I’ve been working on finding out precisely who the esteemed leaders of this City have blocked on Twitter. The other day I wrote about about 11 of our 15 Council Districts¹ and revealed the perhaps unexpected but still somehow not that surprising fact that soon-to-be-incarcerated CD14 Councilbro Jose Huizar by far leads his council colleagues in smackblocking, with 21 users silenced by this thin-skinned fellow.

But he does not compare, not at all, not even close, to Steve Soboroff, president of the Los Angeles Police Commission. Soboroff tweets under the colorful sobriquet @SteveSoboroff and it turns out that he is blocking an astonishing one hundred and fifty six users. He’s also muting six users. There is a list, of course, of live links after the break. Are you on it? If not, why not?!

At the same time I got this essential info I also got a list of the users blocked by @lapdcommission, the official Commission account. There are eight of these, all well-known corporate accounts for whatever reason. It’s possible that all this has some actual importance as far as the First Amendment goes given a recent ruling by a federal district court that it’s unconstitutional for Donald Trump to block users.

I don’t know much about that, but I do know that this information is of great interest here in Los Angeles, where in order to maximize our chances for changing things we must know our enemies. You may recall that in 2016 our work here at MK.Org led to the City of Los Angeles resuming enforcement of a law that had been ignored for more than 15 years which requires security guards, including BID security, who operate on public streets to register with the Police Commission and thus be subject to some public oversight.

In December 2017 I got powerful independent confirmation that the City’s renewed enforcement was due to the work of this blog when Greg Foster, security honcho for the downtown criminal conspiracy known as the Central City East Association, stated in an open and public meeting that such was the case.

And yesterday I received a copy of this June 2017 email from Chinatown BID boss George Yu to City BID analyst Rita Moreno bitching and moaning about the requirement and thereby providing even more confirmation. In fact George Yu sent Rita Moreno a link to this very blog!¹ And he introduced the link with the following statement: “Please see link below on what lead up to this.” How’s that for confirmation?!

This was part of a massive dump of material that was obtained from the City Clerk via the California Public Records Act and subsequently shared with me. I’ll be writing about the rest of the material from time to time, and of course there’s a transcription of the entire exchange after the break along with some inconsequential commentary. On Monday morning I was honored to attend the 2017 annual meeting of the Central City East Association, run by the voodoo queen of Skid Row, Estela Lopez herself. Of course I recorded the whole thing,¹ and you can watch it either on YouTube or else on Archive.Org, depending on your personal preference. I usually can’t make it to the CCEA’s meetings because of having to go to my damned job, but for whatever reason my schedule was open Monday morning, and how lucky that turned out to be!

You may recall that in 2016 I discovered that the City of Los Angeles had failed to enforce LAMC §52.34 against BID security for more than fifteen years and that due to my reporting the City resumed enforcement in 2017. But aside from one phone call from Police Commission officer Ernesto Vicencio, who was in charge of the reimplementation of the law, the City has refused to provide me with any information about the process.² So how fascinating it was to hear Greg Foster, who’s CCEA’s chief of security,³ explicitly attribute the change to my work! As he said:

… the website, [unintelligible], MichaelKohlhaas.Org, began to generate documentation that this particular municipal code is not being adhered to by the City of Los Angeles, and it should be. For many many years this went on, in and out of regulation. A gentleman by the name of [Mike] began to get a bit of momentum and challenge the City in 2016 to have this reinstated.

You can listen to this segment here and of course there’s a transcription after the break. Now, LAMC §52.34 has two main effects. First, it establishes Police Commission oversight of BID security officers. Second, it requires all BID security officers to undergo annual background checks before they can be permitted to operate on public streets. The most stunning, and brand-new, piece of information to come from Greg Foster’s revelations, was this:

That day on June first, 2017, every public safety BID across the City had to go before the Police Commission and have every single public safety officer vetted and pass the background check. As you can imagine, that was challenging, not just to our particular BID but to every BID across the City. There was a drop of thirty percent of personnel staff for Allied’s [unintelligible].

That is to say, before the City reimplemented enforcement on June 1 of this year, 30% of CCEA’s security officers were unfit for duty according to the law. Remember THAT the next time you hear some damned BIDdies ranting and raving about how much they respect the damned law! BIDs love to go about the place crowing about how their damnable security patrols make the City’s streets safer, but it seems that before my work removed illegal, unqualified officers from our public streets, the BIDdies were actually making things more damned dangerous! OK, yay! And you’re welcome, City of Los Freaking Angeles, amirite fam?!

