The California Public Records Act gives every person access to official writings because, as the law itself tells us,1 “the Legislature … finds and declares that access to information concerning the conduct of the people’s business is a fundamental and necessary right of every person in this state.” And this isn’t just some random preamble to some random law. It is among the fundamental human rights enumerated in the California Constitution itself,2 which states that:

“The people have the right of access to information concerning the conduct of the people’s business, and, therefore, the meetings of public bodies and the writings of public officials and agencies shall be open to public scrutiny.”

Among the other fundamental rights enumerated in this same article are freedom of the press, of speech, of religion, the right to civilian control of the military, the prohibition of slavery, equal protection, habeas corpus, and so on.3 This right of access to public records, measured both intrinsically and by comparison with the company it keeps, is hugely important. Fundamental.

But nevertheless, the City of Los Angeles4 habitually, consistently ignores its duties under the CPRA, flouts this fundamental right in a way that they’d never think of doing with, e.g., the right to be free of slavery. And they don’t just ignore their duties, don’t just flout the law. They flout it in the stupidest, most arrogant, most flamboyant ways possible.

Rebecca Cooley v. City Of Los Angeles — On October 21, 2018 Carol Sobel Filed Yet Another Federal Suit Against The City Of Los Angeles — Alleging The Illegal Confiscation And Destruction Of The Property Of Rebecca Cooley, Benjamin Hubert, And Casimir Zoroda — Three Disabled Homeless People Living In Venice At The Time — Seeks Class Action Status For Approximately 60 Others Similarly Situated

On October 21, 2018 Carol Sobel filed suit in federal court against the City of Los Angeles on behalf of three named homeless people along with about sixty others similarly situated. The three, Rebecca Cooley, her husband Benjamin Hubert, and Casimir Zaroda, are homeless people who were living on the streets in Venice in September 2017 when the City of Los Angeles, without notice and without any kind of process, confiscated and destroyed their property, including tents, blankets, essential paperwork, transit passes, and other items essential to the maintenance of human life. The suit comes just as the City is resuming its horrific, indiscriminate sweeps of homeless encampments outside of neighborhoods covered by the various injunctions.

The initial complaint claims that the City’s actions violate constitutional bans on takings and on unlawful seizure as well as the constitutional guarantee of due process. These familiar theories have been consistently upheld by federal courts up to and including the Ninth Circuit,1 all of which have been willing to issue and/or uphold injunctions against the City’s property confiscation and destruction policies. So it’s hard to imagine that the City can prevail on these issues.

Also, because two of the three named plaintiffs are disabled along with many of the similarly situated unnamed plaintiffs, the complaint also alleges that the City violated the Americans With Disabilities Act by confiscating their essential papers and means of transportation, by storing confiscated property in locations and facilities not properly accessible to disabled people, and, in general, by following policies and practices with respect to homeless people’s property that disproportionately burden disabled people.

Someone recently obtained a bunch of emails from 2016 between Laurie Sale of the Pacific Freaking Palisades BID and Rick Scott of the City Clerk’s office who is, it seems, the BID’s analyst.1 The goodies were passed to me and I uploaded the whole batch of them to Archive dot Org for your edification and titillation, and click here to browse through ’em!

And as you know, the Palisades BID, besides being generally creepy and rather floridly delusional, has proved itself unable to comply even minimally with California’s twin government transparency ordinances, the California Public Records Act and the Brown Act. I’ve written a little about their struggles with CPRA compliance2 and a little more about their struggles with Brown Act compliance, like see this episode and this especially nutty and horrific episode.

So with all of that in mind it was pleasant but not really a surprise to find this little gem of an email exchange in today’s yield. It all began when Sue Pascoe, editor of the famously floofball advertiser known as the Palisades News, emailed Laurie Sale, now retired zeck dreck of the BID, telling her that it was a violation of the Brown Act’s agenda posting requirements to post the agenda in a place that was not handicapped accessible.

Rather than asking a lawyer as anyone with any sense and some assets to protect might do, Laurie Sale emailed Rick Scott of the City Clerk’s office asking him for advice and basically saying that Sue Pascoe was a big meanie and why should the BID have to follow the damn law anyway? Then Rick Scott wrote back and told Laurie Sale that he wasn’t a lawyer and couldn’t give advice. What else did she expect? Turn the page, as always, for transcriptions of everything!

Watch, listen, and learn1 as Marie Rumsey of the Central City Association and PR flackette Jessica Borek of thuggish PR RICO Rodriguez Strategies fill in the HPOA board on their strategic schemes to allow the BID Patrol to continue to arrest, shackle, and humiliate the ice-cream man. These people are so power-mad they want to ban bacon dogs, the national food of Los Angeles!(Transcription, as always, after the break).

Even after all this time, it’s hard to understand why these people are so dead-set against legalizing and regulating something that’s not only happening now, but is going to be happening in the future because it’s an integral part of the culture of Los Angeles. We have some ideas, but whatever their reasoning is, we don’t think it would be too much to ask that they tell the truth while they’re opposing it.

First of all, Marie Rumsey wants you to know that there are only nine health inspectors for all of LA county and there are 50,000 street vendors. The point is that it’s unlikely that food vendors would be inspected sufficiently. Let’s forget, just for a second, that currently none of the vendors are inspected, so inspecting ANY of them would improve public health. According to Bloomberg, there are 10,000 illegal food vendors in Los Angeles (granted, out of 50,000 vendors total, but health inspectors don’t worry about balloon-sellers, do they?) That’s lie number one, Marie. Next, we can’t find hard data for the number of health inspectors in LA County at the moment, but a moment’s googling told us that in 1989 there were 47 of them, and in 1997 there were 161. That the number has dropped to 9 in 2015 seems beyond implausible. That’s lie number two, Marie.
