, and look for them here soon.2 Much more importantly, as I mentioned above, Ms. Laurie Hughes has just recently provided me with a ton of emails and Board minutes, and you can find links and descriptions after the break.

Almost 200 Emails Between the City Of LA And the East Hollywood BID. Also, Lunada Bay Boys Hearing Tomorrow And Also Ethics Commission Meeting!

Tonight I had the pleasure of receiving from self-proclaimed active member of the revitalized Hollywood community3 Jeffrey Charles Briggs almost 200 emails between the East Hollywood Business Improvement District and various far-too-friendly folks at the City of Los Angeles. For now these are available here on Archive.Org. They’re PDFs, but they’re that super-PDF-format that one can make with genuine Adobe software that embeds attachments right in there with clickable links.4 I have only been able to give these a cursory look-over, but I can already see a few crucial items. I’ll be writing on these matters as soon as I possibly can, but if you want a preview of one of them take a look at this juicy little number.

And tomorrow is a huge day at the Civic Center. In the morning there is a hearing in the Lunada Bay Boys case, featuring Palos Verdes Peninsula zillionaire surf-localism-thuggery at its most flamboyantly weird. In the afternoon there is an essential meeting of the Ethics Commission. Turn the page for times, locations, and brief descriptions. Perhaps I’ll see you there!

Good Lord, there’s too much to describe, but this is a rich, rich set of documents. I spent more than two hours at City Hall this morning scanning this nonsense, and here it is, in the rawest possible form. There are gems in that mine, friends, but until I have time, you’ll have to scratch them out your own self. For now they’re all up on our Archive.Org account. There’s stuff about the Venice Beach BID, and Carol Schatz‘s lil baby, the Downtown Center BID got audited in 2013, Daniel Halden and Kerry H. CPRA Goes Meta: Holly Wolcott Refuses To Release Some Records But Ends Up Releasing Advice Email From Deputy City Attorney Mike Dundas Authorizing Her Refusal

Holly Wolcott reimagined as a child of the 60s, chanting the Nam Myoho Renge Kyo of her people, which goes like this: “CPRA does not obligate me to answer questions. Only to provide records. CPRA does not obligate me to answer questions. Only to provide records.” HEY HOLLY!! CPRA also does not obligate you to not answer questions…
Perhaps you remember the long and winding narrative of how I spent almost half of last year trying to get the City Clerk’s office to cough up mailing addresses for the property owners in the Venice Beach BID, which they finally did do. There is a reasonable summary with links right here. Today I can reveal a little behind-the-scenes episode in that story.

A few weeks ago, in the middle of about a thousand pages of emails that the City Clerk’s office finally handed over, only about six months after I asked for them, I found this little gem of an email chain. Most of it is me hassling various Clerk staffies for the list of addresses, but right in the middle of it all, there’s an interlude between Holly Wolcott and Deputy City Attorney Mike Dundas, who’s evidently some kind of CPRA specialist over there in City Hall East.5

The TL;DR is that she goes: “Mike, do I gotta give him the goods?” and Mike’s all: “Nah, Holly, you don’t gotta because reasons.” It’s also interesting that the reasons he gives her are specious, providing, among other things, yet another example of how the Property and Business Improvement District Law of 1994 (which makes BIDs subject to CPRA) seems not to be understood so well over at City Hall. Shadowy BID Consultant Tara Devine Unilaterally Removed A Commercially Zoned Parcel From The Venice Beach BID In 2015 And Then Told Unhappy Property Owners In 2016 That She Was Not Allowed To Remove Parcels From The BID If They Were Commercially Zoned

The Venice Post Office; zoned commercial. Now it’s in the BID! Now it’s out of the BID! Now it’s back in the BID!
I recently wrote in excruciating detail about how everyone involved with the BID formation process denies, almost certainly wrongly, that they have any power at all over which parcels are included in a BID. Thus, e.g., did Tara Devine inform unhappy property owner William Kuel in this email from August 2016 that his property, which is zoned commercial but used for residential purposes, must be included in the Venice Beach BID. She went so far as to tell him explicitly that “neither the Engineer nor I can remove your parcel from the proposed BID.” This phenomenon has been hugely controversial in the formation of the Venice Beach BID, and is the basis of a lawsuit filed against the City by Venice residents upset over the inclusion of their property in the BID.

So what a surprise it was to find, buried amongst thousands of pages of nonsense in this latest pile of emails between Tara Devine and various employees of the City Clerk’s office, this June 30, 2015 missive from Tara Devine to a bunch of people, stating that she was unilaterally removing a commercially zoned property from the BID for, seemingly, no particular reason:

I will also re-send the database as we made one tiny change. After a discussion with Ed, we removed the federal USPS parcel (Venice post office.) It was on the edge of the BID and was not required for a contiguous boundary, so we just removed it from dbase and other docs.

Leaving aside the evident fact that Tara Devine doesn’t know the difference between contiguous and continuous, isn’t this interesting? She “just removed” a piece of property from the BID. And then a year later she was telling property owners that she didn’t have the power to remove parcels, and some of those property owners are now suing the City partially on the basis of this claim she6 has been pushing about her powerlessness. It will be interesting to see if this turns out to be evidence in the lawsuit!7 It’s extremely interesting to see that she told a bunch of City Clerk employees that she’d done this and not one of them questioned her ability to do it, which is in stark contrast to Holly Wolcott’s 2016 assertions that no one was empowered to remove properties.

Tara Devine’s justification for her unwillingness to exclude property has been that commercially zoned parcels cannot be removed,8 so perhaps this property isn’t zoned commercial? Well, good old ZIMAS will let us investigate this matter more thoroughly. This and some other issues with the property, including its current status with respect to BID inclusion, are discussed in painfully obsessive detail after the break.