Here’s a brief summary of the background: Late last year, on the basis of my complaint to the Police Commission, the City of LA resumed enforcement of LAMC 52.34 against BID security forces.¹ Since then I’ve been tracking the progress of this massive project via various CPRA requests. In November 2016 the Police Commission informed all BIDs of the registration requirement. In December 2017 the Police Commission told the BIDs to quit whining and comply with the law.

Yesterday, after numerous failed attempts on her part,² Suzanne Holley of Carol Schatzie’s baby-doll of a Downtown Center BID, sent me a bunch of emails between her staff and the LAPD. You can get all of these at Archive.Org in various useful formats.³ Amongst these was yet another copy of Eugene Shin’s email to all BIDs directing them to get their security patrols registered with the Police Commission.

But much more interesting than that was DCBID Executive Directrix Suzanne Holley’s response, sent precisely 59 minutes later, informing Eugene Shin that…well, I’ll let Suzanne Holley tell you in her own words, right after the break!

Meanwhile, the latest piece of evidence in the ongoing saga of the registration of BID Patrols with the Police Commission comes from a huge release of emails by the Fashion District BID² These span the time from July 1, 2016 through January 31, 2017 and are mostly between BID staff and the City of Los Angeles.³

There is an awful lot to write about here, but today I just want to highlight this interesting December 2016 email from FDBID operations director Randall Tampa to Eugene Shin, who’s the Police Commission investigator who’s handling the registration project. Randall Tampa sees the bigger picture here. It’s not a loss for BIDs who want to be free of any kind of oversight by the City, but a win for higher quality governance for everyone in Los Angeles:

I totally agree and support the police commission (and you) in your efforts to assure that only qualified personnel are patrolling the streets of Los Angeles.

In his email, Randall Tampa explicitly relates this opinion to his own experience as a police officer, proving yet again that people with experience in matters usually are much saner and have much more robust insights into how to regulate them. Most of the BIDs in our fair City are run by a bunch of cop-loving wannabes⁴ who are essentially see City governance as some kind of bizarre role-playing game, like Zillionaires versus Homeless, or whatever, rather than as an arena where wisdom and experience are far more essential than zillionaire-itude.

True, the Fashion District BID is presently having the stuffing sued out of it in federal court for its malfeasance and illegal conspiracies with the LAPD, and rightly so. They will lose this suit if there’s justice in the world, and be forced to pay endless amounts of money, but while they’re losing that suit, while they’re criminally conspiring with the cops, at least they’re putting up a professional front. Well, just yesterday, as part of a larger release of records from the East Hollywood BID, I discovered a February 2017 email from Eugene Shin to Nicole Shahenian. Eugene Shin, as you may recall, is the Police Commission investigator that’s heading up the registration project. Nicole Shahenian is the Executive Director of the East Hollywood BID. The email confirms that not only is registration still ongoing, but that the Police Commission is pursuing it fairly aggressively. Turn the page for a transcription and some discussion.

Newly Obtained Email From November 2016 Reveals That LAPD Threatened Non-Compliant BID Patrol Officers With Arrest For Failing To Register With Police Commission In Accordance With LAMC 52.34

Recall that in June 2016 I sent a petition to the Police Commission asking them to clarify why BID security guards were not registered in compliance with LAMC 52.34. In October I learned that the City Attorney agreed that BID security was subject to the registration requirement and that steps would be taken to get BIDs to comply.

In January 2017 I obtained a December 1, 2016 email from Police Commission investigator Eugene Shin confirming that the registration process was ongoing. In that email Officer Shin hinted that he’d received a bunch of complaints about the new registration policy from BIDs. This, in turn, suggests that he or someone had sent an earlier communication about registration. I do not yet have copies of any of the complaints, bitching, and moaning, although I’m certainly working on getting them. However, just yesterday, as part of a significant email release from the FCBID¹ I received this November 29, 2016 email from Eugene Shin to all the BIDs, announcing that their security guards would have to register. This seems to be what caused the firestorm of unhappiness hinted at in the December 1 email.

There is a full transcription of this fascinating document after the break, and it’s well worth reading. But the most interesting bit of all is this threat, with which Eugene Shin ends his missive:

Failure to register and obtain the permits may result in criminal charges being filed against the security company and citations or arrests of their security officers.

