The Hollywood Property Owners Alliance supports laws that prioritize the view on the right over the view on the left.

Maybe you remember in January when Outfront Media illegally, immorally, and with reckless disregard, vandalized a bunch of trees in Silver Lake. Well, that’s smack in the heartland of Mitch O’Farrell world, so the CM and his compatriot David Ryu introduced a motion directing the Bureau of Street Services to figure out how to prevent this kind of horror in the future (the full council file CF 15-0467-S4 is here). It’s a little off-topic, but nevertheless interesting, to note that Outfront is a client of megalobbyist Veronica Perez, at whom Silver Lake residents directed a lot of justified rage on Facebook and elsewhere about this issue in March.

Well, in April, BSS came back with a list of proposed amendments to the City tree-trimming ordinance, and they mean to put some teeth into it, and as we know, our old friends the Hollywood Property Owners Alliance just hate to have to follow any laws at all since, they think, laws are what criminals break and we’re not criminals.

HPOA staffies Kerry Morrison and Matthew Severson, who propound the views of their masters with a level of passion that only the paid flunkies of zillionaires seem to be able to muster, frame it as a matter of more misdirected and incompetent government regulation. Real-estate zillionaire, BFF of Kerry Morrison, and revealed plagiarist John Tronson is gonna talk to Mitch about it at the fundraiser next week. Mark Echevarria, boss of Los Angeles spiritual/cultural nexus Musso & Frank, proves that you don’t have to be a genius to run a holy site by chuckling over the fact that he’s never heard of tree surgeons. It’s just yet another display of ignorance, privilege, and conspiracy to bribe public officials; business as usual at the HPOA. Hollywood BID Patrol Arrest Rate Continues to Plummet in 2016: by Week 12 there were 23% Fewer Arrests than in 2015 and more than 50% Fewer than in 2014

Recall that the Andrews International Hollywood BID Patrol arrested more than 40% fewer people in 2015 than they did in 2014, and that this precipitous drop was almost certainly due to our scrutiny. Well, newly obtained figures show that as of Week 12 of 2016¹ the BID Patrol had arrested only 130 people. This is an annualized rate of

$\frac{130}{12}\frac{arrests}{week}\times 52\frac{weeks}{year}=564\frac{arrests}{year}$

Recall that in 2015 the BID Patrol arrested 606 people, so this projected figure represents a projected 7% decrease from last year’s already strikingly attenuated figures.

Furthermore, by week 12 of 2015 the BID Patrol had arrested 169 people, compared to only 130 this year. This represents a stunning 23% reduction from 2015’s level. For the sake of comparison, note that by week 12 of 2014 the BID Patrol had already arrested 261 people. Thus 2016’s week 12 total is less than half of the 2014 figure from the same week.

Central Hollywood Coalition Cleared by Franchise Tax Board of All Fiscal Wrongdoing, Tax Exempt Status Reinstated After Months of Struggle, and it Wasn’t an Audit After All!!

Proof that the SVBID is all good once again with the Franchise Tax Board.

Yesterday the gracious-seemingly-in-spite-of-herself Kerry Morrison sent me a bunch of documents pertaining to the months-long struggle between the HPOA and the Franchise Tax Board over the tax-exempt status of the Central Hollywood Coalition, the shell corporation which exists, seemingly, mostly to hire the HPOA to manage the Sunset & Vine BID. And there are two salient points. First, everything is finally all settled and the CHC is good to go on wreaking havoc in its little corner of Hollywood without having to pay any of those pesky taxes. Second, as Kerry informed me in the email missive that accompanied the documents, “Please also note this that was not an audit – even though I mistakenly used this label at the board meeting where you were present.”

George Islas (Badge #128) falsely arrested a man in Selma Park on September 17, 2009.

If you haven’t kept up with our investigations into Selma Park, here is good starting place. The short version is that in 2007 the Hollywood Property Owners Alliance illegally placed signs in the park stating that it was for children and caregivers only and proceeded to arrest some people and eject others from the park for the next 8 years until I got the signs removed by Recreation and Parks. When I first asked her for records on the matter, Kerry Morrison told me that

“A/I says that after looking into this, it is unlikely that any arrests ever were made by A/I in Selma Park with specific regard to the signs and penal code section you recite (as opposed to public urination, drinking, and other reasons)…”

Well, I then requested copies of all arrest reports and daily activity logs, and they’ve been trickling in at the glacial pace that Kerry seems to find acceptable for meeting her legal obligations under the California Public Records Act. Every new batch has revealed that, even if Andrews did tell Kerry that they didn’t arrest people for merely being in the park, they were not telling the truth. The same is true for the 2009 material, which is on Archive.org. In particular I found another case of a man arrested in Selma Park, accused of nothing more than being there without children:

(I apologize in advance for this necessarily data-heavy post, but it’s essential information).

In 2013¹ the BID Patrol arrested homeless people at more than 57 times the rate that the LAPD did. Furthermore, they were responsible for more than 1% of all arrests made in the entire City of Los Angeles that year even while working only 0.13% of the hours that the LAPD did. Approximately one in fourteen arrests of homeless people in the entire city of Los Angeles that year was made by the BID Patrol.

