“Hold Your Beer Up and Smile.” Video Suggests that So-Called “Referral” Arrest is Actually Just a Warning, Demonstrating that 2015 BID Patrol Arrest Rate is Down 70% from 2014; Far More than Previously Thought

“Hold your beer up. HOLD YOUR BEER UP. And smile, if you want to.” These are the words of an anonymous1 BID Patrol officer caught on video confronting a homeless woman on Hollywood Boulevard about the fact that she’s drinking in public. However, this is more than a particularly lurid demonstration of the BID Patrol’s almost ludicrously unprofessional reign of misrule in Hollywood. It also helps shed some light on a long-standing mystery about just how many people the BID Patrol arrested in 2015.

I’ve reported before that the BID Patrol’s arrest rate in 2015 was over 40% smaller than it was between 2007 and 2014. The new evidence in this video suggests that actually only 313 of these were full custodial arrests (as opposed to 606, as I previously thought), making the actual decrease from 2014 to 2015 more than 70%. Here is the spreadsheet containing the 2015 totals. Note that there are 606 total arrests listed, and that these include 313 “Al Ref” arrests. You can see the arrest total summary spreadsheets from 2007 through 2015 here.

The phrase “Al Ref” almost certainly refers to “alcohol referrals.” These were discussed by Steve Seyler at the March 2015 Joint Security Committee meeting, where he stated:

We are starting to see some early trends. Arrests are down by 56 compared to this time last year. This is largely due to a strategy change in our enforcement of drinking in public. These arrests have accounted for about 60% of our arrest year after year. That number is holding true for this year as well. We still believe that it is important to curtail public drinking as this has a direct effect on assaults and other crimes.

Our new approach involves more warnings and more importantly referrals. We have
made 56 such referrals so far. If the person is agreeable, we give them a warning and
information about local Alcoholic Anonymous meetings and other resources. We will
attempt to gather data to see if this will bring positive results.

Many Years Worth of New Documents: Arrest Reports, Daily Logs, Photographs, Videos, Fashion District Emails

MINOLTA DIGITAL CAMERAI’m pleased to announce a huge amount of records, mostly from the Andrews International BID Patrol. These include arrest reports and daily logs, which bring our coverage up to the end of 2015. I put these on the Archive because the amount of material would overwhelm our hosting plan. There are individual links after the break and also here.

Note that there’s something fishy about the 2015 arrest reports. There are fewer than 350 of them, when the 2015 totals spreadsheet claims 606. This may have something to do with a new category for 2015 called “alcohol referral.” If these turn out to not be genuine custodial arrests we will have reduced the BID Patrol arrest rate by far, far more than I previously thought.

Video of Yesterday’s Central City East Association Meeting Now Available

I’m formally initiating coverage of the Central City East Association with some video of yesterday’s meeting of the Board of Directors at CCEA headquarters at 725 S. Crocker Street. You can find Part 1 and also Part 2. Note that the record is not complete because the Board went into closed session and I couldn’t stick around to see them reconvene. Part I consists entirely of CD14 representative Jose Huizar policy director Martin Schlageter talking about homeless issues in the BID’s territory and then, most interesting of all, taking questions from the Board members. The level of micromanagement is astonishing. We hope to write on some of the details later, but check some representative Q&A after the break. Part 2 is mostly taken up by a representative from the Runyon Group seeking CCEA support for entitlements for their ROW DTLA project (this project was formerly known as Alameda Square). Someone here will be writing on this soon in some detail.

Federal Judge Michael W. Fitzgerald of the U.S. District Court for the Central District of California Shows Up BIDs for the Mewling and Puking Liars they Are

Note that formerly Ukrainian first amendment maven and all-round mensch Eugene Volokh has already explained this better than we’re ever going to, so you may want to hop over to there for background. TL;DR is that the city of Inglewood sued Inglewood resident Joseph Teixeira in federal court, claiming that Teixeira’s reuse of their city-produced videos of city council meetings to create weaponized mockery of, among others, Inglewood mayor James Butts violated their copyright in said videos.

Well, Judge Michael W. Fitzgerald of the U.S. District Court for the Central District of California (that’s federalese for “Los Angeles”) not only dismissed Inglewood’s case, he terminated it with extreme prejudice. You can read the order here if you wish, and it’s smoking hot. The salient bit for this blog is, according to Volokh, that:

The court held that, under California law (see, e.g., County of Santa Clara v. Superior Court (Cal. Ct. App. 2009)), cities can’t claim copyright in public records. And while the city claims that this provision is trumped by federal copyright law, the court rejected that argument — federal law treats local governments as political subdivisions of the state, and a state has the power to control what its subdivisions do (including which federal rights they claim).

The Hollywood BID Patrol’s Intransigence on Transience Provides Yet Another Performative Demonstration of David Graeber’s Theory of Violence, Stupidity, and Interpretive Labor

Watch here for the final bit of a Hollywood BID Patrol operation on Ivar Avenue on June 30, 2015. There are about 12 of them milling around on the sidewalk after, evidently, having kicked out a bunch of homeless people, most probably on the basis of suspected violations of disgraceful LAMC 41.18(d). Of course, if you know the spot you’ll know that there are homeless people there essentially all the time, only very rarely getting kicked out by the BID Patrol.

So what horrific incident was it that required the presence of about a dozen of Hollywood’s finest1 on a pleasant Tuesday afternoon on Ivar Avenue? Murder, rape, homeless encampment, street-preaching? The amazing thing is that no one there seemed to know for sure except, we assume given that the principle of charity requires us to assume that the BID Patrol both has reasons for its actions and at the same time knows what those reasons are, the officers themselves.

One witness, though, spent the time and the effort to share his theory on the BID Patrol’s motivation with our correspondent. This is what David Graeber calls “interpretative labor,” an activity which, as Graeber has it, “much of the everyday business of social life” comprises, an activity in which people with guns, made stupid by their own potential for state-sanctioned violence, do not typically engage, as they clearly do not in this case:2

We’ve written previously about John Tronson, who, for whatever reason, is no longer president of the Hollywood Entertainment District BID Board of Directors, and his disingenuous, self-serving, mendacious contention that the state of California has no need for the saintly Senator Carol Liu‘s recently introduced SB608, the Right to Rest Act. According to Tronson:

You know, I mean, it, the, the, the reality, the LAPD or the BID Patrol, nobody is gonna ask anybody to move who’s just resting for a couple minutes cause they need to rest. This is just another vehicle to, you know, allow permanent, facilitate, the living on the sidewalk.

John Tronson at the Joint Security Committee meeting on April 9, 2015, a guy who will lie about how LAMC 41.18(d) is enforced by the BID Patrol. Falsus in uno, falsus in omnibus, as the judge will instruct Tronson’s jury at the time when all accounts are settled.
He’s talking, of course, about the despicable LAMC 41.18(d), which prohibits sitting on sidewalks in the absence of a parade and which the Right to Rest Act is meant to send to a well-deserved oblivion. But, you know, perhaps we’re being too harsh on John Tronson. Perhaps it’s really true that the BID Patrol will not arrest people just for sitting on the sidewalk. We mean, the evidence seems to suggest that, on the one hand, they will arrest homeless black people for it but, to be sure, they will not arrest non-homeless, non-black people for it. Today’s series of videos reveals that sometimes, even when the citation reads LAMC 41.18(d), the real charge is contempt of cop.

Hollywood BID Patrol Sought in 2013 to Hire Off-Duty LAPD Officers for Video Monitoring

Here are a couple of documents regarding the Hollywood Entertainment District BID Patrol’s request to be allowed to hire off-duty LAPD officers to monitor live video feeds. I’m seeking more information regarding this matter and will make it available as it comes in. There’s something interesting going on here in that the BID patrols already represent an effort to privatize policing in Los Angeles, thereby making it more opaque to public scrutiny. If they hire actual LAPD officers for privately assigned work this really exacerbates the problem, doesn’t it? The documents are embedded after the break and can be downloaded here and here.

Smarmy BID Patrol Officer Baxter Performs Now-Illegal Creepy Cop Trick Live on Camera

What if you entered a building intending to steal something and you stole it and then someone died because it wasn't there and that person would have invented a way to prevent any baby anywhere in the world from dying ever??  You'd be responsible for all those deaths!!  How does that make you feel, you miserable little creep?? Bzzzztttt!!!!
What if you shoplifted but it was really felony burglary and then someone died because of what you done and that person would have invented a way to prevent an asteroid from hitting the earth and killing EVERYONE?!? You’d be responsible for genocide under the FELONY MURDER LAW!! You know you’re not supposed to commit genocide, don’t you, you maniac?!
Look and listen here as a smarmy, self-satisfied little BID Patrol guy whose name seems to be Baxter interrogates his victim, who evidently stole a bottle of Justin Timberlake™ perfume of some sort. (NOTE: We made the video private at the request of the subject. The transcript is accurate, and you can obtain a copy from Kerry Morrison under the CPRA like we did if you want one)

In the video (complete transcription after the break), Baxter, in his smarmy cop interrogation tone of voice, gets the man to admit that he entered the store intending to shoplift. This used to be a favorite creepy cop trick for inflating minor charges beyond all reasonable proportion. Once on a time California Penal Code §459 could be used to charge such an act as burglary instead of mere theft. Security minions such as Baxter, not content with merely protecting the interests of their employers, would routinely use this nasty little loophole to overcharge people. Why? That’s just what they do, these icky little lawboys. It’s how they keep score in their psychotic little game.

Of course, as with all such nonsense, it ends up being the people of California who pay the price. Not just the petty criminals who get overcharged into oblivion, whose lives get ruined by undeservedly severe criminal records and the horrific collateral consequences that ensue, but also the taxpayers who have to support prisons full of nonviolent people, support courts and jails and probation offices and all the apparatus necessary to track and control the people dumped into the justice system by creepy private security henchmen who are so pleased with their delusory cleverness that they film themselves in the act so they can laugh about it later with all their cop buddies…

Well, as will sometimes happen, the people of California got wise to this nonsense and fed up with it as well and, in 2014, passed Proposition 47 which, among other things, added the following language to the penal code:

Watch the first minute of this video and see, in 2010, some BID Patrollies confront and accuse a man of “blocking the sidewalk”:

Officer: OK, so do me that favor and just get up and go somewhere cause you’re blocking the sidewalk.

Man: Not blocking the sidewalk, people got places to walk right past me.

Officer: You’re blocking the sidewalk.

Man: I’m not blocking nothing.

And you can see from the video that the man is not, in fact, blocking the sidewalk. But, unsurprisingly, the BID patrollies arrest him anyway.

First Batch of BID Patrol Videos Available

No one here has had time to watch these thoroughly yet. If you see something we should write about please drop a line. Meanwhile, in this video from December 2009, you can see an LAPD officer calmly and deliberately use his taser on a prone, unresisting man (at 6:40), contrary to both human decency and LAPD policy (see §573 Use of Non-Lethal Control Devices). The victim’s last words before he’s tased? “I ain’t doing nothing.” And he ain’t, either.