Reading that is almost, but not quite, enough to make me sympathize with the BIDs. After all, they’d managed to go 16 years without complying with the law and all of a sudden they’re being threatened with having their security guards ARRESTED if they don’t register? Email From Police Commission Definitively Confirms Ongoing Registration of BID Security, Procedure Includes Individual Background Checks of BID Patrol Officers!

BID Security has been flipping off the Los Angeles Police Commission for the last 16 years, but that is most definitely over now!

I reported a couple months ago that as a direct result of my June 2016 petition to the Police Commission, BID Security would be required to abide by LAMC 52.34 and register with the City like all other private security patrol operators must do. At that time I had only the oral assurance¹ of Police Commission enforcement officer Ernesto Vicencio that this was the case.

However, just this evening, as part of ongoing production of responsive materials to my recent CPRA request to the good old Hollywood Media District BID, I received a copy of this December 1, 2016 email from Eugene Shin of the Police Commission to every freaking BID in the City telling them that yes, as a matter of fact, they do have to obey the law. He mentions that he has “received numerous emails and voicemails and I feel this is the most efficient way to answer your questions.” And I just bet the tone was not joyous and grateful!² Anyway, it’s important to have independent written confirmation that this registration is actually going to happen. Shin also makes it clear that the registration process involves individual background checks of every BID security officer, which is absolutely fabulous news. Police Commission Investigation Into Excessive Force Allegation Against BID Patrol Concludes That “No Violations Of Law Occurred Or Other Improper Behavior” But Crucial Precedent Is Set Nevertheless

Here’s the story so far: In November 2015 the BID Patrol attacked a homeless man while in the process of arresting him. It really looks like excessive force, so, at the direction of Richard Tefank, Executive Director of the Police Commission, in September I submitted a complaint to him and also to Kerry Morrison.¹ As I reported two months ago, the Police Commission agreed to investigate my complaint, and assigned it to Officer Ernesto Vicencio.

Well, just yesterday I received a letter from Richard Tefank informing me that the investigation was complete and that they had found no wrongdoing on anyone’s part.² This is disappointing, to be sure, because, as would all sane, right-thinking individuals, I would like to see the BID Patrol jailed, fined, and shut down, and it seems really, really, really clear that those BID Patrollies are breaking the law. However, it’s not that disappointing, because a clear and transcendently important precedent has been set, which will have lasting consequences for the future of BIDs in our City.

VICTORY!! All Los Angeles BID Security Patrols To Register With Police Commission Per City Attorney, BID Patrol Excessive Force Complaint Under Investigation By LAPD; Direct Result of MK.Org Reporting!

Earlier this afternoon I spoke with Ernesto Vicencio, who is an LAPD investigator assigned to the Police Commission. He told me that the City Attorney either has sent or will soon send a letter to all Los Angeles Business Improvement Districts informing them that their security patrols are required to register with the Los Angeles Police Commission per LAMC 52.34.

This incredibly welcome development is a direct result of my discovery in the Summer of 2016 that it was likely that BID security registration had inadvertently ceased in 2000 due to an oversight. I don’t believe I mentioned it at the time, but in addition to writing a number of posts on the subject, I also sent a petition to the Police Commission asking them to look into the matter and to conclude that BID security ought in fact to register with them.

According to Officer Vicencio the City Attorney has decided to implement this request.¹ This development is hugely important, not least because LAMC 52.34 requires private patrol services to have a procedure for investigating citizen complaints. It also grants the Police Commission a great deal of regulatory power over the activities of security patrols who are required to register.

Which brings us to the second stunning and absolutely unexpected thing that Officer Vicencio told me. You may recall that I recently reported on what seemed like a clear use of excessive force by members of the Andrews International Hollywood BID Patrol. Well, about three weeks ago I submitted a report on this matter to Kerry Morrison of the HPOA and also to the Police Commission, as instructed by the Commission’s executive director, Richard Tefank.

Today Vicencio told me that he is handling this matter. He has tried, without success so far, to locate the victim, and he is going to investigate further. Obviously there’s no guarantee that any of these officers will suffer any consequences,² but again, the larger implications of the fact that they’re being investigated by the City are huge. This means that the Police Commission agrees that they have jurisdiction over citizen complaints against BID security. This changes everything.
