Kerry Morrison on February 18, 2016, the 13th anniversary of her receipt of an “offensive” letter from a lawyer regarding the very first known CPRA request to the HPOA.Electronic versions of the HPOA Board of Directors minutes from 1996 through 2006 haven’t been retained by the HPOA, so while waiting on physical copies1 to publish here, I’m taking advantage of good old section 6253(a) of CPRA,2 which tells us that:
Public records are open to inspection at all times during the office hours of the state or local agency and every person has a right to inspect any public record, except as hereafter provided.
Consequently, last Thursday I went over to HPOA secret headquarters on Hollywood Boulevard to read through this material, something I plan to make a regular habit of doing. Justice Walter Croskey wrote the landmark 2001 opinion in Epstein v. Hollywood Entertainment District BID. And there is much fascinating material there, not least of which is the complete unfolding in real time of Aaron Epstein’s epic lawsuit against the HPOA. This ended, of course, in a landmark 2001 decision by the Second District of the California Court of Appeal making BIDs subject to both the Brown Act and CPRA. That story is woven through years and years worth of minutes, so it must wait for the copies to arrive. However, I was able to photograph3 a description of the very first CPRA request known to have been received by the HPOA (on February 5, 2003).

The upshot seems to be that some guy a while ago forgot to pay some fee, and things escalated through no fault of Kerry’s, to the point where, because bureaucrats are dumb and mail letters to the wrong place, the FTB is auditing the CHC but a lot of records are missing because 12 years ago is a long time and how can they expect that we would still have them?!? There’s also a looming problem, unmentioned here by Kerry, in that the CHC, like all BID management companies, signed a pledge to the City of Los Angeles that they would “…notify the awarding authority [the Los Angeles City Clerk] within 30 calendar days after receiving notification that any governmental agency has initiated an investigation which may result in a finding that the contractor did not comply with any federal, state, or local law in the performance of the contract…” Kerry didn’t mention anything about this clause, and we don’t (yet) know whether the CHC is complying with it. And now the city of Los Angeles intends to forcibly convert Hollywood into a cultural and economic wasteland like New York City by allowing such miscreants to operate with impunity on our streets. “Not on our watch,” say BIDs.Street food is one of the signature pleasures of the great cosmopolitan cities of the world. Practically alone amongst its peers, though, Los Angeles forbids vending on its public rights of way. This is because there are really no bounds to the willingness of the economic elites of this city to prohibit anything that normal human beings enjoy if by doing so they can stick a dagger in the neck of the poor. They will certainly destroy the village in order to save it. Representative of the Hollywood BIDs metaphorically destroying the city of Los Angeles in order to save it from perceived (albeit delusionally) unintended consequences of an all-too-rare outburst of sanity with regard to its street-vending policy.
Case in point: the City Council recently began to discuss legalizing street vending in Los Angeles. Sane people everywhere rejoice at this attempt to allow civilization to flourish and also bring an estimated half-billion dollars worth of economic activity out of the shadows and onto the bottom line. There’s a hot dog in the public manger, though.
The BIDs and their minions have leapt into coordinated action! They are in a cyclonic tizzy, explaining fast and loud how the unintended consequences of the sane and harmless choice to legalize street vending will ruin everything. It will e.g. impoverish small businesses, encourage crime, cause the unauthorized commercial use of public trash cans, cause the unauthorized non-use of public trash cans, provide increased funding to criminal street gangs, encourage armed robbery, cause diseases, and even more stuff too weird to list here.
