Scope of BID Patrol Surveillance, Counterintelligence Far Broader than Previously Thought: Email to LAPD Demonstrates Long-Term Tracking, Unsupported Allegations of Sexual Misconduct, Drug Use Against BID Opponent

According to Kerry Morrison, BID Patrol boss Steve Seyler kept a “history” of him for years. The HPOA involved the LAPD in their surveillance program to some extent. What a mess.
In October 2015 we wrote about a number of cases where the Andrews International Hollywood BID Patrol collected intelligence information on its perceived enemies, mostly residents of Hollywood who opposed them in some manner. Among these instances of BID Patrol spying there was a mysterious case involving a man named Eric, pictured to the right. Our faithful correspondent has recently obtained a number of emails from the LAPD, which he’s preparing for publication and plans to make available quite soon. We jumped the queue on this email,1 though, because it explains a number of lacunae in our previous post.

It’s from Kerry Morrison to LAPD officer Mark Dibell about Eric, written in September 2014, 33 months after the January 2012 surveillance photographs of the man were taken by the BID Patrol. The subject line is “A matter for Vice.” TL;DR is that Eric “…had a routine of harassing and filming the BID patrol…” and so Kerry Morrison and A/I tracked his movements, photographed him, and almost three years later, wrote to the LAPD on behalf of his new landlord, Kelly Vickers of Eastown Apartments, reporting past, evidently unsupported, allegations of “sexual misconduct…and drug use” among other things. The subject line suggests that Kerry is trying to get this guy in trouble with the Vice squad as a service to one of the property owners in the BID.

How does anyone think this is OK? How does the BID carry on a three year vendetta against this guy for filming their security guards? Sure, Kerry claims it’s because of “sexual misconduct…and drug use,” but really, if the guy was provably up to those things why all the emails and subterfuge? Why not just call the actual cops and make an actual police report like actual non-creepy-zillionaires have to do in such circumstances? It’s pretty unlikely anyway that one can move into a fancy douchebag-serving apartment paradise like Eastown without a criminal background check, so the “allegations” remain only allegations. And even if he was or is guilty of “sexual misconduct…and drug use,” how is investigating that the business of the BID Patrol? They’re freaking security guards, not spies, not detectives.

The City of Los Angeles is famous for using BIDs to implement policies which it itself has been forced to eschew, but this kind of spying, which the contemporary LAPD has explicitly disavowed, reveals this dynamic to be playing out on an entirely unsuspected level. Yesterday we presented part 1 of our coverage of Garcetti aide Alisa Orduna’s visit to the Sunset-Vine BID meeting on Tuesday, November 10, 2015, in which, among other nonsense, she announced that part of what the state of emergency means to the BIDs is that Garcetti is going to spend a million bucks on iPads for the BID Patrol. Today we bring you part two, in which she proposes to empower the BID Patrol (as well as the currently-being-sued-in-freaking-federal-court-for-how-they-deal-with-the-homeless Central City East no less) to deal with homelessness since they’re front-line responders, according to her. As if, with their guns, their shackles, their COINTELPRO-style surveillance of their critics, their freaking blessing by the LAPD, their locking up of every harmless heladero that falls into their clutches, their arrests of over 1000 homeless people per year, they weren’t freaking empowered enough. but what’s the role for BIDs? I mean, so many of our BID officers are front line on the street. I met with Central City East BID, this BID, there was another BID, um, I forgot, but, you know, there was another BID that we’ve just been talking to, and the spike in violence, spike in substance abuse, the spike in, um, families, so it’s people with children that are out on the street in these encampments and often are abandoned, sometimes if their parents are active substance abusers, just the spike in the number of people, the spike in, the sense of permanency, I would say, with encampments, when before they’ve been, you know, none of this is [unintelligible], but someone may have been in a sleeping bag at the bus stop, but now, those coming in [unintelligible], they’re out in San Pedro, there was like a block-long encampment, that was pretty sturdy, you wouldn’t just be able to go in and take it down, you know, at some point, there was carpentry skills keeping it up, so it’s, it’s, how do we, how do we, adjust this, and what are, what do you guys see, and what’s, how can we empower BIDs so that, that information that they’re seeing and that experience that they’re having is fed back into us as policy-makers and we can together come [unintelligible] a solution.

Well, our faithful correspondent hasn’t had time to attend a BID meeting in a while, but he made it to the SVBID Board Meeting on Tuesday, November 10, over at the Hollywood YMCA (right across the street from the famed Selma Park). And what a witches brew of craziness he witnessed over there! They had brand-new Eric Garcetti aide Alisa Orduna there to talk to them about the mayor’s declaration of a state of emergency about homelessness. And can she ever talk. Does she make sense? Some of the time.1 But, as Sigmund Freud taught the world, even in incomprehensible free-associationalism, truth can be found by those who take the time to look. And it does take time. We were planning to cover Alisa’s entire 40-ish minute thing in one post, but after spending two days transcribing just the first 12 minutes, we found that our sanity requires us to lay it on you in increments. Thus spake Alisa Orduna: So with all of that said, on September 22nd, Mayor Garcetti along with City Council made an announcement declaring an emergency. And there was a commitment of a hundred million dollars in resources to finally address homelessness. And, looking at it since that time, what does that really mean?

And later she said: So the hundred million was an announcement, and that was just a commitment, so that was just kinda throwing a benchmark out there and saying how are we gonna rise to the occasion?

And then Fabio Conti proclaimed: Did anybody think, oh a hundred million! That’s [unintelligible]. There’s no hundred million.

And she replied: It’s kind of [unintelligible] is standing by that commitment, so everyone is looking for it.

No one had the hundred million, but don’t worry, it shows we take it seriously and also don’t worry, we’re all out looking for the money! So we guess this was known, kind of. We guess there’s not really a revelation here. The New York Times quoted Herb Wesson at the time of the declaration as saying “The $100 million figure was chosen in part for its symbolism, said Herb J. Wesson Jr., the City Council president, to show county, state and federal officials that the city was willing to make a significant contribution to an urgent problem.” Now we find out from Alisa that actually it was chosen not just in part for its symbolism, but it was entirely symbolic. We wondering if she’s talking out of school, being new and maybe not entirely broken to the plow. Time will tell, we suppose. Read on for the rest of the news. And iPads! When will the city learn that iPads are not only going to solve problems, they’re likely to lead to FBI raids on public buildings and speculation about indictments?

Since 2004, More than 19% of all Violations of Penal Code 653b(a) Brought to the City Attorney for Prosecution from the Entire Freaking City of Los Angeles Originated at Selma Park

Please, friends, forgive the wonkish headline, and read on to understand why it’s so important. If you haven’t been following the tragic saga of Selma Park, catch up here in the archives. The TL;DR is that the HPOA illegally proclaimed adults in Selma Park without children in tow to be in violation of California Penal Code 653b(a) and then proceeded arrest a bunch of people on these trumped-up charges. Every last one of the people arrested at that park for that crime whose cases were sent to the city attorney for prosecution had their prosecutions rejected. While we can’t (at the moment) prove that all 46 people arrested for violating that law at that park since 2008 were arrested by the Andrews International BID Patrol under the auspices of the Hollywood Property Owners Alliance, we can, as of now, prove something else that’s quite suggestive indeed. Right here, you can download a spreadsheet containing all PC653b(a) cases brought to the City Attorney’s office in the entire city of Los Angeles for as far back as electronic records are searchable. There’s one in there dated 2004, so perhaps that’s how far back they go.

On 3-7-15, our bike officers were on patrol at 6801 Hollywood Blvd. A large group of self-proclaimed anarchists were screaming and drawing all over the sidewalks with chalk. The group approached our officers and did their best to provoke them. Our officers showed great restraint and even backed into the street in order to avoid a confrontation. We called the LAPD. One of the people shoved one of our officers and then fled the scene as the LAPD arrived. A young marine stepped forward and commended our officer’s
[sic] for their restraint. He also offered to be a witness regarding the anarchist’s actions if that was needed.

Retraction: Documents Attesting to More than a Decade of Tragically Futile HPOA Support for Public Toilets in Hollywood Show Conclusively that City of Los Angeles is 100% to Blame for their Lack

Well, long-time readers of this blog will recall a number of shrill screeds on our part about how the BID Patrol keeps arresting people for public urination but the HPOA doesn’t do anything to get public toilets installed. And aren’t we embarrassed now. We had assumed that the HPOA had so much political juice that they could get anything they wanted out of the city, so the fact that Hollywood has no public toilets, we wrongly assumed, was proof that the HPOA was opposed to them.