Here’s how I calculated these figures: That year the LAPD made 14,838 arrests of homeless people² whereas the Andrews International BID Patrol made 1,096 arrests.³ Reading through A/I’s 2013 arrest reports and examining A/I’s 2013 arrest photos I see no reason to believe that the BID Patrol arrested non-homeless people in 2013 in any significant number.⁴ Continue reading In 2013 The Andrews International BID Patrol Arrested Homeless People at More than 57 Times the Rate that the LAPD Did and were Responsible for 1 in 14 Homeless Arrests in Entire City of Los Angeles →

Final Figures for 2015 Show that Arrest Rate Reduction Even Higher than Estimated: 42.7% Drop From 2014 Total, Which is 4.18 Standard Deviations from the 2009-2014 Mean

Last month I reported that BID Patrol arrests had dropped off precipitously between 2014 and 2015. At that time I didn’t have the final arrest total for 2015, so annualized the figure from November to 666. Yesterday I received the actual figures, and the total number of arrests turns out to be even lower than suspected. The BID Patrol arrested only 606 people in 2015, compared to 1057 in 2015 (and a running average of 1183 between 2009 and 2014.¹ As I said before, it’s hard not to attribute this massive drop-off to our scrutiny.² Note that the standard deviation for those years is 107.7, so that the absolute change of 451 arrests is 4.18 standard deviations, meaning that this result is exceedingly unlikely to be due to chance. I also really have to wonder, if they can arrest over 40% fewer people year over year,³ what were they even arresting them all for in the first place?

I recently obtained a 2013 list of people most arrested by the BID Patrol beginning in 2007. Since Kerry Morrison has told me¹ that neither the HPOA nor Andrews International tracks outcomes of arrests made by the BID Patrol, I asked the City Attorney to run a report on all cases involving these people sent to them for prosecution.² I subsequently tallied up the arrests and the referrals for the time period by hand³ and it turns out that the vast majority of cases involving BID Patrol arrests are not even referred for prosecution, and among those that are, over half are rejected. The data is incomplete and subject to some interpretation, but it appears that less than 20% of these cases are actually prosecuted.⁴ In particular, there are 1144 arrests of these 44 people between 2007 and 2013. Of these, no more than 407 (35.6%) were referred for prosecution. Of those cases, 222 were rejected for various reasons and the rest seem to have been prosecuted.

This is an astonishingly low rate if one thinks that the purpose of arresting people is to stop them from breaking the law, and it’s harmful both to the people arrested and to society at large. The incomparable Alexandra Napatoff, writing about misdemeanor convictions (although her argument is as strong regarding the arrests themselves, and even more so if the conviction rate is so very low), puts it like this;

Because the misdemeanor world is so large, its cultural disregard for evidence and innocence has pervasive ripple effects, not the least of which is the cynical lesson in civics that it teaches millions of Americans every year. In these ways, the misdemeanor process has become an influential gateway, sweeping up innocent as well as guilty on a massive scale and fundamentally shaping not only the ways we produce criminal convictions but also who is likely to sustain them.

Electronic versions of the HPOA Board of Directors minutes from 1996 through 2006 haven’t been retained by the HPOA, so while waiting on physical copies¹ to publish here, I’m taking advantage of good old section 6253(a) of CPRA,² which tells us that:

Public records are open to inspection at all times during the office hours of the state or local agency and every person has a right to inspect any public record, except as hereafter provided.

Consequently, last Thursday I went over to HPOA secret headquarters on Hollywood Boulevard to read through this material, something I plan to make a regular habit of doing.

Justice Walter Croskey wrote the landmark 2001 opinion in Epstein v. Hollywood Entertainment District BID.

And there is much fascinating material there, not least of which is the complete unfolding in real time of Aaron Epstein’s epic lawsuit against the HPOA. This ended, of course, in a landmark 2001 decision by the Second District of the California Court of Appeal making BIDs subject to both the Brown Act and CPRA. That story is woven through years and years worth of minutes, so it must wait for the copies to arrive. However, I was able to photograph³ a description of the very first CPRA request known to have been received by the HPOA (on February 5, 2003).

Well, getting records out of the Downtown Center BID is like pulling teeth from a fricking hippopotamus,¹ but after almost four months and one exceedingly detailed complaint to the Los Angeles City Clerk about their general bloody-minded uncooperative stonewalling, they have released a bunch of records relating to their public relations firm, Macy + Associates.² You can find this material here on the Archive. Note that they’re, as usual, mercilessly and certainly illegally redacted. I’m working on this, but I don’t expect any results quickly.

Following six years of essentially level arrest rates (1184 per year on average) between 2009 and 2014 inclusive, as of November 2015 the Andrews International BID Patrol was on track to make only 665 arrests in Hollywood last year.¹ This represents a 36.99% drop, which is exceedingly unlikely to be due to chance.² Long-time readers of this blog will recall that in December 2014 we discovered that on October 10, 2014, the very day after my first visit to a BID meeting of any kind, Steve Seyler wrote to Kerry Morrison, stating:
