I’m a little late in writing this up, but on December 9, with the able assistance of Abenicio Cisneros and Joseph Wangler I filed yet another petition under the California Public Records Act seeking to compel the City to follow the damn law and hand over a bunch of records I had asked for ever so long ago. And as they often will do, they actually started handing them over immediately, although I haven’t gotten the most interesting ones yet.

The petition covers three major requests,1 unrelated other than by the fact that they were all made to the City’s Information Technology Agency. These are the folks to file CPRA requests for emails with if you want MBOX format, which ultimately is the best way to get emails.2 ITA is also the sole source for emails in the accounts of former City employees. Here’s a link to the very interesting petition, worth reading for many reasons and also containing every last detail of the requests at issue, described more briefly below.

First is a request I first made in 20163 for emails having to do with Eric Garcetti when he was repping CD13, his staffers Heather Repenning and Helen Leung, and their conspiracy with Kerry Morrison, then-commander of the Hollywood Entertainment District BID, to illegally exclude homeless people from Selma Park in Hollywood.

Mayra Alvarez Files Absolutely Smashing Opposition To Jose Huizar’s Motion To Stay Proceedings — “[Huizar] is merely using seductive—albeit empty—rhetoric to goad this Court into granting him a reprieve from further public scrutiny and embarrassment — The Court should decline such invitation and deny Defendant’s motion” — Hearing Scheduled For June 24, 2019 at 8:30 AM — Stanley Mosk Courthouse Dept 17

OK, remember that former council aide Mayra Alvarez is suing all-round creepy councilbro Jose Huizar for workplace creepism and at the same time the FBI is raiding dude’s house and making him and, more generally, pretty much everyone on the fourth floor of 200 N Spring Street really freaking nervous? And so Huizar filed a motion recently asking the court to put a hold on Alvarez’s civil lawsuit against him because he wouldn’t be able to defend himself without compromising his defense in the FBI stuff. And yesterday Alvarez filed an absolutely smashing opposition to Huizar’s motion. Just hammered the dude, hammered him.

The argument is essentially that Huizar never established that there is even a criminal case against him. He never said what this putative criminal case might be about. His best evidence that there is a criminal case seems to come from the LA Times. So unless he’s either charged or coughs up some evidence that he’s likely to be charged, says Alvarez, the court should let the case go on.

The argument cites, clearly, Alvarez’s interest in having the case go forward so that she’s not denied justice through delay, but, interestingly, also invokes the interest of other City employees and the public at large in having Huizar’s workplace misdeeds exposed. There’s a transcription of selections below, but if you only read one part, read this:

So, Huizar’s desire to stay this matter pending a vaguely described “criminal investigation”—one with an unnamed target and undescribed purpose—is simply a stall tactic so that the Councilmember can ride out the rest of his term while continuing to shield his misdeeds from the citizens of this City and continuing to collect a taxpayer-funded paycheck.

But, “the fact that a man is indicted cannot give him a blank check to block all civil litigation on the same or related underlying subject matter. Justice is meted out in both civil and criminal litigation.” And, here, Huizar has not even been indicted. The bottom line is: Huizar has not been charged with a crime; his motion does not affirmatively state that he himself is the target of the FBI’s investigation (as opposed to a peripheral witness or subject); nor does Huizar’s motion come even remotely close to describing what the FBI is actually investigating such that he can reasonably represent to the Court that criminal charges against him are even possible. Thus, at this point, Huizar’s motion appears to be based purely on conjecture, and he is merely using seductive—albeit empty—rhetoric to goad this Court into granting him a reprieve from further public scrutiny and embarrassment. The Court should decline such invitation and deny Defendant’s motion unless and until Huizar is either charged with a crime or proffers affirmative evidence that he is the target of the FBI’s investigation.

Jose Huizar Files Actual Motion Asking For Permission To File His Motion To Stay The Proceedings In Mayra Alvarez’s Workplace Creepiness Suit Against Him Till After The Criminal Case Is Done — He Lays Out Line By Line Which Parts Of The Motion To Stay Reveal Secrets — Hearing On This Is May 16 At 8:30 AM — Stanley Mosk Courthouse Department 17

The quick background is this: Soon-to-be-former Councilbro Jose Huizar is being sued by two former employees for generally egregious workplace creepiness. One suit was filed by Mayra Alvarez and the other by Pauline Medina. Of course, he’s also being investigated by the FBI for general criminal kingpinitude. And, according to Huizar, he can’t defend himself against Alvarez and Medina without revealing information that will harm his defense in the not-yet-filed criminal case against him.

Thus did he announce recently that he will be filing motions to stay both civil cases until after the criminal case is over with. However, according to Huizar, he can’t even adequately explain why the civil cases ought to be stayed without revealing the same secrets, so recently he filed motions asking the two civil case judges to allow him to file his motions to stay under seal. The Medina judge denied his request outright but the Alvarez judge scheduled a hearing1 to allow Huizar to present his case.

And so on April 19 Huizar filed his motion asking the court to allow him to file his motion to stay under seal, and you can read the motion here. Interestingly Huizar also requests that, if the court won’t let him file the whole motion in secret, that he be allowed to file only parts in secret, and the parts are listed line by line by line. Interestingly, he also refuses to actually admit that there’s a criminal case being built against him, referring in the motion to a “purported criminal investigation initiated by the U.S. Attorney’s Office and the Federal Bureau of Investigation”

Huizar also somewhat disingenuously argues that he’s not seeking to keep all the paper filed in the case secret, but only this one single motion. He doesn’t mention that the motion he’s seeking to conceal would have the effect of stopping the case, so there won’t be any more papers filed to keep secret.

There is also a transcription of selections after the break. I’m not sure when the opposition to this motion is due, but I’ll post a copy when it shows up. Also, according to the Los Angeles Times, their lawyers plan to intervene and ask the judge not to allow the motion to be sealed. If and when they file any pleadings I’ll post copies of those as well.

Last week soon-to-be-incarcerated Los Angeles City Councilmember Jose Huizar filed a motion with the court that is hearing his former employee Mayra Alvarez’s lawsuit against him for creating a hostile work environment and engaging in a remarkable number of really creepy behaviors. He says that he will be filing a motion to stay the proceedings because he can’t defend himself without revealing secret stuff about his criminal case.

The same, he says, will be true about the motion to stay itself, so he wants permission to file THAT motion under seal. Last week he asked for and obtained permission from the court to have a hearing on the motion to file the motion to stay under seal. That hearing will take place at the Stanley Mosk Courthouse on Thursday, May 16, 2019 at 8:30 a.m. in Department 17. Here are links to the records, and turn the page for transcribed selections.

José Huizar Files Totally Formulaic Response To Medina Complaint — Also Challenges Assigned Judge Barbara Meiers — Affirming That She Is So Biased That He “cannot, or believes that he cannot, have a fair and impartial trial or hearing before” Her! — What’s Up With That?!

Unaccountably-not-yet-resigned City Councilmember José Huizar has two lawsuits pending against him, filed by former employees. Both of them most plausibly allege at least 31 flavors of harassment, outlawry, and workplace insanity against him. One was filed by Mayra Alvarez, his former scheduler, and you can read about it here. The other, filed a week later by Pauline Medina, is discussed here.

And last week Huizar filed his response to Medina’s complaint, and I got a copy of it yesterday (and added it to my growing collection of pleadings here on Archive.Org). And it’s not that interesting. These first answers to complaints rarely are. It’s basically just a list of reasons why Huizar denies everything. In fact, the most interesting thing about it is that it’s essentially cribbed from his answer to Alvarez, filed the week before it. I suppose if he’s going to make a habit of inducing these kind of lawsuits, he might as well save money by developing a generic response form.

But that wasn’t the only thing filed last week. Huizar also filed this peremptory challenge to Judge Barbara Meiers. The California Code of Civil Procedure at §170.6(a) allows any litigant to file such a challenge to one judge per case by affirming that the judge is biased against the party. It’s not required to present evidence for this.

I’m not sure what it is that Huizar has against Meier, and there’s not much on the Internet that tends to enlighten. Meier’s reviews on the Robing Room are pretty uniformly abysmal, but that’s true for most judges, it seems, so we’re probably never going to know the facts. José Huizar And City Of Los Angeles File Answers To Mayra Alvarez’s Complaint — Get Your Copies Here! — Also We Have A Copy Of Pauline Medina’s Complaint Against José Huizar — With Even More Stupid José Tricks!

On October 22, 2018, Mayra Alvarez, a former CD14 staffer, filed suit against her old boss José Huizar and the City Of Los Angeles, alleging that he created a bizarre, hostile, sexually threatening, and retaliatory work environment. The Times had a good article about it at the time and I published a copy of Alvarez’s complaint as well. And on December 20, 2018 Huizar and the City of Los Angeles both filed their replies to Alvarez’s petition. I finally managed to lay my hands on copies and you can get them here:

And I mean, don’t hesitate to read them, but the sad fact is that all of these petition answers are routine. Basically they all say (a) we didn’t do it but (b) if we did do it no harm was done and (c) if harm was done we’re legally not responsible but (d) if we are responsible the plaintiff brought it all on herself so we don’t owe money. It’s very ritualistic.

But tonight’s other news is not at all ritualistic. In the blinding light generated by Alvarez’s petition it’s easy to forget that she was not the only plaintiff who filed a complaint against Huizar in October. Again, David Zahniser at the Times had an excellent story on the matter, and again I have a copy of the complaint for you. This petition contains many of the same themes as Alvarez’s, but at least some very different factual allegations. Huizar again comes off as a domineering sexual aggressor as well as a petulant, vengeful, possessive, and borderline violent boss. Also newly revealed is the claim that Medina was first hired by Huizar in 2008 because she is the mother of his nephew.

Some of Medina’s allegations are familiar from Alvarez’s complaint, e.g. tension created by Huizar’s multiple affairs with his staffers, his demands for personal services, fundraising improprieties related to Bishop Salesian High, and so on. Indeed, some of the language is copied verbatim between the complaints. However, some of the allegations are quite different. Medina alleges, for instance, that Huizar routinely spent City money on family parties and other events unrelated to City business, which we didn’t see in Alvarez’s complaint.

Also, it seems that prior to August 2017 Huizar’s staffers were allowed to work from home at will, or even skip work without charging the time to vacation or sick leave. She says, though, that at that time Huizar, through his chief of staff Paul Habib, changed the policy to allow him to track the location of his current mistress.1 In particular Habib told Alvarez to quiz the staff on their intended whereabouts every morning and then send him an email telling him where they were going to be.

She also claims that through this new tracking duty and for other reasons she was forced into complicity with Huizar’s mistress’s lies to Habib about her attendance at work and that ultimately Huizar and Habib retaliated against her for complaining about these and similar matters. Oh Man! — The LA Times Sure Left A Lotta Tea Unspilled On Mayra Alvarez’s Allegations Against Rapiest Councilboy Of ‘Em All — Her Former Boss, José Huizar — Facebook And Instagram Stalker — Notebook Thrower — Whiny-Baby Tea Drinker — Hypocritically Jealous Adulterer — Subordinate Intimidator With A Butt-Grabbing Brother — Read All About It Right Here Cause We Finally Got A Copy Of The Actual Complaint As Filed!

Everybody who’s reading this blog by now knows that Mayra Alvarez, who is José Huizar’s former scheduler, is suing him for harassment, retaliation, and various other important matters. David Zahniser had an excellent story about it in the Times a few weeks ago when the suit was filed. And David Zahniser covered some important allegations. For instance, Huizar ordered Alvarez to alter his calendars in front of public records act requests and when she objected he took away her responsible position as scheduler and made her into his receptionist. And to work on the 2020 election campaign of Mrs. José Huizar on City time. And so on.

But the Times, for whatever reason, journalistic integrity, admirable prudence, pure good sense, lack of space, an instinct for dignity, didn’t provide a copy of the complaint and also didn’t reveal many of the most lurid and yet entirely believable allegations against José Huizar who, it turns out, is even rapier than we thought, and that was already pretty damn rapey. Fortunately we here at MK.Org suffer from not one of those impediments! The purpose of tonight’s post is to fill both of the gaps left by David Zahniser’s reporting. The second comes first. Here’s the initial complaint filed by Mayra Alvarez in Los Angeles County Superior Court on October 22, 2018.

And what kind of creepy crapola did José Huizar get up to? All kinds of stuff, from repeatedly texting the word “tea” to her from his office in response to her putatively slow tea service to obsessively stalking her Facebook and her Instagram and emailing her with extra work every time she posted a picture of her with her husband.

Huizar’s extramarital affairs have been widely reported, but this is the first time we learn that he, evidently out of wildly hypocritical jealousy, forbade some of his own male staffers from working closely with his paramours. And his brother, it seems, is a butt-grabber, and José Huizar in response is an intimidator of women whose butts are grabbed, cause it’s going to make him look bad if they complain. And, because why not, he also evidently threw stuff at Mayra Alvarez during his tea tantrums. All in all he’s bad news indeed. Turn the page for transcribed selections from the complaint.

It Is Now Confirmed That The Subject Of Furtive Hereditary Imperialist Zillionaire Michael Delijani’s Meeting With José Huizar, Estela Lopez, and Batty Little Fusspot Queen of the Historic Core BID Blair Besten Was In Fact The Skid Row Neighborhood Council, And Although The Details Aren’t Yet Known, They Can’t Possibly Be Pretty, Can They?

It not only seems like just yesterday, but it was in fact just yesterday that I wrote about a meeting in January 2017 wherein Estela Lopez of the freaking Central City East Association, Blair Besten of the freaking Historic Core BID, and furtive hereditary imperialist zillionaire Michael Delijani all got together in a pile like puppies with ironically-styled-heartthrob Councilboy José Huizar of the good old 14th. At that time, I had no idea what the subject of the confabulation was, although I insinuated just a little teensy bit that it might have had something to do with the creepy-slash-shadowy-slash-illegal zillionaire total war against the formation of the Skid Row Neighborhood Council.

Well, this morning bright and early I hopped the good old 704 eastbound to the good old Red Line to good old Pershing Square Station and beat it on up to the HCBID where I was allowed, under the too-close-for-civility observation of a bunch of weirdo BIDdies and one DLANCkie old yank in his clanky old tank,1 to sit in the freaking dark on a freaking bench2 and look at a freaking bunch of emails. You’ll be hearing much, much more about this surreal episode in both the near and the distant futures,3 and the purpose of tonight’s episode is just to get before you one of the essential pieces of evidence that turned up in the partial yield.

It seems, in fact, as I thought yesterday but did not yet have the evidence to state explicitly, that the subject of the January 2017 meeting between Delijani, Besten, Lopez, and Huizar was in fact the formation of the Skid Row Neighborhood Council. And given the positions taken by all the principals over the course of the next few months leading up to April’s disastrous election, you know it wasn’t a conversation in which the interests of the actual residents of Skid Row were treated with any respect at all.