It turns out that we were dead wrong about that. The HPOA has been trying for over a decade to get the city to put public toilets around Hollywood without any success. Just mere moments ago our faithful correspondent received documents that demonstrate this in great detail, and we apologize for our hasty leaping at conclusions. If you’ve been following the Selma Park story you’ll recall that, even as we’ve discovered that the park was illegally made off-limits to all but adults with children, even as we’ve uncovered a stinking, sordid history of both roustings-out and illegal arrests, it hasn’t been exactly clear who was actually, explicitly responsible for this ugly situation. Well, amongst the documents laid on you the other day by our faithful correspondent we found the actual smoking gun in an email written on January 22, 2008, by Kerry Morrison to Heather Repenning and Helen Leung, then-council-president and CD13 representative Eric Garcetti’s District Director of Community Development and Hollywood Field Deputy respectively.

So that settles that. HPOA and Eric Garcetti’s staff illegally excluded everyone without kids from Selma Park at some time before January 22, 2008.

Kerry Morrison! You just illegally banned everyone from a public park, starting off a chain of at least 46 illegal arrests and God only knows how many color-of-law civil-rights violations. Are you going to Disneyland?! Nope.

New Documents About Selma Park From the HPOA, New Document Storage System

First of all, I reorganized our documents. I think the new system will make it easier for you to find things. I know it’ll make it easier for me to add new material, and I have a lot of stuff coming in soon. The “Document” menu in the header now leads to a link and an iframe pointing at this page, which is just a raw files and directory set-up. For now I’m only allowing http access, but I might set up ftp access in the future. In any case, have at it! The only problem left unsolved is how to host the 15+ gigs of photos I have on hand. I’m working on a solution involving dropbox, since archive.org has turned out to be pretty slow for that many images and Flickr seems complicated for bulk uploads and metadata editing. I could be wrong about this, though. More news soon. Second, there’s a bunch of new stuff about Selma Park. Read on for details.

At Least 46 People Arrested for Being in Selma Park Without Children Since July 1, 2008, All 46 Cases Rejected for Prosecution by LA City Attorney

We have today a list of all cases referred to the City Attorney for prosecution for arrests in Selma Park for violating 653b(a) PC which, as you may recall, is the statute referenced on the recently removed and completely phony signs forbidding adults without children in the park. The list is an excel spreadsheet which we’ve edited from the original spreadsheet obtained today by Mike. That document lists everyone arrested in the park for any reason, and if you want it, you can get it from the city attorney’s office, or even just drop us an email.
On July 1, 2008, Jesse Gutierrez became the first human being in history to be (falsely) arrested at Selma Park for violating 653b(a) PC and having his case referred to the city attorney for prosecution, subsequently rejected for who knows what reason.

There are 46 people on the list, which means that at least that many were arrested, possibly more. We can’t tell yet who arrested all of these people, but since the arrests started in July 2008 (the list we obtained began in 2002) we’re guessing it’s the BID Patrol rather than the LAPD who’s responsible. Some of them we can be sure were arrested by the BID Patrol because we have their pictures. In any case, note the fact that every single one of the 46 case numbers begins with the letter “R.” The ever helpful Mike Dundas, who’s the CPRA contact over there, tells us that that means the case was rejected for prosecution. Unfortunately records which explain why cases were rejected are exempt from production. Oh well.

Selma Park Once Again Free and Open to the Public After Seven Long Years!! How Will Hollywood Ever Be Made Whole?

A little more than two weeks ago, we reported that, despite the fact that someone, probably the HPOA, had posted a bunch of signs to the contrary, Selma Park, at the corner of Selma Avenue and Schrader Blvd., was, according to the LA City Recreation and Parks Commission, actually open to all people, including adults without children in their care. At the time he received this information from RAP, our correspondent told the commission about the signs and the arrests and asked if they could remove the signs. He never heard back, but when walking by this afternoon, he was pleased to note that the signs were gone. So, he tells us, he sat in the park for an hour reading and also took some pictures!

Now, this is a very good thing. And we look forward to many fine hours eating lunch in the park and playing checkers on the super-cool built-in tile boards on the picnic tables.
